Over the past few years, printing enterprises have developed rapidly nationwide, which had an effect on mitigating the fact that “book publishing was difficult”. But it should also be considered that printing enterprises have developed in overly many numbers, overly rapidly and excessively, exceeding real needs, not a few printing enterprises are managed chaotically and do business in violation of regulations, illegal printing activities occur repeatedly, large quantities of publications of vulgar style, or that are even reactionary or obscene flow into society through the segment of printing, which gravely upsets the construction of a Socialist spiritual society. In order to strengthen management over printing enterprises and improve and rectify printing enterprises well, the Administration of Press and Publications, the Ministry of Public Security, the State Administration of Industry and Commerce, the Ministry of Culture and the Ministry of Light Industry have jointly formulated the “Provisional Printing Sector Management Rules”, that were promulgated and implemented on 5 November 1988. Through one year of improvement and rectification the book, newspaper and periodical printing sector’s chaotic situation has been somewhat brought under control, all levels’ administrative press and publications departments’ management and supervision over book, newspaper and periodical printing enterprises has somewhat strengthened, but the problem that there are excessively many printing enterprises has not been basically resolved, and the objective of blocking “porn sources” in the stage of the printing of publications is far from being achieved. Recently, the CCP Central Committee Secretariat and the State Council Secretariat issued the “Notice concerning Rectifying and Cleaning Up the Book, Newspaper, Periodical and Audiovisual Markets, and Strictly Attacking Criminal Activities” (hereafter simply named “Two Secretariats’ Notice”), that put forward strict requirements concerning rectifying and clearing up publications printing work units. In order to implement the requirements of the “Two Secretariats’ Notice”, rectify and clean up book, newspaper and periodical printing enterprises well, guarantee the healthy development of the book, newspaper and periodical printing sector strengthen management over book, newspaper and periodical printing and stop illegal printing activities, the following is hereby reiterated and supplementary provisions made:
I, All provincial, autonomous region and municipal press and publications bureaus shall, together with relevant departments, realistically implement the “Two Secretariats’ Notice” and the “Provisional Printing Sector Management Rules”, and complete rectification work of printing enterprises in their areas as soon as possible. Through rectification, a one-time education on persisting in the Four Cardinal Principles, persisting in the construction of a Socialist spiritual civilization, observing discipline and abiding by the law, and strictly observing relevant regulations on printing sector management work is to be broadly launched among printing enterprises. At the same time, a complete, investigation, registration and inspection round shall be conducted of printing enterprises in their areas.
II, All provincial, autonomous region and municipal press and publications bureaus may, after the conclusion of printing enterprises rectification work, on the basis of the requirements of overall demand for book, newspaper and periodical printing capacity in their regions and reasonable distribution, through strict inspection, issue book, newspaper and periodical printing permits to printing enterprises that truly have book, newspaper and periodical printing equipment, have certain production capacities and technological abilities, that can guarantee product quality, that observe discipline and abide by the law, that have a complete management basis, regular materials provision channels and have undertaken printing tasks of a number of books (including textbooks and teaching materials) over the years.
Village-run printing enterprises contracting printing is to be handled according to the relevant provisions of the “Two Secretariats’ Notice”.
All provincial, autonomous region and municipal press and publication bureaus shall, on the basis of the requirements of the abovementioned provisions, and in integration with the real situation in their regions, formulate basic conditions and book, newspaper and periodical permit issuance rules for book, newspaper and periodical printing enterprises in their area.
Printing enterprises of which the rectification was already completed before the issuance of these Provisions, and that have been issued with a book, newspaper and periodical printing permit, shall be re-inspected, printing enterprises whose applications were untruthful or who do not conform to the abovementioned provisions, shall have their book, newspaper and periodical printing permits revoked.
All printing enterprises that do not have a book, newspaper and periodical printing permit issued by the provincial, administrative region or municipal press and publications bureau may without exception not engage in book, newspaper and periodical printing business.
III, A book and periodical fixed printing point system is implemented for the entrusted printing of official publications (meaning publications having a book or periodical number, similar hereafter) of publishers and periodical publishers (editorial departments).
Book and periodical fixed printing point enterprises are divided into national and provincial fixed point categories, national book and periodical fixed printing point enterprises may accept the printing of publications on a nationwide scope, provincial-level book and periodical fixed printing point enterprises can only accept the printing of publications from that province (autonomous region, municipality).
Book and periodical fixed printing point enterprises are strictly selected and composed of enterprises having obtained a book, newspaper and periodical printing permit. They have State-operate large and mid-size book and periodical printing backbone enterprises at the core, and include book and periodical printing plants that have been listed into book and periodical printing sector statistics for years, a number of printing plants that have printed teaching materials (including textbooks) for years, and a number of publishers’ printing plants and a number of military book and periodical printing plants.
Nationwide book and periodical fixed printing point examination and approval is subject to allocation quota decided upon by our Administration and all provincial, administrative region and municipal press and publications bureaus, the applying enterprise fills out a “Book and Periodical Fixed Printing Point Enterprise Registration Form”, the provincial, administrative region or municipal press and publications bureau will strictly examine and verify this, and put forward an examination and approval opinion, a book and periodical fixed printing point enterprise certificate is issued after verification and approval by our Administration. Provincial-level book and periodical fixed printing point enterprises are examined, approved and issued with certificates by the provincial, administrative region or municipal press and publications bureau, and report to our Administration for filing. Book and periodical fixed printing point enterprise registration forms and fixed point enterprise certificates are uniformly printed by our Administration.
IV, After book and periodical fixed printing points are designated, the printing of all official publications of publishers and periodical publishers (editorial departments) shall be entrusted to book and periodical fixed printing points. When entrusting printing to local book and periodical fixed printing point enterprises, publishers are to provide a stamped manuscript sheet and printing task sheet, periodical publishers (editorials) are to provide a periodical publishing certificate. When entrusting printing to a local non-book and periodical fixed printing point enterprise having obtained a book, newspaper and periodical printing permit, the provincial-level press and publications bureau of the locality of the entrusting work unit must give approval. When entrusting printing to a non-local national book and periodical fixed printing point enterprise, the provincial-level press and publications bureau of the locality of the printing entrusting and the entrusted work unit must give approval. The entrusting work unit may not entrust non-local non-national book and periodical fixed printing point enterprises with the printing of official publications. In case of violation, the liability of the publisher, periodical publisher (editorial department) and contracted printing plant will be prosecuted.
Books of central-level publishers for which the printing is uniformly arranged outside of Beijing by the China Printing Company, are to be printed by national book and periodical fixed printing point enterprises outside of Beijing by arrangement of the Central China Company through annual production dispatching talks.
V, Book and periodical fixed printing point enterprises must strengthen internal enterprise management, strengthen a sense of competition and a service mentality, increase production varieties, raise product quality, reduce print production times, improve service quality, and serve the construction of the two civilizations as well as the development of the publishing undertaking.
In order to make it convenient for relevant leading organs, statistical departments and enterprises to timely understand the situation of the book and periodical printing sector, henceforth, book and periodical fixed printing point enterprises’ basic situation, including production, commerce, finance, personnel, etc., must be brought into the scope of book and periodical printing industry statistics, book and periodical fixed printing point enterprises shall submit the materials needed for industry statistics to relevant industry statistics departments regularly and according to regulations.
All provincial, administrative region and municipal press and publications bureaus must realistically strengthen management, supervision, inspection and guidance of book and periodical fixed printing point enterprises. The fixed point enterprise status of book and periodical fixed printing point enterprises that cannot complete directive book and periodical production tasks, whose product quality does not meet industry or local standards and provisions, that do not regularly submit statistical information according to regulations, or that accept printing not according to regulations, and their fixed point enterprise certificate is recalled.
VI, Book and periodical printing enterprises (including printing enterprises who also deal with books, newspapers and periodicals) must respect the laws and regulations of the State and local people’s governments, it is prohibited to accept the printing of reactionary, obscene, superstitious publications and other publications that are prohibited by government decree, and they may not engage in illegal printing activities.
VII, Book, newspaper and periodical printing enterprises shall, apart from accepting the leadership of their higher-level controlling departments, accept the supervision and inspection of local press and publications, culture, public security, and industry and commerce management organs.
VIII, Book, newspaper and periodical printing enterprises must, when contracting printing, strictly observe the following provisions:
1. Where book and periodical fixed printing points undertake the printing of publications entrusted by local publishing work units (including books, newspapers, periodicals, New Year pictures, wall calendars, desk calendars, pictorials, etc., similar hereafter), publishers must provide a stamped manuscript sheet and printing task sheet, newspaper publishers and periodical publishers (editorial departments) must provide a newspaper and periodical registration certificate. Where national book and newspaper fixed printing point enterprises undertake the printing entrusted by publications of non-local publishing work units, the entrusting work unit must also provide an approval certificate issued by the provincial-level press and publications bureau of the localities of the entrusting and entrusted work unit.
2. Non-book and periodical fixed printing point enterprises having obtained a book, newspaper and periodical printing permit may not undertake the printing of publications entrusted by non-local publishing work unit. When entrustment of publications of local publishing work units is accepted, the entrusting work unit must provide approval of the local provincial-level press and publications bureau. sAt the same time, publishers must provide a stamped manuscript sheet and printing task sheet, newspapers publishers and periodical publishers (editorial departments) must provide a newspaper and periodical registration certificate.
3. When publications from local and non-local non-publishing work units are entrusted, entrusting work units must provide approval documents from controlling departments (district or city-level or higher) and printing approval certificates issued by the press and publications bureau of the localities of the entrusting and entrusted work units.
All publications for which the abovementioned formalities are not conducted may without exception not be accepted by book, newspaper and periodical printing plants.
IX, Publishing or printing work units and individuals violating these Provisions are punished by all localities’ press and publications organs jointly with local industry and commerce, public security and culture organs according to regulations. Cases violating criminal law shall be handed over to judicial organs for the investigation of criminal liability.
X. All localities shall establish and complete printing sector management organs, and allocate a certain number of management personnel with good political qualities, who understand their speciality, realistically strengthen management and supervision over the local printing industry, and ensure that it serves the construction of the two civilizations even better.
