Notice Concerning Audiovisual Product Import Management Function Adjustment and Imported Audiovisual Product Content Examination Items

All provincial, autonomous region and municipal press and publication bureaus, the Liberation Army General Political Propaganda Press and Publication Bureau, all audiovisual publication work units, production work units, duplication work units, distributing work units in the entire country:

According to relevant provisions of the “State Council Secretariat Notice Concerning Printing and Distribution of the Provisions on the Main Duties, Internal Organization and Personnel Allotment of the General Administration of Press and Publication (National Copyright Administration” (SCS No. [2008]90), the duties of audiovisual product import management are transferred from the Ministry of Culture to the General Administration of Press and Publication. The relevant matters are notified as follows:

I, From today onwards, all foreign, as well as Hong Kong, Macao and Taiwan region imported audiovisual finished products and audiovisual products used for publication, dissemination through information networks and other uses, shall all be reported to the General Administration of Press and Publication for content examination. The General Administration of Radio and Television is responsible for audiovisual programme import supervision and management work in the entire country.

II, The General Administration of Radio and Television shall establish an imported audiovisual programme examination committee, to be composed of a number of famous experts, to be responsible for examining imported audiovisual programmes content. Under the committee, an office shall be set up, to be responsible for accepting imported audiovisual programmes reporting materials and submitted samples, and organizes the experts’ carrying out of content examination. The General Administration of Radio and Television formulates a decision of approval or non-approval on the basis of the expert examination opinion. To those approved, an “Imported Audiovisual Product Approval Note” shall be issued; to those not approved, an “Imported Audiovisual Product Examination Notification Note” shall be issued, and the reasons shall be stated. The duration of examination is limited to 30 days.

III, Reporting procedure and materials

(1) For import of audiovisual programmes used in publication or for dissemination through information networks, the relevant production work unit shall file an application with the General Administration of Radio and Television and hand over the following documents and materials:

1. an “Imported Audio (Video) Product Reporting Form”;

2. the craft of the copyright trade agreement (Chinese and foreign language version), a letter of certification for the original copyright and a registration authentication document of the State copyright authentication organ;

3. a programme sample (the media form may be CD, VCD or DVD);

4. other materials necessary for content examination.

(2) For import of a finished audiovisual programme, the finished audiovisual programme importing work unit shall file an application with the General Administration of Radio and Television and hand over the following documents and materials:

1. an “Imported Audio (Video) Product Reporting Form”;

2. the import agreement draft;

3. a programme sample, and written material such as Chinese and foreign language lyrics, etc.;

4. other materials necessary for content examination.

(3) For import of an audiovisual programme used in exhibitions or expos, the organizing work units for the exhibitions or expos shall file an application, and report the audiovisual programme catalogue and sample films to the General Administration of Radio and Television for content examination.

IV, audiovisual programme import reporting requirements

(1) importing work units must submit a completely filled out reporting form, copyright trade contract, letter of certification of the original copyright, proof of copyright licensing, copyright authentication documents as well as a programme sample.

(2) The main items of filling in the “Imported Audio (Video) Product Reporting Form”: audio programme reporting form: the list of songs, performers and lyric writers must be accurate and precise; in the video programme reporting form, “content introduction” must be finished objectively. The column “importing work unit preliminary opinion”, must make an appraisal of the imported programme thought content and artistic level, and for content or plots not conforming with State regulations, a handling opinion must be put forward, but in the programme sample, content may not be deleted or abridged. When filling out the reporting form, the importing work unit must stamp it, and the work unit’s persons in charge must sign. The sequence of the list of songs or the programme collection (film) written on the reporting form must be identical to the reported sample and lyric material.

(3) The reported samples must have a clear signal, and a complete pregame. The sample discs of foreign language video programmes must have Chinese subtitles or Mandarin dubbing. Foreign language audio programmes must have Chinese and foreign language lyric material, the lyric material must be standardized and clear, and may not randomly alter lyrics. Foreign language video programmes must have a Chinese name, the Chinese programme name must use standard language characters, the programme sample disc must have Chinese subtitles or Mandarin dubbing.

(4) For reported written materials, faxed documents may not be used, for copyright authentication materials, the original documents must be used.

V, Publication of imported audiovisual programmes must comply with the following requirements:

(1) within the period of validity of the copyright licence of audiovisual programmes approved for import and publication (the period of licence validity is in general not less than three years), finished products of that audiovisual programme may not be imported.

(2) Publication work units must indicate the General Administration of Radio and Television import approval document number on a clear location on the audiovisual programme and its packaging, must use the approved Chinese programme name, foreign programmes shall indicate the Chinese and foreign language name on the audiovisual programme and its packaging, the programme name may not be altered and the programme content may not be deleted or abridged without authorization.

(3) Publication of imported audiovisual programmes shall comply with the State-promulgated spoken and written language standards and technical quality norms.

(4) Of imported audiovisual programmes, within 30 days of publication, the importing work unit must hand over duplicate specimens to the General Administration of Radio and Television for filing.

VI: audiovisual programme importing work units go to Customs to handle master tape (master disc) or finished audiovisual programme import formalities with the General Administration of Radio and Television audiovisual programme import approval documents.

VII: The “Imported Audio (Video) Product Reporting Form” is printed according to the template and norms formulated by the General Administration of Radio and Television by the audiovisual programme importing work unit themselves. Relevant documents and forms may be downloaded from the General Administration of Radio and Television government website.

VIII: Application materials and programme samples are to be sent up to the General Administration of Radio and Television Publication Management Department Audiovisual and Electronic Office in duplicate. This notice takes effect on the day of promulgation.

各省、自治区、直辖市新闻出版局,解放军总政宣传部新闻出版局,全国各音像出版单位、制作单位、复制单位、发行单位:

根据《国务院办公厅关于印发国家新闻出版总署(国家版权局)主要职责内设机构和人员编制规定的通知》(国办发[2008]90号)的有关规定,音像制品进口管理的职责由文化部划入新闻出版总署。现将有关事项通知如下:

一、今后凡从外国及香港、澳门和台湾地区进口音像制品成品和进口用于出版、信息网络传播及其他用途的音像制品,均应报新闻出版总署进行内容审查。新闻出版总署负责全国音像制品进口的监督管理工作。

二、新闻出版总署将设立进口音像制品审查委员会,由若干名专家组成,负责审查进口音像制品的内容。委员会下设办公室,负责受理进口单位申报材料和报审样品,并组织专家进行内容审查。新闻出版总署根据专家审查意见做出批准或不批准的决定。批准的,发给《进口音像制品批准单》;不批准的,发给《进口音像制品审查通知单》,并说明理由。审查时限为30日。

三、报送程序和材料

(一)进口用于出版或用于信息网络传播的音像制品,应当由有关出版单位向新闻出版总署提出申请并报送以下文件和材料:

1.《进口录音(像)制品报审表》;

2.版权贸易协议(中外文文本)草案,原始版权证明书,版权授权书和国家著作权认证机构的登记认证文件;

3.节目样片(载体形式为CD、VCD或DVD);

4.内容审查所需的其他材料。

(二)进口音像制品成品,由音像制品成品进口单位向新闻出版总署提出申请并报送以下文件和材料:

1.《进口录音(像)制品报审表》;

2.进口协议草案;

3.节目样片、中外文歌词等文字材料;

4.内容审查所需的其他材料。

(三)进口用于展览、展示的音像制品,由展览、展示活动主办单位提出申请,并将音像制品目录和样片报新闻出版总署进行内容审查。

四、音像制品进口申报要求

(一)进口单位需提交填写完整的报审表,版权贸易合同,原始版权证明书,版权授权证明,版权认证文件以及节目样片。

(二)填写《进口录音(像)制品报审表》注意事项:录音节目报审表中,曲目、表演者及词曲作者要准确无误;录像节目报审表中,“内容介绍”要客观完整。报审表中“进口单位初审意见”一栏,必须对进口节目的思想内容和艺术水平做出评价,对不符合国家规定的内容、情节,要提出处理意见,但不要在节目样片上删减节目内容。在填写报审表时,进口单位要盖章,单位负责人要签字。在报审表上填写的曲目或节目集(部)的顺序要与报审样片、歌词材料的顺序一致。

(三)报审样片要信号清晰,节目完整。外文录像节目的样盘须有中文字幕或普通话配音。外语录音节目要有中外文歌词材料,歌词材料要标准、清晰,不得随意更改歌词。外语录像节目要有中文名称,节目中文名称要使用规范的语言文字,节目样盘须有中文字幕或普通话配音。

(四)报审的文字材料不得使用传真件,著作权认证材料要用原件。

五、出版进口音像制品须遵照以下要求:

(一)在经批准进口出版的音像制品版权授权期限内(授权期限一般不低于3年),不得进口该音像制品成品。

(二)出版单位须在音像制品及其包装的明显位置标明新闻出版总署的进口批准文件的文号,须使用经批准的中文节目名称,外语节目应当在音像制品及封面包装上标明中外文名称,不得擅自变更节目名称和增删节目内容。

(三)出版进口音像制品应当符合国家公布的语言文字规范和质量技术标准。

(四)进口音像制品自出版之日起30日内,进口单位须将样品一式两份报送新闻出版总署备案。

六、音像制品进口单位凭新闻出版总署进口音像制品批准文件到海关办理母带(母盘)或者音像制品成品的进口手续。

七、《进口录音(像)制品报审表》由音像制品进口单位按照新闻出版总署制定的样式和规格自行印制。有关文件和表格可在新闻出版总署政府网站上进行下载。
