Article 1: In order to stimulate Sino-foreign cultural exchange, make television drama (video) production flourish, strengthen Sino-foreign coproduced television drama (video) management, protect the lawful rights and interests of producers, according to the relevant laws and regulations of our Country, these Regulations are formulated.
Article 2: Sino-foreign television drama video coproduction as named in these Regulations, refers to activities wherein a domestic film and television programme production organ and audiovisual publishing work unit (hereafter simply named Chinese side) and a foreign legal person or natural person (hereafter simply named foreign side), within the borders produce television dramas (videos) in manners such as joint production, cooperative production, entrusted production, etc. “Television drama ” as named in these Regulations refers to story-type television programmes produced using electronic recording means; “video” refers to story-type recorded programmes produced by audiovisual publishing work units for publication, distribution, screening or broadcast.
Article 3: The Ministry of Radio, Film and Television is responsible for Sino-foreign television drama (video) co-production management work nationwide. Provincial-level administrative radio and television entities are responsible for concrete Sino-foreign television drama (video) co-production management work in their administrative areas.
Article 4: Sino-foreign television drama (video) co-production shall abide by the People’s Republic of China’s Constitution, laws, regulations and relevant provisions.
Article 5: Joint production refers to the television drama (video) production method of the Chinese party and the foreign party jointly investing, together arranging creative personnel, mutually share profits and mutually undertake risk. Its conditions are as follows: (1) both parties invest jointly, including direct monetary investment, or investing through price reduction of labour, objects, advertising time, etc.; (2) the script is jointly determined; (3) creative personnel, technical personnel engaging in the complete shooting process is jointly arranged, of the main creative personnel (including script writers, directors, main actors), the Chinese party’s personnel share may not be less than one third; (4) television drama (video) copyright is jointly held by the Chinese party and the foreign party.
Article 6: Cooperative production refers to the television drama (video) production method of the foreign party investing and providing the main creative personnel, shooting all or part of the external scenes inside the borders, and the Chinese party providing labour and equipment, materials, venues in assistance. Both parties shall conduct profit sharing according to an agreement.
Article 7: Entrusted production refers to the method of the foreign party entrusting the Chinese party with production inside the borders.
Article 8: When applying for television drama (video) joint production, the following documents shall be submitted: (1) an application letter; (2), the complete Chinese-language script or a story outline of more than 1500 characters per episode; (3) CV of the producer, director and screenwriter, a list of names of the performers; (4) production planning, domestic scenic shooting spots and detailed shooting agendas; (5) a letter of intent for cooperation; (6) a copy of the television drama production permit; (7) certification of the foreign party’s legal person registration (if the foreign party is a natural person, an investor CV shall be submitted), credit certification, and when necessary, notarized third-party guarantee letters of the foreign party must be submitted.
Article 9: When applying for television drama (video) cooperative production, the following documents shall be submitted: (1) an application letter; (2) a story outline of more than 1000 characters per episode, and scripts of the scenes or episodes in the scenario with content referring to our Country as well as scenic spots; (3) a list of names of the script writer, director and main actors; (4) domestic shooting scenic spots and shooting agenda; (5) a letter of intent of cooperation; (6) when necessary, credit certification of the foreign party shall be submitted.
Article 10: Applications for entrusted television drama (video) cooperative production, are to be carried out with reference to the provisions of Article 9.
Article 11: Television programme production organs directly subordinate to the Ministry of Radio, Film and Television producing television dramas (videos) in cooperation with foreign parties, shall be examined and approved by the Ministry of Radio, Film and Television. Audiovisual publications work units and television drama programme production organs subordinate to central work units or their subordinate undertaking work units, applying to produce television dramas (videos) in cooperation with foreign parties, shall after examination and verification by their higher-level controlling authority, report to the Ministry of Radio, Film and Television for approval. Other film and television programme production organs and audiovisual publication work units applying to produce television dramas (videos) in cooperation with foreign parties, after examination and verification of the provincial-level administrative radio and television entity of their locality, report to the Ministry of Radio, Film and Television for examination and approval. In special circumstances, after examination and verification by the Ministry of Radio, Film and Television according to regulations, it shall be reported to relevant entities for approval.
Article 12: It is prohibited to conduct substantial modifications to scripts or story outlines passed through examination.
Article 13: In Sino-foreign television dramas (videos), the following content may not appear: (1) violations of the People’s Republic of China’s Constitution and laws; (2) damage to the national interest, social security, national dignity and national unity; (3) violations of social and public moral standards; (4) propagation of superstition; (5) propagation of sex, sexual exposure, violence and detailed description of criminal methods; (6) content possibly harming the physical and mental health of minors; (7) other content and plot details that should be prohibited.
Article 14: Examination and approval organs shall complete examination and approval within sixty days after receipt of the complete application materials. To those conforming to all conditions of these Regulations, the examination and approval organ shall approve shooting and issue a “Television Drama (Video) Co-Production Permit”.
Article 15: Sino-foreign television drama (video) co-production without approval is prohibited.
Article 16: Transfer in any way of the “Television Drama (Video) Co-Production Permit” is prohibited.
Article 17: Without agreement of all parties, production of different television drama (video) versions is prohibited.
Article 18: Sino-foreign television drama co-productions to be distributed within the borders and broadcast on television stations, shall be examined and approved by the Ministry of Radio, Film and Television.
Article 19: Against those violating the provisions of Article 12, Article 13, Article 15, Article 16, Article 17 and Article 18 of these Regulations, the Ministry of Radio, Film and Television may impose the following administrative punishment depending on the gravity of the circumstances: (1) warning; (2) order cessation of production, publication, distribution or broadcast; (3) cessation of the qualification for television drama (video) co-production; (4) revocation of Sino-foreign television drama production qualifications.
Article 20: Against violations of these Regulations with grave circumstances, constituting a crime, the judicial authorities shall investigate criminal liability according to the law.
Article 21: Television drama (video) co-production with legal persons and natural persons from the regions Hong Kong and Macau, shall be carried out with reference to these Regulations. Television drama (video) co-production with legal persons and natural persons from the region Taiwan, shall still be carried out according to document RDF No. (1994)89.
Article 22: Responsibility for interpreting these Regulations lies with the Ministry of Radio, Film and Television.
Article 23: These Regulations take effect on the day of promulgation.
颁布单位: 广播电影电视部 颁布时间: 950901 第一条 为促进中外文化交流，繁荣电视剧（录像片）创作，加强中外合作制作电视剧（录像片）管理，保护制作者的合法权益，根据我国有关法律和法规，制定本规定。 第二条 本规定所称中外合作制作电视剧（录像片），系指境内影视节目制作机构及音像出版单位（以下简称中方）与外国法人及自然人（以下简称外方）在境内以联合制作、协作制作、委托制作等方式制作电视剧（录像片）的行为。本规定中所称”电视剧”系指采用电子摄录手段制作的有故事情节的电视节目；”录像片”系指音像出版单位制作的供出版、发行、放映或播放的具有故事情节的录像节目。 第三条 广播电影电视部负责全国中外合作制作电视剧（录像片）的管理工作。 省级广播电视行政部门负责本行政区域内中外合作制作电视剧（录像片）的具体管理工作。 第四条 中外合作制作电视剧（录像片）应当遵守中华人民共和国宪法、法律、法规和有关规定。 第五条 联合制作（简称合拍）系指中方与外方共同投资、共派主创人员、共同分享利益及共同承担风险的电视剧（录像片）制作方式。其条件如下： （一）双方共同投资，包括以货币直接投资，或以劳务、实物、广告时间等折价作为投资；（二）剧本由双方共同确定； （三）共派创作人员、技术人员进行全程摄制，主创人员（包括剧本作者、导演、主要演职员）中，中方人员不得少于三分之一； （四）电视剧（录像片）版权归中方及外方共同所有。 第六条 协作制作（简称协拍）系指由外方出资并提供主创人员，在境内拍摄全部或部分外景，中方提供劳务或设备、器材、场地予以协助的电视剧（录像片）制作方式。双方根据协议进行利益分配。 第七条 委托制作系指外方委托中方在境内制作的方式。 第八条 申请合拍电视剧（录像片），应提交下列文件： （一）申请书； （二）全剧中文剧本或每集１５００字以上的故事梗概； （三）制片人、导演、编剧履历、剧组演职员名单； （四）制作计划、境内拍摄景点及详细拍摄日程； （五）合作意向书； （六）电视剧制作许可证的复印件； （七）外方法人注册登记证明（外方为自然人者应提交投资人履历）、资信证明，必要时需提交经过公证的外方第三者担保书。 第九条 申请协拍电视剧（录像片），应提交下列文件： （一）申请书； （二）每集１０００字以上的故事梗概、剧本中涉及我国的内容以及景点章、集的脚本； （三）剧本作者、导演及主要演职员名单；（四）境内拍摄景点及拍摄计划； （五）合作意向书； （六）必要时需提交外方的资信证明。 第十条 申请委托制作电视剧（录像片）参照第九条规定执行。 第十一条 广播电影电视部直属的影视节目制作机构申请与外方合作制作电视剧（录像片），由广播电影电视部审查批准。中央单位或其所属事业单位下属的影视节目制作机构及音像出版单位，申请与外方合作制作电视剧（录像片），应经其上级主管单位审核后，报广播电影电视部审查批准。其他影视节目制作机构和音像出版单位申请与外方合作制作电视剧（录像片），由所在地省级广播电视行政部门审核后，报广播电影电视部审查批准。 特殊情况下，按规定由广播电影电视部审核后，报有关部门批准。 第十二条 对经审查通过的剧本或故事梗概不得进行实质性的改动。 第十三条 中外合作制作电视剧（录像片）中，不得出现下列内容： （一）违背中华人民共和国宪法和法律； （二）损害国家利益、社会安定、民族尊严和民族团结； （三）违反社会公共道德规范； （四）宣扬迷信； （五）宣扬色情、性裸露、暴力及详述犯罪手段； （六）可能伤害未成年人身心健康； （七）其他应禁止的内容和情节。 第十四条 审批机关应在接到全部申请材料之日起六十日内审批完毕。对于符合本规定各项条件的，审批机关应批准拍摄并发放《合作制作电视剧（录像片）许可证》。 第十五条 禁止未经批准中外合作制作电视剧（录像片）。 第十六条 禁止以任何形式转让《合作制作电视剧（录像片）许可证》。 第十七条 非经合作各方同意，不得制作不同的电视剧（录像片）版本。 第十八条 中外合作制作的电视剧在境内发行及电视台播放，应经广播电影电视部审查批准。 第十九条 对违反本规定第十二条、第十三条、第十五条、第十六条、第十七条、第十八条规定的，广播电视行政部门可根据情节轻重，作出以下行政处罚： （一）警告； （二）责令停止制作、出版、发行或播放； （三）停止合作制作电视剧（录像片）资格； （四）取消中方电视剧制作资格。 第二十条 对违反本规定，情节严重，构成犯罪的，由司法机关依法追究其刑事责任。 第二十一条 与香港、澳门地区的法人与自然人合作制作电视剧（录像片），参照本规定执行。与台湾地区的法人及自然人合作制作电视剧（录像片）仍按广发外字〔１９９４〕８９号文件执行。第二十二条 本规定由广播电影电视部负责解释。 第二十三条 本规定自发布之日起施行。
