Ministry of Radio, Film and Television Temporary Regulations on Copyright Protection of Audio and Video Publications

1: In order to protect the legitimate rights of authors, performers and sound and video publication work units (hereafter named audiovisual publication work units), to make the audiovisual publishing enterprises flourish and develop, and with the approval of the National Copyright Agency, these temporary regulations are formulated.

2: The Ministry of Radio, Film and Television been entrusted by the National Copyright Agency to be responsible for the management work of copyright for audiovisual publications in the entire country.

3: Items named in these temporary regulations:

Audiovisual publications, refers to recorded sound or (and) images that were written and performed, records and audio and video tape and video discs sold in the form of commercial products;

Audiovisual publication work units, refers to approved publishing units carrying out declaration procedures according to the “Temporary Regulations on the Management of Sound and Video Products “(National Development and Reform Commission (1982), document 154), approved by the State Council;

Duplication production work units, refers to approved publishing units carrying out declaration procedures according to the “Temporary Regulations on the Management of Sound and Video Products “(National Development and Reform Commission (1982), document 154), approved by the State Council.

4: Audiovisual publications form one whole; its copyright belongs to the publishing work unit. The duration of protection lasts 25 years, to be calculated starting from the end of the year in which the audiovisual publication was published first, or when it was produced. All audiovisual publication work units should indicate on their publications the expression “All Rights Reserved”, the name of the work unit and the year of publication. Any other work unit and individual may not make commercial duplications without a license of the publishing work unit.

5: Audiovisual publication work units must respect and uphold the legitimate interests of writers and performers of audiovisual works:

1) For all musical, dramatic and dance works of which the recording is already publicly published, and on the basis of written teaching material already published, audiovisual publication work units may without the rights holder of the original work, but at the time of publishing must clearly indicate the name of the work and the full name of the author, and remuneration should be paid to the rights holder of the original work. If the work needs to be adapted, then written approval of the rights holder of the work should be obtained, at the time of publishing, apart from the name of the adaptor, the full name of the original author should be listed.

Works other than musical, dramatic and dance works of which the recording is already publicly published and written teaching material, written approval must be obtained from the author or rights holder

Copyright of authors of relevant written, art and scientific works, will be interpreted according to the “Trial Regulations on Copyright Protection of Books and Periodicals”, promulgated by the Ministry of Culture.

2) Audiovisual publication work units must sign a contract or agreement with the performers who are recorded, defining the rights and duties of both parties. The relevant naming, economic remuneration, publication time, time limit on use of the recorded programme, the possibility of transfer as well as liability for breach of contract and other items, must all be clearly stipulated in the contract or agreement, but the main performers must be named. The main performers may not record the same programme with the same performing manner for another publishing work unit during the duration of the contract.

6: Audiovisual publication work units may purchase audiovisual material made by non-publication work units and audiovisual material preserved by individuals, but at the time of publication must obtain approval of the rights holder of such audiovisual material, and must solicit the approval of main performers recorded in the work or their legitimate successor. At the time of publication, the name o the recording work unit and the full name of the author and main performers must be clearly indicated.

7: Audiovisual publication work units may mutually transfer copyright on audiovisual publications between them, but may not transfer to duplication production work units or other non-publication work units in any way. Both parties should promptly report the transfer contract or agreement to the Ministry of Radio, Film and Television.

8: Cooperative publications and copyright trade of audiovisual publication work units and foreign business people (including export, introduction and cooperative recording), should be reported to the Ministry of Radio, Film and Television for approval by higher level competent bodies.

9: When copyright of audiovisual publications is infringed, the audiovisual publication work unit, the author, the performers, have authority to submit it to the Ministry of Radio, Film and Television for examination and handling. They may also directly file a complaint with the Courts.

Methods of handling include: order the infringer to stop the infringing act, order a public apology, order compensation for economic damage of the victim, confiscate infringing gains, confiscate infringing publications, cancel the publishing or duplication production rights.

10: The right of interpretation of these temporary regulations belongs to the Ministry of Radio, Film and Television

11: After the national promulgation and implementation of the Copyright Law, all contradictions between these temporary regulations and the Copyright Law, the Copyright Law will function as standard.

12: These regulations will go into effect from 1 January 1987.

录音录像出版物版权保护暂行条例

一、为保护作者、表演者、录音录像出版单位(以下简称音像出版单 位)的正当权益,繁荣和发展音像出版事业,征得国家版权局同意,特制 定本暂行条例。

二、广播电影电视部受国家版权局的委托,负责全国的音像出版物版 权管理工作。

三、本暂行条例所称:

音像出版物,是指录有经过创作、表演的音响或(和)图像,以商品 形式销售的唱片、音带、像带和视盘;

音像出版单位,是指按国务院批准的《录音录像制品管理暂行规定》 (国发〔1982〕154号文件)履行申报程序并经批准的出版单位;

复录生产单位,是指按国务院批准的《录音录像制品管理暂行规定》 (国发〔1982〕154号文件)履行申报程序并经批准的出版单位。

四、音像出版物作为一个整体,其版权归出版单位所有。保护期限为 25年,自音像出版物首次发行或录制之年的年底起计算。各音像出版单 位应在其出版物上标明“版权所有”字样及出版单位名称和出版年份,未 经出版单位授权,其他任何单位和个人不得作商业性翻录。

五、音像出版单位必须尊重并维护所录制作品的作者和表演者的正当 权益:

1.凡录制已经公开发表的音乐、戏剧、舞蹈作品,和根据已经发表 的文字教材,音像出版单位可不征得原作品的版权所有者的同意,但出版 时必须注明作品名称和作者姓名,并向原作品的版权所有者支付报酬。如 需对作品改编,则应征得原作品的版权所有者书面同意,出版时除改编者 署名外,仍应署原作者姓名。

凡录制已发表的音乐、戏剧、舞蹈作品和文字教材以外的作品,须取 得作者或版权所有者的书面授权。

有关文字、艺术和科学作品作者的版权按文化部颁发的《图书、期刊 版权保护试行条例》解释。

2.音像出版单位必须与所录制作品的表演者签订合同或协议,确定 双方的权利和义务。有关署名、经济报酬、出版时间、所录节目使用期限 ,可否转让以及违约责任等项,在合同或协议中均须有明确的规定,但主 要表演者必须署名。主要表演者在合同规定期间内不得以同一种表演方式 为另外的音像出版单位录制同一节目。

六、音像出版单位可以收购非出版单位制作的音像资料和个人保存的 音像资料,但出版时必须征得音像资料版权所有者的同意,必须征求被录 制作品的主要表演者或其合法继承人的同意。出版时应注明原录制单位名 称和作者、主要表演者姓名。

七、音像出版单位之间可以互相转让音像出版物的版权,但不得以任 何方式转让给复录生产单位或其他非出版单位。转让的合同或协议,双方 应及时抄报广播电影电视部。

八、音像出版单位与外商的合作出版和版权贸易(包括出口、引进和 合作录制),均须经上级主管部门核准后报广播电影电视部批准。

九、音像出版物版权受到侵犯时,音像出版单位、作者、表演者有权 提请广播电影电视部调查处理。也可直接向法院起诉。

处理办法包括:责令侵权人停止侵权活动,责令公开道歉,责令赔偿 受害者经济损失,没收其侵权所得,没收其侵权出版物,取消其出版或复 录生产权利。

十、本暂行条例的解释权属广播电影电视部。

十一、国家公布并实施版权法以后,本暂行条例的规定,凡与版权法 相抵触的,以版权法为准。

十二、本暂行条例自1987年1月1日起生效。
