Chapter I: General Principles
Article 1: Publications as named in this products, means documents and images printed using mechanic or chemical means for sale or distribution
Article 2: Publications are divided in the following three kinds:
1: Newsprint: refers to those using a certain name, which are continuously distributed daily or with a space of six days or fewer between them.
2: Magazine: refers to those using a certain name, which are continuously distributed weekly or with a space of three months or fewer between them.
3: Books and other publications: all publications outside of the above two items fall under this.
Newsprint and magazines’ extra numbers or supplementary numbers are considered as newsprint or magazine.
Article 3: Distributor as named in this law, means the person in charge of selling or distributing publications.
Article 4: Author as named in this Law, means the person writing or producing the document or image.
In case of taking down performances of other persons, printing them in publications or ordering other persons to print them, the note-taker is considered as the author. But where the performer has made special commitments concerning news printing, he shall also bear the responsibility of the author.
Concerning compilation of publications, the compiler shall be considered as author. But where the original author has made special commitments concerning compilation, he shall also bear the responsibility of the author.
Concerning translation of publications, the translator shall be considered as author.
Concerning publications written under the name of schools, companies, associations and other groups, the representative of the school, company, association or other group shall be considered as author.
Article 5: Editor as named in this Law, means the person in charge of editing newsprint or magazines.
Article 6: Where publications are distributed by government offices, two copies are to be sent to the Central Party Propaganda Department and the Ministry of the Interior.
Chapter II: Newsprint and magazines
Article 7: Those distributing newsprint or magazines, shall, fifteen days before the first publication, state all following matters in writing, present them at the provincial government of the distribution location or the municipal government subordinate to the Executive Yuan, which transfer them to the Ministry of the Interior and request registration.
1: The name of the newsprint or magazine.
2:Whether or not it carries matters concerning the Party platform, Party affairs or government affairs.
3: The periodical period
4: The date of first publication
5: The location and name of the distribution office and printing shop.
6: The full name, age and address of the distributor and editor, where the editor of each version is different, also the full name, age and address of all the said editors.
Where newsprint or magazines are already being distributed before the implementation of this Law, they shall request to register the former matters within two months after implementation of this Law.
Where newsprint or magazines print matters related to the Party platform or Party affairs, they shall also make a request for registration through the provincial Party Committee or a Party Committee equal to a provincial Party Committee with the Central Party Propaganda Department.
Article 8: Where matters that should be registered by provision of the previous Article change, a request for registration modification must be made within seven days of the change.
Article 9: No fees are collected for registration according to the previous two Articles.
Article 10: Persons with all following matters may not act as the editor or distributor of newsprint or periodicals:
1: Those having no domestic address.
2: Those deprived of their rights to manage and dispose of property
3: Those punished with a prison sentence or a short detention of one month or more, which is being executed.
4: Those deprived of their civil rights that have not yet been restored.
Article 11: When distribution of newsprint or magazines is cancelled the original distributor shall, according to the procedure of the time of registration, request cancellation of registration.
Where newsprint exceed the provided publication period by two months, and magazines exceed the provided publication period by four months, without having been distributed, it shall be considered as cancellation of distribution.
Article 12: Newsprint or magazines shall record the full name of the editor and distributor, the date of distribution, the name and address of the distribution office and the printing shop.
Article 13: Newsprint or magazines’ distributors shall send two copies to the Ministry of the Interior at the time of distribution, one copy is sent to the provincial government or municipal government of the locality of the distribution office, one copy is sent to the prosecution office of the locality of the distribution office.
Where newsprint or magazines carry matters related to the Party platform or Party affairs, one copy is also submitted to the provincial Party Organization or a Party Organization equal to a provincial Party Organization, and one copy is submitted to the Central Party Propaganda Department.
Article 14: Matters printed by newsprint or magazines, where the person himself or directly related persons request corrections or printing a letter of refutation, daily newsprint shall do this completely according to the correction or letter of refutation within three days after receiving the request, in other newsprint or magazines, this shall be done by the second distribution after receipt. But where the content of the correction or refutation obviously violates laws and decrees or where the requesting person’s name and address are not indicated, or where requests where filed in excess of six months after the original publication, this restriction does not apply.
The publication of corrections or letters of refutation, their position and font size shall be matched to that in which the original text was printed.
Chapter III: Books and other publications
Article 15: The distributors of books and other publications shall at the time of distribution, submit two copies to the Ministry of the Interior, and this is similar for distributors in case of revision or modification of original publications
Publications in the above item, where their content involves the Party platform of Party affairs, shall also submit one copy to the Central Party Propaganda Department.
Article 16: Books or other publications, shall indicate the distributors’ full name, address, date of distribution, and the name and locality of the distribution office and the printing shops on the last sheet.
Article 17: The provisions of the above two Articles do not apply to notices, rules, business operating reports, catalogues, leaflets, advertising, playbills, arrangement bills, all sorts of forms, certificates, securities and photographs.
Article 18: Leaflets or slogans relating to politics, that have not been permitted by the responsible police office, may not be printed or distributed.
Chapter IV: The limits of matters printed in publications
Article 19: Publications may not record the following items:
1: Intentional violations of the Chinese Guomindang or the Three Principles of the People.
2: Intentional subversion of the National Government or injury to the interest of the Republic of China.
3: Intentional destruction of public order.
4: Impairing good customs.
Article 20: Publications may not carry debates concerning incidents and lawsuits that are prohibited from being made public.
Article 21: In wartime, in the event of turmoil or when there are other special needs, it is permitted to, on the basis of the provisions ordered by the National Government, prohibit or limit publications’ printing of matters concerning military matters and foreign affairs.
Chapter V: Administrative punishment
Article 22: To those not having made a request for registration according to Article 7 or Article 8, or those distributing newspapers while having made false statements when registering, provincial governments or municipal governments may stop the distribution of the newsprint or magazine concerned until lawful request of registration has been made.
Article 23: Where the Ministry of the Interior identifies that publications contain one of the matters listed in all items of Article 19, or prohibited or limited matters as provided in Article 21, it may point out that matter and prohibit sale or dissemination of the publication, and may detain them when necessary
Publications detained according to the provisions of the above clause, if the distributor requests so, they may be given back after eliminating the matter concerned.
In cases where the first clause applies, and the circumstances are light, the Ministry of the Interior will order correction and impose a warning.
Article 24: Where foreign distributed newsprint and magazines, are subject to punishment under the first clause of the previous Article, the Ministry of the Interior may prohibit their import.
Newsprint and magazines of which import is prohibited according to the above clause, may be detained by provincial governments or municipal governments at the time of import.
Article 25: Newsprint and periodicals distributed in violation of a prohibition according to Paragraph 1 of Article 41, may be detained by provincial governments or municipal governments.
Article 26: When detaining books or other publications, if it is believed to be necessary, negative plates may also be detained.
For negative plates detained on the basis of the provisions of the above clause, the provisions of Paragraph 2 of Article 23 apply.
Chapter VI: Punitive provisions
Article 27: Those distributing newsprint or periodicals without requesting registration according to Article 7 and Article 8, are punished with a fine of 200 Yuan or less.
Article 28: Persons listed in all items of Article 10 distributing or editing newsprint or magazines, are punished with a fine of 200 Yuan or less.
Article 29: Distributors violating the provisions of Paragraph 1 of Article 11, are punished with a fine of 100 Yuan or less.
Article 30: Distributors of publications not recording matters as provided by Article 12 or Article 26, or recording them falsely, are punished with a fine of 200 Yuan or less
Article 31: Distributors violating the provisions of Article 13, and not submitting newsprint or magazines, are punished with a fine of 100 Yuan or less.
Article 32: Editors violating the provisions of Article 14, are punished with a fine of 200 Yuan or less.
Article 33: Distributors violating the provisions of Article 15 and not submitting books or other publications, are punished with a fine of 100 Yuan or less.
Article 34: Printers or distributors violating the provisions of Article 18, are punished with a fine of 100 Yuan or less.
Article 35: In case of violating the provisions of Article 19, distributors, editors, writers and printers are punished with imprisonment of one year or less, short detention or a fine of 1000 Yuan or less. But where other laws provide for heavier punishment, those provisions are followed.
Article 36: In case of violating the prohibitions or limitations provided in Article 21, distributors, editors, writers and printers are punished with imprisonment of one year or less, short detention or a fine of 1000 Yuan or less.
Article 37: When publications are newsprint or magazines, and writers receive punishment according to Article 35, this will be limited to those responsible for and signing off on printing the matter concerned, the same applies to writers receiving punishment according to Article 36.
Article 38: Those distributing newsprint or magazines in violation of a cessation of distribution order under Article 22, are punished with a fine of 200 Yuan or less.
Article 39: Where distributors violate prohibitions as provided in Article 23, they are punished with imprisonment of one year or less, short detention or a fine of 1000 Yuan or less, those knowingly selling or disseminating publications with these matters, are punished with imprisonment of six months or less, short detention or a fine of 500 Yuan or less.
Those knowingly importing, selling or distributing, in violation of a prohibition under Paragraph 1 of Article 24, publications carrying these matters, are permitted to be punished respectively using the provisions of the above clause.
Article 40: Those impairing the implementation of detention or punishment as provided in Paragraph 1 of Article 23, Paragraph 2 of Article 24, Article 25 or Article 26, are punished with imprisonment of six months or less, short detention or a fine of 500 Yuan or less.
Article 41: Those punished under the provisions of Article 35 because of matters printed in newsprint or magazines, with grave circumstances, may be prohibited from distributing newsprint or magazines.
Where distributors violate the provisions provided in the above clause, they are punished with imprisonment of one year or less, short detention or a fine of 1000 Yuan or lower, those knowingly selling or disseminating newsprint or magazines with these matters are punished with imprisonment of six months or less, short detention or a fine of 1000 Yuan or lower.
Article 42: The provisions in the Criminal Law on recidivism and combined determination of guilt do not apply to all crimes provided in this Law.
Article 43: Where the right to pursue a suit is not implemented within one year for all crimes listed in this Law, they will be eliminated because of prescription.
For the crimes in Article 35 and Article 36, the period of prescription for the right to pursue a suit is to be calculated from the day of distribution.
Chapter VII: Supplementary provisions
Article 44: This Law takes effect on the day of publication.
