“Provisional Periodical Management Regulations” Administrative Punishment Implementation Rules

Article 1: According to the “Provisional Periodical Management Regulations” (hereafter simply named “Rules”), in order to implement the provisions relating to administrative punishment, these Rules are formulated.

Article 2: In all cases of violations of the “Provisional Periodical Management Regulations”, administrative press and publications management organs impose the following administrative punishment according to these Rules:

(1) a warning;

(2) a fine;

(3) confiscating illegal income;

(4) cessation of sales, confiscation or destruction of unlawful periodicals;

(5) provisional cessation of publication;

(6) cessation of business for rectification;

(7) cancellation of registration.

Article 3: Provincial, autonomous region, municipal and plan-listed city press and publication bureaus imposing the punishments provided in items (4), (5), (6) and (7) of the previous Paragraph, must report to the Administration of Press and Publications for verification and approval.

All levels’ administrative press and publications management organs investigating and prosecuting, or implementing administrative punishment decisions according to these Rules, may adopt administrative measures of inspecting, sealing up and detaining relevant periodicals.

Article 4: Where one periodical has two or more kinds of acts violating these Rules, they will be punished for the gravest one or in combination with regard to the concrete circumstances.

Article 5: Periodical publishers who disagree with the punishment decision of the administrative press and publications management organ of the locality of registration, may within ten days of receiving notification put forward an appeal with the administrative press and publications management organ of one level higher, and the administrative press and publications management organ of one level higher will make a decision within 15 days of receiving the complaint.

The period of appeal does not influence the implementation of the punishment decisions.

Article 6: Periodicals publishing content listed in item (1) or item (2) of Article 5 of the Regulations, are punished with cancellation of registration, confiscation of the illegal income and cessation of sale, confiscation or destruction of the unlawful periodicals.

Article 7: Periodicals publishing content listed in item (3), item (4), item (5) or item (6) or Article 5 of the “Regulations”, are punished with provisional cessation of publishing, and confiscation of unlawful income, cessation of sales, and confiscation or destruction of the unlawful periodicals may also be imposed; where circumstances are grave, registration is cancelled.

Article 8: Periodicals publishing content listed in item (7) or item (8) of Article 5 of the “Rules” are given a warning, and cessation of sales, confiscation or destruction of unlawful periodicals may also be imposed; where circumstances are graved, business is ceased for rectification.

Article 9: Periodicals publishing content listed in item (9) of Article 5 of the “Rules” are punished according to the provisions of Article 6, Article 7 and Article 8.

Article 10: Internally distributed official periodicals changing their publication scope without authorization, are punished with a fine of half to one time the total price, and are also punished with confiscation of illegal income and cessation of sales, confiscation or destruction of unlawful periodicals.

Article 11: Non-official periodicals that are openly distributed, displayed, sold or where business activities are conducted without authorization, are punished with a fine of half to one time the total price and confiscation of illegal income; where circumstances are grave, registration is cancelled.

Article 12: Where periodicals exceed their approved specialization scope or are published in violation of their editorial policy, they are punished with a fine of one time to two times the total price, and the punishment of confiscation of illegal income or cessation of sales, confiscation or destruction of unlawful periodicals may also be imposed.

Article 13: Where periodicals have one of the following acts violating management regulations, they are punished with confiscation of illegal income and cessation of sales, confiscation or destruction of unlawful periodicals, and the punishment of a fine of one time to five times the total price may also be imposed; where circumstances are grave, business is ceased for rectification;

(1) periodicals publishing supplementary issues without authorization;

(2) published supplementary issues are inconsistent with the purpose, book size or distribution scope of the official periodical.

Article 14: Periodicals changing their name without authorization are punished with provisional cessation of publishing, and shall resume their original periodical name.

Article 15: Periodicals publishing two or more versions with one periodical number, are punished with cessation of business for rectification, confiscation of illegal income and cessation of sales, confiscation or destruction of unlawful periodicals, and a fine of one time to two times the total price may be imposed; where circumstances are grave, registration is cancelled.

Article 16: Where the same periodical issue is published in two versions or more, this is punished by confiscation of illegal income and cessation of sales, confiscation or destruction of the unlawful periodicals, and a fine of one time to two times the total price may be imposed; where circumstances are grave, business is ceased for rectification.

Article 17: Where periodicals have one of the following acts violating management regulations, they shall be warned; where circumstances are grave, their publication shall be stopped for a limited time.

(1) where periodicals alter their lawful publishing evidence registration matters without authorization;

(2) where periodicals are not published according to registration and without approval from the administrative press and publication management organ.

Article 18: Where periodicals re-lend or transfer their lawful publication evidence, they will be punished by cessation of business for rectification, and punished by a fine of one time or more but less than two times the general fixed price, the unlawful periodicals are confiscated or destroyed; where circumstances are grave, registration is cancelled.

Where periodicals rent out or sell their lawful publishing evidence, they are punished with cancellation of registration, confiscation of illegal income and cessation of sales, confiscation or destruction of the unlawful periodicals, and a fine of one time or more but less than five times the general fixed price may also be imposed.

Article 19: Where periodicals use periodical numbers to publish books, they are punished with confiscation of the illegal income and cessation of sales, confiscation or destruction of the unlawful books, and a fine of one time or more but less than two times the general fixed value may additionally be imposed; where circumstances are grave, business is ceased for rectification.

Article 20: Where periodicals do not print a colophon on the front page or the back cover, they are warned; where circumstances are grave, they are fined 1000 Yuan.

Article 21: Where periodicals have one of the following acts violating management regulations, they are punished with a fine of more than half but less than one time the general fixed price, and they may also be punished with cessation of sales and confiscation or destruction of the unlawful periodicals; where circumstances are grave, business is ceased for rectification.

(1) where official periodicals do not print the periodical name, date or number on the front cover, or replace the date and number with a general period;

(2) where official periodicals replace the periodical name with the principal items or the principal items are smaller than the periodical name;

(3) where official periodicals publish supplementary numbers, and do not print the domestic uniform periodical number and the one-time supplementary number permit number do not print the name of the official periodical on the cover, or do not indicate “supplementary number”

Article 22: Where periodicals, after publication, do not timely submit samples according to regulations, they are warned; where circumstances are grave, registration is cancelled.

Article 23: Where openly distributed periodicals reprint or extract content from internally-distributed books, newspapers, periodicals and other internal publications without authorization, or print information related to publication or activities of internally-distributed publications, they are warned, and a fine of more than half to one time the general fixed price may also be imposed; where circumstances are grave, sales are ceased and unlawful periodicals confiscated or destroyed.

Article 24: Where ethnic autonomous regions cannot completely apply the provisions of these Rules, the autonomous region administrative press and publications management organ may, on the basis of the local situation and the basic principles of these Rules, formulate flexible or supplementary regulations, to be implemented after petitioning the local administrative region people’s government and the Administration of Press and Publications for approval.

Article 25: “more than” and “less than” as named in these Rules include the cardinal number.

Article 26: These rules take effect on 1 September 1989.

 

Annex: Explanation concerning Some Questions on the Implementation of the “‘Provisional Periodical Management Regulations’ Administrative Punishment Implementation Rules”

The “‘Provisional Periodical Management Regulations’ Administrative Punishment Implementation Rules” formulated by our Administration (hereafter simply named “Rules”) were promulgated on 22 June 1989, and will take effect on 1 September 1989, hereby, the following explanation is given concerning some questions on implementing the “Rules”:

I, How to differentiate between cessation of publication for a limited time and cessation of business for rectification

Article 2, Clause (5) and Clause (6) of the “Rules” have stipulated the two sorts of administrative punishment of cessation of publication for a limited time and cessation of business for rectification.

Cessation of publication for a limited time refers to ceasing the publication of a certain period of a periodical.

Cessation of business for rectification refers to the cessation of all business activities related to publishing activities of a periodical publisher (editorial department) for a limited time, and conducting rectification. This means ceasing the work of the periodical publishers’ (editorial departments’) editing, printing and distribution work, and conducting rectification in these three departments.

Where the publication of one periodical is ceased twice because of violations of the “Rules” within two years, the punishment the second time should be heavier, and business cessation for rectification should be imposed according to Article 2 Clause (6) of the Rules. The time is to be calculated from the date of the punishment decision.

The period of cessation of business for rectification refers to the fact that this sort of administrative punishment should be longer than one month but less than six months. Where the business of one periodical is ceased twice because of violations of the “Rules” within two years, the punishment the second time should be heavier, and cancellation of registration should be imposed according to Article 2 Clause (7) of the Regulations. The time is to be calculated from the date of the punishment decision.

II, How to punish unlawful periodicals with cessation of sales, confiscation or destruction of unlawful periodicals during the period of reporting for approval.

Article 2 Clause (4) of the “Rules” provides for cessation of sales, confiscation and destruction of unlawful periodicals, on the basis of the provisions of Article 37 of the “Provisional Periodical Management Regulations”, where this punishment is imposed, it must be reported to the Administration of Press and Publications. But, if no certain measures are adopted against unlawful periodicals during the period of verification, the punishment after verification may be empty. In order to be able to effectively implement this punishment, provincial, autonomous region, municipal and plan-listed city press and periodical bureaus may, concerning the punishments in these provisions, during the period of reporting for approval, adopt advance measures to provisionally seal up the unlawful periodicals, and after waiting for Administration verification, may implement matters according to the concrete content of the approval.

III, How to establish that periodicals rent out or sell their legal evidence certificate

Article 18 Paragraph 2 of the “Rules” provides that periodicals renting out or selling their legal evidence certificate, equals the generally mentioned selling of periodical numbers or covert selling of periodical numbers, and refers to periodical publishers entrusting their publishing rights (soliciting contributions, editing contributions, final distribution of manuscripts, printing, advertising, propaganda, etc.) or part of their publishing powers to persons or work units outside of that publisher, and receive a certain payment from the entrusted side; or periodical publishers who enjoy publishing rights in name, but the periodical publisher does not directly appoint persons to settle printing fees, and has persons or work units outside of that publisher act on their behalf, and at the same time entrust them with conducting distribution, advertising, propaganda, etc. on their behalf, and the periodical publisher receives a certain payment from the entrusted side for this. Selling of periodical numbers or covert selling of periodical numbers is to be punished according to the provisions of Article 18 Paragraph 2 of the “Rules”

IV, How to establish use of periodical numbers to publish books.

Article 19 of the “Rules” mention periodicals using periodical numbers to publish books, this refers to periodical publishers publishing so-called periodicals that have only one centre in terms of content, do not have columns or rubrics, where the main subject replaces the periodical name on the front cover, and that have no volume and number or date sequence.

V, How to use the provisions of Article 22 of the “Rules”

Article 22 of the “Rules” provides “after periodicals are published, not timely submitting specimens according to regulations”, timely submitting specimens refers to the fact that periodicals should submit specimens to the relevant departments at the same time as submission for distribution, or within a time limit of one month after publication; those not submitting within one month will be warned; grave circumstances refers to not submitting specimens within six months of publication, and this will also be considered as “After registration, periodicals that do not publish issues within half a year or that cease publishing for half a year without reason, will have their registration cancelled by the registration organ and may no longer publish periodicals” as provided in Article 24 of the “Provisional Periodical Management Regulations”

VI, How to deal with situations where periodicals publish content that violates the Criminal Law, and also violates the “Rules”

First and foremost, the relevant administrative press and publications management organ seals up the periodicals or adopts other measures on the basis of the “Rules”, and afterwards hands them over to judicial organs for punishments, or adopts corresponding measures in coordination with the public security organs. After judicial organs investigate criminal responsibility according to the law, and where it is still necessary, on the basis of the “Rules”,  to impose administrative punishments (such as provisional cessation of publication, cessation of business for rectification, or cancellation of registration” against this periodical, it will be handled according to the “Rules”.

 

《期刊管理暂行规定》行政处罚实施办法

1989年6月22日,新闻出版署

第一条 根据《期刊管理暂行规定》(以下简称《规定》),为实施有关行政处罚的规定,制定本办法。
第二条 凡违反《期刊管理暂行规定》,由新闻出版行政管理机关依照本办法给予下列行政处罚:
(一)警告;
(二)罚款;
(三)没收非法收入;
(四)停止出售,没收或销毁违法期刊;
(五)定期停刊;
(六)停业整顿;
(七)撤销登记。
第三条 省、自治区、直辖市和计划单列市的新闻出版局给予期刊社前条第(四)、(五)、(六)、(七)项规定的处罚,须报新闻出版署核准。
各级新闻出版行政管理机关依照本办法,查处违法行为,执行行政处罚决定,可以采取检查、查封、扣押有关期刊的行政措施。
第四条 一种期刊有两种以上违反本办法行为的,视具体情节从重或者合并处罚。
第五条 期刊社对登记地新闻出版行政管理机关的处罚决定不服的,可以在接到通知后10日内向上一级新闻出版行政管理机关提出申诉,由上一级新闻出版管理机关在接到申诉后15日内作出决定。
申诉期间不影响处罚决定的执行。
第六条 期刊刊载《规定》第五条第(一)、第(二)项内容之一的,处以撤销登记,没收非法收入和停止出售,没收或销毁违法期刊。
第七条 期刊刊载《规定》第五条第(三)、第(四)、第(五)、第(六)项内容之一的,处以定期停刊,可以并处没收非法收入或者停止出售,没收或销毁违法期刊;情节严重的,撤销登记。
第八条 期刊刊载《规定》第五条第(七)、第(八)项内容之一的,处以警告,可以并处停止出售,没收或销毁违法期刊;情节严重的,停业整顿。
第九条 期刊刊载《规定》第五条第(九)项内容的,参照以上第六、第七、第八条的规定处罚。
第十条 内部发行的正式期刊擅自改变发行范围的,处以总定价0.5倍以上1倍以下的罚款,并处以没收非法收入和停止出售,没收或销毁违法期刊。
第十一条 非正式期刊公开发行、陈列、销售和擅自进行经营活动的,处以总定价0.5倍以上1倍以下的罚款和没收非法收入情节严重的,撤销登记。
第十二条 期刊超越报批的专业范围或违背编辑方针而出版的,处以总定价1倍以上2倍以下的罚款,可以并处没收非法收入或者停止出售,没收或销毁违法期刊。
第十三条 期刊有下列违反管理规定行为之一的,处以没收非法收入和停止出售,没收或销毁违法期刊,可以并处总定价1倍以上5倍以下的罚款;情节严重的,停业整顿;
(一)期刊擅自出版增刊的;
(二)出版的增刊与正刊的宗旨、开本和发行范围不一致的。
第十四条 期刊擅自更改刊名,处以定期停刊,并应恢复原刊名。
第十五条 期刊以一个刊号出两种以上版本的,处以停业整顿,并处没收非法收入和停止出售,没收或销毁违法期刊,可以并处总定价1倍以上2倍以下的罚款;情节严重的,撤销登记。
第十六条 同一期期刊出两种以上版本的,处以没收非法收入和停止出售,没收或销毁违法期刊,可以并处总定价1倍以上2倍以下的罚款,情节严重的停业整顿。
第十七条 期刊有下列违反管理规定行为之一的,处以警告;情节严重的,定期停刊。
(一)期刊擅自涂改其合法出版凭证登记项目的;
(二)期刊未经新闻出版行政管理机关的批准,而不按登记的刊期出版的。
第十八条 期刊转借、转让其合法出版凭证的,处以停业整顿,并处总定价1倍以上2倍以下的罚款和停止出售,没收或销毁违法期刊;情节严重的,撤销登记。
期刊出租、出卖其合法出版凭证的,处以撤销登记,没收非法收入和停止出售,没收或销毁违法期刊,可以并处总定价1倍以上5倍以下的罚款。
第十九条 期刊用刊号出版图书,处以没收非法收入和停止出售,没收或销毁违法图书,可以并处总定价1倍以上2倍以下的罚款;情节严重的,停业整顿。
第二十条 期刊不在封底或目录页上刊载版本记录的,处以警告;情节严重的,罚款1千元。
第二十一条 期刊有下列违反管理规定行为之一的,处以总定价0.5倍以上1倍以下的罚款,可以并处停止出售,没收或销毁违法期刊;情节严重的,停业整顿。
(一)正式期刊在封面上不刊载期刊名称和年、月、期、卷,或者以总期号代替年、月、期、卷的;
(二)正式期刊在封面上以要目代替刊名或者刊名小于要目的;
(三)正式期刊出版增刊,不刊印国内统一刊号和一次性增刊许可证编号或者在封面上不刊印正刊名称,不注明“增刊”的。
第二十二条 期刊出版后,不按规定及时缴送样本的,处以警告;情节严重的,撤销登记。
第二十三条 公开发行的期刊擅自转载或摘编内部发行的图书、报纸、期刊和其他内部出版物内容的,或者刊登涉及内部发行出版物的出版、活动消息的,处以警告,可以并处总定价0.5倍以上1倍以下的罚款;情节严重的,停止出售,没收或销毁违法期刊。
第二十四条 民族自治地方不能全部适用本办法规定的,可以由自治区新闻出版行政管理机关根据当地情况和本办法的基本原则,制定变通或者补充的规定,报请当地自治区人民政府和新闻出版署批准施行。
第二十五条 本办法所说的“以上”、“以下”都连本数在内。
第二十六条 本办法自1989年9月1日起施行。

附件:关于执行《〈期刊管理暂行规定〉行政处罚实施办法》若干问题的解释
我署制定的《〈期刊管理暂行规定〉行政处罚实施办法》(以下简称《办法》)已于1989年6月22日公布,并于1989年9月1日开始施行,现对执行《办法》中的有关问题作如下解释:
一、定期停刊与停业整顿的区别何在
《办法》第二条第(五)、第(六)项规定了定期停刊、停业整顿两种行政处罚。
定期停刊,是指停止某一期期刊的出版。
停业整顿,是指定期停止期刊社(编辑部)所有与出版活动有关的业务,并进行整顿。即停止期刊社(编辑部)的编辑、印刷、发行工作,并对以上三个部门进行整顿。
一个期刊在两年内,因违反《办法》而被处以两次定期停刊的,第二次即应加重处罚,按照《办法》第二条第(六)项停业整顿处罚。时间以处罚决定之日起开始计算。
停业整顿所讲的定期,是指该种行政处罚应在1个月以上6个月以下。一个期刊在两年内,因违反《办法》而被处以两次停业整顿的,第二次即应加重处罚,按照《办法》第二条第(七)项撤销登记处罚。时间以处罚决定之日起开始计算。
二、停止出售,没收或销毁违法期刊在报署核准期间,对违法期刊如何处置
《办法》第二条第(四)项规定的停止出售,没收或销毁违法期刊,根据《期刊管理暂行规定》第三十七条的规定,给予该项处罚,须报新闻出版署核准。但是,在核准期间如不对违法期刊采取一定的措施,该项处罚在核准后就会落空。为了能够有效地执行该项处罚,省、自治区、直辖市和计划单列市的新闻出版局对该项规定的处罚,在报署核准期间,可先行采取封存违法期刊的临时措施,待署核准后,再根据核准的具体内容予以执行。
三、怎样认定期刊出租、出卖其合法凭证
《办法》第十八条第二款规定的期刊出租、出卖其合法出版凭证,即是一般讲的卖刊号或变相卖刊号,它是指期刊社将出版权(组稿、编稿、终审发稿、印刷和广告宣传等)或部分出版权委托给本刊社以外的人或单位,并向被委托方收取一定费用;或者期刊社名义上享有出版权,但是,期刊社不直接派人结算印刷费用,而由本刊社以外的人或单位代办,并同时委托其代办发行及广告宣传等,期刊社因此向被委托方收取一定的费用。卖刊号或变相卖刊号依照《办法》第十八条第二款的规定处罚。
四、怎样认定用刊号出版图书
《办法》第十九条讲的期刊用刊号出版图书,是指期刊社以刊号出版在内容上只有一个中心点,不设置栏目,在封面上以要目代替刊号,没有卷、期或年、月顺序编号的所谓期刊。
五、如何运用《办法》第二十二条的规定
《办法》第二十二条规定的,“期刊出版后,不按规定及时缴送样本”,及时缴送样本是指将期刊交付发行的同时应向有关部门缴送样本,限制期限为出版后1个月,超过1个月不缴送的处以警告;情节严重是指出版后6个月不缴送样本的,即视为《期刊管理暂行规定》第二十四条规定的“经登记后半年内不出刊的或无故停刊半年的期刊,由登记机关注销登记,不得继续出刊。”
六、期刊刊载的内容触犯了刑法,又违反了《规定》时,如何处理
首先由有关新闻出版行政管理机关根据《办法》的规定对期刊采取查封或者其他措施,然后移交司法机关处理,或者协助公安部门依法采取相应措施。司法机关依法追究刑事责任之后,根据《办法》仍需对期刊予以行政处罚(如定期停刊、停业整顿、撤销登记)的,依照《办法》处理。
