In order to strengthen film videotape publication work management, according to the film distribution and projection management system endorsed in State Council document no. (1979)198 and the “Imported Films Management Rules” approved by document No. (81)SR156, as well as the provisions of NDC document no. (1982)154 concerning “film videotape products distribution will still be the responsibility of the film distribution entities”, and integrating the present realistic situation, these Rules are formulated.
I, All distributed films and their videotapes and laser discs, shall be imported and published by China Film Distribution and Projection Company (simply named China Film Company), and distributed by all film distribution and projection companies in the entire country. Without authorization or transfer from the publication work unit, any other work unit may not publish or distribute films, videotapes and laser discs.
II, All film enterprises or reproduction work units newly opening for business must be approved by the controlling authority, and possess a business licence issued by the administrative industry and commerce entity of their locality, to begin business. Films and film videotape distribution and projection business, is operating the differential distribution and projection of identical products (viz., films), all film distribution enterprises and projection work units having a film operation business licence, do not need to apply for another business licence.
III, Film enterprises publishing and distributing film videotapes, must implement the principles of serving the people, serving socialism and all relevant policies. All published and distributed film videotapes must be passed through examination by the Ministry of Culture Film Bureau, on the videotape must be printed a “Projection Permit” and the name of the publication and distribution work units, and have already bought or obtained publishing rights for that film, otherwise, publication, distribution or projection shall, without exception, not be permitted.
IV, Film videotape distribution and projection is a component and supplement to film distribution and projection, it benefits to the development of film education, knowledge and entertainment functions. Therefore, it is necessary to coordinate well the relation between both, prevent mutual damage or neutralizing forces. Domestically produced new films shall in general be published and distributed on videotape half a year after public screening. Considering the real situation that there are not enough programmes after the projection stop of a large batch of illegally entered Hong Kong, Taiwan and foreign video, a number of imported films may be first turned into videotapes for distribution, or distributed as specialized video programme.
V, Film videotapes published and distributed by China Film Company, shall be distributed through film distribution channels to all provinces, autonomous regions, municipalities and single cities, implementing a yearly and monthly planned supply. It is necessary to carry out propaganda work and propaganda products provision work like with films.
VI, Film videotapes distribution manner and price settlement shall benefit management and copyright protection, as well start of from the zeal of developing all facets, and formulated by China Film Company. Distribution methods and price settlement for lower than province level, shall be formulated by all provincial, municipal and autonomous region film distribution and projection companies, and reported to China Film Company for filing.
Ticket prices and rental prices for video operations, may be formulated by each locality according to the local concrete situation.
VII, All local film enterprises and projection work units, must implement notices from the Ministry of Culture Film Bureau and China Film Company to stop projection of or edit film videotapes, as well as a reporting system for the film videotape sector. All reproduction work units shall guarantee the reproduction quality of film videotapes.
VIII, To work units and individuals violating these Rules, according to the respective circumstances, punishment shall be imposed. To those publishing, duplicating or infringing copyright in violation of regulations, local administrative industry and commerce entities are requested to confiscate their illegal videotapes and illegal gains, order compensation of economic damage and impose a fine of 1 to 5 times. To those violating criminal law, judicial organs are requested to deal with according to the law; for common activities breaching regulations, all localities’ administrative culture entity is requested to take responsibility for punishment.
