Audiovisual Products Management Regulations

(Promulgated by the State Council Decree no. 165 on 25 August 1994, taking effect on 1 October 1994)

Chapter 1: General provisions

Article 1: In order to strengthen audiovisual products management, promote the healthy development and flourishing of enterprises engaged in the manufacture of audiovisual products, enrich the masses’ cultural life and stimulate the construction of socialist material civilization and spiritual civilization, these Regulations are formulated.

Article 2: These Regulations shall apply to management of publication, reproduction, importation, wholesale, retail, and rental of audiovisual products such as audio tapes, video tapes, records, compact discs and laser discs on which contents are recorded and for-profit projection of video works (hereafter simply named projection).

Article 3: People engaged in business activities involving audiovisual products shall observe the Constitution and relevant laws and regulations, adhere to the orientation of serving the people and serving socialism and disseminate ideas, morals and scientific, technical and cultural knowledge beneficial to economic development and social progress.

Dealing in audiovisual products with the following content is prohibited:

(1) content that endangers the unity and territorial integrity of the nation and sovereignty of the State;

(2) content that incites the division of the ethnicities and undermines national solidarity;

(3) content that divulges State secrets;

(4) content that propagates obscenity and superstition or glorifies violence;

(5) content that slanders or insults others;

(6) other content of which the publication and dissemination are prohibited by State provisions.

Article 4: The State implements management at different work units and different levels for audiovisual products.

The State Council administrative press and publications work unit oversees publication, reproduction and importation of audiovisual products in the entire country; the State Council administrative cultural affairs work unit and radio, film and television work unit jointly set up an examination organ for the contents of audiovisual products (referred to below as the examining organ) to oversee the examination of audiovisual products ocntent in the entire country; the State Council administrative cultural affairs work unit shall oversee the wholesale, retail, rental and projection of audiovisual products in the entire country.

Other relevant State Council administrative entities shall, in accordance with the division of duties prescribed by the State Council, assist the work units listed above in the administration of audiovisual products.

The job division of all County-level and higher local People’s Governments’ relevant work units for audiovisual product management work. shall be determined by the provincial People’s Government.

The higher-level competent administrative entity and the controlling work unit of an work unit dealing in audiovisual products shall supervise the business activities of the subordinate work unit dealing in audiovisual products in accordance with relevant State provisions.

Article 5: The State shall enforce a licence system for publication, reproduction, importation, wholesale, retail, rental and projection of audiovisual products.

Article 6: The higher-level competent administrative entities of work units dealing in audiovisual products shall practise the rule of separating the functions of an enterprise from those of a government work unit and may not deal in audiovisual products, and also may not participate in the business activities of their subordinate work units dealing in audiovisual products.

Chapter 2: Publication

Article 7: The State Council administrative press and publications entityshall be responsible for formulating a development program concerning the publication of audiovisual products and determining the total number, distribution and structure of publishing work units for audiovisual products in the entire country.

Article 8:  In order to establish an audiovisual publishing work unit, the following conditions should be met:

(1) conform to the development program for the publication of audiovisual products;

(2) have articles of association conforming to the provisions of these Regulations;

(3) have a well-defined scope of business;

(4) have an organization adapted to the needs of its scope of business and a staff of professionals in the publication of audiovisual products who conform to the prescribed qualification requirements;

(5) have the necessary funds and equipment together with regular production premises.

Article 9: For establishment of an work unit for the publishing of audiovisual products, an application shall be submitted by the higher administrative entity responsible for the applicant work unit to the provincial, autonomous or municipal People’s Government administrative audiovisual products management entity where the applicant work unit is located for examination and, after obtaining agreement of the provincial, autonomous region or municipal People’s Government, the provincial, autonomous or municipal People’s Government administrative audiovisual products management entity shall submit the application to the State Council administrative press and publications entityfor examination and approval. The State Council administrative press and publications entity shall, within 90 days from the date of receipt of the application, make a decision on  approving or not approving the application.

The application shall state clearly the following content:

(1) the name and address of the audiovisual product publishing work unit and the economic sector to which it belongs;

(2) the name and addresse of the higher administrative entity responsible for, and the controlling work unit of, the audiovisual product publishing work unit and the economic sector to which the controlling work unit belongs

(3) the names, addresses and qualification certifying documents of the principal responsible persons or legal representatives of the audiovisual product publishing work unit;

(4) the source and amount of funds of the audiovisual product publishing work unit.

Article 10: After the State Council administrative press and publications entityhas approved the application for establishment of the audiovisual product publishing work unit and issued the work unit with a “Audiovisual Products Publishing Business Permit”, the applicant work unit shall take the “Audiovisual Products Publishing Business Permit” to the administrative industry and commerce authority of the place where the work unit is located for registration within 60 days.

On the basis of the “Audiovisual Products Publishing Business Permit” issued by the State Council administrative press and publications entity and relevant regulations concerning industry and commerce management, the administrative industry and commerce authority shall issue a business licence.

Article 11: Where an audiovisual product publishing work unit changes its name, its relation of subordination or its business scope, it shall conduct examination, approval and reregistration in accordance with the provisions of Article 9 and 10 of these Regulations.

Where an audiovisual product publishing work unit changes its address, principal responsible persons or legal representatives, it shall conduct registration altering formalities at the initial organ of issuance of the Permit.

Where an audiovisual product publishing work unit terminates its publishing operations and dealings, it shall conduct cancellation of registration formalities at the initial organ of issuance of the Permit within 30 days from the date of cessation of its business activities.

Article 12: Published audiovisual products shall in a clear location on the audiovisual product and its packaging display data such as the name, address and publishing number of the publishing work unit, the number of the Audiovisual Products Distribution Licence, the year of publication and the name of the copyright owner.

The audiovisual product publishing work unit shall, within 30 days from the date of publication of the audiovisual product, present a specimen to the State Publication Library.

Article 13: An audiovisual product publishing work unit may not transfer, rent or sell its name or publishing number to any work unit or individual.

Article 14: No work unit or individual may purchase or forge the name or publishing number of an audiovisual product publishing work unit or engage in illegal publishing of audiovisual products.

Article 15: Specific procedures for cooperative production of audiovisual products between an audiovisual product publishing work unit and an organization or individual from the region of Hong Kong, Macao or Taiwan or a foreign country, shall be formulated by the State Council administrative press and publications entity jointly with the State Council administrative cultural affairs entity and the administrative radio, film and television entity.

Matters concerning copyright in a contract of cooperative production of audiovisual products have to be registered with the State Council administrative copyright entity.

Article 16: Book-publishing work units may not publish audiovisual products not supplementing books published by that publisher. Where a book-publishing work unit engages in publishing operations of audiovisual products supplementing books published by that publisher, it shall conduct examination and approval  formalities in accordance with the provisions of Article 9 of these Regulations.

Article 17: An audiovisual product publishing work unit shall publish audiovisual products in accordance with the approved list of selected titles. The administrative procedures regarding lists of selected titles shall be formulated by the State Council administrative press and publications entity.

Article 18:  Content of the audiovisual products published by an audiovisual product publishing work unit (including audiovisual products produced by the work unit in cooperation with an organization or individual in the Hong Kong, Macao or Taiwan regions or in a foreign country) shall be examined and approved in accordance with the provision of the audiovisual product content examination organ, which will then issue a “Audiovisual Products Distribution Permit”, only then can these be reproduced or sold wholesale or retail.

Administrative procedures regarding a “Audiovisual Products Distribution Permit” shall be formulated by the State Council administrative press and publications entity jointly with the State Council administrative cultural affairs entity and the State Council administrative radio, film and television.

Chapter 3: Reproduction

Article 19: The State Council administrative press and publications entity shall, in accordance with audiovisual product publishing development planning, determine the total number, distribution and structure of reproduction work units for audiovisual products in the entire country.

Article 20: In order to establish an audiovisual reproduction work unit, the following conditions should be met:

(1) conform to the development program for audiovisual undertakings;

(2) have a well-defined scope of business;

(3) have an organization adapted to the needs of its scope of business;

(4) have the necessary funds, equipment and reproduction premises.

Article 21: Applications for the establishment of an audiovisual reproduction work unit, shall be submitted to the higher-level administrative entity responsible for the applicant work unit to the provincial, autonomous region or municipal People’s Government administrative audiovisual products entity where the applicant work unit is located for examination and, after obtaining agreement of the provincial, autonomous region or municipal People’s Government, the provincial, autonomous or municipal People’s Government administrative audiovisual products management entity shall submit the application to the State Council administrative press and publications entity for examination and approval. The State Council administrative press and publications entity shall make a decision within 90 days from the date of receipt of the application.

The application shall state clearly the following content:

(1) the name and address of the audiovisual reproduction work unit and the economic sector to which it belongs;

(2) the names and addresses of the higher administrative entity responsible for, and the controlling work unit of, the audiovisual reproduction work unit and the economic sector to which the controlling work unit belongs;

(3) the names, addresses and qualification certifying documents of the principal responsible persons or legal representatives of the audiovisual reproduction work unit;

(4) the source and amount of the funds of the audiovisual reproduction work unit.

Article 22: After the State Council administrative press and publications entity has approved the application for the establishment of the audiovisual reproduction work unit and issued the applicant work unit with a “Audiovisual Products Reproduction and Dealing Permit”, the applicant work unit shall take the Licence to the local administrative authority for industry and commerce for registration within 60: days.

On the basis of the “Audiovisual Products Reproduction and Dealing Permit” issued by the State Council administrative press and publications entity and of the relevant provisions concerning industry and commerce management, the administrative industry and commerce authority shall issue the applicant work unit with a business licence.

Article 23: Where an audiovisual reproduction work unit changes its name, its relation of subordination or its business scope, it shall conduct examination, approval and reregistration formalities in accordance with the provisions of Articles 21 and 22 of these Regulations.

Where a audiovisual products reproduction work units changes its address, principal responsible persons or legal representatives, it conduct registration altering registration at the initial organ of issuance of the Permit.

Where a audiovisual products reproduction work units terminates its reproduction operations and dealings, it shall conduct registration cancellation formalities at the initial organ of issuance of the Permit within 30 days from the date of cessation of its operations.

Article 24: An audiovisual product publishing work unit may entrust an audiovisual products reproduction work unit approved by the State with the reproducing of audiovisual products. However, it may not entrust the audiovisual products reproduction work units with the editing of audiovisual products.

Article 25: An audiovisual products reproduction work units shall reproduce audiovisual products based on the certificate of entrustment drawn up by a audiovisual products publishing work unit. When accepting an order, the reproduction work unit shall require the entrusting work unit to provide relevant certifying documents.

Certifying documents mentioned in the section above include a copy each of the “Audiovisual Products Publishing Business Permit” and the business licence of the entrusting work unit, a certificate of entrustment with the signature or seal of the principal responsible person or legal representative affixed, the “Audiovisual Products Distribution Permit”, and the written authorization of the copyright owner.

Audiovisual products reproduction work units shall conclude with the entrusting work unit a contract in which the entrusting work unit shall entrust it with the reproduction, and it shall reproduce audiovisual products according to the stipulations in the contract.

Audiovisual products reproduction work units shall preserve samples of the audiovisual products it reproduces and the relevant certifying documents.

Audiovisual products reproduction work units may not accept an order to produce profit-making audiovisual products from a work unit or individual other than an audiovisual products publishing work unit. Audiovisual products reproduction work units may not reproduce and sell audiovisual products, wholesale or retail, of its own accord.

Article 26: Where a audiovisual products reproduction work unit accepts master tapes and moulds provided from abroad to reproduce audiovisual products, it shall submit the master tapes and moulds to the administrative entity for audiovisual products at the provincial level for content examination, and shall submit the letter of authorization of the copyright owner to the administrative copyright entity affairs for registration. The audiovisual products reproduced shall all be sold abroad.

Chapter 4: Import

Article 27: The audiovisual products content examination organ shall be responsible for examining imported audiovisual products content. After they are examined and found to be satisfactory, the administrative cultural affairs entity and the State Council administrative radio, film and television entity shall each according to its responsibility issue a “Audiovisual Products Distribution Permit” and report the matter to the State Council administrative press and publications entity for filing, only then may the imported audiovisual products be reproduced and sold wholesale or retail.

Article 28:  Where audiovisual products used for reproduction are imported, the relevant copyright matters have to be submitted to the State Council administrative copyright entity for registration.

Audiovisual products imported for reference in research or teaching shall not be used for profit-making reproduction, wholesale, retail, rental and projection.

Chapter 5: Wholesale, retail, rental and projection

Article 29: An work unit applying for engaging in master wholesale operations in audiovisual products shall file an application with the administrative entity for audiovisual products in the Provincial, autonomous region or municipal People’s Government where the work unit is located. After the application is examined and agreed to, it shall be submitted by the said examining work unit to the State Council administrative cultural affairs entity for examination and approval. After the application has been approved and the work unit has obtained a “Audiovisual Product Wholesale Business Permit”, the work unit shall take the Licence to the administrative entity for industry and commerce in the Provincial, autonomous region or municipal People’s Government where the work unit is located for registration and take out a business licence.

An work unit applying for engaging in wholesale operations in audiovisual products shall file an application with the provincial, autonomous region or municipal People’s Government administrative entity for audiovisual products where the work unit is located for examination and approval. After the application has been approved and the work unit has obtained a “Audiovisual Product Wholesale Business Permit”, the work unit shall take the Permit to the administrative entity for industry and commerce in the Provincial, autonomous region or municipal People’s Government where the work unit is located for registration and take out a business licence.

An work unit applying for engaging in audiovisual products retail or rental operation shall file an application with the county level People’s Government administrative entity for audiovisual products in the in the place where the work unit is located for examination and approval. After the application has been approved and the work unit has obtained a “Audiovisual Product Retail Business Permit” or a “Audiovisual Product Rental Business Permit”, the work unit shall submit the Permit to the administrative entity for industry and commerce in the place where the work unit is located for registration and take out a business licence.

A work unit applying for engaging in projection operations of audiovisual products shall file an application with the administrative entity for audiovisual products in the provincial, autonomous region or municipal People’s Government where the work unit is located for examination and approval. After the application has been approved and the work unit has obtained a “Audiovisual Product Projection Business Permit”, the work unit shall take the Licence to the administrative entity for industry and commerce in the place where the work unit is located for registration and take out a business licence.

No work unit or individual may engage in operations such as wholesale, retail, rental and projection, etc., of audiovisual products without having obtained an operating permit and a business licence.

Article 30: An audiovisual product publishing work unit may sell audiovisual products published by itself in accordance with relevant State regulations. Where it intends to engage in sales operations in audiovisual products not published by itself, it shall go through the formalities of examination and approval in accordance with the provisions of Article 29: of these Regulations.

Article 31: An audiovisual product reproduction work unit may not engage in audiovisual products sales operations.

Article 32: Work units engaging in audiovisual products wholesale, retail, rental and projection operations may not deal in audiovisual products for which no “Audiovisual Products Distribution Permit” has been obtained, they may also not deal in audiovisual products infringing others’ copyright.

Audiovisual products for exclusive home use may not be used for profit-making projection.

Article 33: All county-level and higher People’s Governments administrative entities for audiovisual products have the power to supervise and inspect audiovisual wholesale, retail, rental and projection activities within their respective administrative divisions and to investigate and deal with acts of illegal wholesale, retail, rental and projection of audiovisual products.

Chapter 6: Punishment Provisions

Article 34: Where these Regulations are violated, and one of the following activities is present, a warning shall be issued, and cessation of the publishing or sale of audiovisual products, confiscation and destruction of unlawful audiovisual products, confiscation of illegal gains, revocation of the audiovisual publishing or duplication business permit, may be ordered, and a fine of five times or more, but not exceeding ten times the amount of unlawful gains may be imposed by the State Council administrative press and publication entity or the county-level or higher local People’s Government administrative audiovisual products organ:

(1) where an audiovisual product publishing work unit transfers, rents out or sells its own name or publishing number to another work unit or individual;

(2) where a book publishing work unit publishes audiovisual products not supplementing published by itself or publishes audiovisual products supplementing books published by itself without obtaining approval;

(3) where an work unit other than an audiovisual product publishing work unit publishes audiovisual products;

(4) where an audiovisual publishing work unit publishes audiovisual products for which no “Audiovisual Products Distribution Permit” has been obtained;

(5) where an work unit other than an audiovisual reproduction work unit reproduces audiovisual products;

(6) where an audiovisual reproduction work unit reproduces audiovisual products without entrustment or reproduces audiovisual products for which no “Audiovisual Products Distribution Permit” has been obtained;

(7) where audiovisual products are made in cooperation with organizations or individuals in Hong Kong, Macao or Taiwan or in foreign countries without approval having been obtained;

(8) where audiovisual products are imported without having been approved;

(9) where audiovisual products with contents banned by Article 3(2) of these Regulations are published or reproduced.

The administrative punishment of revoking an audiovisual products publishing or duplication business permit has to be approved by the State Council administrative press and publications entity.

Where an act specified in Section 1 of this Article is present, and constitutes a crime, criminal liability shall be prosecuted according to law.

Article 35: Where these Regulations are violated, and one of the following activities is present, a warning shall be issued, and cessation of distribution, retail, renting, projection, confiscation and destruction of unlawful audiovisual products, confiscation of illegal gains, revocation of the audiovisual products distribution, retail, rental or projection business permit, may be ordered, and a fine of five times or more, but not exceeding ten times the amount of unlawful gains may be imposed by the State Council administrative press and publication entity or the county-level or higher local People’s Government administrative audiovisual products organ

(1) where audiovisual products are sold wholesale or retail, rented or projected without an business licence having been obtained;

(2) where audiovisual products for which no “Audiovisual Products Distribution Permit” has been obtained are sold by wholesale or retail, rented or projected;

(3) where audiovisual products published or reproduced by work units other than approved publishing or reproducing work units are sold by wholesale or retail, rented or projected;

(4) where informational audiovisual products for research, teaching and studying reference are sold by wholesale or retail, rented or projected;

(5) where audiovisual products with contents banned by Article 3(2) of these Regulations are sold by wholesale or retail, rented or projected.

The administrative punishment of revoking a wholesale, retail, rental or projection business permit has to be approved by the initial organ of issuance of the permit.

Where an act specified in Section 1 of this Article is present, and constitutes a crime, criminal liability shall be prosecuted according to law.

Article 36: Publication, reproduction, import, sale, rental or projection of audiovisual products, infringing the copyright of others, shall be punished by the administrative copyright entity according to the relevant provisions of the “Copyright Law of the People’s Republic of China”; where the act constitutes a crime, criminal liability shall be prosecuted according to law.

Article 37: Activities violating State laws and regulations concerning the management of industry and commerce shall be punished administratively by the administrative entity for industry and commerce according to the provisions of relevant laws and regulations.

Activities violating security administration shall be punished administratively by the public security organ according to the relevant provisions of the “Security Administration Punishment Law of the People’s Republic of China”.

Article 38:  Where a party disagrees with the decision on administrative punishment, he may apply for administrative redress in accordance with the provisions of the “Administrative Redress Regulations”; where the party is not satisfied with the redress decision, he may institute proceedings in the People’s Court in accordance with the provisions of the “Administrative Procedure Law of the People’s Republic of China”. Where the party does not apply for reconsideration or institute proceedings in the People’s Court within the time limit, and also does not comply with the punishment decision, the organ imposing the punishment may apply to the People’s Court for enforcement.

Chapter 7: Supplementary Provisions

Article 39: Audiovisual product publishing, reproduction, wholesale, retail, rental and projection work units established before the coming into effect of these Regulations shall, within 180 days from the date on which these Regulations came into effect, again conduct examination and registration formalities in accordance with the relevant provisions of these Regulations.

Work units engaging in audiovisual products publication, reproduction, wholesale, retail, rental and projection shall, beginning from the date on which these Regulations came into effect, conduct examination and registration.

Article 40: These Regulations shall take effect on 1 October 1994. The “Provisional Audio and Video Product Management Regulations” published by the former Ministry of Radio and Television with the approval of the State Council shall simultaneously be abolished.

音像制品管理条例

(1994年8月25日国务院令第165号发布,自1994年10月1日起施行)

第一章 总则

第一条 为了加强音像制品的管理,促进音像事业的健康发展和繁荣,丰富人民群众文化生活,推进社会主义物质文明和精神文明建设,制定本条例。

第二条 本条例适用于录有内容的录音带、录像带、唱片、激光唱盘和激光视盘等音像制品的出版、复制、进口、批发、零售、出租和经营性录像放映(以下简称放映)的管理。

第三条 音像制品的经营活动应当遵守宪法和有关法律、法规,坚持为人民服务和为社会主义服务的方向,传播有益于经济发展和社会进步的思想、道德、科学技术和文化知识。

禁止经营有下列内容的音像制品:

(一)危害国家统一、主权和领土完整的;

(二)煽动民族分裂,破坏民族团结的;

(三)泄露国家秘密的;

(四)宣扬淫秽、迷信或者渲染暴力的;

(五)诽谤、侮辱他人的;

(六)国家规定禁止出版、传播的其他内容。

第四条 国家对音像制品实行分部门、分级管理。

国务院新闻出版行政部门主管全国音像制品的出版、复制和进口工作;国务院文化行政部门和广播电影电视行政部门共同组成音像制品内容审核机构(以下简称音像制品内容审核机构)主管全国音像制品内容的审核工作;国务院文化行政部门主管全国音像制品的批发、零售、出租和放映工作。

国务院其他有关行政部门按照国务院规定的职责分工,协助前款所列部门负责有关音像制品的管理工作。

县级以上地方各级人民政府有关部门在音像制品行政管理工作上的分工,由省级人民政府确定。

音像制品经营单位的上级行政主管部门和主办单位应当依照国家的有关规定,对所属音像制品经营单位的经营活动进行监督。

第五条 国家对出版、复制、进口、批发、零售、出租和放映音像制品,实行许可证制度。

第六条 音像制品经营单位的上级行政主管部门应当实行政企分开,不得从事音像制品的经营活动,不得参与所属音像制品经营单位的经营活动。

第二章 出版

第七条 国务院新闻出版行政部门负责制定音像出版事业的发展规划,确定全国音像出版单位的总量、布局和结构。

第八条 设立音像出版单位,应当具备下列条件:

(一)符合音像出版事业的发展规划;

(二)有符合本条例规定的章程;

(三)有确定的业务范围;

(四)有适应业务范围需要的组织机构和符合规定资格条件的音像出版专业人员;

(五)有必要的资金、设备和固定的制作场所。

第九条 申请设立音像出版单位,由申请单位的上级行政主管部门报所在地省、自治区、直辖市人民政府音像制品行政管理部门审核并经省、自治区、直辖市人民政府同意后,由省、自治区、直辖市人民政府音像制品行政管理部门报国务院新闻出版行政部门审批,国务院新闻出版行政部门应当自收到申请书之日起90日内作出批准或者不批准的决定。

申请书应当载明下列内容:

(一)音像出版单位的名称、地址和经济性质;

(二)音像出版单位的上级行政主管部门、主办单位的名称、地址和经济性质;(三)音像出版单位的主要负责人或者法定代表人姓名、住址、资格证明文件;(四)音像出版单位的资金来源及其数额。

第十条 设立音像出版单位的申请经国务院新闻出版行政部门批准并发给《音像制品出版经营许可证》后,申请单位应当在60日内持《音像制品出版经营许可证》到所在地工商行政管理部门登记。

工商行政管理部门根据国务院新闻出版行政部门发给的《音像制品出版经营许可证》和工商行政管理的有关规定,发给营业执照。

第十一条 音像出版单位改变名称、隶属关系、业务范围的,应当依照本条例第九条、第十条的规定重新办理审批登记手续。

音像出版单位改变地址、主要负责人或者法定代表人的,应当到原发证机关办理变更登记手续。音像出版单位终止出版经营活动的,应当自停止经营活动之日起30日内到原发证机关办理注销登记手续。

第十二条 出版音像制品应当在音像制品及其包装的明显位置,标明出版单位的名称、地址和版号、发行许可证号、出版时间、著作权人姓名等事项。

音像出版单位应当自音像制品出版之日起30日内向国家版本图书馆缴送样品。

第十三条 音像出版单位不得向任何单位或者个人转让、出租、出售本单位的名称或者版号。

第十四条 任何单位和个人不得购买、伪造音像出版单位的名称或者版号,不得从事非法音像制品出版活动。

第十五条 音像出版单位与香港、澳门、台湾地区或者外国的组织、个人合作制作音像制品的具体办法,由国务院新闻出版行政部门会同国务院文化行政部门、广播电影电视行政部门制定。

音像制品合作制作合同中有关著作权事项,须向国务院著作权行政管理部门登记。

第十六条 图书出版单位不得出版非配合本版图书的音像制品。图书出版单位从事配合本版图书出版音像制品业务的,应当依照本条例第九条的规定,办理审批手续。

第十七条 音像出版单位应当根据批准的选题计划出版音像制品。选题计划的管理办法,由国务院新闻出版行政部门制定。

第十八条 音像出版单位出版的音像制品(包括音像出版单位与香港、澳门、台湾地区或者外国的组织、个人合作制作的音像制品)的内容,应当依照音像制品内容审核机构的规定,经审核并取得《音像制品发行许可证》后,方可复制、批发、零售。

《音像制品发行许可证》的管理办法,由国务院新闻出版行政部门会同国务院文化行政部门和广播电影电视行政部门制定。

第三章 复制

第十九条 国务院新闻出版行政部门,应当按照音像出版事业的发展规划,确定全国音像复制单位的总量、布局和结构。

第二十条 设立音像复制单位应当具备下列条件:

(一) 符合音像事业发展规划;

(二) 有明确的业务范围;

(三) 有适应业务范围需要的组织机构;

(四) 有必需的资金、设备和复制场所。

第二十一条 申请设立音像复制单位,由申请单位的上级行政主管部门上报所在地省、自治区、直辖市人民政府音像制品行政管理部门审核并经省、自治区、直辖市人民政府同意后,由省、自治区、直辖市人民政府音像制品行政管理部门报国务院新闻出版行政部门审批。国务院新闻出版行政部门应当自收到申请书之日起90日内作出决定。

申请书应当载明下列内容:

(一)音像复制单位的名称、地址和经济性质;

(二)音像复制单位的上级行政主管部门、主办单位的名称、地址和经济性质;

(三)音像复制单位的主要负责人或者法定代表人的姓名、住址、资格证明文件;

(四)音像复制单位的资金来源及其数额。

第二十二条 设立音像复制单位的申请经国务院新闻出版行政部门批准并发给《音像制品复制经营许可证》后,申请单位应当在60日内持《音像制品复制经营许可证》到所在地工商行政管理部门登记。

工商行政管理部门根据国务院新闻出版行政部门发给的《音像制品复制经营许可证》和工商行政管理的有关规定,发给营业执照。

第二十三条 音像复制单位改变名称、隶属关系、业务范围的,应当依照本条例第二十一条、第二十二条的规定重新办理审批登记手续。

音像复制单位改变地址、主要负责人或者法定代表人的,应当到原发证机关办理变更登记手续。

音像复制单位终止复制经营活动的,应当自停止经营活动之日起30日内到原发证机关办理注销登记手续。

第二十四条 音像出版单位可以委托国家批准的音像复制单位复制音像制品;但是,不得委托音像复制单位从事音像制品的编审工作。

第二十五条 音像复制单位凭音像出版单位的委托书复制音像制品。音像复制单位接受委托时,应当要求委托单位提交有关证明文件。

前款所称证明文件包括:委托单位的《音像制品出版经营许可证》和营业执照副本、委托单位主要负责人或者法定代表人签字或者盖章的委托书、《音像制品发行许可证》以及著作权人的授权书。

音像复制单位应当与委托单位签订复制委托合同,并按照合同的约定复制音像制品。

音像复制单位应当保存所复制的音像制品的样本和有关证明文件。

音像复制单位不得接受非音像出版单位和个人的委托,复制经营性的音像制品。音像复制单位不得自行复制、批发、零售音像制品。

第二十六条 音像复制单位接受境外提供母带、模版复制音像制品,应当将母带、模版报送省级音像制品行政管理部门审核其内容,并持著作权人的授权书到著作权行政管理部门登记,复制的音像制品应当全部返销。

第四章 进口

第二十七条 进口音像制品的内容, 由音像制品内容审核机构负责审核;经审核合格的,由国务院文化行政部门和广播电影电视行政部门按照各自的职责分工分别发给《音像制品发行许可证》并报国务院新闻出版行政部门备案,方可复制、批发、零售。

第二十八条 进口用于复制的音像制品,其有关著作权事项须向国务院著作权行政管理部门登记。

进口供研究、教学参考的音像制品,不得进行经营性复制、批发、零售、出租和放映。

第五章 批发、零售、出租和放映

第二十九条 申请从事音像制品总批发业务的单位,应当由所在地省、自治区、直辖市人民政府音像制品行政管理部门审核同意后,报国务院文化行政部门审批;经批准并取得《音像制品批发经营许可证》后,持许可证到所在地省、自治区、直辖市人民政府工商行政管理部门登记,领取营业执照。

申请从事音像制品批发业务的单位,应当报所在地省、自治区、直辖市人民政府音像制品行政管理部门审批;经批准并取得《音像制品批发经营许可证》后,持许可证到所在地工商行政管理部门登记,领取营业执照。

申请从事音像制品零售、出租业务的单位,应当报所在地县级人民政府音像制品行政管理部门审批;经批准并取得《音像制品零售经营许可证》或者《音像制品出租经营许可证》后,持许可证到所在地工商行政管理部门登记,领取营业执照。

申请从事音像制品放映业务的单位,应当报所在地省、自治区、直辖市人民政府音像制品行政管理部门审批;经批准并取得《音像制品放映经营许可证》后,持许可证到所在地工商行政管理部门登记,领取营业执照。

任何单位和个人未取得经营许可证和营业执照的,不得从事音像制品批发、零售、出租和放映等经营活动。

第三十条 音像出版单位可以按照国家有关规定销售本单位出版的音像制品。从事非本单位出版的音像制品销售业务的,应当依照本条例第二十九条的规定办理审批手续。

第三十一条 音像复制单位不得从事音像制品销售业务。第三十二条 从事音像制品批发、零售、出租和放映经营活动的单位,不得经营未取得《音像制品发行许可证》的音像制品,不得经营侵犯他人著作权的音像制品。

家庭专用的音像制品,不得用于营业性放映。

第三十三条 县级以上地方各级人民政府音像制品行政管理部门,有权监督、检查本行政区域内音像制品的批发、零售、出租和放映活动,查处非法批发、零售、出租和放映音像制品的行为。

第六章 罚则

第三十四条 违反本条例,有下列行为之一的由国务院新闻出版行政部门或者县级以上地方人民政府音像制品行政管理部门根据情节轻重,给予警告,责令停止出版、复制、销售音像制品,没收并销毁违法音像制品,没收违法所得,吊销音像制品出版、复制经营许可证,可以并处违法所得5倍以上10倍以下的罚款:

(一)音像出版单位向其他单位或者个人转让、出租、出售本单位的名称或者版号的;

(二)图书出版单位出版非配合本版图书的音像制品和未经批准出版配合本版图书的音像制品的;

(三)非音像出版单位出版音像制品的;

(四)音像出版单位出版未取得音像制品发行许可证的音像制品的;

(五)非音像复制单位复制音像制品的;

(六)音像复制单位未受委托擅自复制音像制品或者复制未取得音像制品发行许可证的音像制品的;

(七)未经批准擅自与香港、澳门、台湾地区或者外国的组织、个人合作制作音像制品的;

(八)未经批准擅自进口音像制品的;

(九)出版、复制有本条例第三条第二款规定禁止的内容的音像制品的。

吊销音像制品出版、复制经营许可证的行政处罚,需经国务院新闻出版行政部门批准。

有本条第一款所列行为,构成犯罪的,依法追究刑事责任。

第三十五条 违反本条例,有下列行为之一的,由国务院文化行政部门或者县级以上地方人民政府音像制品行政管理部门根据情节轻重,给予警告,责令停止批发、零售、出租、放映,没收并销毁违法音像制品,没收违法所得,吊销音像制品的批发、零售、出租、放映经营许可证,可以并处违法所得5倍以上10倍以下的罚款:(一) 未取得经营许可证擅自批发、零售、出租和放映音像制品的;

(二) 批发、零售、出租和放映未取得音像制品发行许可证的音像制品的;

(三) 批发、零售、出租和放映非音像制品出版、复制单位出版、复制的音像制品的;

(四) 批发、零售、出租和放映供研究、教学参考的资料性音像制品的;

(五) 批发、零售、出租和放映有本条例第三条第二款规定禁止的内容的音像制品的。

吊销批发、零售、出租、放映经营许可证的行政处罚,需经原发证机关批准。有本条第一款所列行为,构成犯罪的,依法追究刑事责任。

第三十六条 出版、复制、进口、销售、出租和放映音像制品侵犯他人著作权的,由著作权行政管理部门依照《中华人民共和国著作权法》的有关规定给予处罚;构成犯罪的,依法追究刑事责任。

第三十七条 违反国家有关工商行政管理的法律、法规的行为,由工商行政管理部门依照有关法律、法规的规定给予行政处罚。

违反治安管理的行为,由公安机关依照《中华人民共和国治安管理处罚条例》的规定给予行政处罚。

第三十八条 当事人对行政处罚决定不服的,可以依照《行政复议条例》的规定申请复议;对复议决定不服的,可以依照《中华人民共和国行政诉讼法》的规定,向人民法院提起诉讼,当事人逾期不申请复议、不向人民法院提起诉讼又不履行处罚决定的,作出处罚的机关可以申请人民法院强制执行。

第七章 附则

第三十九条 本条例施行前设立的音像制品出版、复制、批发、零售、出租和放映的单位,应当自本条例施行之日起180日内,依照本条例的有关规定重新办理审核登记手续。

音像制品出版、复制、批发、零售、出租和放映的单位自本条例施行之日起,每2年履行一次审核登记手续。

第四十条 本条例自1994年10月1日起施行。1982年12月23日经国务院批准原广播电视部发布的《录音录像制品管理暂行规定》同时废止。
