Decision concerning Revising Article 45 of the “Constitution of the People’s Republic of China”
(Passed on 10 September 1980 during the 3rd Meeting of the 5th National People’s Congress)
The 3rd Meeting of the 5th National People’s Congress of the People’s Republic of China decides to agree with the proposal concerning suggesting a revision of Article 45 of the “Constitution of the People’s Republic of China” put forward by the Standing Committee of the 5th National People’s Congress, in order to fully carry forward Socialism, complete the Socialist legal system, safeguard the political picture of stability and unity, and guarantee that Socialist modernization construction is conducted smoothly, it is decided that: Article 45 of the Constitution of the People’s Republic of China, “Citizens have the freedom of speech, communication, publication, assembly, to form associations, to demonstrate, march and strike, and have the right to ‘speak out, air views, have debates and post large-character posters.'” is revised into: “Citizens have the freedom of speech, communication, publication, assembly, to form associations, to demonstrate, march and strike.” The provision of the original Article 45 that they “have the right to ‘speak out, air views, have debates and post large-character posters'” is deleted.
关于修改《中华人民共和国宪法》第四十五条的决议

中华人民共和国第五届全国人民代表大会第三次会议同意第五届全国人民代表大会常务委员会提出的关于建议修改《中华人民共和国宪法》第四十五条的议案,为了充分发扬社会主义民主,健全社会主义法制,维护安定团结的政治局面,保障社会主义现代化建设的顺利进行,决定:将《中华人民共和国宪法》第四十五条“公民有言论、通信、出版、集会、结社、游行、示威、罢工的自由,有运用‘大鸣、大放、大辩论、大字报’的权利。”修改为“公民有言论、通信、出版、集会、结社、游行、示威、罢工的自由。”取消原第四十五条中“有运用‘大鸣、大放、大辩论、大字报’的权利”的规定。
