Implementation Rules concerning Newspaper and Periodical Editorial Structure Reform

On the basis of the spirit of the “Central Committee Secretariat and State Council Secretariat Opinions concerning Deepening Structural Reform of Non-Current Affairs-Type Newspaper and Periodical Publishing Work Units” (ZBF No. (2011)19), and according to the relevant provisions of the “Publishing Management Regulations”, integrating the real situation of newspaper and periodical editorial departments, these Implementation Rules are formulated.

These Implementation Rules apply to all newspaper and periodical editorial departments that have undergone approval by the General Administration of Press and Publications to engage in newspaper and periodical publishing activities, have obtained a domestic uniform serial publishing number, but that do not have independent legal person qualifications.

I, The guiding ideology and principle requirements of structural reform in newspaper and periodical editorial departments

In newspaper and periodical editorial department structural reform, it is necessary to take Deng Xiaoping Theory and the important “Three Represents” thought as guidance, deeply implement the scientific development view, and on the basis of the general requirements of raising high the colours, revolving around the larger picture, serving the people, reform and innovation, liberate thoughts, seek truth from facts, move with the times, seek for truth in pragmatism, and completely move structural reform and innovation forward; persist in the progressive direction of advanced Socialist culture, grasp the correct public opinion orientation, incessantly consolidate and develop the mainstream public opinion battlefield, completely put social interest first, strive to realize the organic integration of social interest and economic interest; persist in integrating administrative promotion with market operation, with capital as linkage, move resource reorganization and reorganization forward, raise the concentration level of newspapers and periodicals; persist in stimulating development with reform, closely integrate deepening reform with accelerating development, promote the incessant deepening of reform; persist in strengthening Party leadership, grasp the correct orientation for reform, plan comprehensively, guide in a categorized manner, focus on prominent points, move forward in a stable manner, implement reform tasks according to the principle of who is responsible, manages matters, clarify management tasks, guarantee the smooth implementation of reform.

Newspaper and periodical editorial department structural reform must be integrated with adjusting newspaper and periodical sector structures and transforming newspaper and periodical sector development method, according to the general deployment and requirements of the relevant Central newspaper and periodical publishing work units, integrate with realizing intensified management of the newspaper and periodical sector and fostering large-scale newspaper and periodical media groups, integrate with promoting the transformation of traditional media into digitized and networked modern media, and integrate with the establishment and completion of newspaper and periodical access and withdrawal mechanisms and scientific allocation of newspaper and periodical resources. Through reform, liberation and development of newspaper and periodical production forces, analyse and explain the structural malpractices of the newspaper and periodical sector in terms of “smallness, scattering and overflow”, realize the transformation and upgrading of the newspaper and periodical sector, promote that the newspaper and periodical sector develops both well and rapidly, strengthen newspaper and periodical publishing and dissemination capacity.

II, Implementation rules for newspaper and periodical editorial department structural reform

In principle, the newspaper and periodical editorial department structure will not be maintained. Concerning existing newspaper and periodical editorial departments, different reform methods will be implemented according to different circumstances.

Newspaper and periodical editorial departments, subordinate to newspaper and periodical publishing work units, that should reform into enterprises, are to conduct enterprise transformation without exception, following the work unit to which they are subordinate.

Newspaper and periodical editorial departments run by Party and government departments, democratic parties, people’s organizations, sector associations, social organizations, undertaking work units and State-owned enterprises, merge into press and publications publishing media enterprises of that department and that work unit; where the department of work unit do not have press and publications media enterprises, and have three or more newspaper and periodical editorial departments they control or sponsor, with the approval of the General Administration of Press and Publications, may merge into one newspaper and periodical publishing enterprise; where they control or sponsor less than 3 newspaper and periodical editorial departments, they merge into other press and publications media enterprises.

Newspapers and periodicals sponsored or controlled by Party and government departments, democratic parties, People’s Organizations, sector associations, social organizations, undertaking work units and State-owned enterprises for use in guiding work, facing distribution within that system, are without exception changed into internal informative publications, and are only limited to internal distribution within the department or the system, they may not be distributed through subscription, may not carry advertising, and may not attract subsidy or engage in commercial activities.

Newspaper and periodical editorial departments not suited to the abovementioned reform methods are to be closed down, and newspaper and periodical editorial departments with grave circumstances of publishing in violation of laws and regulations are to be cancelled. The newspaper and periodical publishing permit of newspaper and periodical editorial departments that are closed down or cancelled, is cancelled by the General Administration of Press and Publications.

Furthermore, the extreme small number of newspaper and periodical editorial departments that have a controlling and sponsoring work unit conform to State provisions, that have full-time editorial personnel conform to State-provided qualifications and conditions, have fixed business premises, having statutory funding sources, with a relatively large circulation nationwide, with a good commercial situation, that are able to undertake legal and regulatory responsibilities and duties, and that have the conditions to transform into a newspaper or periodical publishing enterprise, may change into an newspaper and periodical publishing enterprise with the permission of the General Administration of Press and Publications.

Party newspaper and Party periodical publishing work units and large-scale press and publications media group companies are encouraged and supported to integrate with newspaper and periodical editorial departments, it is encouraged and supported to integrate newspaper and periodical editorial departments with the daughter newspapers and periodicals of Party newspapers and periodicals, and sector-type newspaper and periodical publishing enterprises with great strength in the lead, shaping large-scape comprehensive or specialist newspaper and periodical publishing media group companies.

III, Implementation rules for editorial department structural reform of science and technology periodicals and academic periodicals

Science and technology periodicals and academic periodicals sponsored or controlled by scientific research departments and higher education institutes, are an important component part of the newspaper and periodical sector. Science and technology periodical and academic periodical editorial department structural reform must happen according to the reality and characteristics of science and technology periodicals and academic periodicals, in line with the principles of prominent focus, forging brands, integrating resources and strengthening guarantees.

In principle, the structure of science and technology periodicals and academic periodicals is no longer maintained. Existing science and technology periodical and academic periodical editorial departments are all to merge into news publishing media enterprises; those having conditions to establish a newspaper and periodical publishing enterprise may transform into periodical publishing enterprise with permission of the General Administration of Press and Publications. Scientific research departments and higher education institutes controlling or sponsoring many science and technology periodical and academic periodical editorial departments, with permission of the General Administration of Press and Publications, may transform their subordinate science and technology periodical and academic periodical editorial departments into integrated enterprise structures , and establish a specialist periodical publishing media group company.

Concerning academic journal editorial departments controlled or sponsored by higher education institutes, they merge into the press and publications media enterprise of the school in questions, academic journal editorial departments of schools that do not have a press and publications media enterprise but that have conditions to establish a periodical publishing enterprise, with the permission of the General Administration of Press and Publications, may be transformed into periodical publishing enterprises; academic journal editorial departments of schools that do not have press and publications media enterprises and that cannot transform into periodical publishing enterprises, with the permission of the General Administration of Press and Publications, with a similar or identical specialization or academic discipline as basis, are to merge into another press and publications media enterprise or a specialist periodical publishing media group company.

Periodicals of scientific research departments that mainly undertake tasks of work guidance in specialist academic areas and exchange of circumstances and other school newspapers, are without exception changed into internal informative publications.

Focus science and technology periodical and academic periodical editorial departments that have a leading level in national basic disciplines and forefront disciplines, that can represent national academic levels, where the conditions to merge into press and publications media enterprises or transformation into periodical publishing enterprises are not mature, may be preserved for the time being, but must establish operational models where the scientific research department respectively edits it, and a publishing enterprise uniformly publishes and distributes it, relying on large-scale press and publications media group companies with setting up academic publishing commerce platforms.

IV, Policy guarantees for newspaper and periodical editorial department structural reform

All State policies relating to State-current affairs-type newspaper and periodical work units apply to the structural reform of all newspaper and periodical editorial departments. All central departments and work units, and all localities are encouraged to integrate reality, research and formulate all sorts of supplementary policies to support and carry forward newspaper and periodical editorial department structural reform.

Vigorously strive for the support of all State finding for academic periodicals, bring the focus science and technology periodicals and academic periodicals in basic national disciplines and forefront disciplines into the scope of national natural science, social science and publishing funding assistance; vigorously strive for Central and local financial administrations to provide support to focus science and technology periodical and academic periodical publishing work unit through arranging cultural industry special development funds, propaganda and culture special funds and other channels; vigorously strive for preferential taxation policies for focus science and technology periodical and academic periodical development. Through establishing State-level academic levels and academic standard appraisal structures, building digitized focus State science and technology periodical and academic periodical platforms, implementing focus State science and technology periodical and academic periodical brand projects and other measures, expand the support strength for focus science and technology periodicals and academic periodicals.

Strictly standardize next editorial department structural reform work according to relevant State policies and regulations. Strengthen and perfect controlling and sponsoring structures for after newspaper and periodical editorial departments transform into newspaper and periodical publishing enterprises, explore the establishment of controlling and sponsoring management structures and financing management structures’ organic integration; straiten the duties of sponsoring and controlling work units, require controlling and sponsoring work units to realistically bear the tasks of managing guidance, managing cadres and managing assets. According to relevant State regulations, during the process of newspaper and periodical editorial department transforming or merging into newspaper and periodical publishing enterprises, no non-public capital may enter.

Where newspaper and periodical editorial departments are closed down and cancelled, according to the principle of who manages is responsible, the controlling and sponsoring work units are responsible for finishing personnel arrangements, asset disposition, credit and debt settlement work. Formulate special personnel redundancy arrangement rules, adopt many kinds of channels to conduct arrangement, and preferentially consider arrangements within the department or the work unit; to those having agreed to find jobs by themselves, the controlling and sponsoring work units are to honour economic contracts and continue the social security relationship according to relevant State regulations.

V, Organizational guidance over newspaper and periodical editorial department structural reform

Newspaper and periodical editorial department structural reform involves many matters, situations are complex, and it has a strong policy nature. All Central departments and work units, and all localities, must realistically strengthen organizational leadership over newspaper and periodical editorial department structural reform work, carefully deploy, meticulously organize, grasp implementation and vigorously and appropriately move forward reform according to this Notice

Reform work in all Central department and work unit newspaper and periodical editorial departments, is conducted under the organization and coordination by the joint conference for non-news-type newspaper and periodical publishing work unit structural reform work and the General Administration of Press and Publications; structural reform work for newspaper and periodical editorial departments in all provinces, is conducted under the organizational guidance of all provincial, autonomous region or municipal cultural structural reform and development work leading small groups and press and publications bureaus. Newspaper and periodical editorial departments’ controlling and sponsoring work units are concretely responsible for the organization and implementation of structural reform of newspaper and periodical editorial departments subordinate to them. During the process of implementing reform, they must earnestly perform political and ideological work, and realistically resolve all sorts of concrete issues well. It is necessary to grasp the power to appoint or dismiss cadres, the power to make policy concerning major events and the final adjudication power over newspaper and periodical content, guaranteeing the correct orientation and sustained development. It is necessary to realistically safeguard the lawful rights and interests of staff, and fully muster the vigour and initiative of workers in participating in reform. It is prohibited to move or secretly divide assets in the process of reform.

Structural reform plans for newspaper and periodical editorial departments subordinate to all Central departments and all work units, are reported through their controlling department to the  joint conference for non-news-type newspaper and periodical publishing work unit structural reform work, the office of the joint conference for non-news-type newspaper and periodical publishing work unit structural reform work examines, verifies and approves the submitted plans. All provincial, autonomous region and municipal newspaper and periodical editorial department structural reform plans, are reported respectively by all provincial, autonomous region and municipal cultural structural reform and development work leading small groups and press and publications bureaus to the Central Cultural Structural Reform and Development Work Small Group Office and the General Administration of Press and Publications, and the General Administration examines and verifies them, and the agreement of the Central Cultural Structural Reform and Development Work Small Group Office agreement is sought, the Central Cultural Structural Reform and Development Work Small Group Office and the General Administration of Press and Publications respectively approve them.

Structural reform plans for all Central departments and all work units’ controlling and sponsoring newspaper and periodical editorial departments in all localities, on the basis of consultative agreement, are reported by all Central departments and work units or the localities according to abovementioned procedures.

关于报刊编辑部体制改革的实施办法

根据《中央办公厅、国务院办公厅关于深化非时政类报刊出版单位体制改革的意见》(中办发〔2011〕19号)精神,依照《出版管理条例》有关规定,结合报刊编辑部的实际情况,制定本实施办法。
本实施办法适用于所有经新闻出版总署批准从事报刊出版活动、获得国内统一连续出版物号、但不具有独立法人资格的报刊编辑部。
一、报刊编辑部体制改革的指导思想和原则要求
报刊编辑部体制改革要坚持以邓小平理论和“三个代表”重要思想为指导,深入贯彻落实科学发展观,按照高举旗帜、围绕大局、服务人民、改革创新的总要求,解放思想、实事求是、与时俱进、求真务实,全面推进体制机制创新;坚持社会主义先进文化前进方向,把握正确舆论导向,不断巩固和发展主流舆论阵地,始终把社会效益放在首位,努力实现社会效益和经济效益的有机统一;坚持行政推动与市场运作相结合,以资本为纽带,推进资源重组和结构调整,提高报刊业集中度;坚持以改革促发展,把深化改革与加快发展紧密结合起来,推动改革不断深入;坚持加强党的领导,把握正确改革方向,统筹规划、分类指导、突出重点、稳步推进,按照谁主管谁负责原则,落实改革任务,明确管理责任,确保改革顺利进行。
报刊编辑部体制改革必须按照中央有关报刊出版单位体制改革的总体部署和要求,与调整报刊业结构、转变报刊业发展方式相结合,与实现报刊业集约化经营、培育大型报刊传媒集团相结合,与推动传统报刊业向数字化、网络化现代传媒业转型相结合,与建立健全报刊准入和退出机制、科学配置报刊资源相结合。通过改革,解放和发展报刊生产力,破解报刊业“小、散、滥”的结构性弊端,实现报刊业转型和升级,推动报刊业又好又快发展,增强报刊出版传播能力。
二、报刊编辑部体制改革的实施办法
原则上不再保留报刊编辑部体制。对现有报刊编辑部,区别不同情况实施不同改革办法。
应转企改制的报刊出版单位所属的报刊编辑部,一律随隶属单位进行转企改制。
党政部门、民主党派、人民团体、行业协会、社会团体、事业单位和国有企业主管主办的报刊编辑部,并入本部门本单位新闻出版传媒企业;本部门本单位没有新闻出版传媒企业、其主管主办的报刊编辑部有3个(含3个)以上的,经新闻出版总署批准,可合并建立1家报刊出版企业;主管主办报刊编辑部不够3个的,并入其他新闻出版传媒企业。
对于党政部门、民主党派、人民团体、行业协会、社会团体、事业单位和国有企业主管主办的用于指导工作、面向本系统发行的报刊,一律改为内部资料性出版物,仅限于在本部门本系统内部交流,不得征订发行,不得刊登广告,不得拉赞助和开展经营性活动。
对于不适用上述改革办法的报刊编辑部予以停办,对违法违规出版情节严重的报刊编辑部予以撤销。对停办和撤销的报刊编辑部,由新闻出版总署注销其报刊出版许可证。
此外,对于极少数有符合国家规定的主管主办单位、有符合国家规定资格条件的专职采编人员、有固定办公场所、有法定资金来源,全国发行量较大,经营状况良好,能够承担法律规定的责任和义务,具备转为报刊出版企业条件的报刊编辑部,经新闻出版总署批准,可转为报刊出版企业。
鼓励和支持党报党刊出版单位和大型新闻出版传媒集团公司对报刊编辑部进行整合,鼓励和支持以党报党刊的子报子刊、实力雄厚的行业性报刊出版企业为龙头对报刊编辑部进行整合,形成大型综合性或专业性报刊出版传媒集团公司。
三、科技期刊和学术期刊编辑部体制改革的实施办法
科研部门和高等学校主管主办的科技期刊和学术期刊,是报刊业的重要组成部分。科技期刊和学术期刊编辑部体制改革要根据科技期刊和学术期刊的实际和特点,本着突出重点、打造品牌、整合资源、加强保障的原则实施改革。
原则上不再保留科技期刊和学术期刊编辑部体制。现有科技期刊和学术期刊编辑部均并入新闻出版传媒企业;对其中具备建立报刊出版企业条件的,经新闻出版总署批准,可转为期刊出版企业。主管主办多种科技期刊和学术期刊编辑部的科研部门和高等学校,经新闻出版总署批准,可对所主管的科技期刊和学术期刊编辑部实行整体转企改制,组建专业性期刊出版传媒集团公司。
对于高等学校主管主办的学报编辑部,并入本校新闻出版传媒企业;对于本校没有新闻出版传媒企业但具备建立期刊出版企业条件的学报编辑部,经新闻出版总署批准,可转为期刊出版企业;对于本校没有新闻出版传媒企业且不能转为期刊出版企业的学报编辑部,经新闻出版总署批准,以相同相近的专业和学科为基础,并入其他新闻出版传媒企业或专业性期刊出版传媒集团公司。
对于科研部门主要承担专业学术领域工作指导、情况交流任务的期刊和高等学校校报,一律改为内部资料性出版物。
对于在国家基础学科和前沿学科中具有领先水平、能代表国家学术水准,并入新闻出版传媒企业或转为期刊出版企业条件不成熟的重点科技期刊和学术期刊编辑部,可暂时保留,但要建立由科研部门分别编辑、出版企业统一出版发行的运行模式,依托大型新闻出版传媒集团公司搭建学术出版经营平台。
四、报刊编辑部体制改革的政策保障
国家有关非时政类报刊出版单位体制改革的各项政策适用于所有报刊编辑部体制改革。鼓励中央各部门各单位和各地区结合实际,研究制定支持和扶持报刊编辑部体制改革的各项配套政策。
积极争取国家各种基金对学术期刊的支持,将国家基础学科和前沿学科的重点科技期刊和学术期刊纳入国家自然科学、社会科学和出版基金资助范围;积极争取中央和地方财政通过安排文化产业发展专项资金、宣传文化发展专项资金等渠道,对重点科技期刊和学术期刊出版单位予以扶持;积极争取支持重点科技期刊和学术期刊发展的财税优惠政策。通过建立国家级学术水平及学术标准的评价体系、构建国家重点科技期刊和学术期刊数字化平台、实施国家重点科技期刊和学术期刊品牌工程等措施,加大对重点科技期刊和学术期刊支持力度。
严格按照国家有关政策和法规规范报刊编辑部体制改革工作。加强和完善报刊编辑部转为报刊出版企业后的主管主办制度,探索建立主管主办管理体制和出资人管理体制有机衔接的工作机制;严格主管主办单位职责,要求主管主办单位切实担负起管导向、管干部、管资产的任务。按照国家有关规定,在报刊编辑部转制或合并建立报刊出版企业中,不得有非公有资本进入。
报刊编辑部停办和撤销的,按照谁主管谁负责的原则,由主管主办单位负责做好人员安置、资产处置和债权债务处理工作。制定专门的人员分流安置办法,采取多种渠道进行安置,并优先考虑在本部门本单位内部进行安置;经协商一致自谋职业的,由主管主办单位依照国家有关规定兑现经济合同、接续社会保险关系。
五、报刊编辑部体制改革的组织领导
报刊编辑部体制改革涉及面广,情况复杂,政策性强。中央各部门各单位和各地区要切实加强对报刊编辑部体制改革工作的组织领导,周密部署,精心组织,抓好落实,依照本通知积极稳妥地推进改革。
中央各部门各单位报刊编辑部体制改革工作,在非时政类报刊出版单位体制改革工作联席会议和新闻出版总署的组织协调下进行;各省自治区直辖市报刊编辑部体制改革工作,在各省自治区直辖市文化体制改革和发展工作领导小组和新闻出版局的组织协调下进行。报刊编辑部的主管主办单位具体负责所属报刊编辑部体制改革工作的组织实施。在实施改革过程中,要认真做好政治思想工作,切实解决好各种具体问题。要始终掌握对主要干部的任免权、重大事项的决策权和报刊内容的终审权,确保正确导向和持续发展。要切实维护职工的合法权益,充分调动职工参与改革的积极性和主动性。严禁在体制改革中转移和私分财物。
中央各部门各单位所属报刊编辑部体制改革方案,通过其主管单位向非时政类报刊出版单位体制改革工作联席会议办公室报送,非时政类报刊出版单位体制改革工作联席会议办公室对所报方案予以审核和批复。各省自治区直辖市报刊编辑部体制改革方案,由各省自治区直辖市文化体制改革和发展工作领导小组办公室和新闻出版局分别向中央文化体制改革和发展工作领导小组办公室和新闻出版总署报送,经新闻出版总署审核并征求中央文化体制改革和发展工作领导小组办公室意见后,由中央文化体制改革和发展工作领导小组办公室和新闻出版总署分别予以批复。
中央各部门各单位主管主办在各地区的报刊编辑部体制改革方案,在协商一致的基础上,由中央各部门各单位或地方按照上述程序报送。
