Notice concerning Reiterating Regulations on Problems Related to Using Economic Sanction Methods to Strengthen Publishing Management

With the agreement in principle of the State Council, the Ministry of Culture, the Ministry of Finance and the State Administration of Industry and Commerce have jointly issued the “Notice concerning Printing and Distributing the Ministry of Culture ‘Request for Instructions concerning Using Economic Sanction Methods to Strengthen Publishing Management'” on 15 November 1985. The said document provides that, concerning work units and individuals violating publishing regulations, where economic sanctions are necessary, “regulations are respectively implemented by administrative publishing management organs, and administrative industry and commerce management organs, problems discovered in the process of book compilation or printing, are dealt with by administrative publishing management organs; problems happening in the area of circulation, are dealt with by administrative industry and commerce management organs, illegal income obtained in violation of regulation and fines are handed over by the administrative industry and commerce management organ to the local finance administration. Matters happening in the Beijing region (including in Central first-level work units), according to the above principle of the division of work, are dealt with by the Beijing administrative publishing management organ and administrative industry and commerce management organ.”
On 5 July 1988, with the approval of the State Council, the Administration of Press and Publications formulated the “Regulations concerning Reiterating the Strict Prohibition of Obscene Publications” and the “Provisional Regulations concerning the Management of Publication Covers and Illustrations and Publication Advertising”. These have reiterated relevant regulations. At the same time, in order to increase the responsibilities of provincial, autonomous region and municipal press and publication bureaus, they have made supplementary provisions concerning economic and administrative punishment. Among these, it provides that “all provincial, autonomous region and municipal press and publications bureaus are empowered to make punishment decisions concerning publications and unlawful work units in their localities.”
All localities’ administrative publishing management organs and industry and commerce management organs must closely coordinate and provide mutual support, and realistically do investigation and prosecution work of banned publications according to the responsibilities of each. It is hereby notified.
