All provincial, autonomous region and municipal radio, film and television offices (bureaus):
In order to further make television screens flourish, according to relevant laws, regulations and policies such as the “Radio and Television Management Regulations”, etc., our Administration has decided to, from 1 November 1998 onwards, implement a domestic television drama distribution permit system.
I, Television dramas produced by central work units, after examination by the SARFT television drama examination committee, are issued a “Domestic Television Drama Distribution Permit” by SARFFT; television dramas produced by local work units, after examination by the local provincial-level administrative radio and television entity television drama examination small group, are issued a “Domestic Television Drama Distribution Permit” by the provincial-level administrative radio and television entity. At the time of sending a television drama for examination, the “Television Drama Production Permit” shall be submitted, as well as written materials such as shooting files, etc.
Where production work units object to the SARFT or provincial-level television drama examination organ’s examination conclusion of a television drama, they may petition the SARFT re-examination committee for re-examination. Television dramas passed by SARFT re-examination, will be issued a “Domestic Television Drama Distribution Permit” by SARFT.
The “Domestic Television Drama Distribution Permit” is uniformly printed by the SARFT Social Management Department.
II, According to the provisions of Article 32 of the “Radio and Television Management Regulations”, television dramas containing one of the following situations, will not be granted a “Domestic Television Drama Distribution Permit”:
1. violating national unity, sovereignty and territorial integrity;
2. violating national security, honour and interests;
3. inciting ethnic separation, destroying ethnic unity;
4. divulging State secrets;
5. libelling or slandering others;
6. propagating sex, superstition or playing up violence;
7. not having obtained a television drama production permit;
8. other content prohibited by the provisions of laws or administrative regulations.
III, Except in unforeseeable circumstances, SARFT and provincial-level administrative radio and television entities shall, within 45 days of receiving the television drama applied for and the complete written application materials, complete the work of examination and issuing a “Domestic Television Drama Distribution Permit”; for television dramas requiring re-examination, SARFT shall, within 30 days of receiving the application for re-examination, complete the work of re-examination and issuing a “Domestic Television Drama Distribution Permit”.
IV, All television dramas completed before 1 November but not yet distributed and completed afterwards, may only be distributed after the producing work unit obtains a “Domestic Television Drama Distribution Permit” according to the provisions of these Regulations, before distribution, the “Domestic Television Drama Distribution Permit” and the “Television Drama Production Permit” numbers must be shown at the opening and ending titles of every episode of the drama.
V, Before 31 October 1998, all television dramas of which television broadcast organs have already bought broadcast rights and production is completed, may, after their name is reported before 15 November, only be broadcast after reporting to the provincial, autonomous region or municipal administrative radio and television entity for filing, and after being examined according to the original regulations.
From 31 October onwards, of all television dramas of which television broadcast organs have already bought broadcast rights but production is not yet completed, the production work units must obtain a “Domestic Television Drama Distribution Permit” according to the provisions of these Regulations, and only then may be broadcast by television broadcast organs.
From 1 November onwards, all television broadcast organs may not buy and broadcast television dramas that according to the provisions of this Notice should obtain but have not obtained a “Domestic Television Drama Distribution Permit” .
VI, All provincial-level administrative radio and television entities shall, in the first week of every season, report the “Domestic Television Drama Distribution Permit” issuance situation to the SARFT Social Management Department for filing.
VII, The responsible work unit of those violating the provisions of Article 2, Article 4 or Article 5 of these Provisions, are to be punished with the corresponding administrative punishment by the county-level or higher administrative radio and television management entity according to the provisions of Article 49 and Article 50 of the “Radio and Television Management Regulations”
It is hoped that all offices and bureaus, after receiving this Notice, immediately transmit it to all relevant work units, and earnestly implement it.
