In order to implement the provisions in the CCP Central Committee Secretariat and State Council Secretariat “Notice concerning Compressing and Rectifying Audiovisual Work Units” (ZBF No. (1991)2) concerning uniformly issuing import permits, and strengthen management over audiovisual product import, the following matters are notified as followed:
I, For all import of audiovisual products used for publishing (master tapes, binding and layout sheets, backing sheets, etc.), an import and publishing permit (see attachment) must be applied for and obtained in advance.
II, Import and publishing permits are uniformly formulated and issued by the Administration of Press and Publications
III, Audiovisual publishing work units that engage in imported publications business with Administration of Press and Publication approval, must conduct import and publishing business strictly within the permitted publishing scope. It is strictly permitted that approved audiovisual publishing work units import or publish foreign audiovisual products of their own accord.
IV, The import of audiovisual products used for publishing must be reported to the audiovisual controlling department for examination and approval of literature and art-type audiovisual products according to regulations, and reported to the Ministry of Radio, Film and Television, the Ministry of Culture or the Administration of Press and Publications according to the system; educational, science and technology-type audiovisual products must be reported to the relevant ministry or committee for examination and approval. Their copyright trading agreement is to be reported to the National Copyright Administration for examination and registration. Customs collect taxes and let goods pass on the basis of a (brief) import and publishing permit signed and issued by the Administration of Press and Publications and stamped by the abovementioned controlling department (see attachment).
V, The import of audiovisual product specimen tapes used for reporting for inspection (limited to 3.81mm analogue cassette tapes, and common VHS or Betamax cassette tapes), does not require an audiovisual product import and publishing permit.
A uniformly printed “Foreign Literature and Art Audiovisual Programme Reporting and Inspection Specimen Tape Import Certificate” (see attachment) (summary) is used for imported audiovisual product specimen tapes. Audiovisual publishing work units subordinate to central ministries and commissions that import specimen tapes, obtain approval from the audiovisual controlling department determined in the previous Article; audiovisual publishing work unit in all localities importing specimen tapes obtain approval from provincial, autonomous region or municipal audiovisual controlling departments, Customs collect taxed and let goods pass on the basis of relevant approval documents. Specimen tapes that Customs has already let pass, but that cannot be used of publishing, will be preserved by the approving work unit.
VI, When the audiovisual products determined in this Notice are imported, Customs may conduct spot checks. Where prohibited content is discovered, Customs confiscates them or removes them from transportation; the Administration of Press and Publications, on the basis of circumstances, cancels already signed audiovisual product import permits.
VII, To apply for and obtain and audiovisual product import permit, audiovisual controlling department examination and approval documents and National Copyright Administration copyright inspection and registration certificates must be held. The content of the application includes the name of the imported audiovisual product, the copyright provider, the country (region) of origin, the medium form, the number of episodes, standards, port of arrival, foreign exchange sources, master tape format, master tape quantity, number of volumes, total value and other matters. Where the permit-issuing organ examines and verifies them, and they conform to provisions, it signs and issues and audiovisual product import and publishing permit.
A work unit applying to obtain an audiovisual product import and publishing permit must report matters truthfully, and may not report falsehoods. Where formalities or incomplete or administrative audiovisual publishing management rules are violated, signing and issuance is not granted.
VIII, Audiovisual product import and publishing permits have a period of validity of one year. When audiovisual products have not been imported within the period of validity, the period of validity of the permit shall be extended on the basis of the provisions in the contract. If the programme is changed, import approval formalities must be conducted again.
IX, Where import takes place without permits or audiovisual product import and publishing permits are forged, altered or transferred, Customs will deal with this according to relevant Customs procedures.
X, For audiovisual products that have already been examined and approved by audiovisual controlling departments before the issuance of this Notice, but have not yet been imported, Customs will collect taxes and let goods pass on the basis of supplementary permits issued after confirmation from the Administration of Press and Publications.
XI, This Notice takes effect on the date of promulgation, where past rules concerning the import and inspection of audiovisual products used for publishing conflict with this Notice, this Notice will apply.
