Notice concerning Firmly Curbing Secret Import and Screening of Foreign and Hong Kong, Taiwan and Macau Region Feature Films

All provincial, autonomous region, municipal and plan-listed city Party Committee propaganda departments, radio and television offices (bureaus) cultural offices (bureaus), the Guangdong Customs Division, all directly-subordinate Customs, the Shanghai Municipal Film Bureau:

In order to further strengthen uniform management over imported foreign films, and firmly put an end to the phenomenon of secret import and screening of foreign and Hong Kong, Taiwan and Macau Region feature films, all localities must strictly manage matters according to the provisions of the “Imported Film Management Rules” (No. (1981)GHZ156) approved by the State Council and the “Notice concerning Firmly Stopping Secret Import and Screening of Smuggled Films and Striking Hard Against Film Smuggling Activities” (GFYZ No. (1989)788) promulgated jointly by the Central Propaganda Department, the Ministry of Radio, Film and Television, the Ministry of Culture, the Ministry of Public Security, the State Administration of Radio, Film and Television and the General Administration of Customs. Hereby, the following matters aimed at a number of new situations and problems are notified as follows:

I, No controlling personnel of any region or department may exceed the scope provided in document No. (1981)GHZ156, and approve without authorization the import of foreign or Hong Kong, Taiwan or Macau region feature films.

II, All business falling under importing and distributing films or preview copies from abroad or the Hong Kong, Taiwan and Macau regions is to be conducted and managed by the China Film Distribution and Screening Company according to relevant regulations; everything falling under importing non-commercial documentary films is to be handled and managed by the China Film Documentary Centre according to relevant regulation. outside of this, no other department, work unit or foreign business may import or bring in foreign, Hong Kong, Taiwan and Macau region feature films in any way, offenders will be refused and returned without exception by customs.

III, The examination and approval powers for all localities nationwide organizing special academic performances documentary film and academic study activities lies with the Ministry of Radio, Film and Television, the Film Bureaus entrusts the China Film Documentary Centre with accepting applications, qualifications inspections and relevant matters for these activities. For films falling under internal academic studies, tickets may not be sold openly or film advertising produced. Films not stored by the Chinese Film Documentary Centre all prohibited from circulating into or being screened at special academic performances and academic study activities, as well as other scopes, offenders will be corrected and punished with document GFZY No. (1988)788 as basis.

IV, Films imported or smuggled in, in violation of regulations, are to be dealt with according to the provisions of document No. (1981)GHZ156 and document GFZY No. (1988)788.

V, A number of regions have already imported foreign and Hong Kong, Taiwan and Macau region feature films, after receiving this Notice, they shall immediately seal up these films, cease screening, and submit a catalogue of these films to the Ministry of Radio, Film and Television Film Bureau. The Film Bureau will respectively make a decision of transferring them to the China Film Documentary Centre or destroying them on the spot, on the basis of whether or not the films are worth preserving or have reference value. All expenses for films transferred to the China Film Documentary Centre (including films confiscated and turned over from all localities) are to be borne by the China Film Documentary Centre.

VI, Documentary films of the documentary film department subordinate to the Shanghai Film Bureau must be handled strictly according to the provisions of the “Notice concerning Printing and Issuing the “Report concerning the Issue of Coordinating the Relevant Cultural Management Structures in the Shanghai Cultural Development Strategy” (WTZ No. (1989)1636), Ministry of Radio, Film and Television Film Undertaking Management Bureau document no. (1990)DZ172 and no. (1990)DZ327.

This Notice shall be timely transmitted to all levels’ administrative propaganda and culture departments, all localities’ Customs and all relevant film work units.

各省、自治区、直辖市、计划单列市党委宣传部、广播电视厅(局)、文化厅(局),广东海关分署,各直属海关,上海市电影局:
为进一步加强对进口外国影片的统一管理,坚决杜绝私自引进和放映外国和台、港、澳地区故事影片的现象,各地必须按照国务院批准的《进口影片管理办法》((1981)国函字156号)和中宣部、广播电影电视部、文化部、公安部、国家工商行政管理局、海关总署联合颁发《关于坚决制止私自引进和放映走私影片严厉打击走私影片活动的通知》(广发影字(1989)788号)文件的规定严加管理。现针对一些新的情况和问题,通知如下:
一、任何地区和部门的主管人员,均不得超越(1981)国函字156号文件的规定范围,擅自批准进口外国及台、港、澳地区的故事影片。

二、凡属从外国及台、港、澳地区进口发行影片或试映拷贝的业务,统由中国电影发行放映公司按照有关规定经营管理;凡属非商业性的资料影片的进口,统由中国电影资料馆按照有关规定经办管理。除此之外,其他任何部门和单位及外商均不得以任何方式进口或带进外国及台、港、澳地区的故事影片,违者,海关一律予以退运。

三、全国各地举办资料影片学术专场和学术观摩活动的审批权在广播电影电视局,由电影局委托中国电影资料馆受理此项活动的申请、资格审查及有关事宜。属于内部学术观摩的影片不得在外公开售票或出示影讯广告。非中国电影资料馆馆藏影片均严禁进入学术专场和学术观摩及其他范围内流通放映,违者以广发影字围(1989)788文件为依据予以纠正、处理。

四、对违反规定进口的或走私进口的影片,均按照(1981)国函字156号文件和广发影字(1989)788号文件的规定处理。

五、部分地区已进口的外国及台、港、澳地区的故事影片,接到本通知后,应立即将影片封存停止放映,并将影片目录报送广播电影电视部电影局。电影局根据影片是否具有保留和参考价值,分别作出移交中国电影资料馆或就地销毁的决定。凡移交中国电影资料馆的影片(包括各地没收上交的影片)运费由中国电影资料馆承担。

六、上海电影局下设的电影资料部门的资料影片,要严格按照文化部《关于印发〈关于协调上海文化发展战略中有关文化管理体制问题的报告〉的通知》(文厅字(1986)1636号、广播电影电视部电影事业管理局(1990)电字第172号文和(1990)电字第327号文的规定办。
本通知应及时传达到各级宣传、文化行政部门,各地海关及各有关电影单位。
