Chapter I: General Principles

Article 1: In order to stimulate the flourishing and development of our country’s audiovisual publishing undertakings, strengthen management over audiovisual products, on the basis of the relevant provisions of the “Audiovisual Product Management Regulations”, these Rules are formulated.

 

Article 2: These Rules apply to all audiovisual products (including audio tapes, video tapes, records, laser discs and laser video discs, etc., with recorded content) publishing activities.

 

Article 3: Audiovisual products are a component part of our country’s socialist publishing undertakings, their establishment and development scale are brought into comprehensive national publishing undertaking planning.

 

Article 4: The State implements uniform guidance, and level-based management over audiovisual product publishing. The Administration of Press and Publications is in charge of audiovisual product publishing work nationwide. All local levels’ People’s Government administrative audiovisual product management entities are responsible for audiovisual publishing management work in their administrative areas.

 

Article 5: It is prohibited to publish audiovisual products with the following content:

(1) content that endangers the unity of the nation, sovereignty or territorial integrity;

(2) content that incites ethnic division, or destroys ethnic unity;

(3) content that divulges State secrets;

(4) content that propagates obscenity, superstition or plays up violence;

(5) content that insults or slanders others;

(6) other content prohibited by laws, regulations or State provisions.

 

Chapter II: Audiovisual publishing work unit establishment

Article 6: The Press and Publications Administration is responsible for formulating development plans for audiovisual publishing undertakings, determining the total amount, distribution and structure of audiovisual publishing work units.

 

Article 7: For establishing an audiovisual publishing work unit, the following conditions shall be met:

(1) conforming to audiovisual publishing undertaking development plans;

(2) having articles of association conform to these Rules;

(3) having a fixed professional scope;

(4) having organizational structures adapted to professional scope requirements and audiovisual publishing expert personnel conform to regulatory qualification conditions.;

(5) having the necessary funds, equipment and fixed business premises.

 

Article 8: Applications for establishment of an audiovisual publishing work unit, are to be reported by the applying work unit’s higher-level controlling authority to the provincial, autonomous region and municipal People’s Government administrative audiovisual product management entity of that locality for examination and verification, and after provincial, autonomous region and municipal People’s Government agreement, will be reported by the provincial, autonomous region and municipal People’s Government administrative audiovisual product management entity to the Administration of Press and Publications.

Application letters shall indicate the following content:

(1) audiovisual publishing work unit name, address and economic status;

(2) audiovisual publishing work unit’s higher-level controlling authorities’ and sponsoring work units’ names, addresses and economic status;

(3) audiovisual publishing work unit’s main responsible persons’ or legal representatives’ names, addresses and qualification certification documents;

(4) audiovisual publishing work unit’s financial sources and their amounts.

 

Article 9: After the application for establishing an audiovisual publishing work unit is approved by the Administration of Press and Publications and a “permit” is issued, the applying work unit shall within 60 days go to the administrative industry and commerce entity of their locality with the “permit” for registration. Administrative industry and commerce entities issue a business licence on the basis of the “permit” and the provisions of relevant administrative industry and commerce management regulations.

 

Article 10: the Administration of Press and Publications shall make a decision of approval or non-approval within 90 days of receiving the application letter. Where sponsoring work units do not agree with a Administration of Press and Publications decision of non-approval, they may within 15 days of receiving the decision notification, apply for reconsideration with the deciding organ; the deciding organ shall make a reconsideration decision within two months of receiving the application letter for reconsideration.

 

Article 11: Where audiovisual publishing work units do not publish audiovisual products within 6 months of registration, after the provincial, autonomous region and municipal administrative audiovisual product management entity reports to the Administration of Press and Publications for approval, the “permit” is recalled.

 

Article 12: Where audiovisual publishing work units change their name, subordination relation or professional scope, according to the provision of Article 8 and Article 9 of these Rules, examination, approval and registration formalities shall be conducted again according to the law. Audiovisual publishing work units changing address, main responsible personnel or legal representative, they shall go to the original permit-issuing organ to conduct modification of registration formalities. Where audiovisual publishing work units terminate publishing activities, they shall within 30 days of ceasing activities go to the original permit-issuing organ to conduct registration cancellation formalities.

 

Article 13: Audiovisual publishing work units shall according to the requirements relating to audiovisual statistics reporting, fill out and submit audiovisual product reporting forms, and submit them according to statutory times to the provincial level administrative audiovisual product management entity. Provincial-level administrative audiovisual product management entities report these to the Administration of Press and Publications after compilation.

 

Article 14: Audiovisual publishing work units conduct examination and verification of registry procedures once every two years. Starting in 1997, audiovisual publishing work units shall submit annual examination reports before 31 January of every odd year to the provincial-level administrative audiovisual product management entity, the management organ shall conduct complete examination of their situation of publishing work, implementation of regulations, etc., handle annual examination qualification registration formalities for work units meeting statutory requirements, and do not handle or postpone annual examination qualification registration formalities for work units not meeting statutory requirements. Audiovisual publishing work units not obtaining qualification registration formalities may not engage in audiovisual publishing work.

 

Article 15: Any work unit not having obtained the “permit” may not engage in audiovisual product publishing work.

 

Article 16: Non-commercial audiovisual products for internal use produced by organs, enterprises and undertaking work units must be approved by the provincial-level or higher administrative audiovisual product management entity, and only after an “Audio and Video Product Reproduction Entrustment Letter” is issued and approve, may be reproduced and circulated.

 

Chapter III Audiovisual product publication

Article 17: Audiovisual publishing work units shall organize and formulate annual audiovisual theme selection plans. Audiovisual theme selection shall reflect the publishing aim of audiovisual publishing work units, and conform to the publishing business scope.

 

Article 18: Audiovisual publishing work units’ annual theme selection plans must, after examination and verification by the sponsoring and controlling work units, be reported to the provincial, autonomous region and municipal administrative audiovisual product management entity for examination and approval, and be reported to the Administration of Press and Publications for filing. Annual theme selection plans of audiovisual publishing work units controlled by central work units in Beijing must be reported to the Administration of Press and Publications for filing after examination and approval by their controlling authorities.

 

Article 19: Reporting of annual theme selection plans shall include names, categories, carriers, content outlines, planned publishing times, etc. The reporting time ends at the end of the year before the planned year or at a time required by Administration of Press and Publications requirements.

 

Article 20: The final responsibility for audiovisual publishing work unit-published audiovisual products, is with the audiovisual publishing work unit’s editor-in-chief.

 

Article 21: Audiovisual publishing work units may not transfer, rent or sell the name or publishing number of that work unit to any work unit or individual. Audiovisual publishing work units must carry complete responsibility for the master tape, cover, propaganda material and entrustment of reproduction and distribution methods of audiovisual products published by them, and may not assign publication numbers to editing and production entities or editing individuals; the power of final adjudication may not be entrusted to others for exercise on its behalf.

 

Article 22: Published audiovisual products shall clearly indicate items such as the publishing work unit’s name, address, Chinese standard audio and video production number, publishing time, author name, etc., on a clear location on the audiovisual product or its packaging.

 

Article 23: Audiovisual publishing work units may distribute audiovisual products published by that work unit according to relevant State Regulations

 

Article 24: Audiovisual publishing work units implement president, and editor-in-chief on-the job training and examination systems.

 

Article 25: Audiovisual publishing work units shall within 30 days of publishing audiovisual products, hand in samples with the Chinese edition library and report samples to the Administration of Press and Publications for filing.

 

Article 26: Management rules for audiovisual products improved from abroad, will be formulated elsewhere.

 

Chapter IV: Punitive provisions

Article 27: Those in violation of these Rules, having one of the following act, shall be issued a warning, ordered to cease publishing audiovisual products, have their illegal audiovisual products confiscated and destroyed, have their illegal income confiscated, have their audiovisual product publishing business permit revoked, and may be fined 5 times or more but 10 times or less the unlawful income by the Administration of Press and Publications or the county-level or higher People’s Government administrative audiovisual product management entity on the basis of the gravity of the circumstances, where it constitutes a crime, criminal liability shall be investigated according to the law:

(1) audiovisual publishing work units transferring, renting or selling the name or publishing number of that work unit to other work units or individuals;

(2) book publishers publishing audiovisual products not supplementary to their book publications and publishing audiovisual products supplementary to their book publications without approval;

(3) non-audiovisual publishing work units publishing audiovisual products;

(4) audiovisual publishing work units publishing audiovisual products not having obtained an “Audiovisual Product Distribution Permit”;

(5) publishing audiovisual products with content prohibited by State regulations.

The administrative punishment of revoking the “permit” must be approved by the Administration of Press and Publications.

 

Article 28: Where publishing of audiovisual products infringes other persons’ copyright, the administrative copyright entity imposes punishment on the basis of the “Copyright Law of the People’s Republic of China”; where it constitutes a crime, criminal liability will be investigated according to the law.

 

Article 29: Rectification shall be ordered and a warning may be issued to audiovisual publishing work units refusing to submit annual theme selection plans, and refusing to submit audiovisual product samples.

 

Article 30: Non-audiovisual publishing work units, in violation of these Rules, accepting, renting or buying audiovisual publishing work unit’s name or publishing number, shall be ordered to cease publishing activities, and be fined 5 times or more but less than 10 times the illegal income.

 

Chapter V: Supplementary provisions

Article 31: These rules take effect on the day of promulgation. In all cases where these rules contradict with audiovisual publication management regulations promulgated earlier, these Rules take precedence.

 

Article 32: Interpretation of these Rules is the responsibility of the Administration of Press and Publications.

 

音像制品出版管理办法

新闻出版署令第3号

第一章 总  则

第一条 为了促进我国音像出版事业的健康发展和繁荣,加强音像制品出版 的管理,根据《音像制品管理条例》的有关规定,制定本办法。

第二条 凡从事音像制品(含录有内容的录音带、录像带、唱片、激光唱盘和 激光视盘等)出版活动,适用本办法。

第三条 音像出版事业是我国社会主义出版事业的组成部分,其建设和发展 规模纳入国家出版事业总体规划。

第四条 国家对音像制品的出版实行统一领导,分级管理。新闻出版署主管全国的音像出版管理工作。地方各级人民政府音像制品行政管理部门负责本行政区域的音像出版管理工作。

第五条 严禁出版下列内容的音像制品:

(一)危害国家统一、主权和领土完整的;

(二)煽动民族分裂、破坏民族团结的;

(三)泄露国家秘密的;

(四)宣扬淫秽、迷信或者渲染暴力的;

(五)诽谤、侮辱他人的;

(六)国家规定禁止出版、传播的其他内容。

第二章 音像出版单位的设立

第六条 新闻出版署负责制定音像出版事业的发展规划,确定全国音像出版 单位的总量、布局和结构。

第七条 设立音像出版单位,应当具备下列条件:

(一)符合音像出版事业的发展规划;

(二)有符合本办法的章程;

(三)有确定的业务范围;

(四)有适应业务范围需要的组织机构和符合规定资格条件的音像出版专业人员;

(五)有必需的资金、设备和固定的经营场所。

第八条 申请设立音像出版单位,由申请单位的上级主管部门报所在地省、自治区、直辖市人民政府音像制品行政管理部门审核并经省、自治区、直辖市人民政府同意后,由省、自治区、直辖市人民政府音像制品行政管理部门报新闻出版署审批。

申请书应当载明下列内容:

(一)音像出版单位的名称、地址和经济性质;

(二)音像出版单位的上级主管部门、主办单位的名称、地址和经济性质;

(三)音像出版单位的主要负责人或者法定代表人的姓名、住址、资格证明文件;

(四)音像出版单位的资金来源及其数额。

第九条 设立音像出版单位的申请经新闻出版署批准并发给《音像制品出版 经营许可证》后,申请单位应当在60日内持《音像制品出版经营许可证》到所在地工商行政管理部门登记。工商行政管理部门根据《音像制品出版经营许可证》和工商行政管理的有关规定,发给营业执照。

第十条 新闻出版署自收到申请书之日起90日内作出批准或者不批准的决定。主办单位对新闻出版署的不批准决定不服的,可以自收到决定通知之日起15日内,向作出决 定的机关申请复议;作出决定的机关应当自收到申请复议书之日起两个月内作出复议决定。

第十一条 音像出版单位自登记之日起满6个月未出版音像制品的,由各省 、自治区、直辖市音像制品行政管理部门报新闻出版署同意后,收回《音像制品出版经营许 可证》。

第十二条 音像出版单位改变名称、隶属关系、业务范围的,应当依照本办 法第八条、第九条的规定,重新办理审批登记手续。音像出版单位改变地址、主要负责人或者法定代表人,应当到原发证机关办理变更登记手续 。音像出版单位终止出版经营活动的,应当自停止经营活动之日起30日内到原发证机关办 理注销登记手续。

第十三条 音像出版单位应按照有关音像统计报表的要求,填报音像制品报表,按规定时间报送省级音像制品行政管理部门。省级音像制品行政管理部门汇总后,报新闻出版署。

第十四条 音像出版单位每两年履行一次审核登记手续。音像出版单位从1997年开始,逢单年1月31日前向省级音像制品行政管理部门报送年检报告,由管理机关对其出 版业务、执行法规等情况进行全面检查,对达到规定要求的单位,准予办理年检合格登记手续,对未达到规定要求的单位,不予或暂缓办理年检合格登记手续。未取得合格登记手续的 音像出版单位,不得从事音像出版业务。

第十五条 未取得《音像制品出版经营许可证》的任何单位不得从事音像制 品的出版业务。

第十六条 机关、企业、事业单位制作的供内部使用的非经营性的音像制品 ,须经省级以上音像制品行政管理部门批准,并核发《录音录像制品复制委托书》后,方可 复制、交流。

第三章 音像制品的出版

第十七条 音像出版单位应当组织、制定音像年度选题计划。音像选题计划 应体现音像出版单位的出版宗旨,符合出版业务范围。

第十八条 音像出版单位的年度选题计划须经主办、主管单位审核后,报当 地省、自治区、直辖市音像制品行政管理部门核准,报新闻出版署备案。在京中央单位主管的音像出版单位的年度选题计划须经其主管部门审核后报新闻出版署备案 。

第十九条 上报年度选题计划应包括名称、类别、载体、内容提要、计 划出版时间等。上报时间截止于本年度的上一年底或者新闻出版署规定要求的时间。

第二十条 音像出版单位出版的音像制品,由音像出版单位的总编辑负责 终审。

第二十一条 音像出版单位不得向任何单位或者个人转让、出租、出售本单 位的名称或者版号。音像出版单位必须对其出版的音像制品的母带、封面、宣传品及委托复制、发行方式负全部 责任,不得将版号分配给编辑、制作部门或编辑个人掌握;终审权不得委托他人代为行使。

第二十二条 出版音像制品应当在音像制品及其包装的明显位置,标明出 版单位的名称、地址、中国标准音像制品编码、出版时间、著作人姓名等事项。

第二十三条 音像出版单位可以按照国家的有关规定发行本单位出版的音像 制品。

第二十四条 音像出版单位实行社长、总编辑上岗前的岗位培训、考核制度 。

第二十五条 音像出版单位应当自音像制品出版之日起30日内,向中国版本图书馆缴送样品并将样品报新闻出版署备案。

第二十六条 从境外引进的音像制品的出版管理办法,另行规定。

第四章 罚  则

第二十七条 违反本办法,有下列行为之一的,由新闻出版署或者县级以上地方人民政府音像制品行政管理部门根据情节轻重给予警告,责令停止出版发行音像制品, 没收并销毁违法音像制品,没收违法所得,吊销音像制品出版经营许可证,可以并处违法所 得5倍以上10倍以下的罚款,构成犯罪的,依法追究刑事责任:

(一)音像出版单位向其他单位或者个人转让、出租、出售本单位的名称或者版号的;

(二)图书出版社出版非配合本版图书的音像制品和未经批准出版配合本版图书的音像制品的 ;

(三)非音像出版单位出版音像制品的;

(四)音像出版单位出版未取得《音像制品发行许可证》的音像制品的;

(五)出版有国家规定禁止的内容的音像制品的。

吊销《音像制品出版经营许可证》的行政处罚,需经新闻出版署批准。

第二十八条 出版音像制品侵犯他人著作权的,由著作权行政管理部门依照 《中华人民共和国著作权法》的有关规定给予处罚;构成犯罪的,依法追究刑事责任。

第二十九条 对拒绝报送年度选题计划的、拒绝缴送音像制品样品的音像出版单位,应当责令改正并可给予警告。

第三十条 非音像出版单位违反本办法,受让、租用、购买音像出版单位的名称或者版号的,责令其停止出版活动,并处以违法所得5倍以上10倍以下的罚款。

第五章 附  则

第三十一条 本办法自发布之日起施行。本办法发布前有关音像出版管理的规定,凡与本办法相抵触的,以本办法为准。

第三十二条 本办法由新闻出版署负责解释。
