Notice Concerning Relevant Regulations for Establishing a Special Fund Supporting the “9550” Excellent Film Product Project.

All provincial, autonomous region and municipal radio and television (film and television) offices (bureaus), financial offices (bureaus), China Central Television:

According to Central leadership memos and the spirit of “agreeing to extract a part of funds from television income to support film development and […] earnestly realize the mutual support of film and television” in the State Council “Minutes of the Conference Researching Questions Concerning Television Work” (GAC No. [1995]167), and after research it has been decided to establish a ministerial and provincial double-level “Special Fund Supporting the ‘9550’ Excellent Film Product Project” (hereafter simply named Excellent Film Product Fund). Also, the following provisions have been made:

I: The Excellent Film Production Fund is established by extracting a part of funds from television advertising income.

(1) China Central Television shall annually submit three percent from net television advertising income (net income after paying business tax, hereafter the same) to the Ministry of Radio, Film and Television (no less than 30 million Yuan every year) for transferral to a special bank account, in support of excellent film product production.

(2) All provincial, autonomous region and municipal provincial-level television stations shall annually submit three percent from net television advertising income to the provincial radio and television (film and television) bureau (office), for transferral to a special bank account, in support of excellent film product production.

(3) Whether or not plan-listed city-level and provincial capital-level television stations submit, shall be decided by all provinces and autonomous regions.

II, The Excellent Film Production Fund is to be used for support to excellent film product production, provinces, autonomous regions and municipalities not having film studios shall use the funds to support film shooting in the “One of Five Project”.

III, The Excellent Film Production Fund is a State financial fund, and shall be managed as part of the “State Film Undertaking Development Special Fund”. Funds must persist in using special bank accounts and using money for earmarked purposes. All provincial, autonomous region and municipal radio and television (film and television) offices (bureaus) shall before the end of every February, report the funding intake and use situation of the previous year to the financial administration of the same level, and report it upward at the same time. All levels’ financial administrations must strengthen supervision over the use situation of this fund.

IV, All levels’ television stations may not increase financial liabilities because of this Excellent Film Production Fund.

V, Administrative controlling authorities for filmmaking and film production enterprises shall draw aid from the establishment this Excellent Film Production Fund, which promotes the reform of film production mechanisms and shapes a sort of brand new film making mechanisms.

VI, These Regulations take effect on 1 January 1996.

广播电影电视部、财政部关于设立支持电影精品“九五五0”工程专项资金有关规定的通知[失效]

各省、自治区、直辖市广播电视(影视)厅(局)、财政厅(局),中央电视台:

根据中央领导批示和1995年12月27日国务院《研究电视工作有关问题的会议纪要》(国阅[1995]167号)中关于“同意从电视收入中提取部分资金支持电影发展……努力实现电影电视互济”的精神。经研究决定,设立部、省两级“支持电视精品‘九五五0工程’专项资金”(以下简称电影精品专项资金)。并作出如下规定:

一、电影精品专项资金由电视广告收入中提取部分资金建立。

(一)中央电视台每年按电视广告纯收入(缴纳营业税后的纯收入,下同)的3%计算,上缴广播电影电视部(每年不少于3000万元),专户存储,支持电影精品摄制。

(二)各省、自治区、直辖市的省级电视台按其电视广告纯收入的3%计算,上缴给省广播电视(影视)厅(局),专户存储,支持电影精品摄制。

(三)计划单列市及省会城市电视台是否上缴,由各省、自治区决定。

二、电影精品专项资金专项用于支持电影精品的摄制,没有制片厂的省、自治区、直辖市,则用以支持“五个一工程”中的电影拍摄。

三、电影精品专项资金是国家财政性资金,应作为“国家电影事业发展专项资金”一部分来管理。资金必须坚持专户存储、专款专用。各省、自治区、直辖市广播电视(影视)厅(局)应于每年2月底以前,将上年专项资金收缴及使用情况报同级财政部门,同时抄报广播电影电视部、财政部。各级财政部门都要对这项资金使用情况加强监督。

四、各级电视台不得因上缴此项电影精品专项资金增加财政负担。

五、电影制片行政主管部门和电影制片企业,应借助此次电影精品专项资金的建立,推动电影制片机制的改革,形成一种崭新的制片机制。

六、本规定自1996年1月1日起执行。
