Provisional Periodical Management Regulations

Chapter I: General Principles

Article 1: In order to stimulate the flourishing and development of the Socialist science and culture undertaking, strengthen the administrative management of periodicals, and make periodicals serve the construction of a Socialist material civilization and spiritual civilization even better, these Regulations are formulated.

Article 2: Periodicals as named in these Regulations, refers to continuous publications having a fixed name, using serial numbering with volumes and numbers, or years and months, in complete copies.

Article 3: All periodicals that have undergone examination, verification and approval by the administrative management department for press and publications, have performed registration formalities, have obtained a “Periodical Registration Certificate” and are entered into the “Domestic Uniform Periodical Numbering System”, are considered to be official periodicals. The distribution of official periodicals is divided into two categories, “open” and “internal”. Openly distributed official periodicals may solicit subscriptions or be sold domestically and abroad; internally distributed official periodicals can only solicit subscriptions or be distributed in a domestic, determined scope, they may not be openly subscribed to, displayed or sold in society, and it is prohibited to distribute them abroad.

Article 4: All informative, non-commercial internal periodicals having an “Internal Periodical Approval Certificate” that are used for guiding work, exchanging experience, sharing information in their system or work unit, and that are exchanged internally in a sector, are named “non-official periodicals”. Non-official periodicals are not listed into the “Domestic Uniform Periodical Numbering System”, they may not be openly distributed or displayed, they may not be sold, they may not engage in any commercial activity.

Article 5: No periodical may carry the following content:

(1) inciting subversion of the people’s democratic dictatorship regime and the Socialist system, division of the state or inciting rebellion or riots;

(2) inciting opposition against the Chinese Communist Party;

(3) inciting resistance or destruction of the implementation of the Constitution or laws;

(4) exposing State secrets, harming national security or damaging national interests;

(5) inciting ethnic or racial discrimination or hatred, destroying ethnic unity;

(6) propagating violence, obscenity, sex or instigating crime;

(7) slandering or insulting other persons;

(8) impairing the fair trial of cases by the judicial departments;

(9) other content prohibited for publication by laws.

Article 6: In periodical management, a method integrating system-separated management and specialized management by administrative press and publications management departments is implemented, the all Central Committee and State Council ministries and commissions, all directly-subordinate organs, all democratic parties, people’s organizations and all local systems shall earnestly manage periodicals run by themselves and their subordinate work units; all periodicals shall also accept guidance and management from the administrative press and publications management departments.

Chapter II: Periodical examination and approval

Article 7: To set up an official periodical, the following conditions shall be met:

(1) having a purpose conform to the provisions of the Constitution, serving the construction of a Socialist spiritual civilization or material civilization;

(2) having a determined sponsoring work unit and a clear specialization scope and editorial policy;

(3) having a higher-level controlling department realistically bearing leadership responsibility;

(4) having complete editorial departments, having full-time editors-in-chief conform to the requirement of the specialization and a certain number of full-time editors;

(5) having the necessary funding, fixed business premises and printing work units.

Article 8: For setting up official periodicals, a letter of application shall be submitted according to the requirements of Article 6 of these Regulations, and  important matters, such as the name, publishing period, size, writing length, distribution scope, etc., must be described clearly, this is reported for approval after examination and verification of the controlling department.

Article 9: All Central Committee and State Council ministries and committees, all directly subordinate organs, all democratic parties, people’s organizations and their subordinate work units setting up official periodicals (including entrustment of periodicals run by local work units), are to be classified according to the discipline of the periodical after agreement of the controlling ministry or commission, directly subordinate organ, democratic party or people’s organization leading organ, those falling under social sciences are reported to the Administration for Press and Publications for examination and approval; those falling under the natural sciences or technology are reported to the National Commission for Science and Technology, and within the quota determined by the Administration of Press and Publications in consultation with the National Commission for Science and Technology, are checked and approved by the National Commission for Science and Technology and are reported to the Administration of Press and Publications for filing; official periodicals set up in the Liberation Army system, are reported to the Administration of Press and Publications for filing after examination and approval by the Liberation Army General Political Department, those falling under the natural science or technology category among these must also be reported to the National Commission for Science and Technology for filing.

Article 10: Local work units setting up official periodicals, where they fall under the social sciences, applications are put forward by the controlling department to the provincial-level press and publications bureau, and are verified and approved within the quota determined by the Administration of Press and Publications; where they fall under the natural sciences or technology, applications are put forward by the controlling department to the provincial-level science and technology commission and the press and publications bureau, and after joint examination and verification, are verified and approved within the quota determined by the Administration of Press and Publications. In all cases, before verification and approval, the periodical name must be checked with the Administration of Press and Publications Periodical Bureau, and they must be reported to the Administration of Press and Publications for filing; the natural sciences and technology ones must also be reported to the National Commission for Science and Technology for filing.

Article 11: Where two or more work units jointly run periodicals, one main sponsoring work unit and controlling department are to be determined, and one department must report for approval; where Central Committee work units and local work units jointly run periodicals (including those run under entrustment of local work units), the Central Committee work unit will handle matters according to the Central Committee work unit.

Article 12: Periodicals run jointly with a foreign side, in all cases where they are distributed under the jurisdiction of the People’s Republic of China and the national government, the work unit running the periodical on the Chinese side applies for approval according to the provisions of Article 8 and Article 9 of these Rules, at the same time, the following relevant materials must be provided:

(1) a letter of intent to cooperate from both sides, including the objective for running the periodical, the scientific discipline, the publication scope, clear responsibilities and final adjudication powers, copyright ownership, profit distribution and the duration of the cooperation;

(2) registration certification that the cooperating side has legal person qualifications;

(3) the credit situation of the cooperating side.

Article 13: Periodicals run in cooperation with the Hong Kong and Macau regions or Taiwan are to be dealt with according to the provisions of the previous paragraph.

Article 14: Already approved and registered periodicals changing the periodical name, sponsoring work unit or language category, shall be reported for approval again according to the provisions of Article 8, Article 9 and Article 16 of these Rules.

Changes in other registered matters, where they concern periodicals run by Central Committee work units, are examined and approved by the Central Committee ministry or commission-level work unit, where they concern those run by local work units, are examined and approved by the provincial-level press and publications bureau, all are to be reported to the Administration of Press and Publications for filing; those in the natural science and technology categories, must also be reported to the National Commission for Science and Technology for filing.

Article 15: Periodicals may not publish supplementary issues as they please. If it is truly necessary to publish supplementary issues (including selected or digest editions), periodicals run by Central Committee work units of the natural science or technology category, must report to the National Commission of Science and Technology for verification and approval, other categories of publications report to the Administration of Press and Publications for verification and approval. Locally-run periodicals report to the provincial-level press and publications bureau for verification and approval. The National Commission for Science and Technology and the provincial-level press and publications bureaus will, after verification and approval, report matters to the Administration of Press and Publications for approval. Publication of periodical bound volumes and annual catalogues or indexes are not subject to these restrictions.

The purpose, size and distribution scope of periodicals publishing supplementary issues, will be consistent with the main publication.

Article 16: Where filing organs discover in their filing materials that there the same name is used, regulations are violated and other problems, they must return the matter to the original verifying and approving organ for reverification and approval.

Article 17: On the verification and approval of non-official periodicals, where they fall under Central Committee work units, they are verified and approved by the Central ministry or commission-level department; those run by local work units are verified and approved by the provincial-level press and publications bureau.

Non-official periodicals changing into official publications, shall apply for examination and approval according to Article 6, Article 7, Article 8 and Article 9 of these Regulations.

Chapter III: Periodical registration and publication

Article 18: For periodicals approved according to Article 8, Article 9 and Article 10 of these Regulations, the sponsoring work units shall go to the provincial-level press and publications bureau of the locality of the editorial department (the editorial department must be in the same locality as the sponsoring work unit or the undertaking work unit) with the approval documents to apply for and conduct registration, and fill out a registration application form.

After official publications’ registration application form has been examined and found correct, a “Newspaper and Periodical Registration Certificate” with a “Domestic Uniform Periodical Number” is issues; for non-official periodicals, an “Internal Periodical Permission Certificate” is issued.

A duplicate of the periodical registration, is reported to the Administration of Press and Publications for filing by the registering organ within 15 days after certification issuance.

If registering organs discover that there are matters that do not conform with registered matters when examining approval documents or when periodicals apply for registration, they shall return this to the verification and approval organ for reverification and approval.

Article 19: For supplementary issues approved for publication according to Article 15 of these Regulations, the periodical running work unit goes to the original registry organ with the permission document to conduct registration. The registry organ issues a one-time “Supplementary Issue Permit”

Article 20: For all periodicals for which name change is permitted according to Article 14 of these Regulations, the periodical running work unit goes to the provincial-level press and publications bureau of the locality of the sponsoring work unit with the permission document to conduct new periodical registration.

Article 21: Only one edition is permitted of every issue of periodicals. The different editions and versions of periodicals are issued registration certificates as different periodicals, with one number per periodical.

Article 22: The fees for periodical registration are handled according to relevant State regulations.

Article 23: Openly published periodicals may apply for an international standard serial number with the International Serial Publication Data System Chinese National Centre on the basis of the approval document.

Article 24: If periodical running work units do not conduct registration within three months from the date of approval, the approval document is automatically cancelled and registration organs will no longer accept registration. After registration, periodicals that do not publish issues within half a year or that cease publishing for half a year without reason, will have their registration cancelled by the registration organ and may no longer publish periodicals. If they want to continue to run periodicals or publish periodicals again, they shall report for approval again according to the provisions of Article 8 and Article 9 of these Regulations.

Article 25: Periodicals ceasing publishing must conduct registration cancellation with the periodical registration organ on the basis of certification from the controlling department, return the “Newspaper and Periodical Registration Certificate” of the “Internal Newspaper and Periodical Approval Certificate” to the registration organ, and timely report to the Administration of Press and Publications for filing; those falling under the natural science and technology categories must also report to the National Commission for Science and Technology for filing.

Article 26: The annual registration, registration modification and registration cancellation situation of periodicals will be reported to the Administration of Press and publications by all localities’ registration bureaus after collection before the end of the year.

Article 27: The period of validity and renewal time of the “Newspaper and Periodical Registration Certificate” of official periodicals are decided by the Administration of Press and Publications; the period of validity and renewal time of the “Internal Newspaper and Periodical Permission Certificate” are decided by provincial-level press and publications bureaus.

Article 28: Already registered periodicals must publish according to the registration matters of the “Newspaper and Periodical Registration Certificate” or the “Internal Newspaper and Periodical Permission Certificate”. The “Newspaper and Periodical Registration Certificate” or the “Internal Newspaper and Periodical Permission Certificate” is the basis for lawful publication of periodicals, and may only be used by the periodical holding the registration. It is strictly prohibited to lend, transfer, rent out or sell it, its registration matters may also not be altered without authorization.

It is strictly prohibited to use book numbers to publish periodicals or to covertly publish periodicals, periodical numbers may also not be used to publish books.

Article 29: Periodicals must include a colophon on the back cover or the index page, including the sponsoring work unit, publishing work unit, printing work unit, distributing work unit, date of publication, name of the chief editor, distribution scope, fixed price or production cost, domestic uniform periodical number or printing permission number and the advertising business permit number. Of these, the domestic uniform periodical number or the permission certificate number must be printed at the bottom of the back cover. Periodicals having obtained an international standard serial number shall at the same time print this number.

Official periodicals must carry the periodical name, date and issue number on the front dover. The principal content may not be used to replace the name of the periodical.

Official publications publishing supplementary issues, apart from having to print the domestic uniform periodical number, must also at the same time print the number of the one-time supplementary issue permit, and print the name of the official periodical and indicate “supplementary issue” on the front cover.

It is prohibited to use book numbers to publish periodicals.

Article 30: After publication, every periodical shall timely submit a specimen to the Administration of Press and Publications.

Chapter IV: Periodical publisher operations

All periodical publishers with independent management and independent accounting publishing official periodicals, after agreement from the higher-level controlling department and the administrative press and publications management department, may apply for a business licence with the administrative industry and commerce management organ, and launch many kinds of business activities within the scope permitted by State laws and regulations.

Periodical publishers publishing official periodicals for internal distributions, may not launch in open or foreign-related business activities. Periodical publishers publishing non-official periodicals may not conduct business activities.

When publishing advertising related to newspapers or periodicals, the “Newspaper and Periodical Registration Certificate must be clearly indicated”; when publishing advertising related to books, the name of the publishing work unit must be clearly indicated. Official periodicals may not publish advertising related to non-official periodicals or newspapers, or publications of other departments; openly-distributed periodicals may not publish advertising for internally-distributed periodicals or books.

Article 32: All openly distributed periodicals, shall conduct trademark registration of the name of the periodical, according to the provisions of the “Trademark Law of the People’s Republic of China.

Article 33: Openly distributed periodicals may not reprint or publish extracts of the content of internally-distributed books, newspapers, periodicals and other internal publication; where it must be reprinted because of special circumstances, the agreement of the publishing work unit of the publication that is reprinted or extracted from must be obtained.

Openly distributed periodicals may not publish information relating to the publishing or activities of internally-distributed publications.

Article 34: If periodicals establish offices or journalist stations in other places, print or distribute outside of their region of registration, they must undergo approval by the press and publications bureau of their own locality and the other locality, and accept the management of the administrative press and publications management department of the other locality. Internally distributed official periodicals and non-official periodicals may not establish offices, journalist stations or other similar organs.

Article 35: The internal organizational structure, personnel allotment, finances, operational accounting method, etc., of periodical publishers are to be decided by the periodical sponsoring work unit or the higher-level controlling department.

Chapter V: Punishment

Article 36: In all cases of violation of these Regulations, the administrative press and publications management organ, differentiating the gravity of the circumstances, imposes the following administrative punishments:

(1) a warning;

(2) a fine;

(3) confiscation of illegal income

(4) cessation of sale; confiscation or destruction of unlawful periodicals;

(5) provisional cessation of publishing

(6) cessation of business for rectification

(7) cancellation of registration;

Article 37: Provincial, autonomous region, municipal and plan-listed city press and publications bureau imposing punishments listed in items (4), (5), (6) and (7) of the above Paragraph, must report these to the Administration of Press and Publications for verification and approval.

Article 38: Those who, in violation of these Regulations, do not undergo approval and registration, engage in unauthorized periodical publishing activities, or in buying, passing off or counterfeiting the name, registration number or other matters of periodicals, or engage in periodical publishing, printing or distribution activities, constituting a crime, shall be punished according to relevant regulation within the powers of the administrative press and publications management department, the administrative industry and commerce management organs and the public security organs.

Chapter VI: Supplementary provisions

Article 39: The interpretation of these Regulations is the responsibility of the Administration of Press and Publications.

Article 40: These Regulations take effect on the date of promulgation.

第一章 总 则
第一条 为促进社会主义科学文化事业的繁荣和发展,加强期刊的行政管理,使期刊更好地为建设社会主义的物质文明和精神文明服务,特制定本规定。
第二条 本规定所称期刊,是指有固定名称、用卷、期或年、月顺序编号,成册的连续出版物。
第三条 凡经新闻出版行政管理部门审核批准、履行登记注册手续,领取“报刊登记证”,编入“国内统一刊号”的期刊,即视为正式期刊。正式期刊的发行分为“公开”和“内部”两种。公开发行的正式期刊可以在国内外公开征订、销售;内部发行的正式期刊只能在国内按指定范围征订、发行,不得在社会上公开征、陈列和销售,禁止向国外发行。
第四条 凡持有“内部报刊准印证”,用于本系统、本单位指导工作、交流经验、交换信息,并在行业内部进行交换的资料性、非商品性内部期刊,称为“非正式期刊”。非正式期刊不编入“国内统一刊号”,不得公开发行、陈列,不准销售,不得进行任何经营活动。
第五条 任何期刊不得刊载下列内容:
(一)煽动颠覆人民民主专政政权和社会主义制度、分裂国家或煽动叛乱、暴乱的;
(二)煽动反对中国共产党领导的;
(三)煽动抗拒、破坏宪法和法律实施的;
(四)泄露国家秘密,危害国家安全,损害国家利益的;
(五)煽动民族、种族歧视或仇视、破坏民族团结的;
(六)宣扬凶杀、淫秽色情或教唆犯罪的;
(七)诽谤或侮辱他人的;
(八)妨害司法部门公正审理案件的;
(九)法律禁止刊载的其它内容。
第六条 期刊管理采用系统分口管理与新闻出版行政管理部门归口管理相结合的办法,中央和国务院各部委、各直属机构(各民主党派、人民团体和地方各系统对自己及所属单位办的期刊应当认真进行管理;各期刊还应当接受新闻出版行政管理部门的指导和管理。
第二章 期刊的审批
第七条 创办正式期刊,应当具备下列条件:
(一)有符合宪法规定的、为社会主义精神文明和物质文明建设服务的宗旨;
(二)有确定的主办单位和明确的专业范围和编辑方针;
(三)有切实担负领导责任的上级主管部门;
(四)有健全的编辑部、有符合本专业要求的专职主编及一定数量的专职编辑。
(五)有必需的资金、固定的办公场所、承印单位。
第八条 创办正式期刊,应当按照本规定第六条的要求提出申请书,并须写明期刊的名称、刊期、开本、篇幅、发行范围等主要事项,经主管部门审核后报批。
第九条 中央和国务院各部委、各直属机构、各民主党派、人民团体及其所属单位创办正式期刊(含委托地方单位办的期刊),经主管部委、直属机构、民主党派、人民团体领导机构审核同意后,按期刊的学科分类,属社会科学的报新闻出版署审批;属自然科学、技术类的报国家科委,在新闻出版署与国家科委商定的数额内,由国家科委核准,报新闻出版署备案;解放军系统创办正式期刊,由解放军总政治部核准后,报新闻出版署备案,其中属自然科学、技术类的还须报国家科委备案。
第十条 地方单位创办正式期刊,属社会科学的由主管部门向省级新闻出版局提出申请,在新闻出版署确定的指标内核批;属自然科学、技术类的由主管部门向省级科委和新闻出版局提出申请,经共同审核后,在新闻出版署确定的指标内核批。核批前均须向新闻出版署期刊局进行刊名查重,并报新闻出版署备案;自然科学、技术类的并须报国家科委备案。
第十一条 两个以上单位合办的期刊,须确定一个主要主办单位和主管部门,由一个部门报批;中央单位和地方单位合办(含委托地方单位办的)的期刊,由中央单位按第八条规定办理。
第十二条 与国外合办的期刊,凡在中华人民共和国政府管辖范围内发行的,由中方办刊单位按第八条和第九条的规定申请报批,同时必须提供以下有关材料:
(一)双方合作意向书,包括办刊目的、学科、刊载范围、明确的责任和终审权、版权归属、利益分配、合作期限;
(二)合作对方具有法人资格的登记证明;
(三)合作对方的资信情况。
第十三条 与香港、澳门地区或台湾合作办刊,按前款的规定办理。
第十四条 已经批准登记的期刊改变刊名、主办单位、文种,应当依照本规定第八条、第九条、第十六条重新报批。
其它登记项目的变动,属中央单位办的期刊由中央部委级单位核批,属地方单位办的由省级新闻出版局核批,均报新闻出版署备案;自然科学、技术类的,还须报国家科委备案。
第十五条 期刊不得随意出版增刊。如确有必要出版的增刊(含精选、精华本),中央单位办的期刊,自然科学、技术类的,须报国家科委核批,其它类期刊,报新闻出版署核批。地方办的期刊,报省级新闻出版局核批。国家科委及省级新闻出版局在核批后,均报新闻出版署备案。出版期刊合订本及年度目录索引不在此限。
期刊出版增刊,其宗旨、开本和发行范围应当与正刊一致。
第十六条 备案机关发现备案件有重名或违反规定等问题,得退回原核批机关重新核批。
第十七条 非正式期刊的核批,属中央单位办的,由中央部委级部门核批;地方单位办的由省级新闻出版局核批。
非正式的期刊改为正式期刊,应按本规定第六条、第七条、第八条、第九条申报审批。
第三章 期刊的登记与出版
第十八条 按本规定第八条、第九条、第十六条批准的期刊, 由主办单位持批准文件, 向编辑部(编辑部须与主办单位或承办单位同地)所在地的省级新闻出版局申请办理登记,并填报申请登记表。
正式期刊申请登记表经审核无误后,发给编有“国内统一刊号”的“报刊登记证”;非正式期刊发给“内部报刊准印证”。
期刊登记副本,由登记机关于发证后15天内报新闻出版署备案。
登记机关在审核批准文件或期刊申请登记表时,如发现有与登记项目不符者、应当发还核批机关重新核批。
第十九条 按本规定第十五条批准出版的增刊,由办刊单位持批准件,向原登记机关办理登记。由登记机关发给一次性的“增刊许可证”。
第二十条 凡按本规定第十四条批准改变名称的期刊,由办刊单位持批准件向主办单位所在地的省级新闻出版局办理新刊登记。
有按本规定第十四条改变主办单位的,由办刊单位持批准件向所在地的省级新闻出版局申请办理变更登记。
期刊改变登记地的,须按本规定第八条、第九条并持注销证明重新报批,经批准后予以登记。
第二十一条 每期期刊只许有一种版本。期刊的不问版别、文种均按不同的期刊发给登记证,一刊一号。
第二十二条 期刊登记的收费,按国家的有关规定办理。
第二十三条 公开发行的期刊,可持登记证向国际连续出版物数据系统中国国家中心申请国际标准刊号。
第二十四条 期刊从批准之日起,办刊单位在3个月之内不办理登记者,批准件自行失效、登记机关不再受理登记。经登记后,半年内不出刊的或无故停刊半年的期刊,由登记机关注销登记,不得继续出刊。如要继续办刊或重新出刊,应按本规定第八条、第九条重新报批。
第二十五条 期刊停刊须由办刊单位持主管部门的证明向期刊登记机关办理注销登记,向登记机关缴回“报刊登记证”或“内部报刊准印证”,并及时报新闻出版署备案;自然科学、技术类的还须报国家科委备案。
第二十六条 期刊每年登记、变更登记、注销登记的情况,由各地登记机关汇总后于年底前报新闻出版署期刊管理局。
第二十七条 正式期刊“报刊登记证”的有效期和换发时间,由新闻出版署规定;非正式期刊的“内部报刊准印证”的有效期和换发时间由省级新闻出版局规定。
第二十八条 业经登记的期刊,须按“报刊登记证”或“内部报刊准印证”的登记项目出版。“报刊登记证”或“内部报刊准印证”为期刊合法出版的凭证,只限经登记的期刊持有使用。严禁转借、转让、出租和出卖,其登记项目也不得擅自涂改。
严禁用书号出版期刊或变相出版期刊,也不得用刊号出版图书。
第二十九条 期刊必须在封底或目录页上刊载版本记录,包括主办单位、出版单位、印刷单位、发行单位、出版日期、主编姓名、发行范围、定价或工本费、国内统一刊号或准印证编号和广告经营许可证编号。其中国内统一刊号或准印证编号须印在封底下方。领有国际标准刊号的期刊,同时应刊载此项刊号。
正式期刊须在封面上刊载期刊名称和年、月、期、卷。不得以要目替代刊名。
正式期刊出版增刊,除须刊印国内统一刊号外,还须同时刊印一次性增刊许可证编号,并在封面刊印正刊名称和注明“增刊”。禁止用书号出版增刊。
第三十条 各期刊出版后,应按规定及时向新闻出版行政管理部门送缴样本。
第四章 期刊社的经营
第三十一条 凡独立经营、单独核算的出版正式期刊的期刊社,经上级主管部门和新闻出版行政管理部门同意后,可向工商行政管理机关申请营业执照,在国家法律、法规允许的范围内开展多种经营活动。
出版内部发行的正式期刊的期刊社,不得开展公开的、涉外的经营活动。出版非正式期刊的期刊社,不得进行经营活动。
刊登有关报纸、期刊的广告,须验明“报刊登记证”;刊登有关图书的广告,须注明出版单位名称。正式期刊不得刊登有关非正式期刊、报纸和其它内部的出版物的广告;公开发行的期刊不得为内部发行的正式报刊、图书做广告。
第三十二条 凡公开发行的期刊,应依照《中华人民共和国商标法》的规定,办理期刊名称的商标注册。
第三十三条 公开发行的期刊不得转载或摘编内部发行的图书、报纸、期刊和其它内部出版物的内容;特殊情况须转载的,须征得被转载或摘编的出版物出版单位的同意。
公开发行的期刊不得刊登涉及内部发行出版物的出版、活动消息。
第三十四条 期刊在外地设立办事处、记者站或在登记地以外的地区印制和总发行,须经本地和当地新闻出版局的批准,并接受当地新闻出版行政管理机关的管理。内部发行的正式期刊和非正式期刊不准设立办事处、记者站或其它类似机构。
第三十五条 期刊社的内部组织机构、人员编制、经费、经营核算方式等,由期刊主办单位或上级主管部门决定。
第五章 处 罚
第三十六条 凡违反本规定,由新闻出版行政管理机关区别情节轻重,给予下列行政处罚:
(一)警告;
(二)罚款;
(三)没收非法收入;
(四)停止出售;没收或销毁违法期刊;
(五)定期停刊;
(六)停业整顿;
(七)撤销登记;
第三十七条 省、自治区、直辖市和计划单列市的新闻 出版局给予前条第(四)(五)、(六)、(七)项规定的处罚,须报新闻出版署核准。
第三十八条 违反本规定,不经批准和登记,擅自从事期刊出版活动,或者以收买、假冒、伪造期刊的名称、登记号和其他手段,从事期刊的出版、印刷、和发行活动,构成犯罪的,由新闻出版行政管理机关、工商行政管理机关和公安机关在本部门的权限内,依照有关规定处理。
第六章 附 则
第三十九条 本规定由新闻出版署负责解释。
第四十条 本规定自发布之日起施行。
