Audiovisual Product Import Management Rules

The “Audiovisual Product Import Management Rules” are hereby promulgated, and take effect on the day of promulgation.

Audiovisual Product Import Management Rules

Chapter I: General principles

Article 1: In order to strengthen management of audiovisual product import, stimulate the healthy and orderly development of our country’s audiovisual market, enrich the popular masses’ cultural life, according to relevant State regulations, these Rules are formulated.

Article 2: Audiovisual products as named in these rules, refers to audio tapes, video tapes, records, laser records and laser discs (for product naming and their HS Number, see attachment 1), etc., with recorded content.

Article 3: these Rules apply to everyone importing audiovisual products from abroad and the Hong Kong Special Administrative Region, Macau and Taiwan, and engaging in the following activities:

(1) for use in publishing by audiovisual publishing work units;

(2) for use in direct sales;

(3) for use in research and educational reference;

(4) where export is required for other special circumstances.

Article 4: The Ministry of Culture is responsible for audiovisual product import management nationwide according to its tasks determined by the State Council, formulates audiovisual product import plans, examines and approves the business qualifications of audiovisual publishing work units and audiovisual product business work units (hereafter named import work units), examines and verifies the content of imported audiovisual products, and regulates and controls audiovisual product import varieties.

Provincial, autonomous region and municipal People’s Government administrative audiovisual product management departments manage audiovisual product import work in their administrative areas according to these Rules.

Article 5: Audiovisual product import business activities shall abide by the Constitution and corresponding laws and regulations, persist in the orientation of serving the people and serving socialism, and disseminate ideological, moral, scientific, technological and cultural knowledge benefiting economic development and social progress.

Article 6: The State prohibits import of audiovisual products violating other persons’ intellectual property rights and having the following content:

(1) endangering national unity, sovereignty and territorial integrity;

(2) damaging the image and dignity of China

(3) inciting ethnic separation, destroying ethnic unity;

(4) propagating obscenity, sex, superstition, violence, drug using, etc., violating social moral standards, or harmful to the physical and mental health of the masses;

(5) violating basic principles of international relations, that may influence our country’s regular relationships with other countries;

(6) having vulgar and low ideological and artistic levels;

(7) other content prohibited from distribution provided by laws and regulations.

Article 7: The State implements a permit system over audiovisual product import business

Chapter II: Import work units

Article 8: Audiovisual publishing work units and audiovisual production business work units shall undergo  approval by the Ministry of Culture according to these Rules, and only then may engage in audiovisual product import business activities.

Article 9: Audiovisual product work units conducting audiovisual product publishing and distribution business shall conform to the following conditions:

(1) conforming to the objective of publishing house establishment and the professional scope;

(2) having prominent achievements in publishing domestic audiovisual products;

(3) having a registered capital of 2 million Yuan or higher.

Apart from the above conditions, they shall also conform to the quantitative, distribution and structuring plans formulated by the Ministry of Culture concerning audiovisual product work units.

Article 10: Audiovisual product business work units engaging in audiovisual product import, and directly engaging in retail business shall conform to the following conditions:

(1) conforming to the objective of the establishment of that work unit and the business scope;

(2) having prominent achievements in handling domestic audiovisual product export work and retail of domestic audiovisual products;

(3) having a registered capital of 5 million Yuan or higher.

Apart from the above conditions, they shall also conform to the quantitative, distribution and structuring plans formulated by the Ministry of Culture concerning audiovisual product work units.

Article 11: Nationwide and provincial, autonomous region and municipal libraries, audiovisual material centres, scientific research organs, higher education institutes, as well as work units with other special needs, importing audiovisual products for research and scientific reference, shall entrust an audiovisual product business work unit having import qualifications with handling import work.

Article 12: Work units applying to engage in audiovisual product import work, are reported to the Ministry of Culture after examination, verification and agreement by the provincial, autonomous region or municipal People’s Government administrative audiovisual product management department of their locality, and are uniformly published by the Ministry of Culture.

Chapter III: Import permission

Article 13: The State implements a content examination system over audiovisual product import and sales of the following audiovisual products:

(1) feature films (including stageplays, dramas, art films);

(2) documentary films

(3) fine art films (including cartoons, etc.);

(4) special subject films;

(5) music programmes (including MTV music programmes).

Article 14: Audiovisual product work units importing audiovisual products for publishing use, shall report the following documents and materials to the Ministry of Culture:

(1) an Import of Audio (Video) Product Application Form;

(2) a copyright trade agreement accredited and registered by the copyright accreditation organ (Chinese and foreign language versions);

(3) programme specimen tapes (discs).

Article 15: Audiovisual product business work units importing audiovisual products for direct sales, shall report the following documents and materials to the Ministry of Culture:

(1) an Import of Audio (Video) Product Application Form;

(2) an import agreement

(3) programme specimen tapes (discs).

Article 16: Reporting work units shall report an original specimen tape (disc), and may not change the programme name or content.

When reporting classical music or repeated audiovisual product import, it is permitted to not submit specimen tapes (discs).

Specimen tapes (discs) imported for reporting use shall hold an “Imported Audiovisual Product Specimen Tape (Disc) Collection Note” uniformly printed by the Ministry of Culture, and after registration with and stamping by the provincial, autonomous region or municipal People’s Government administrative audiovisual product management department, import formalities for provisional import of goods shall be conducted with Customs.

Article 17: After the Ministry of Culture receives the complete reporting documents and materials, it organizes an expert examination committee to examine audiovisual product content, and makes a decision of approving import or not within ten working days after examination, where there are special circumstances, this shall not exceed 20 working days; a “Audiovisual Product Distribution Permit” will be issued to those approved for import; to those not approved, the reasons shall be explained. Where the reporting work unit disagrees with the examination and approval decision, it may apply for re-examination.

Article 18: The Ministry of Culture establishes and audiovisual product content expert examination committee, committee members are experts invited from relevant areas by the Ministry of Culture

Article 19: Import work units go to Customs with the “Audiovisual Product Distribution Permit” to conduct master tape (master disc) and retail audiovisual product import formalities.

Article 20: Concerning audiovisual products imported for research or scientific reference, the import agency work unit conducts examination and approval formalities with the Ministry of culture on the basis of the import agreement and catalogue.

Article 21: When importing audiovisual products especially used for exhibitions or shows, after approval by the Ministry of Culture, an audiovisual product import business work unit is entrusted to conduct temporary import formalities; where it concerns importing demonstration or propaganda-type audiovisual products complementary with exhibitions or shows of other goods, provisional import formalities are conducted according to relevant Customs regulations.

When importing audiovisual products for special use in exhibitions or shows, they may not be sold or given as present. When it is necessary to sell or give them as presents, examination and approval formalities shall be conducted according to the relevant provisions of these Rules.

Article 22: Concerning audiovisual products entering end exiting the borders carried or mailed by individuals for non-commercial use, the “People’s Republic of China Customs Management regulations on Printed Goods and audiovisual Products Entering and Exiting the Borders Carried or Mailed by Individuals”

Article 23: For audiovisual products imported at the same time as machinery, that contain operating system, equipment manuals, special software and other content, import formalities are handled according to relevant Customs regulations.

Chapter IV: Import management

Article 24: Work units and individuals not having obtained import qualifications may not engage in audiovisual product import business.

Article 25: No work unit or individual may publish, reproduce, wholesale, retail, rent or commercially screen imported audiovisual products not having obtained an “Audiovisual Product Distribution Permit”.

Article 26: Imported audiovisual products used for research or scientific reference may not be commercially reproduced, wholesaled, retailed, rented or screened.

Article 27: Import work units’ import trade agreements signed with foreign sides shall conform to the provisions of Chinese laws and regulations.

Article 28: Concerning audiovisual products of which import is approved and that are used for publication, within three months after the day of approval, it is prohibited to import audiovisual products of that programme for direct retail.

Article 29: No work unit or individual may transfer an “Audiovisual Product Distribution Permit”.

Article 30: When publishing imported aps, the “Audiovisual Product Distribution Permit” approval number as well as the original language name of the programme must be indicated in a clear position on the audiovisual product and its packaging.

Article 31: Audiovisual product work units must strictly according to the examination decision of the Ministry of Culture produce and publish audiovisual products, and may not change the programme name, add or delete programme content without permission.

Article 32: During the production and publication of imported audiovisual products, State standard language and writing shall be used.

Article 33: Within 30 days of publishing an imported audiovisual product, import work units shall send a sample to the Ministry of Culture for filing.

Where there is no implementation for some reason within one year after import approval or a decision is made to terminate it, the import work unit shall report this to the Ministry of Culture for filing and explain the reasons, the Ministry of Culture shall cancel the “Audiovisual Product Distribution Permit” approval number.

Article 34: Reproduction and processing of imported audiovisual products (including covers and packaging), apart from where there is no domestic production capacity, shall be completed domestically.

Article 35: The Ministry of Culture regularly publishes an imported audiovisual product catalogue.

Chapter V: Punitive provisions

Article 36:Where these Rules are violated, and one of the following acts is present; the county-level or higher People’s Government administrative audiovisual product management department, on the basis of the gravity of the circumstances, issues a warning, orders cessation of publication, reproduction, wholesale, retail, rental and screening, confiscates unlawful audiovisual products and unlawful income, and the original permit-issuing department cancels audiovisual product business permits, additionally a fine of five times or more but less than ten times the unlawful business income may be additionally imposed:

(1) importing audiovisual products without obtaining import qualifications, without authorization;

(2) publishing, reproducing, wholesaling, retailing, renting or commercially screening imported audiovisual products that have not obtained an “Audiovisual Product Distribution Permit”;

(3) commercially reproducing, wholesaling, retailing, renting or screening audiovisual products imported for research or scientific reference;

(4) transferring an “Audiovisual Product Distribution Permit”.

Article 37: Where reports are made with documents and materials, and an “Audiovisual Product Distribution Permit” is fraudulently obtained, apart from ordering the provision of the real situation, the Ministry of Culture imposes a fine of 10000 Yuan or more but less than 30000 Yuan; of those already approved, approval documents are cancelled, and in view of the gravity of the circumstances, their import business is suspended for half a year to one year, or their import credentials are cancelled. Where other hazards are created, punishments are imposed according to relevant regulations.

Article 38: Where these Rules are violated, and one of the following acts is present; the Ministry of Culture, on the basis of the gravity of the circumstances, impose a fine of 1000 Yuan or more but less than 30000 Yuan; where circumstances are grave or these provisions are cumulatively violated twice, import business is suspended for half a year to one year:

(1) not indicating the “Audiovisual Product Distribution Permit” number as well as the original language programme name according to regulations when publishing imported audiovisual products;

(2) using language and writing not conform to State standards;

(3) importing work units not submitting specimens to the Ministry of Culture for filing according to regulations.

Article 39: Where audiovisual publishing work units do not produce and publish according to the Ministry of Culture approval decision, or change programme names, add or delete programme content without authorization, the Ministry of Culture, on the basis of the gravity of the circumstances, issues a warning, imposes a fine of 10000 Yuan or more but less than 30000 Yuan, and suspends import business for half a year to one year or cancels import qualifications.

Where unauthorized adding or deleting in audiovisual products improved for import leads to it containing content prohibited by State regulations, the Ministry of Culture or the county-level or higher People’s Government administrative audiovisual product management department, on the basis of the gravity of the circumstances, issues a warning, orders cessation of publishing, reproduction, wholesale, retail, rental and screening of the said audiovisual product, confiscates unlawful audiovisual products and unlawful income, and additionally imposes a fine of 5 times or more but less than 10 times the unlawful business income, and the original permit-issuing organ cancels their audiovisual product publishing business permits.

Article 40: Those violating Customs regulations will be punished by Customs according to the law.

Where violations of these Rules constitute a crime, criminal liability will be prosecuted according to the law.

Chapter VI: Supplementary provisions

Article 41: The interpretation of these Rules is the responsibility of the Ministry of Culture. Where it involves Customs work, the General Administration of Customs is responsible for interpretation.

Article 42: These Rules take effect on the day of promulgation, where there is conflict between earlier relevant regulations and these Rules, these Rules are implemented.

音像制品进口管理办法

第一章 总则

第一条 为了加强对音像制品进口的管理,促进我国音像市场健康有序地发展,丰富人民群众的文化生活,根据国家有关规定,制定本办法。

第二条 本办法所称音像制品,是指录有内容的录音带、录像带、唱片、激光唱盘和激光视盘(商品名称及其HS编码见附件一)等。

第三条 凡从外国及香港特别行政区、澳门和台湾地区进口音像制品从事下列活动的,均适用本办法:
(一)用于音像出版单位出版的;
(二)用于直接销售的;
(三)用于研究、教学参考的;
(四)其他特殊情况需要进口的。

第四条 文化部依照国务院确定的职责负责全国音像制品的进口管理,制定音像制品进口规划,审定音像出版单位和音像制品经营单位(以下称进口单位)进口经营资格,审核进口音像制品内容,调控音像制品进口的品种。
省、自治区、直辖市人民政府音像制品行政管理部门依照本办法管理本行政区域内的音像制品进口工作。

第五条 音像制品进口经营活动应当遵守宪法和有关法律、法规,坚持为人民服务和为社会主义服务的方向,传播有益于经济发展和社会进步的思想、道德、科学技术和文化知识。

第六条 国家禁止进口经营侵犯他人知识产权和有下列内容的音像制品:
(一)危害国家统一、主权和领土完整的;
(二)有损中国形象和尊严的;
(三)煽动民族分裂,破坏民族团结的;
(四)宣扬淫秽、色情、迷信、暴力、吸毒等,违反社会道德规范,有损群众身心健康的;
(五)违背国际关系基本准则,可能影响我国与其他国家正常关系的;
(六)思想和艺术水平庸俗、低下的;
(七)法律、法规规定禁止传播的其他内容。

第七条 国家对音像制品进口经营实行许可制度。

第二章 进口单位

第八条 音像出版单位和音像制品经营单位应当依照本办法经文化部批准后,方可从事音像制品进口经营活动。

第九条 音像出版单位经营进口音像制品的出版发行业务应当符合下列条件:
(一)符合出版社成立宗旨和业务范围;
(二)制作出版国产音像制品成绩突出;
(三)注册资本在人民币200万元以上。
除上述条件外,还应当符合文化部制定的进口音像制品出版单位的总量、布局、结构的规划。

第十条 音像制品经营单位从事音像制品进口,并直接从事销售业务应当符合下列条件:
(一)符合本单位成立宗旨和业务范围;
(二)办理国产版音像制品出口业务或者销售国产版音像制品成绩突出;
(三)注册资本在人民币500万元以上。
除上述条件外,还应当符合文化部制定的从事音像制品进口单位的总量、布局、结构的规划。

第十一条 全国性和省、自治区、直辖市的图书馆、音像资料馆,科研机构、高等院校,以及有其他特殊需要的单位,进口供研究、教学参考的音像制品,应当委托有进口资格的音像制品经营单位办理进口业务。

第十二条 申请从事音像制品进口业务的单位,由所在地省、自治区、直辖市人民政府音像制品行政管理部门审核同意后,报文化部批准,并由文化部统一公布。

第三章 进口许可

第十三条 国家对进口出版、销售的下列音像制品实行内容审查制度:
(一)故事片(含舞台、戏剧、艺术片);
(二)纪录片;
(三)美术片(含动画片等);
(四)专题片;
(五)音乐节目(含音乐MTV节目)。

第十四条 音像出版单位进口用于出版的音像制品,应当向文化部申报以下文件和材料:
(一)进口录音(像)制品报审表;
(二)经著作权认证机构认证登记的版权贸易协议(中外文文本)。
(三)节目样带(片)。

第十五条 音像制品经营单位进口用于直接销售的音像制品,应当向文化部申报以下文件和材料:
(一)进口录音(像)制品报审表;
(二)进口协议;
(三)节目样带(片)。

第十六条 申报单位应当报送原始样带(片),并不得更改节目名称和内容。
申报古典音乐和重复进口的音像制品,可以不报送样带(片)。
进口用于报审的样带(片),应当持由文化部统一印制的《进口音像制品样带(片)提取单》,经省、自治区、直辖市人民政府音像制品行政管理部门登记、盖章后,到海关按暂时进口货物办理进口手续。

第十七条 文化部在收到全部申报文件和材料后,组织音像制品内容专家审查委员会审查,并在审查后的10个工作日内作出是否批准进口的决定,有特殊情况的,不超过20个工作日;经批准进口的,发给《音像制品发行许可证》;不予批准的,应当说明理由。申报单位对审批决定不服的,可以申请复审。

第十八条 文化部设立音像制品内容专家审查委员会,委员会成员由文化部聘请有关方面的专家组成。

第十九条 进口单位凭《音像制品发行许可证》到海关办理母带(母盘)和销售用音像制品的进口手续。

第二十条 进口用于研究、教学参考的音像制品,由代理进口的单位将进口协议和目录报文化部办理进口审批手续。

第二十一条 进口专门用于展览、展示活动的音像制品,经文化部批准后,委托音像制品进口经营单位办理暂时进口手续;为配合其他商品展览、展示活动进口示范宣传性音像制品的,依照海关有关规定办理暂时进口手续。
进口专门用于展览、展示活动的音像制品不得销售、赠送。需要转为销售、赠送的,应当按照本章有关规定办理审批手续。

第二十二条 个人携带和邮寄用于非经营目的的音像制品进出境,按照《中华人民共和国海关对个人携带和邮寄印刷品及音像制品进出境管理规定》执行。

第二十三条 随机器设备同时进口的记录操作系统、设备说明、专用软件等内容的音像制品,按照海关的有关规定办理进口手续。

第四章 进口管理

第二十四条 未取得进口资格的单位和个人,不得从事音像制品的进口业务。

第二十五条 任何单位和个人不得出版、复制、批发、零售、出租和营业性放映未取得《音像制品发行许可证》的进口音像制品。

第二十六条 用于研究、教学参考的进口音像制品,不得进行经营性复制、批发、零售、出租和放映。

第二十七条 进口单位与外方签订的进口贸易协议应当符合中国法律法规的规定。

第二十八条 经批准进口用于出版的音像节目,自批准之日起3个月内,禁止进口用于直接销售的该节目音像制品。

第二十九条 任何单位和个人不得转让《音像制品发行许可证》。

第三十条 出版进口音像制品必须在音像制品及其包装的明显位置标明《音像制品发行许可证》批准文号以及节目名称的原文。

第三十一条 音像出版单位必须严格按照文化部的审查决定制作出版音像制品,不得擅自变更节目名称和增删节目内容。

第三十二条 进口音像制品的制作出版应当使用国家规范的语言文字。

第三十三条 进口音像制品自出版之日起30日内,进口单位应当将样品送文化部备案。
自批准进口一年内因故未执行或决定终止进口的,进口单位应当报文化部备案并说明原因,文化部撤销其《音像制品发行许可证》批准文号。

第三十四条 进口音像制品的复制加工(含封面和包装),除境内不能生产的以外,均应在境内完成。

第三十五条 文化部定期公布进口音像制品目录。

第五章 罚则

第三十六条 违反本办法,有下列行为之一的,由县级以上人民政府音像制品行政管理部门根据情节轻重,给予警告,责令停止出版、复制、批发、零售、出租和放映,没收违法音像制品和违法所得,由原审批部门吊销音像制品经营许可证,可以并处违法所得5倍以上10倍以下的罚款:
(一)未取得进口资格,擅自进口音像制品的;
(二)出版、复制、批发、零售、出租和营业性放映未取得《音像制品发行许可证》的进口音像制品的;
(三)经营性复制、批发、零售、出租和放映用于研究、教学参考的进口音像制品的;
(四)转让《音像制品发行许可证》的。

第三十七条 以虚假文件和材料报批,骗取《音像制品发行许可证》的,除责令其提供真实情况外,由文化部处以1万元以上3万元以下的罚款;已经批准的,撤销批准文件,并视其情节轻重,停止其进口业务半年至一年,或者取消其进口资格。造成其他危害的,根据有关规定处罚。

第三十八条 违反本办法,有下列行为之一的,由文化部根据情节轻重给予警告,处以1万元以上3万元以下的罚款;情节严重或者累计违反本规定两次的,停止其进口业务半年至一年:
(一)出版进口音像制品未按照规定标明《音像制品发行许可证》批准文号以及节目名称的原文的;
(二)使用不符合国家规范的语言文字的;
(三)进口单位未按照规定向文化部报送样品备案的。

第三十九条 音像出版单位未按照文化部的批准决定制作出版,擅自变更节目名称或增删节目内容的,由文化部根据情节轻重,给予警告,处以1万元以上3万元以下的罚款,并停止其进口业务半年至一年或者取消其进口资格。
擅自增删经审查批准进口的音像制品导致其含有国家规定禁止内容的,由文化部或者县级以上人民政府音像制品行政管理部门根据情节轻重,给予警告,责令停止出版、复制、批发、零售、出租、放映该音像制品,没收违法音像制品和违法所得,并处违法所得5倍以上10倍以下的罚款,由原发证机关吊销音像制品出版经营许可证。

第四十条 违反海关规定的,由海关依法处理。
违反本办法构成犯罪的,依法追究刑事责任。

第六章 附则

第四十一条 本办法由文化部负责解释。涉及海关业务的,由海关总署负责解释。

第四十二条 本办法自发布之日起施行,此前有关规定与本办法相抵触的,按本办法执行。
