Sina Weibo Community Pact (Trial)

In order to establish a harmonious, rule of law and healthy network environment, safeguard the order of the Sina Weibo community, and even better guarantee the lawful rights and interests of users, Sina Weibo has formulated this Pact together with users.

Chapter I: General provisions

Article 1: Sina Weibo is a social interaction network platform set up and operated by Sina Corporation.

Article 2: Sina Weibo users refers to registered users of Sina Weibo, their acts shall abide by this Pact; those not registered shall also consult and follow this Pact concerning their activities on this platform.

Article 3: Sina Weibo users may not violate existing laws and regulations in their activities on this platform. This platform cooperates with judicial organs to safeguard the lawful rights and interests of persons whose rights are infringed according to corresponding laws and regulations and the user registration agreement.

Article 4: The Sina Weibo Community Management Centre (hereafter designated as “the Web Site) formulates the “Sina Weibo Community Management Regulations (Trial)” on the basis of present laws and regulations, and this Pact, and implements management.

Chapter II: Users’ rights

Article 5: Users enjoy the use rights of Sina Weibo accounts. This use right may not be transferred in any way, the acts of accounts shall be considered as the acts of the registered user.

Article 6: The Web Site encourages users to verify their real identity and apply for specific designations, the application method and verification conditions are open and transparent. This sort of users enjoys more service. Specific designations include individual certification, Weibo star member, organic certification, etc.

Article 7: Users’ expressions on this platform may not infringe other persons’ lawful rights and interests, and may not conflict with existing laws and regulations, and this Pact.

Article 8: Users’ individual privacy receives protection.

Sina Weibo users’ true information verification information is preserved by a third party platform. Protecting user privacy is a basic policy of Sina Weibo, except where users voluntarily make information public or judicial organs requires their disclosure according to statutory procedure.

Article 9: When users’ just rights and interests are harmed on Sina Weibo, they may safeguard their rights and interests through the Weibo reporting function or judicial channels.

Chapter III: User activity norms

Article 10: User registration and user of Weibo shall conform to existing laws and regulations. They may not in any way transfer their Weibo account use rights and may not misappropriate other persons’ accounts.

Article 11: Users may not maliciously register for Weibo accounts, publish information or follow persons through machine, software and other non-humanpower methods, except for the application of software officially permitted by Weibo.

Article 12: Users have the right to set up individual accounts (including: nickname, portraits, individual introduction, account templates, etc.), but may not set up account information with the following content:

(1) violating State laws and regulations;

(2) including content of a personal attack nature;

(3) suggesting at confusion with other persons and organs;

(4) including illegal information.

Obscure expressions and other methods may not be used to circumvent the above limitations.

Article 13: Users have the right to publish information, but may not publish information with the following content:

(1) opposing the basic principles determined in the Constitution;

(2) violating national unity, sovereignty and territorial integrity;

(3) divulging State secrets, endangering national security or harming national honour and interest;

(4) inciting ethnic hatred or ethnic distribution, destroying ethnic unity, or violating ethic customs or habits;

(5) propagating superstition or heresy;

(6) propagating rumours, disordering social order, destroying social stability

(7) propagating obscenity, gambling, violence or instigating crimes;

(8) inciting illegal gatherings, associations, demonstrations, marches, assembling crowds to disrupt public order;

(9) other content prohibited by laws, administrative regulations and State provisions

Article 14: Users shall not publish false information. For details on the scope of false information, see the “Sina Weibo Community Management Regulations (Trial)”.

Article 15: users shall respect the right to reputation of other members, and may not engage in personal attacks against other persons through insulting, libellous or other methods.

Article 16:Users shall respect other persons’ right to privacy, and may not violate other persons’ privacy. Except where it involves public interest or happens with the agreement of the party concerned.

Privacy includes real names, identity card numbers, telephone numbers, home addresses and other individual information that the user does not wish to be made public.

Article 17: Users shall respect other persons’ portrait rights, and may not engage in unauthorized use or revision of other persons’ portraits without their approval.

Article 18: Users shall respect other persons’ right to tranquillity, and may not utilize Weibo to harass other persons. Comment, @other persons, personal letters, follow requests and other methods shall not be used to repeatedly transmit duplicate or similar information, or information with similar appeals.

Article 19: Users shall respect other persons’ copyright. When publishing other persons’ originally-created content, the source must be indicated, or it must have a clear republishing symbol.

Chapter IV: Community management

Article 20: Sina Weibo community management will be jointly completed by the Web Site and the community management committees.

Article 21: The Web Site may discover acts violating regulations through active discovery or user reports, and users having completed real name verifications may use the Weibo reporting function.

Article 22: The Web Site deals with acts violating regulations according to the “Sina Weibo Community Management Regulations (Trial)”.

Article 23: Punishment for violating of regulations includes: dealing with content or accounts:

Punishment for content includes: deleting, prohibiting reprinting, prohibiting comment, marking, etc.

Punishment for accounts includes: prohibition to post microblogs, prohibition to be followed, etc., up to cancellation.

Article 24: The Web Site directly deals with acts violating regulations that can be clearly distinguished, other acts violating regulations are delay with after judgement by the community committees.

Article 25: Community committees are divided into two categories: the normal committee judging user disputes, and the expert committee judging false information. Community committee members are all openly recruited.

Article 26: During the judgement of acts suspected to violate regulations, the community committees form a judgement decision using the method of a majority within a limited period, the Web Site will act upon its completion.

Article 27: The process of handling regulation violations is published using the web page file method.

Article 28: The Web Site’ punishment measures adopted on the basis of the community committees’ judgements, belong to the category of user self-discipline and do not represent the standpoint of Sina Weibo.

Chapter V: Supplementary provisions

Article 29: Legal disputes initiated because of users’ activities on Weibo, have no relationship with the Sina Corporation.

Article 30: The Web Site may, according to the different stages of Internet development, following the incessant enrichment of community management experience, and starting from the objective of safeguarding the Weibo community order, incessantly perfect these Regulations.

Article 31: These Regulations take effect on 28 May 2012.

新浪微博社区公约(试行)
为构建和谐、法治、健康的网络环境,维护新浪微博社区秩序,更好的保障用户合法权益,新浪微博与用户共同制定本公约。

第一章总 则

第一条
新浪微博是由新浪公司创建、运行的社交网络平台。

第二条
新浪微博用户是指新浪微博的注册用户,其行为需遵守本公约;未注册者在本平台的活动亦参照本公约。

第三条
新浪微博用户在本平台的活动不得违反现行法律法规。本平台将按照相关法律法规及用户注册协议,配合司法机关维护被侵权人合法权益。

第四条
新浪微博社区管理中心(以下统称“站方”)根据现行法律法规及本公约,制定《新浪微博社区管理规定(试行)》并实施管理。

第二章用户权利

第五条
用户享有新浪微博帐号的使用权。该使用权不得以任何方式转让,帐号的行为将被视为注册用户的行为。

第六条
站方鼓励用户验证真实身份及申请特定标识,申请方式和审核条件公开透明。此类用户享有更多服务。特定标识包括:个人认证、微博达人、机构认证等。

第七条
用户在本平台的表达不得侵害他人合法权益,不得与现行法律法规和本公约相冲突。

第八条
用户的个人隐私受到保护。
新浪微博的用户真实身份验证信息由第三方平台保存。对用户隐私的保护是新浪微博的基本政策,用户自行公开、司法机关依照法定程序要求披露的除外。

第九条
用户在新浪微博的正当权益受到侵害时,可通过微博举报功能或司法途径维护权益。

第三章用户行为规范

第十条
用户注册、使用微博应符合现行法律法规。不得以任何方式受让微博帐号使用权,不得盗用他人帐号。

第十一条
用户不得恶意通过机器或软件等非人力手段注册微博帐号、发布内容或关注他人,经微博官方许可的软件应用除外。

第十二条
用户拥有设置个性化帐号信息的权利(包括:昵称、头像、个人介绍、帐号模板等),但不得设置含有以下内容的帐号信息:
(一) 违反国家法律法规的;
(二) 包含人身攻击性质内容的;
(三) 暗示与他人或机构相混同的;
(四) 包含非法信息的。
不得使用隐晦表达等方式规避以上限制。

第十三条
用户拥有发布信息的权利,但不得发布含有以下内容的信息:
(一) 反对宪法确定的基本原则的;
(二) 危害国家统一、主权和领土完整的;
(三) 泄露国家秘密、危害国家安全或者损害国家荣誉和利益的;
(四) 煽动民族仇恨、民族歧视,破坏民族团结,或者侵害民族风俗、习惯的;
(五) 宣扬邪教、迷信的;
(六) 散布谣言,扰乱社会秩序,破坏社会稳定的;
(七) 宣扬淫秽、赌博、暴力或者教唆犯罪的;
(八) 煽动非法集会、结社、游行、示威、聚众扰乱社会秩序的;
(九) 有法律、行政法规和国家规定禁止的其他内容的。

第十四条
用户不应发布不实信息。不实信息范围详见《新浪微博社区管理规定(试行)》。

第十五条
用户应尊重他人名誉权,不得以侮辱、诽谤等方式对他人进行人身攻击。

第十六条
用户应尊重他人隐私权,不得侵害他人隐私。涉及公众利益或经由当事人同意的除外。
隐私包括真实姓名、身份证号、电话号码、家庭住址及用户不愿公开的其他个人信息。

第十七条
用户应尊重他人肖像权,未经他人同意不得擅自使用或修改其肖像。

第十八条
用户应尊重他人安宁权,不得利用微博骚扰他人。不应以评论、@他人、私信、求关注等方式对他人反复发送重复、近似、诉求相同的信息。

第十九条
用户应尊重他人著作权。发布他人原创内容需注明出处或带有明显转载标识。

第四章社区管理

第二十条
新浪微博社区管理由站方和社区委员会共同完成。

第二十一条
站方可通过主动发现及接受用户举报发现违规行为,完成真实身份验证的用户可使用微博的举报功能。

第二十二条
站方根据《新浪微博社区管理规定(试行)》处理违规行为。

第二十三条
违规处理包括:内容处理和帐号处理。
内容处理包括:删除、禁止被转发、禁止被评论、标注等。
帐号处理包括:禁止发布微博、禁止被关注等,直至注销。

第二十四条
对于可明显识别的违规行为,由站方直接处理;其他违规行为,由社区委员会判定后处理。

第二十五条
社区委员会分为两类:判定用户纠纷的普通委员会,判定不实信息的专家委员会。社区委员会成员均为公开招募。

第二十六条
在涉嫌违规行为的判定中,社区委员会在时限内以多数决的方式,形成判定结果,站方据此完成处理。

第二十七条
违规处理过程以网页卷宗的方式公示。

第二十八条
站方根据社区委员会判定结果所采取的处理措施,属于用户自律范畴,不代表新浪微博立场。

第五章附 则

第二十九条
用户因微博行为引发的法律纠纷,与新浪公司无关。

第三十条
站方可依照互联网发展的不同阶段,随着社区管理经验的不断丰富,出于维护微博社区秩序的目的,不断完善本公约。

第三十一条
本公约自2012年5月28日起施行。
