After issue of the Ministry of Culture “Notice Concerning Sticking a Uniform Anti-Counterfeit Symbol on Audiovisual Products”, all localities have vigorously organized implementation. According to the concrete situation of all localities’ audiovisual markets, a supplementary notice on relevant question is as follows:
I, According to relevant State Council regulations, the China National Publications Import & Export Corporation is the only work unit approved by the State to engage in finished audiovisual product import work. In order to further protect intellectual property rights, safeguard the national interest, all finished audiovisual products imported by the China National Publications Import & Export Corporation, apart from bearing the Ministry of Culture-supervised and issued “Audiovisual Product Anti-Counterfeit Symbol”, at the same shall bear a China National Publications Import & Export Corporation “Imported Original Audiovisual Product Anti-Counterfeit Symbol”.
II, The China National Publications Import & Export Corporation “Imported Original Audiovisual Product Anti-Counterfeit Symbol” is round, and uses holographic technology, in an arc on the upper half of the symbol, the six English letters CNPIEC (the English abbreviation of China National Publications Import & Export Corporation) are successively arranged; in an arc on the lower half, the four characters “Chinese Company” are successively arranged; in the centre is a large round English letter M contrasting with a musical stave; above and below the “M”, there are the two characters for “music”.
III, The “Imported Original Audiovisual Product Anti-Counterfeit Symbol” is produced and used by the China National Publications Import & Export Corporation itself. Any work unit or individual may not forge, buy or sell it, violators shall be severely punished according to the law.
IV, For audiovisual products published by education-type audiovisual publishers, that are already approved by the State and determined as educational material aids, the anti-counterfeit symbol sticking work may be completed before 31 July 1997.
V, In order to vigorously and safely complete sticking the uniform anti-counterfeit symbol logo work, the closing time limit for completing sticking work is adjusted from 1 January 1997 until 30 June 1997. Apart from the circumstances of Article 4 of this Notice, where audiovisual products for wholesale, retail or rental do not bear an anti-counterfeit symbol, they may without exception not be circulated on the market in any way.
VI, From 30 June 1997, all audiovisual product anti-counterfeit symbols issued by all provincial, autonomous region or municipal administrative audiovisual product management entities are abolished.
All provincial (regional, municipal) administrative audiovisual product management entities must in the near future organize humanpower to conduct market inspections, strictly require all audiovisual publishing work units in their jurisdiction to stick Ministry of Culture-produced anti-counterfeit symbols on all audiovisual products brought for sale on the market.
