Issued on 31 October 1989 by the Ministry of Radio, Film and Television
Article 1: In order to make television drama creation flourish, raise television drama quality, strengthen television drama production management, stimulate the construction of a socialist spiritual civilization, these Regulations are hereby formulated.
Article 2: The Ministry of Radio, Film and Television is responsible for management work over television drama production nationwide. Provincial, autonomous region and municipal radio, film and television offices (bureaus) are responsible for television drama production management work in their administrative regions.
Article 3: Any work unit (including all levels’ television station) producing television dramas must have a television drama production permit (hereafter named permit). It is prohibited for private persons to produce television dramas.
Article 4: There are two kinds of permits, long-term permits and temporary permits.
Long-term permits are valid for three years, at the time of expiry, if it is required to further produce television dramas, a new application must be made.
Temporary permits are limited for use only for the programme applied for, and is not valid for other programmes.
Article 5: Where the following conditions are present, specialized propaganda, arts and literature work units truly needing to produce television dramas may apply for a long-term permit.
I, Having a specialized editing, directing, shooting and recording, etc., creation team able to independently produce television dramas. The main creative personnel shall have a vocational-college or higher cultural level and a corresponding specialization, or be a specialized staff member having produced three or more television dramas that were broadcasted by provincial-level or higher television stations.
II, Provide for themselves complete sets of specialized equipment able to simultaneously produce two or more television dramas.
III, Possessing specialized funds for the production of television dramas.
Article 6: Where the following conditions are present, specialized propaganda, arts and literature work units truly needing to produce television dramas may apply for a temporary permit.
I, Having a script signed passed by the city (local) level or higher propaganda department.
II, Having specialized editing, directing, recording, acting, etc., creation personnel required for the programme applied for production.
III, Having the specialized equipment required for the programme applied for production.
IV, Having specialized funds required for the programme applied for production.
Article 7: The application permit examination and approval procedure:
I, Centre-subordinated specialized propaganda, arts and literature work units producing television dramas, shall apply for a permit with the Ministry of Radio, Film and Television. All specialized propaganda, arts and literature work units in provincial, autonomous region and municipal administrative areas producing television dramas shall apply for a permit with their provincial, autonomous region and municipal radio, film and television offices (bureaus).
II, Work units applying for a permit must provide real and reliable certification documents, and truthfully fill out the application forms.
III, Permit-issuing work units conduct examination of the application work units strictly according to the provided conditions, those examined, as meeting conditions, shall be issued a permit. Work units applying for a temporary permit, must apply before shooting, those applying in the middle of shooting or after completion of the television drama will without exception not be granted a permit.
IV, All provincial, autonomous region and municipal radio, film and television offices (bureaus) after issuing a permit to a producing work unit, shall immediately file this with the Ministry of Radio, Film and Television.
Article 8: All levels’ television stations may only broadcast television dramas produced by work units having a permit, television dramas produced by work units without a permit may not be broadcasted. Television dramas produced by work units having a permit being submitted for broadcast approval, must include in the permit number in the production titles, this is verified by the television station, and the examined picture may only be broadcast after being passed. Simultaneous with broadcast examination of television dramas produced by work units having a temporary licence, the completed picture must be given to the permit-issuing work unit for filing.
Article 9: Work units having a long-term permit shall at the end of every year report the television drama production situation of that year to the permit-issuing work unit in writing. Work units having a permit, within the period of validity of the permit, not having the conditions to produce television dramas because of change in personnel, funding, equipment or other conditions, shall timely report to the permit-issuing work unit, and shall hand back the permit.
Work units having a temporary permit, after conducting broadcast formalities, shall timely hand back the permit to the permit-issuing work unit. If work units having a temporary permit, within six months of receiving the permit, have not yet started shooting, the permit-issuing work unit has the power to recall the permit.
Article 10: The permit may not be altered, sold, rented or lent, or transferred. Work units having a permit may in no way let work units not meeting conditions or not having a permit produce television dramas.
In cooperative production of a television drama, a producing work unit having a permit must lead. The party having a permit must have the main creative personnel take part in the production work.
If a work unit having a permit produces a television drama, receives financial aid from enterprise or undertaking work units or individuals, the aiding work unit or individual may not intervene in editing, directing, shooting or recording work.
Article 11: The permit-issuing work unit has the power to conduct inspection and supervision over the situation of personnel, equipment, funding use, production, etc., in work units having a permit. Of production work units repeatedly producing inferior-quality television dramas, not meeting conditions or having chaotic internal management, the permit will be recalled.
Article 12: If production work units violate these Regulations, they shall be punished by issuance of a warning, receipt a report of criticism, fined, or have their permits revoked according to the gravity of the circumstances. Work units of which the permit was revoked, may not reapply for a permit within three years (to be calculated from the day of revocation).
Television stations broadcasting television dramas without a permit in violation of these Regulations, shall be dealt with by warning, report of criticism and fines, etc. according to the gravity of the circumstances.
Article 13: Interpretation of these Regulations is within the purview of the Ministry of Radio, Film and Television.
Article 14: These Regulations take effect on the day of promulgation. Document No. RDP (1986)210 will be abolished simultaneously.
