Notice Concerning Implementing the “Publications Management Regulations”

The “Publications Management Regulations” (hereafter simply named Regulations” have been promulgated by the State Council, and take effect on 1 February 1997. This is a large matter in the construction of our country’s publishing legal system, and has an extremely important significance for strengthening and improving publishing management work, stimulating all levels’ administrative press and publications management departments to administer according to the law, guaranteeing the citizen’s exercise of their right to freedom of publication according to the law, protecting the lawful rights and interests of publishing, printing and distribution work units and professionals  of books, newspapers, periodicals, audiovisual and electronic publications, and letting Socialist publishing undertakings develop and flourish. In order to guarantee that the “Regulations” is completely and correctly implemented, all levels’ administrative press and publications management departments must give it high regard, and realistically perform relevant work. To this end, the following matters are notified:

I, Earnestly organizing professional personnel to study the “Regulations”. The “Regulations” are the first relatively systematic and complete administrative regulation relating to publishing management since the founding of the country, and have determined basic principles and basic systems for the management of publishing, printing and distribution activities of books, newspapers, periodicals, audiovisual products and electronic publications, and have constituted a basic legal framework for a Socialist publishing management system with Chinese characteristics. It is necessary to make studying the “Regulations” into an important content for the nationwide press and publications “3rd Five Years” legal dissemination. The nationwide publishing system as well as all publishing work units’ professional personnel must ensure that nobody is without a copy if the “Regulations”, and achieve that the basic articles of the “Regulations” are known and mastered (the People’s Press has already published offprints). The Administration of Press and Publications will organize deliberation classes on the implementation of the “Regulations”, to train professional backbones. All levels’ management organs and leading comrades must take the lead and act as examples, especially in integrating reality, and earnestly research and study the “Regulations”, knowing and mastering the regulations well. It is necessary to further clarify that the implementation of the “Regulations” has an great importance and a promoting function in implementing the resolutions of the 6th Plenum of the 14th Party Congress, progressively establishing a Socialist publishing management system with Chinese characteristics, in deeply and lastingly launching the “Sweeping Pornography” and “Striking Illegality” struggles and implementing the requirements put forward by the Centre on “curing scattering and curing excess” in press and publication, etc. All levels’ management organs must renew concepts, transform functions, renew management methods and management ways through studying the “Regulations”, further clarify and rationalize management systems, stimulating administration according to the law, raising management levels, striving to complete the historical task of press and publications work.

II, Grasping the performance of complementary drafting and revision work of relevant regulations and rules. According to the “Regulations”, the Press and Publications Administration must formulate a number of complementary rules, implementation regulations, etc., and must revise or abolish many existing regulations according to the provisions of the “Regulations”. This work has a strong policy nature and is a heavy task, and it is necessary to integrate it with implementing administrative punishments, it is necessary to partly tidy up and partly revise existing regulations and normative documents. By 31 December of this year, where administrative punishments provided in existing regulations do not conflict with the “Regulations”, they will still have effect until the promulgation and implementation of new regulations. All provincial, autonomous region and municipal press and publications bureaus must also integrate their local situation, and on the basis of the provisions of the regulations, put forward opinions on the relevant local rules or governmental regulations of their locality, and report it to the provincial, autonomous region or municipal People’s Government.

III, Establishing and completing work systems. The promulgation and implementation of the “Regulations” has put forward higher requirements on strengthening and improving publishing management work. All levels’ management organs must first and foremost further clarify intra-organ duty divisions according to the requirements of the “Regulations”, formulate scientific and rational work procedures and work methods, improve and perfect existing work systems, raise work effectiveness and work quality, improve and strengthen macro-level management and micro-level supervisions over publications undertakings. In order to perform publications management administrative punishment work, all localities must earnestly implement public hearing systems according to State regulations, investigate evidence collection and punishment decision separation systems, fining decision and fine collection separation systems, guaranteeing law enforcement quality.

IV, Strengthening publishing legal system work and team construction. The Press and Publications Administration will hold a nationwide press and publications legal system work conference this year, to focus on researching questions on strengthening the publishing legal system construction through implementing the “Regulations”, etc. All localities must realistically strengthen leadership over press and publications legal system work, earnestly research and concretely guide it. Through implementing the “Regulations”, making legislative work, law enforcement work, law enforcement supervision work and law dissemination work move up a step. It is necessary to adopt measures to strengthen the construction of those departments’ legal system work organs, and those not having specially established legal system work organs must also appoint departments to undertake legal system work duties. Please report the legal system work department the name of its responsible person before 10 March.

All levels’ management organs and work personnel are all to grasp certain duties such as examination and approval powers, registration powers, extending of permits and imposing administrative punishment, etc., according to the “Regulations”. In order to guarantee the exercise of functions and powers according to the law, Party-type education and legal system education for law enforcement personnel must be strengthened, and on-the-job training with content focusing on the “Regulations” must be conducted, law enforcement personnel qualification and certification management must be strengthened, management personnel’s political quality and professional quality must be raised, and a level of consciousness of handling matters according to the law must be strengthened.

All localities must, after receiving this Notice, integrate it with the real situation of their localities, and formulate concrete work plans for studying and implementing the “Regulations” in locality, and report them to the Press and Publications administration before 10 March. Please also timely report relevant important matters and questions in the process of implementing the “Regulations”.

新闻出版署关于贯彻实施《出版管理条例》的通知
《出版管理条例》(以下简称条例)已由国务院颁布,自1997年2月1日起施行。这是我国出版法制建设的一件大事,对于加强和改进出版管理工作,促进各级新闻出版行政管理部门依法行政,保障公民依法行使出版自由的权利,保护图书、报纸、期刊、音像及电子出版物的出版、印制、发行单位和从业人员的合法权益,发展和繁荣社会主义出版事业,有着极其重要的意义。为了保证《条例》全面、正确地实施,各级新闻出版管理部门必须予以高度重视,切实做好有关工作。为此,特作如下通知:
一、认真组织从业人员学习《条例》。《条例》是建国以来第一部比较系统、全面的有关出版管理的行政法规,对于图书、报纸、期刊、音像制品和电子出版物的出版、印制、发行活动的管理,确定了基本原则和基本制度,构成了有中国特色社会主义出版管理体制的基本法制框架。要把《条例》的学习作为全国新闻出版系统“三五”普法的重要内容。全国出版系统以及各出版单位的从业人员要做到《条例》人手一册,对条例的基本条款要作到应知应会(人民出版社已出版单行本)。新闻出版署将举办贯彻实施《条例》研讨班,培训业务骨干。各级管理机关和领导同志要率先垂范,尤其是结合实际,认真研究、学习《条例》,熟悉和掌握条例。要进一步明确《条例》的施行对贯彻落实党的十四届六中全会的决议,对逐步建立有中国特色社会主义的出版管理体制,对深入持久地开展“扫黄”、“打非”斗争和贯彻中央提出的新闻出版业“治散治滥”要求等都具有重要意义和推动作用。各级管理机关要通过学习《条例》更新观念,转变职能,更新管理手段和管理方式,进一步明确和理顺管理体制,促进依法行政,提高管理水平,努力完成新闻出版工作的历史性任务。
二、抓紧做好有关法规、规章的配套制定和修订工作。依据《条例》,新闻出版署将要制定若干办法、细则等配套规章,对现行的许多规章都要依照《条例》的规定予以修改或者废止。这项工作政策性强、任务重,要同实施行政处罚法结合起来进行,对现行规章和规范性文件要边清理、边修订。截止今年12月31日,现行规章已规定的行政处罚,凡与《条例》不相抵触的,在新的规定颁布施行之前依然有效。各省、自治区、直辖市新闻出版局也要结合本地的情况,根据条例的规定,对本地的有关地方性法规或政府规章提出意见,报省、自治区、直辖市人民政府。
三、建立健全工作制度。《条例》的颁布和施行对加强和改进出版管理工作提出了更高要求。各级管理机关首先要根据《条例》的要求进一步明确机关内部职责分工,制定科学、合理的工作程序和工作办法,改进和完善现行工作制度,提高工作效率和工作质量,改进和加强对出版事业的宏观管理和微观监督。为做好出版管理行政处罚工作,各地要按国家规定认真执行听证制度,调查取证与处罚决定分开制度、罚款决定与罚款收缴制度,保证执法质量。
四、加强出版法制工作和队伍建设。新闻出版署今年要召开全国新闻出版法制工作会议,着重研究通过贯彻实施《条例》,加强出版法制建设等问题。各地要切实加强对新闻出版法制工作的领导,认真研究并具体指导。通过实施《条例》,使出版系统的立法工作、执法工作、执法监督工作和普法工作再上一个新台阶。要采取措施加强本部门法制工作机构建设,没有专设法制工作机构的也要指定部门承担法制工作任务。请于3月10日前将法制工作部门及负责人姓名报署办公室。
各级管理机关及其工作人员依据《条例》都掌握着一定的审批权、登记权、发放许可证和执行行政处罚等职权。为了确保依法行使职权,要对执法人员加强党性教育、法制教育,要有针对性地以《条例》为内容进行岗位培训,要加强对执法人员的资格、证件管理,提高管理人员的政治素质和业务素质,增强依法办事的自觉性。
各地接到本通知后,要结合本地的实际情况,制定本地区学习和实施《条例》的具体工作方案,并请于3月10日以前报新闻出版署。实施《条例》过程中有关重要情况和问题也请及时报告。
