In order to adapt to the needs of cleaning up and rectifying the newspaper, book, periodical and audiovisual markets at present, the competences to appraise (determine) obscene publications and sexual publications may be appropriately transferred to a lower level. The concrete rules are:
1. appraisal of obscene works and sexual works in illegal publishing activities may be conducted by all provincial, autonomous region and municipal people’s governments (governments may entrust the press and publications bureau with this responsibility), and they report to the Administration of Press and Publications for filing;
2. appraisal of publications in local work units, may be conducted by all provincial, autonomous region and municipal people’s government, and they report to the Administration of Press and Publications for filing;
3. for appraisal of publications of external publishing work units, the press and publications bureau puts forward a preliminary opinion, and reports this to the press and publications bureau of the locality of the publishing work unit, which conducts appraisal; at the same time, a copy is reported to the Administration of Press and Publications, when necessary, the Administration may directly conduct appraisal;
4. for appraisal of publications of Central publishing work units, the bureau of press and publications still puts forward a preliminary opinion, and the Administration of Press and Publications conducts appraisal.
Where the above circumstances 3 and 4 apply, in order to timely handle matters, the local controlling department may, on the basis of approval of the government, adopt necessary measures in advance, including detaining investigated criminals, in order to avoid losing the opportune moment.
