Provisional Management Rules for Distribution of Film Videotapes Published by the China Distribution and Screening Company

In order to implement the “Notice Concerning Improving Culture and Art Videotape Supply and Strengthening Video Screening Management, a nationwide administrative film videotape distribution management work was held in July of this year, among those participating were managers from all provincial, autonomous and municipal, as well plan-listed city film distribution and screening companies and responsible persons from radio, film and television office or bureau audiovisual management offices. The meeting discussed and formulated the “Provisional Management Rules for Distribution of Film Videotapes Published by the China Distribution and Screening Company”, for implementation in all localities.
I, The China Film Distribution and Screening Company (hereafter simply named China Film Company) publishing and distributing Chinese and foreign film videotapes, is an important step in changing the present insufficiency of audiovisual market and audiovisual screening activities, and is also an important task for film distribution and screening entities. All levels; film distribution and screening companies shall rectify work guiding opinions, and persist in the policy of serving the People and serving socialism, place social interest first, allocate personnel, formulate rules, and do well film videotape distribution work.
II, China Film Company is a work unit operating in Chinese and foreign film videotapes with State approval, and shall receive protection of copyright held over the film videotapes they publish and distribute. All levels’ film distribution and screening companies are operational management organs engaging in distribution work representing China Film Company in all localities, without China Film Company agreement, any work unit or individual may not reproduce or record film videotapes by themselves, or conduct other distribution and screening activities in violation of regulations or laws.
Film videotapes published and distributed by China Film Company, shall strictly observe the statutory examination and approval procedure: Chinese and foreign films already distributed, shall be approved by the Film Bureau of this Ministry; foreign films imported only for recording on videotapes and distribution, are to be reported to the Ministry for examination and approval. Where China Film Company issues notices to stop screening or edit film videotapes, all localities shall implement this.
Film videotapes produced and distributed by China Film Company, must indicate the publishing work unit name and trademark in the middle of the tape. Film tapes imported from abroad, must also display the approval certification, and a uniformly printed cover must be stuck on the box.
Film videotapes in principle may not be screened in urban cinema screening rooms.
III, Film videotapes published and distributed by China Film Company, are distributed to society through all localities’ film distribution and screening companies, including progressive development of renting work to households, in all localities in which the audiovisual system has already established video distribution channels, film and audiovisual distribution channels shall mutually support each other, cooperate closely, and the local radio, film and television entity shall coordinate the relationship between the two channels.
IV, China Film Company provides film videotape prints to the entire nation according to the requirements of all provincial, autonomous region and municipal film companies. Rules concerning distribution methods and accounting, will be tried out according to the film agency distribution mode. China Film Company bears copyright fees, dubbing fees, and printing fees for provided propaganda materials; provincial and municipal companies are responsible for videotape fees and all fees paid locally. In line with the principles of reasonable distribution, benefiting the mustering of grass-roots work units’ vigour, division is implemented according to video distribution income. All provincial, autonomous region and municipal film companies’ split share, is decided by China Film Company. The proportion retained by all city and county-level companies, is decided by the provincial, autonomous region and municipal companies, and reported to China Film Company for filing.
Other video publishing work units, if entrusting China Film Company to distribute culture and art video programmes on their behalf, may according to the above method distribute and settle accounts, and may also decide separately according to the principles of voluntarily and mutual benefit.
Film video distribution income shall all be brought into that level’s film company income, and may not be transferred into collective possession. Ticket prices of video screening, may in principle not be higher than film ticket prices, and are implemented with reference to the local pricing entity and radio, film and television entity-formulated standards. Film videotape work reporting forms shall be earnestly filled out by distribution and screening work units.
VI, Supply plans for nationwide distribution of videotapes by China Film Company, shall be timely sent to all provincial, autonomous region or municipal radio, film and television offices (bureaus) for filing. All provincial, autonomous region and municipal film companies’ film videotape distribution plans shall also timely be submitted to radio, film and television offices (bureaus).
All localities’ radio, film and television entities shall attract the local film company to participate in video market management:
(1) Drafting decrees, regulations and rules relevant to video management, as well as policies and plans for video screening point development, shall be discussed with participation of the local film company.
(2) Film screening work units such as cinemas and film and theatre buildings having film screening as main work, etc., if concurrently engaging in or reforming into videotape screening, shall first undergo preliminary examination and agreement of the local film company, and afterwards report to the MRFT for approval.
(3) Film companies are to be attracted to conduct supervision and examination over the programmes screened in screening points.
Other management participation matters, as well as steps to be adopted, may be decided by the controlling authority in each locality.
