PPA Decree No. 5
Article 1: In order to enrich the popular masses’ cultural life, strengthen audiovisual product import management, according to the relevant regulations of the “Audiovisual Product Management Regulations”, these Rules are formulated.
Article 2: These Rules apply to the following activities:
1, audiovisual publishing work units engaging in imported audiovisual product publishing business;
2, engaging in audiovisual product import and trade business;
3, importing audiovisual products for research, teaching or reference.
Article 3: The Press and Publications Administration is in charge of audiovisual product import work nationwide; provincial, autonomous region and municipal People’s Government administrative press and publications management entities are responsible for audiovisual product import work in their administrative areas.
Article 4: Audiovisual publishing work units engaging in imported audiovisual product publishing business must meet the following conditions:
1, conforming to the publishing establishment purpose and business scope;
2, having outstanding achievements in producing and publishing domestic audiovisual products;
3, having corresponding editing technology backbones and distribution capacity.
Article 5: Work units applying do launch imported audiovisual product publishing business, with the agreement of the controlling authority of the applying work unit, and after examination and verification by the local provincial, autonomous region or municipal People’s Government administrative audiovisual product management entity, are reported to the Press and Publications Administration for approval.
Article 6: The content of audiovisual products imported for use in publishing and retail must be examined and verified by the audiovisual product content examination and verification organ.
Article 7: Copyright matters related to audiovisual products imported for use in publishing, must be reported for registration to the National Copyright Administration.
Article 8: Work units engaging in audiovisual product import and trade business, must meet the following conditions:
1, those engaging in culture and education publications import and trade business;
2, those exporting domestic audiovisual products with outstanding achievements;
3, having corresponding funds and expert personnel.
Article 9: Examination and approval formalities for work units applying to engage in audiovisual product and trade business are handled according to the procedure in Article 5 of these Rules.
Article 10: For import of audiovisual products for use in publishing or retail, the Press and Publications Administration, according to the examination and verification opinion of the audiovisual product content examination and verification organ conducts macro-level control over imported audiovisual products, issues an imported audiovisual product catalogue, and the Ministry of Culture and Ministry of Radio, Film and Television issue “Audiovisual Product Distribution Permits” according to their duties.
“Audiovisual Product Distribution Permits” issued by the Ministry of Culture or the Ministry of Radio, Film and Television are reported to the Press and Publications Administration for filing. Those not having obtained an “Audiovisual Product Distribution Permit” may not be published, reproduced or sold.
Article 11: Unapproved work units and individuals may not engage in audiovisual product import business.
Article 12: Work units that are approved to engage in audiovisual product import business shall formulate annual plans for audiovisual product import, and report them to the Press and Publications Administration for filing. Organization of national-scale audiovisual product trade fairs, after examination, verification and agreement of the local provincial, autonomous region or municipal administrative audiovisual product management entity, is reported to the Press and Publications Administration for examination and approval.
Article 13: Work units applying to import audiovisual products for the purpose of research or teaching reference must, after examination, verification and agreement by the provincial, autonomous region or municipal administrative audiovisual product management entity, report to the Press and Publications Administration for examination and approval. The examination and approval method will be provided separately by the Press and Publications Administration.
Article 14: Audiovisual products imported for the purpose of research or teaching reference, may not be subject to reproduction, wholesale, retail, rental and commercial broadcast.
Article 15: Work units engaging in imported audiovisual product business, will implement examination, verification and registration formalities once every two years.
Article 16: The Press and Publications Administration or county-level or higher administrative audiovisual product management entities shall, considering the gravity of the circumstances, impose the following punishments against work units and individuals importing audiovisual products without approval or authorization:
2, cessation of publication and distribution;
3, confiscation of unlawful income;
4, fines of more than five times but less than 10 times the unlawful income.
Article 17: The Press and Publications Administration is responsible for interpreting these Rules.
Article 18: These Rules take effect on the day of promulgation, in all cases where regulations concerning audiovisual product import management from before promulgation of these Rules conflict with these Rules, these Rules shall apply.
第十条 进口用于出版、销售的音像制品，由新闻出版署根据音像制品内容审核机构的审核意见，对进口的音像制品进行宏观调控，发布进口音像制品的目录，由文化部、广播电影电视部按照各自的职责发放《音像制品发行许可证 》。
第十二条 经批准从事音像制品进口业务的单位应当制定进口音像制品的年度计划，并报新闻出版署备案。 举办国际性音像制品展销会由所在地省、自治区、直辖市音像制品行政管理部门审核同意后，报新闻出版署审批。
