Notice concerning Continuing to Investigate and Capture Obscene Publications and Illegal Publications
All provincial, autonomous region and municipal press and publications bureaus, and public security offices (bureaus)
Recently, all localities’ press and publications, and security departments have, on the basis of State Council instructions, adopted forceful measures in the activities to inspect and capture obscene and sexual publications, and attack illegal publishing activities, they have done great amounts of work, and severely punished law-breakers and criminals, causing a certain turn for the better in the book market. But, in a number of cities, obscene and sexual publications that have already been subject to a banning order are still sold at high price, illegal publishing activities also rear their head again, bringing about grave harm to society. In order to deeply implement the Centre’s spirit concerning banning obscene and sexual publication and strictly attacking illegal publishing activities, and further do this work well, the following is hereby notified:
I, All localities are requested, upon receiving this notice, to report to Party Committees and governments, and jointly with industry and commerce, radio, film and television, culture, market management, finance, taxation and other relevant departments, continue to do inspection and capturing work of obscene and sexual publications subject to a banning order and to stop the sale of illegal publications, and firmly curb their continued dissemination.
II, All localities shall use all kinds of methods to propagate State regulations concerning banning obscene and sexual publications and illegal publications, and may desist investigating the responsibility of those actively surrendering obscene and sexual books and magazines and illegal publications (where official publishers publish this sort of books and publications, economic damage is borne by that publisher). Work units and individuals who conceal them and do not hand them over, who continue to engage in reprinting, wholesale, sale and rental of obscene and sexual books and magazines and illegal publications, will have their obscene and sexual books and magazines, as well as illegal publications confiscated, and are published with a fine of twenty times the value of the books they printed, sold or rented, and the industry and commerce departments will be suggested to cancel their business licence. Those violating criminal law, are subject to investigation of criminal responsibility according to the law.
III, All localities must further adopt effective measures, such as establishing reporting phone lines or mailboxes, to encourage the masses to report work units and individuals who engage in dissemination activities of obscene and sexual books and magazines, and illegal publications. In al cases where reports are verified, praise must be given under the prerequisite of guaranteeing the safety of the informer, and appropriate material rewards are granted. The source of the reward will be settled from fines by the press and publications bureau together with local finance, industry and commerce and other relevant departments.
IV, All localities must, during investigation and capturing work, pay special attention to concealed operation and variable tricks in the production and dissemination of obscene and sexual publications and illegal publications at present and other characteristics, adopt corresponding countermeasures, exchange information, timely check and verify, categorically carry out operations, and severely attack unlawful and criminal activities of disseminating obscene and sexual publications and illegal publishing. All localities are requested to timely report the investigation and capturing situation to the Administration of Press and Publications and the Ministry of Public Security.
