Some Provisional Regulations concerning Local Foreign Affairs Work in Radio and Television

In the past few years, following the implementation of our country’s reform and opening up policy, and especially after the Centre put forward the strategy to develop the coastal provinces, the radio and television system has launched multi-level, multi-channel and multi-variational foreign exchange activities from the Centre to the localities. In order to adapt to the new circumstances of reform, and on the basis of the principles of the Centre concerning specialized management and hierarchical approval, hereby, the 7th Clause of the 1986 Ministry of Radio, Film and Television Implementation Rules to Implement the CCP Central Committee and State Council “Regulations concerning Examination and Approval Powers for Dispatching Personnel Temporarily Leaving the County and Inviting Foreign Personnel to Visit China” is revised as follows:

I, All provincial, autonomous region and municipal radio and television offices (bureaus) sending radio and television delegations led by office or vice-office (bureau) level personnel abroad, are to be reported to the Ministry of Radio, Film and Television after being approved by the provincial, autonomous region or municipal government; other personnel leading delegations abroad are to report to the provincial, autonomous region or municipal government for examination and approval, and report to the Ministry of Radio, Film and Television for filing. If it involves a visit to States with whom diplomatic relations have not yet been established or politically sensitive countries and regions, it must be reported to the Ministry of Radio, Film and Television for examination and approval in consultation with the Ministry of Foreign Affairs (some among these must also be reported to the State Council Foreign Affairs Office for examination and approval).

II, Invitations under the name of radio and television offices (bureaus) and stations of the coastal provinces and municipalities and Sichuan, Shaanxi, Hubei, Xinjiang and Heilongjiang of delegation led by responsible persons from local radio stations and television stations, are to be reported to the provincial, autonomous region and municipal government for examination and approval, and reported to the Ministry of Radio, Film and Television for filing: if there are special needs to invite delegations led by responsible persons from nationwide radio stations and television stations, this must be reported to the Ministry of Radio, Film and Television for examination and approval after examination and verification by the provincial, autonomous region or municipal government; if leaders and common personnel of local radio stations or television stations from countries with whom diplomatic relations have not been established or politically sensitive countries or regions, it must be reported to the Ministry of Radio, Film and Television for examination and approval in consultation with the Ministry of Foreign Affairs.

III, Foreign, Hong Kong, Macau and Taiwan radio and television journalists coming for newsgathering, film shooting, cooperative film shooting and other projects, must be report to the Ministry of Radio, Film and Television for examination and approval. Foreign radio and television journalists coming to China for newsgathering are generally limited to open regions, in all cases where it is required to go to our country’s regions that have not been opened up for newsgathering, according to relevant provisions of the Ministry of Foreign Affairs and the Ministry of Public Security, obtain approval from the Ministry of Foreign Affairs, or the Ministry of Radio, Film and Television that is responsible for specialized management, or relevant Central or State Council ministries and commissions after obtaining agreement from the relevant military region and the provincial, autonomous region or municipal Foreign Affairs Office; those visiting China should be specialized radio and television journalists (including specialize television cameramen of television production organs), non-radio and television journalists or tourists may not engage in radio and television newsgathering activities in any way.

IV, Where coastal provinces and municipalities, Sichuan, Shaanxi, Hubei, Xinjiang and Heilongjiang radio and television offices (bureaus) and stations conclude radio and television business cooperation protocols with foreign local radio and television organs, the protocol text must be reported to the Ministry of Radio, Film and Television  for examination and approval in advance, after examination and verification by the provincial, autonomous region and municipal government; where, under the name of provincial, autonomous region and municipal radio and television offices (bureaus), radio stations or television stations, professional protocols or important commercial contracts are concluded with foreign radio stations or television stations, the protocol and contract texts must be reported in advance to the provincial, autonomous region and municipal government for examination and approval, and be reported to the Ministry of Radio, Film and Television for filing.

V, Where radio and television stations from provinces and cities among coastal provinces and municipalities, Sichuan, Shaanxi, Hubei, Xinjiang and Heilongjiang that have established twin city relationships abroad, send specialist delegations (groups) for mutual visits or mutual exchanges to corresponding foreign radio stations and television stations on the basis of the annual cooperation plans of the twin provinces and cities, including specialist field-study delegations (groups) with journalists attached), all matters (including cross-provincial and municipal common visits and tours), are to be reported to the provincial, autonomous region and municipal government for examination and approval, and reported to the Ministry of Radio, Film and Television for filing.

VI, Where radio and television stations from provinces and cities among coastal provinces and municipalities, Sichuan, Shaanxi, Hubei, Xinjiang and Heilongjiang that have established twin city relationships abroad, require the conclusion of professional cooperation protocols or commercial contracts, the protocol or contract texts must be reported in advance to the provincial, autonomous region and municipal government for examination and approval, and reported to the Ministry of Radio, Film and Television for filing.

VII, If all provincial, autonomous region and municipal radio and television offices (bureaus) or television stations require to leave the country to purchase television programmes or to participate in foreign-organized television festivals or television programme award activities, etc., they must report to the Ministry of Radio, Film and Television for examination and approval before the end of September of the previous year, after examination and verification by the provincial government.

VIII, All provincial, autonomous region and municipal radio and television stations, in all cases where they organize foreign music broadcast weeks with music programmes provided by foreign twinned cities’ radio stations, are report to the provincial, autonomous region and municipal government for examination and approval, and report to the Ministry of Radio, Film and Television for filing.

IX, Where all provincial, autonomous region and municipal radio and television stations invite foreign, Hong Kong and Macau region actors to perform in programmes in local radio stations and television stations, after obtaining agreement from our consulates and embassies abroad of the Hong Kong office of Xinhua, it is to be reported to the provincial, autonomous region or municipal government for examination and approval, and report to the Ministry of Radio, Film and Television for filing.

X, Apart from Shanghai, Guangdong, Fujian and Hainan, al other provinces, autonomous regions and municipalities, inviting Hong Kong and Macau radio and television organ leaders to visit or television journalists to come to their provinces or municipalities for newsgathering, or requiring the dispatching of a delegation or radio and television journalist groups to visit Hong Kong or Macau, must, after obtaining agreement from the Hong Kong office of Xinhua, report to the Ministry of Radio, Film and Television for approval, and report to the State Council Hong Kong and Macau Office for filing.

XI, In order to import foreign advanced technology, and conduct foreign science and technology exchange in a planned manner, all provincial, autonomous region and municipal radio and television offices (bureaus), radio stations and television stations inviting foreign businesses to organize radio and television equipment exhibitions, must, after examination and verification by September of the previous year by the provincial government, report this to the Ministry of Radio, Film and Television who collect this and compile balanced annual plans, and issue them for implementation after approval in consultation with the Ministry of Foreign Economics and Trade.

XII, All provinces and municipalities containing foreign consulate, if they invite common diplomats to speak at radio stations or television stations must report to the provincial or municipal Foreign Affairs Office for examination and approval, if a (vice) consul for the local consulate general is invited to speak at radio stations or television stations, it shall be reported to the provincial, autonomous region and municipal Foreign Affairs Office for examination and verification, and be reported to the provincial, autonomous region or municipal leader for examination and approval, and be reported to the Ministry of Foreign Affairs and the Ministry of Radio, Film and Television for filing; all invitations of ambassadors to China to speak at local radio stations or television stations must be approved by the Ministry of Radio, Film and Television in consultation with the Ministry of Foreign Affairs after examination and verification by the provincial or municipal Foreign Affairs Office.

广播电影电视部关于广播电视地方外事工作的几项暂行规定

近几年来,随着我国改革开放政策的实施,特别是中央提出发展沿海经济战略后,广播电视系统从中央到地方开展了多层次、多渠道、多形式的对外交流活动。为适应改革开放的新形势,根据中央关于归口管理、分级审批的原则,现将1986年广播电影电视部关于贯彻执行中共中央、国务院《关于派遣临时出国人员和邀请国外人员来华审批权限的规定》的实施细则第七项修订如下:
一、各省、自治区、直辖市广播电视厅(局)由正、副厅(局)级人员率广播电视代表团(组)出访,经省、或自治区、直辖市政府审核后报广播电影电视部审批;其他人员率团出访报省、自治区、直辖市政府审批,报广播电影电视部备案。如涉及出访未建交国家或政治上敏感国家和地区,需报广播电影电视部会商外交部审批(其中有的还要报国务院外办审批)。
二、以沿海省、直辖市及川、陕、鄂、新、黑广播电视厅(局)、台名义邀请国外地方性电台、电视台负责人率团来访,报省、自治区、直辖市政府审批,报广播电影电视部备案;如有特殊需要邀请国外全国性广播电台、电视台负责人率团来访,需经省、自治区、直辖市政府审核后报广播电影电视部审批;如邀请未建交国家或政治上敏感国家和地区的地方广播电台、电视台领导和一般人员来访,需报广播电影电视部商外交部审批。
三、外国及港澳台广播电视记者来华采访、拍片或合作拍片等事项,均需报广播电影电视部审批。外国广播电视记者来华采访,一般限于开放地区,凡需去我国非开放地区采访的,仍应按外交部、公安部的有关规定,需经外交部或负责归口管理的广播电影电视部或中央及国务院有关部委在征得有关大军区和省、自治区、直辖市外办同意后批准;来华采访的应是专业的广播电视记者(含电视制片机构专业电视摄影师),非广播电视记者或旅游者不得从事任何形式的广播电视采访活动。
四、沿海省、直辖市及川、陕、鄂、新、黑广播电视厅(局)、台与外国地方广播电视机构签订广播电视业务合作议定书,议定书文本需事先经省、自治区、直辖市政府审核后报广播电影电视部审批;以省、自治区、直辖市广播电视厅(局)、电台、电视台名义与外国地方电台、电视台签订业务性议定书或重要的商业性合同,议定书合同文本需事先报省、自治区、直辖市政府审批,报广播电影电视部备案。
五、沿海省、直辖市及川、陕、鄂、新、黑与国外建立友好城市关系的省、市广播电台、电视台与外国相应的广播电台、电视台根据友好省市年度合作计划互派专业团(组)互访或互派包括随团记者在内的专业考察团(组)事宜(含跨省、市一般参观访问),报省、自治区、直辖市政府审批,报广播电影电视部备案。
六、沿海省、直辖市及川、陕、鄂、新、黑与国外建立了友好城市关系的省、市广播电台、电视台之间如需签订业务合作议定书或商业性合同,议定书合同文本需事先报省、自治区、直辖市政府审批,报广播电影电视部备案。
七、各省、自治区、直辖市广播电视厅(局)或电视台,如需派出国选购电视片或参加国外举办的电视节、电视节目评奖活动等,均需经省政府审核后于头年九月底前报广播电影电视部审批。
八、各省、自治区、直辖市广播电台凡以外国友好城市电台提供的音乐节目举办外国音乐广播周,报省、自治区、直辖市政府审批,报广播电影电视部备案。
九、各省、自治区、直辖市广播电台、电视台邀请外国及港澳地区演员到地方广播电台、电视台演播节目,在征得我有关驻外使领馆或香港新华分社同意后,报省、自治区、直辖市政府审批,报广播电影电视部备案。
十、除上海、广东、福建、海南外,其他省、自治区、直辖市凡邀请港澳广播电视机构领导人来访或广播电视记者来本省、市采访,或需派出代表团、广播电视记者组访问港澳,需征得香港新华分社同意后,报广播电影电视部审批,报国务院港澳办公室备案。
十一、为引进国外先进技术,有计划地进行对外科技交流,各省、自治区、直辖市广播电视厅(局)、广播电台、电视台邀请国外厂商举办广播电视设备展览,须于头年九月经省政府审核后报广播电影电视部汇总平衡编制年度计划,会商经贸部批准后下达执行。
十二、凡驻有外国领馆的省、市,如邀请一般外交官到广播电台、电视台发表讲话,均需报省、市外办审批,若邀请当地驻华总领事馆正副总领事到当地广播电台、电视台发表讲话,应报省、自治区、直辖市外办审核并报省、自治区、直辖市政府领导批准,并报外交部、广播电影电视部备案;凡邀请驻华大使在地方广播电台、电视台发表讲话,均需经省市外办审核后报广播电影电视部商外交部批准。
