National Copyright Administration Notice Concerning Implementing the “Convention for the Protection of Producers of Phonograms Against Unauthorized Duplication of Their Phonograms”

After the “Berne Convention” and the “World Copyright Treaty” took effect in our country on 15 October 1992 and 30 October 1002 respectively, the Seventh National People’s Congress Standing Committee has passed in its 28th meeting on 7 November 1992 a decision concerning accession of the People’s Republic of China to the “Convention for the Protection of Producers of Phonograms Against Unauthorized Duplication of Their Phonograms”. The letter of accession of our country with this treaty has been handed over to the United Nations Secretariat on 5 January 1993. This treaty will take effect in our country on 30 April 1993.

The “Convention for the Protection of Producers of Phonograms Against Unauthorized Duplication of Their Phonograms” (hereafter simply named “Phonograms Convention”) has been concluded in Geneva on 29 October 1971, by the end of 1992, 44 states were member. The main goal if this treaty is to protect the authors of audio works of the signatories, prevent duplication or open distribution without permission of the right holders of their audio works, preventing illegal duplication import or open distribution.

Article 39 of the “Copyright Law” of our country provides that “Audio and video authors enjoy the rights to permit duplication and distribution, and to receive remuneration, over their audio and video works”. From the day the “Phonograms Convention” takes effect in our country, the abovementioned provisions shall apply to audio work authors in signatory states of this treaty. Simultaneously, our country’s audio work authors’ corresponding rights shall receive protection in signatory states of this treaty.

The term of protection of the rights enjoyed by foreign audio work authors according to the “Phonograms Treaty” shall be determined based on the principle of reciprocity.

各省、自治区、直辖市版权局,中央各有关部门、各有关团体,中华版权代理总公司、中国音乐著作权协会:
继《伯尔尼公约》和《世界版权公约》分别于1992年10月15日和10月30日在我国生效后,第七届全国人民代表大会常务委员会第28次会议于1992年11月7日通过了关于中华人民共和国加入《保护录音制品制作者防止未经许可复制其录音制品公约》的决定。我国加入该项公约的加入书已于19 93年1月5日交联合国秘书长。该项公约将于1993年4月30日在我国生效。
《保护录音制品制作者防止未经许可复制其录音制品公约》(以下简称《录音公约》)于1971年10月29日在日内瓦签订,截至1992年底,参加的有44个国家。该公约的主要目的是保护缔约国的录音制品制作者,防止未经权利人的许可而复制或公开发行其录音制品,防止非法复制品进口或公开发行。
我国《著作权法》第三十九条规定“录音录像制作者对其制作的录音录像制品,享有许可他人复制发行并获得报酬的权利”。从《录音公约》在我国生效之日起,上述规定将适用于该公约缔约国的录音制作者。与此同时,我国的录音制作者的相应权利也将在该公约的其他缔约国得到保护。
对于外国录音制作者根据《录音公约》可享有的权利的保护期,将依据对等原则确定。
