The “Film Management Regulations” were passed on 29 May 1996, by the 45th executive meeting of the State Council, are hereby promulgated, and take effect on 1 July 1996.

Film Management Regulations

Chapter 1: General Provisions

Article 1: In order to strengthen film industry management, developing and make prosper the film sector, satisfy the people’s cultural needs and stimulate the construction of a socialist material civilization and spiritual civilization, these Regulations are formulated.

Article 2: These Regulations apply to production, import, export, distribution and projection, etc., of films such as feature film, documentary film, science and education film, special subject films, etc., within the territory of the People’s Republic of China.

Article 3: Activities concerning films such as film production, import, export, distribution and projection, etc., must persist in the orientation of serving the people and serving socialism.

Article 4: The State Council administrative radio, film and television entity shall take charge of the nationwide work of films.

County-level or higher People’s Government administrative radio, film and television entities shall, in accordance with these Regulations, be responsible for the film management within their respective regions.

Article 5: National film sector social organizations film, in accordance with their constitutions and under the guidance of the State Council administrative radio, film and television entity, implement self-discipline in the management.

Article 6: The state shall give rewards to work units and individuals having made remarkable contributions to the development of the film sector.

Chapter 2: Film Production

Article 7: Films are to be produced by film production work units.

Article 8: Establishment of a film production work unit must conform to the plan on the total number, distribution and structure of film production work units formulated by the State Council administrative radio, film and television entity, and satisfy the following requirements:

(1) Have the aim and articles of association of a film production work unit;

(2) Have a well-defined scope of business;

(3) Have funds suitable to its business;

(4) Have premises and equipment according with film production regulations; and

(5) Have an organizational structure and professional personnel suitable to the demands of the business.

Article 9: Applications for establishment of a film production work unit, shall be submitted by the administrative department in charge of the applicant work unit shall provincial, autonomous region or municipal People’s Government administrative film entity for examination and approval, after approval, the application shall be submitted to the State Council administrative radio, film and television entity for examination and approval.

The application shall contain the following content:

(1) The name, address and economic nature of the film production work unit;

(2) The name, address and nature of the controlling authority, and the sponsoring work unit of, the film production work unit;

(3) The name, address and credentials of the legal representative of the film production work unit; and

(4) The source and amount of the funds of the film production work unit.

Article 10: The State Council administrative radio, film and television entity shall, within 180 days after receiving the application to establish a film production work unit, make a decision on whether or not to approve it, notify the applicant in writing, where the application has not been approved, the reason shall be stated. Where the application is approved, the State Council administrative radio, film and television entity shall issue a “Film Production Permit”, the applicant may register with the State Council administrative industry and commerce management entity using the Permit and obtain a business licence.

Article 11: A film production work unit shall, to the extent of all its legal person assets, enjoy civil rights and assume civil obligations in accordance with the law.

Article 12: The State shall carry out annual inspection on licences for film production. Inspection rules shall be formulated by the State Council administrative radio, film and television entity.

Article 13: Changes and termination of a film production work unit shall be subject to the approval of the State Council administrative radio, film and television entity, and shall conduct the modification of cancellation formalities.

Article 14: Film production work units may engage in the following activities:

(1) producing films;

(2) making reproductions of films produced by themselves;

(3) in accordance with relevant State regulations, distribute films and their reproductions produced by themselves allowed for public projection;

(4) In accordance with relevant State regulations, export films and their reproductions produced by themselves allowed for public projection.

Article 15: Film production work units shall establish and improve the management system and guarantee film quality.

Article 16: Film production work units shall enjoy copyright over films produced by themselves. Except as otherwise stipulated by laws or regulations, any work unit or individual shall obtain authorization from the copyright owner before exploiting a film product by means of reproduction, distribution, projection, broadcast, publication, dubbing, adaptation, etc.

Anyone who exploits a film product under the provisions of the preceding paragraph shall conclude a contract with the copyright owner and pay remuneration in accordance with the stipulations of the contract.

Article 17: The state encourages official organs, enterprises, institutions and other social organizations and citizens to participate in film production by investing or giving financial aid, concrete rules shall be formulated by the State Council administrative radio, film and television entity.

Article 18: Film production work units may, either inside or outside China, produce films in cooperation with foreign film producers.

Article 19: For Sino-foreign film coproduction, the Chinese side shall submit an application in advance to the State Council administrative radio, film and television entity, which shall, after getting opinions from relevant departments and examined to be conform with relevant provisions, issue a “Sino-Foreign Film Coproduction Permit” for that application only. After obtaining the Permit, the applicant shall, in accordance with relevant provisions, conclude a contract for the coproduction.

Article 20: When it is needed to import equipment, materials, film or props for Sino-foreign film coproduction, the producer shall conduct import or temporary import formalities with Customs with the approval documents issued by the State Council administrative radio, film and television entity.

Article 21: When producing films in cooperation with Chinese film production work units or in other forms in the territory of the People’s Republic of China, foreign film producers shall observe laws and regulations of the People’s Republic of China and respect the customs and habits of all Chinese ethnicities.

Article 22: The development post-production of negatives and sample copies of a film produced either by a domestic film production work unit or a Sino-foreign joint effort must be completed in the territory of the People’s Republic of China. When it needs to be completed outside China due to some special technological needs, a specific application shall be submitted to the State Council administrative radio, film and television entity for approval.

Chapter 3: Film Examination

Article 23 The state establishes a film examination system.

Films not examined and approved by the film examination organ of the State Council administrative radio, film and television entity may not be distributed, projected, imported or exported.

Article 24: Films are prohibited from containing the following content:

(1) Content endangering national unity, sovereignty and territorial integrity;

(2) Content harming the security, honour and interests of the State;

(3) Content inciting ethnic separatism, disrupting the work unity of the ethnicities;

(4) Content divulging State secrets;

(5) Content propagating obscenity or superstitions or spreading violence;

(6) Content insulting or slandering others;

(7) Other content prohibited by the State.

Films technological quality shall conform to the national standards.

Article 25: Film production work units shall, in accordance with the provisions of Article 24 of these Regulations, conduct script examination before production and film examination before leaving the studios.

Film production work units shall submit scripts which they plan to put into production to the film examination organ for filing, concrete rules shall be formulated by the State Council administrative radio, film and television entity.

Article 26: Film production work units shall, after film production completion, submit the film to the film examination organ for examination and pay the examination fee in accordance with relevant State regulations. Film import business work units shall, after conducting temporary film import formalities, submit the film to the film examination organ for examination and pay the examination fee.

The schedule of fees for film examination shall be fixed by the financial department and price department of the State Council together with the administrative department of radio, film, and television of the State Council.

Article 27: The film examination organ shall, within 30 days after receiving the film submitted for examination, notify the submitting work unit in writing of the decision on the examination and, if the film has passed the examination, issue a “Film Projection Permit” for this film. Film production work units and film import business work units shall put the number of their “Film Projection Permit” on the title of the first copy of the film.

Article 28: Where a film production work unit or a film import business work unit disagrees with film examination decision, it may, within 30 days after receiving the decision, apply for re-examination with the film re-examination organ of the State Council administrative radio, film and television entity; the latter shall issue a “Film Projection Permit” for the film if it passes the re-examination.

Chapter 4:  Film Import and Export

Article 29: Import of films shall be managed by work units approved by the State Council administrative radio, film and television entity for engaging in film import; without approval, any other work units or individuals may engage in film import.

Article 30: To import films for examination, the film import business work unitshall conduct temporary import formalities with Customs with the approval document issued by the State Council administrative radio, film and television entity.

Films imported for projection shall be examined by the film examination organ; those having passed examination shall be issued a “Film Projection Permit” and documents approving import. Only with the documents approving import may the film import business work unit conduct import formalities with Customs.

Article 31: Film import business work units shall exploit film products with authorization and within the authorization scope of the copyright owner of the film; without authorization, any work unit or individual may not exploit imported film products.

Article 32: Copyright ownership of a dubbed film shall be stipulated by the dubbing party and entrusting party in the dubbing contract, where the contract does not contain stipulation, copyright of the dubbed film shall be owned by the dubbing party.

Article 33: To export a film produced by themselves, a film production work unit may conduct film export formalities with Customs with the “Film Projection Permit”.

Article 34: To export a Sino-foreign coproduced film, the Chinese side may conduct the film export formalities with Customs with the “Film Projection Permit”.

Article 35: To import special subjects films as reference materials for scientific research or education, the importing work unit shall submit an application to the relevant administrative department of the State Council for approval and, with an approval document, may conduct import formalities with Customs and shall, within 30 days after the import, report to the State Council administrative radio, film and television entity for filing.

China Film Library may directly conduct formalities with Customs to import reference films, and report quarterly to the State Council administrative radio, film and television entity for filing. Any other work unit or individual may not import feature films or other films prohibited by the State in the name of scientific research or education.

Article 36: To hold a Sino-foreign film exhibition or international film festival or participating in foreign-related film exchange activities such as film exhibitions or film festivals held abroad, an application shall be submitted to the State Council administrative radio, film and television entity for approval, and the films to be involved in the exchanges shall be submitted to the State Council administrative radio, film and television entity for examination; temporary film import or export formalities may be handled with Customs only after approval.

Chapter 5: Film Distribution and Projection

Article 37: For establishment of a film distribution and projection work, the requirements specified by the State Council administrative radio, film and television entity must be satisfied.

Article 38: To establish a film distribution work unit, an application shall be submitted to the provincial, autonomous region or municipal People’s Government film department, which shall, where finding it in conformity with stipulations after examination, issue a Film Distribution Permit; the applicant shall register with the local administrative department for industry and commerce with the licence.

Article 39: To establish a film distribution work unit involving more than one province, autonomous region or municipality directly under the central government, an application shall be submitted to the State Council administrative radio, film and television entity, which shall, where finding it in conformity with stipulations after examination, issue a “Film Distribution Permit”; the applicant shall register with the local administrative department for industry and commerce with the licence.

Article 40: To establish a film projection work unit, an application shall be submitted to the county-level or higher People’s Government administrative film entity, which shall, if considering it in conformity with stipulations after examination, issue a “Film Projection Permit”; the applicant shall register with the local administrative department for industry and commerce with the licence.

Article 41: In case of modification or termination of a film distribution or projection work unit, approval from the original approving department must be obtained, and the modification or cancellation formalities shall be conducted in accordance with the law.

Article 42: The state shall adopt an annual inspection system for the “Film Distribution Permit” and the “Film Projection Permit”. Concrete rules for the annual inspection shall be formulated by the State Council administrative radio, film and television entity.

Article 43: For distributing or projecting a film, a “Film Projection Permit” issued by State Council administrative radio, film and television entity is required.

Article 44: For using films to produce audiovisual products, authorization from the copyright owner of the film must be obtained, and publication, reproduction, distribution and projection procedures shall be completed in accordance with State Council regulations concerning of audiovisual products management.

Any work unit or individual may not use reference films for profit-making activities or disguised profit-making activities.

Article 45: Film projection shall conform to the domestic and imported films projection duration ratio

The annual projection duration of by film projection work units of domestic films may not be less than two thirds of the total projection duration annually.

Article 46: Film projection work units shall maintain he public order and general sanitation of the cinemas and guarantee audience safety and health.

Article 47: In some special cases, the State Council administrative radio, film and television entity may make a decision of deletion or suspension of projection on films already having the “Film Projection Permit”; all film distribution and projection work units shall implement such decisions.

Chapter 6: Film Sector Guarantees

Article 48: The State shall establish and improve a film management system compatible with the socialist market economy to develop the film sector.

Article 49: The State shall guarantee the freedom in film creation, value and foster talented persons for the film sector, attach importance to and strengthen the theoretical film research, promote film creation and improve film quality.

Article 50: The state shall establish a special foundation for film sector and adopt other favourable measures to support film sector development.

Article 51: The special foundation for film sector development shall support or give aid to the following projects:

(1) The production of major films and collection of highly rated scenarios advocated and confirmed by the state;

(2) Technological or equipment transformation of key film production bases;

(3) Transformation of film projection equipment;

(4) The film sector development in ethnic minority regions or remote border and poverty-stricken areas;

(5) Other projects needing support.

Article 52: The State encourages and supports of science and educational films, art films, children’s films, etc. production, distribution and projection.

Article 53: The State shall give favourable treatment to film distribution and projection in economically undeveloped areas and rural regions.

Article 54: All levels of local People’s Governments shall incorporate film projection facilities construction planning into their local construction planning.

Rebuilding of film projection facilities shall be submitted to the county-level or higher People’s Government administrative film entity for approval, may not be smaller than the original in scale, and film projection facilities may not be used for other purposes without authorization.

Article 55: County-level or higher People’s governments and their relevant administrative departments shall take timely action to stop film production, distribution or projection disturbing, obstructing or sabotaging activities, investigate and deal with the illegal activities in accordance with the law.

Chapter 7: Penalty Provisions

Article 56: Film production, import, distribution and projection work units established without approval shall be banned by the county-level or higher People’s Government administrative film entity, illegal goods and gains shall be confiscated and a fine from five to ten times the illegal earnings shall be imposed.

Article 57: For film import, distribution or projection without a “Film Projection Permit” in violation of these Regulations, the county-level or higher People’s Government administrative film entity shall order cessation of illegal activities, confiscate illegal goods and gains and impose a fine from ten to fifteen times the illegal gains; where circumstances are serious, suspension for rectification shall be ordered or licences revoked by the organ issuing the licences; where it constitutes a crime, criminal liability shall be investigated in accordance with the law.

Article 58: For committing any of the following acts, violating these Regulations the county-level or higher People’s Government administrative film entity shall order cessation of the illegal activities, confiscate the illegal goods and gains and impose a fine from five to ten times the illegal gains; where circumstances are serious, suspension for rectification shall be ordered or licences revoked by the organ issuing the licences; when it constitutes crime, criminal liability shall be investigated in accordance with the law:

(1) Producing films in cooperation with external organizations or persons without approval;

(2) Importing films without examination and approval;

(3) Using reference films for profit-making activities or disguised profit-making activities;

(4) Not obeying State Council administrative radio, film and television entity decisions on deletion or suspension of projection on a film;

(5) Illegally reproducing films.

Article 59: For conducting development or post-production of the negatives or sample copies of a film outside China without approval, violating these Regulations the State Council administrative radio, film and television entity shall order cessation of illegal activities and set a time limit for correction; where circumstances are serious, the “Film Production Permit” shall be revoked.

Article 60: Sino-foreign film exhibitions and international film festivals held without approval and the participation in external film exhibitions or film festivals without approval shall be banned by the State Council administrative radio, film and television entity, with the illegal gains shall be confiscated and a fine from five to ten times the illegal gains shall be imposed.

Article 61: State Council administrative radio, film and television entity personnel and  county-level or higher People’s Government administrative film entity personnel and other relevant administrative personnel, in conducting the film management, abusing their powers, neglecting their duties or committing favouritism and irregularities shall be investigated for criminal liability where it constitutes a crime, or given a disciplinary sanction if the circumstances are not serious enough to constitute a crime.

Chapter 8: Supplementary Provisions

Article 62: Film production, import, distribution and projection work units established before the implementation of these Regulations according to State regulations other than these Regulations shall, within six months of the effective date of these Regulations, conduct relevant formalities again in accordance with the provisions of these Regulations.

Article 63: Concrete rules for the production and broadcast of film dramas shall be separately formulated by the State Council administrative radio, film and television entity in accordance with the principles of these Regulations.

Article 64 These Regulations shall take effect on July 1, 1996.

电 影 管 理 条 例

第一章  总    则

第一条  为了加强电影行业管理,发展和繁荣电影事业,满足人民群众文化生活需要,促进社会主义物质文明和精神文明建设,制定本条例。

第二条  本条例适用于在中华人民共和国境内的故事片、纪录片、科教片、美术片、专题片等电影片的制片、进口、出口、发行和放映等活动。

第三条  从事电影制片、进口、出口、发行和放映等活动,必须坚持为人民服务、为社会主义服务的方向。

第四条  国务院广播电影电视行政部门主管全国电影工作。

县级以上地方各级人民政府管理电影的行政部门,依照本条例负责本行政区域内的电影管理工作。

第五条  全国性电影行业的社会团体按照其章程,在国务院广播电影电视行政部门指导下,实行自律管理。

第六条  国家对为电影事业发展做出显著贡献的单位和个人,给予奖励。

第二章  电影制片

第七条  电影由电影制片单位摄制。

第八条  设立电影制片单位,应当符合国务院广播电影电视行政部门制定的电影制片单位总量、布局、结构规划,并具备下列条件:

(一)有本电影制片单位的宗旨、章程;

(二)有确定的业务范围;

(三)有与其业务相适应的资金;

(四)有符合规定的电影制片场所和设备;

(五)有适应业务范围需要的组织机构和专业人员。

第九条  申请设立电影制片单位,由申请单位的上级行政主管部门报经所在地省、自治区、直辖市人民政府管理电影的行政部门审核同意后,由省、自治区、直辖市人民政府管理电影的行政部门报国务院广播电影电视行政部门审批。

申请书应当载明下列内容:

(一)电影制片单位的名称、地址和经济性质;

(二)电影制片单位的上级行政主管部门、主办单位的名称、地址和性质;

(三)电影制片单位的法定代表人的姓名、住址、资格证明文件;

(四)电影制片单位的资金来源及数额。

第十条  国务院广播电影电视行政部门应当自收到设立电影制片单位的申请书之日起180日内,做出批准或者不批准的决定,并书面通知申请人;不批准的,应当说明理由。经批准设立的,由国务院广播电影电视行政部门发给《摄制电影许可证》,申请人凭许可证到国务院工商行政管理部门办理登记手续,领取营业执照。

第十一条  电影制片单位及其全部法人财产,依法享有民事权利,承担民事责任。

第十二条  国家实行《摄制电影许可证》年检制度。年检办法由国务院广播电影电视行政部门制定。

第十三条  电影制片单位变更、终止,应当经国务院广播电影电视行政部门批准,并依法办理变更登记或者注销手续。

第十四条  电影制片单位可以从事下列活动:

(一)摄制电影片;

(二)制作本单位摄制的电影片的复制品;

(三)按照国家有关规定在全国范围发行本单位摄制并被允许公映的电影片及其复制品;

(四)按照国家有关规定出口本单位摄制并被允许公映的电影片及其复制品。

第十五条  电影制片单位应当建立、健全管理制度,保证电影的质量。

第十六条  电影制片单位对其摄制的电影,依法享有著作权。除法律、行政法规另有规定外,任何单位和个人以复制、发行、放映、播放、出版、翻译、改编等形式使用电影作品的,应当取得电影著作权人的许可。

依照前款规定使用电影作品的,使用者应当与电影著作权人签订合同,并按照合同约定支付报酬。

第十七条  国家鼓励机关、企业、事业单位和其他社会团体以及公民个人以资助、投资的形式参与摄制电影片,具体办法由国务院广播电影电视行政部门制定。

第十八条  电影制片单位可以与境外电影制片者在中国境内或者境外合作摄制电影片。

第十九条  中外合作摄制电影片,应当由中方合作者事先向国务院广播电影电视行政部门提出立项申请。国务院广播电影电视行政部门征求有关部门的意见后,经审查符合规定的,发给申请人一次性的《中外合作摄制电影片许可证》。申请人取得许可证后,应当按照规定签订中外合作摄制电影合同。

第二十条  中外合作摄制电影片需要进口设备、器材、胶片、道具的,合作者应当持国务院广播电影电视行政部门的批准文件到海关办理进口或者暂时进口手续。

第二十一条  境外电影制片者同中方合作者合作或者以其他形式在中华人民共和国境内摄制电影片,应当遵守中华人民共和国的法律、法规、尊重中国各民族的风俗、习惯。

第二十二条  电影制片单位摄制的电影片和中外合作摄制的电影片的电影底片、样片的冲洗及后期制作,必须在中华人民共和国境内完成。有特殊技术要求的,需单项申请,报经国务院广播电影电视行政部门批准。

第三章  电影审查

第二十三条  国家实行电影审查制度。

未经国务院广播电影电视行政部门的电影审查机构查审通过的电影片,不得发行、放映、进口、出口。

第二十四条  电影片禁止载有下列内容:

(一)危害国家的统一、主权和领土完整的;

(二)危害国家的安全、荣誉和利益的;

(三)煽动民族分裂、破坏民族团结的;

(四)泄露国家秘密的;

(五)宣扬淫秽、迷信或者渲染暴力的;

(六)诽谤、侮辱他人的;

(七)有国家规定禁止的其他内容的。

电影技术质量应当符合国家标准。

第二十五条  电影制片单位应当依据本条例第二十四条的规定,负责电影剧本投拍和电影片出厂前的审查。

电影制片单位应当将其准备投拍的电影剧本报电影审查机构备案,具体办法由国务院广播电影电视行政部门制定。

第二十六条  电影制片单位应当在电影片摄制完成后,报请电影审查机构审查,并按照国家规定缴纳审查费。电影进口经营单位应当在办理电影片暂时进口手续后,报请电影审查机构审查,并缴纳审查费。

电影审查收费标准由国务院财政部门、物价部门会同国务院广播电影电视行政部门规定。

第二十七条  电影审查机构应当自收到报送审查的电影片之日起30日内,将审查决定书面通知送审单位;审查合格的,发放该电影片的《电影片公映许可证》。电影制片单位和电影进口经营单位应当将《电影片公映许可证》证号印制在该电影片拷贝第一本片头处。

第二十八条  电影制片单位和电影进口经营单位对电影片审查决定不服的,可以自收到决定之日起30日内向国务院广播电影电视行政部门的电影复审机构申请复审;复审合格的,应当核发该电影片的《电影片公映许可证》。

第四章  电影进口出口

第二十九条  进口境外电影,由国务院广播电影电视行政部门批准的电影进口经营单位经营;未经批准,任何单位或者个人不得从事电影片的进口业务。

第三十条  进口送审的电影片,电影进口经营单位应当持国务院广播电影电视行政部门的批准文件到海关按暂时进口货物办理进口手续。

进口供公映的电影片,由电影审查机构负责审查;经审查合格的,发给《电影片公映许可证》和批准进口文件。电影进口经营单位持批准进口文件,方可到海关办理进口手续。

第三十一条  电影进口经营单位应当在取得电影片著作权人使用许可后,在许可的范围内使用电影作品;未取得使用许可的,任何单位和个人不得使用进口电影作品。

第三十二条  译制电影片的著作权由译制者与译制委托者在电影片译制合同中约定;电影片译制合同未约定的,由电影片译制者享有译制电影作品的著作权。

第三十三条  电影制片单位出口本单位制作的电影片的,可以持《电影片公映许可证》直接到海关办理电影片出口手续。

第三十四条  中外合作摄制电影片出口的,中方合作者可以持《电影片公映许可证》直接到海关办理电影片出口手续。

第三十五条  进口供科学研究、教学参考的专题电影片,进口单位应当报经国务院有关行政主管部门审批后,凭批准文件到海关办理进口手续,并于进口后30日内向国务院广播电影电视行政部门备案。

中国电影资料馆进口电影资料片可以直接到海关办理进口手续,按季度向国务院广播电影电视行政部门备案。其他任何单位和个人都不得以科学研究、教学的名义进口故事影片和国家规定禁止进口的其他电影片。

第三十六条  举办中外电影展、国际电影节或者参加境外电影影展、电影节等涉外电影交流活动,应当经国务院广播电影电视行政部门批准,并将参加交流的电影片报国务院广播电影电视行政部门审查,经批准后方可到海关办理电影片暂时进口或者出口手续。

第五章  电影的发行和放映

第三十七条  设立电影发行、放映单位,应当符合国务院广播电影电视行政部门规定的条件。

第三十八条  设立电影发行单位,应当向所在地省、自治区、直辖市人民政府管理电影的行政部门提出申请;经审查符合规定的,由省、自治区、直辖市人民政府管理电影的行政部门发给《电影发行经营许可证》;申请人凭许可证到所在地工商行政管理部门办理登记手续。

第三十九条  设立跨省、自治区、直辖市的电影发行单位,应当向国务院广播电影电视行政部门提出申请;经审查符合规定的,由国务院广播电影电视行政部门发给《电影发行经营许可证》;申请人凭许可证到所在地工商行政管理部门办理登记手续。

第四十条  设立电影放映单位,应当向县级以上地方人民政府管理电影的行政部门提出申请;经审查符合规定的,由县级以上人民政府管理电影的行政部门发给《电影放映经营许可证》;申请人凭许可证到所在地工商行政管理部门办理登记手续。

第四十一条  电影发行、放映单位变更、终止,应当经原批准机关批准,并依法办理变更登记或者注销手续。

第四十二条  国家实行电影发行、放映经营许可证年检制度。年检办法由国务院广播电影电视行政部门制定。

第四十三条  发行、放映电影片,必须持有国务院广播电影电视行政部门颁发的《电影片公映许可证》。

第四十四条  利用电影片制作音像制品的,必须征得电影著作权人的许可,并按照国务院有关音像制品管理的规定,办理出版、复制、发行、放映手续。

任何单位和个人不得利用电影资料片从事经营活动或者变相的经营活动。

第四十五条  放映电影片,应当符合国产电影片与进口电影片放映的时间比例。

放映单位年放映国产电影片的时间不得低于年放映电影时间总和的2/ 3。

第四十六条  电影放映单位应当维护电影院的公共秩序和环境卫生,保证观众的安全与健康。

第四十七条  已经取得《电影片公映许可证》的电影片,国务院广播电影电视行政部门在特殊情况下可以作出停止放映或者删剪的决定;发行、放映电影的单位,必须执行停止放映或者删剪的决定。

第六章  电影事业的保障

第四十八条  国家建立和完善适应社会主义市场经济体制的电影管理体制,发展电影事业。

第四十九条  国家保障电影创作自由,重视和培养电影事业人才,重视和加强电影理论研究,繁荣电影创作,提高电影质量。

第五十条  国家建立电影事业发展专项资金,并采取其他优惠措施,支持电影事业的发展。

第五十一条  电影事业发展专项资金扶持、资助下列项目:

(一)国家倡导并确认的重点电影片的摄制和优秀电影剧本的征集;

(二)重点制片基地的技术设备改造;

(三)电影放映设施的改造;

(四)少数民族地区和边远贫困地区电影事业的发展;

(五)需要资助的其他项目。

第五十二条  国家鼓励、扶持科学教育电影、纪录电影、美术电影、儿童电影的制片、发行和放映。

第五十三条  国家对经济不发达地区和农村地区发行、放映电影实行优惠。

第五十四条  地方各级人民政府制定的本行政区域建设规划,应当包括电影放映设施建设的规划。

改建电影放映设施,应当经所在地县级以上地方人民政府管理电影的行政部门批准,并不得小于原有的规模,不得擅自将电影放映设施挪作用他。

第五十五条  对干扰、阻止和破坏电影制片、发行、放映的行为,县级以上各级人民政府及其有关行政部门,应当及时采取措施,予以制止,依法查处非法活动。

第七章  罚    则

第五十六条  未经批准,擅自设立电影制片、进口、发行、放映经营单位的,由县级以上地方人民政府管理电影的行政部门予以取缔,没收违法物品和违法所得,并处违法所得5倍以上10倍以下的罚款。

第五十七条  违反本条例的规定,擅自出口、发行、放映未取得《电影片公映许可证》的电影片的,由县级以上地方人民政府管理电影的行政部门责令停止违法活动,没收违法物品和违法所得,并处违法所得10倍以上15倍以下罚款;情节严重的,由原发证机关责令停业整顿或者吊销许可证;构成犯罪的,依法追究刑事责任。

第五十八条  违反本条例的规定,有下列行为之一的,由县级以上地方人民政府管理电影的行政部门责令停止违法活动,没收违法物品和违法所得,并处违法所得5倍以上10倍以下的罚款;情节严重的,由原发证机关责令停业整顿或者吊销许可证;构成犯罪的,依法追究刑事责任。

(一)未经批准、擅自与境外的组织或者个人合作摄制电影的;

(二)未经审查批准、擅自进口电影片的;

(三)利用电影资料片从事经营活动或者变相的经营活动的;

(四)不执行国务院广播电影电视行政部门停止放映或者删剪电影片的决定的;

(五)非法复制电影片的。

第五十九条  违反本条例规定,擅自将电影底片、样片在境外冲洗及后期制作的,由国务院广播电影电视行政部门责令停止违法活动,并限期改正;情节严重的,吊销《摄制电影许可证》。

第六十条  未经批准,擅自举办中外电影展、国际电影节或者参加境外电影展、电影节的,由国务院广播电影电视行政部门予以取缔,没收违法所得,并处违法所得5倍以上10倍以下的罚款。

第六十一条  国务院广播电影电视行政部门和县级以上地方各级人民政府管理电影的行政部门的工作人员和其他有关行政管理人员,在电影管理工作中滥用职权、玩忽职守、徇私舞弊,构成犯罪的,依法追究刑事责任;尚不构成犯罪的,依法给予行政处分。

第八章  附    则

第六十二条  本条例施行前按照国家规定已经设立的电影制片、进口、发行、放映单位,应当自本条例施行之日起6个月内依照本条例的规定重新办理手续。

第六十三条  电视剧的制作和播映管理办法,由国务院广播电影电视行政部门根据本条例的原则另行制定。

第六十四条  本条例自1996年7月1日起施行。
