Opinions Concerning Strengthening Radio and Television Cable Network Construction and Management (Ministry of Information Industry, State Administration of Radio, Film and Television, 13 September 1999)

 

China’s radio and television transmission network already has a history of nearly 50 years of development. In the beginning after founding the country, development of radio broadcast networks already began. In the early Eighties, the development of cable television began. In the Nineties, radio and television network construction entered a phase of rapid development, and now, about 2.25 million kilometres of cable television transmission networks have been constructed. Since the year 1992, cable television networks have developed at a speed of adding 10 million households per year, by December 1998, the nationwide cable television user number reached 770 million, the number one position in the world. Radio and television and their transmission networks have become an important component part of national informatization. In order to guarantee the safe broadcast of radio and television programmes, avoid duplicate construction of cable transmission networks, hereby, the following opinions concerning strengthening radio and television network construction and management are put forward:

 

Article 1: Persisting in preventing duplicate construction

It is necessary to persist in implementing the “State Council Secretariat Notice Concerning Strengthening Radio and Television Transmission Network Construction and Management” (GBH No. (1998)33) and other relevant regulations, integrate the real situation of radio and television departments, formulating strongly concrete and feasible measures, grasping the implementation of requirements such as practicing separation of government and enterprises in radio and television transmission network construction and management, establishing enterprise-type radio and television transmission enterprises, accepting the comprehensive planning and administrative management by the controlling department for information industry, realistically avoiding duplicate construction, etc. Complying with the spirit of the State Council comrades’ target concerning the necessity to fully utilize the present telecommunications networks and radio and television departments may install cable television access networks, radio and television cable network construction is divided into two situations to deal with: the first category is that radio and television transmission optical backbone lines from the central to the county levels, where the radio and television departments have not built them, they shall in principle not be built anymore. State telecommunication network backbones and other already constructed networks must be fully utilized through all sorts of methods, and no duplicate construction is to be undertaken anymore. Where new construction is truly required, it must conform to national informatization planning and be approved by the controlling department for information industry. The other category is city, district and county or lower radio and television distribution networks, and is also city and county radio and television stations’ front-end broadcast networks reaching the users, whish are to be shaped into correspondingly complete specialized networks by radio and television departments, in order to adapt to the special requirements of radio and television programme management and developing users. New construction of the part of distribution networks above users’ contact points, must agree with the comprehensive planning of the controlling authority of information industry; the connection part of distribution network are to be arranged by radio stations and television stations on the basis of users’ requirements.

 

Article 2: Guaranteeing the safe transmission of radio and television programmes

 

Following the development of science and technology, radio and television has already become the broadest news medium of the masses on the basis of its own technological superiority, and is an important battleground for public opinion and propaganda. This sort of particularity must be fully tested for in radio and television transmission network construction. At the same time, under the circumstances that it will be necessary for China to further open up to the outside world, it will also be necessary to consider how to guarantee the safe transmission of radio and television programmes, therefore, at the same time as providing for the establishment of radio and television network transmission companies, accepting the sectoral management of the controlling department for information industry in aspects such as formulating radio and television transmission network comprehensive planning and nationwide unified technological standards, etc. in order to provide the necessary conditions for managing radio and television propaganda closely and well, there must be further clarification, and establishment of cable television channels, establishment of on-line broadcast front-ends and operation of radio and television programme transmission business, etc., must be permitted by the controlling department for radio and television.

 

Article 3: Accelerating the pace of radio and television sector reform

(1) Establishing enterprise-type radio and television transmission network companies. Integrating the reform of the radio and television sector and the spirit of the Centre concerning eliminating fragmentation and eliminating overflow, with the existing radio and television network assets as basis, with provinces, autonomous regions and municipalities as work units, establishing companies, districts (cities) and counties shall establish branch offices or subsidiary companies and unify operations and management of radio and television transmission business. The question of reorganizing national optical backbone cable assets already constructed by the State Administration of Radio Film and Television will be subject to specialized research, and plans to deal with it will be put forward afterwards. There may be two sorts of methods of subordination for radio and television transmission network companies’: the first is to bring transmission network companies into groups on the basis of provinces, autonomous regions and municipalities reorganizing radio and television groups that include radio stations and television stations; the second is to earmark transmission network assets already formed by all levels’ radio and television departments into radio stations or television stations at the same levels, where the  radio and radio stations or television stations establish radio and television transmission network companies. Transmission network companies guarantee the transmission safety of radio and television programmes according to relevant State regulations, and at the same time deal with the cooperation relationship with telecommunications and other aspects. Before  relevant regulations are made, radio and television transmission network companies are not to go on the market for the time being, where there is a real need, individual cases are to be reported for approval. Radio stations and television stations and their broadcasting business, programme production and broadcasting operations may not go on the market.

 

(2) Forcefully extending public channels. On the basis that county-level radio and television implements unifying the three stations, the provincial-level television station produces a set of public programmes to provide to all county television stations in their jurisdiction for broadcast, from which certain timeslots are provided to county-level television stations to broadcast the news and special theme programmes they produced themselves. Moving the merging of district (city) and provincial-level wireless television stations and cable television stations forward, further optimizing the rational allocation of resources and reducing internal contradictions.

 

Article 4: Substantially reducing network royalties

At present, the fees for renting telecommunications networks are excessively high, and renting networks is less worthwhile than establishing networks. In order to change this sort of phenomenon, it is necessary to determine reasonable prices as soon as possible, and bring rental fees down to levels at which work units using networks feel that building networks is not as good as renting networks, and avoiding duplicate construction from mechanisms.

 

Article 5: Continuing to comply with the division of work between telecommunications departments and radio and television departments

According to regulations, telecommunications departments may not engage in radio and television business, and radio and television departments may not engage in telecommunications business, this must be determinedly implemented.

 

Article 6: Protecting the lawful rights and interests of consumers is the common responsibility of the whole society

The State encourages and supports all organizations and individuals into conducting social supervision over activities harming the lawful rights and interests of consumers. Mass broadcast media shall do propaganda on safeguarding the lawful rights and interests of consumers well, and conduct public opinion supervision over activities damaging the lawful rights and interests of consumers.

中国广播电视传输网络已有近50年发展历史。建国初,已开始发展广播网络。80代初,开始发展有线电视。90年代,广播电视网络建设进入高速发展阶段,现已建成有线电视传输网约225万公里。1992年以来,有线电视每年以新增1000万户的速度发展,至1998年12月,全国有线电视用户已达7700多万,列世界第一位。广播电视及其传输网络,已成为国家信息化的重要组成部分。为保障广播电视节目的安全播出,避免有线传输网络的重复建设,现就加强对广播电视有线网络的建设和管理提出如下意见:

 

第一条 坚决制止重复建设

 

要坚决贯彻执行《国务院办公厅关于加强广播电视传输网络建设管理的通知》(国办函〔1998〕33号)等有关规定,结合广播电视部门的实际情况,制订具体的、操作性强的措施,抓紧落实广播电视传输网络的建设和管理实行政企分开,成立企业化的广播电视传输公司,接受信息产业主管部门的统筹规划和行业管理,切实避免重复建设等要求。遵照国务院领导同志关于要充分利用现有通信网和广播电视部门可以安装有线电视入户网的指标精神,广播电视有线网络建设分两类情况处理:一类是从中央到县一级的广播电视传输光缆干线,广播电视部门未建的原则上不得再建。要通过各种方式充分利用国家通信主干网和其他已建成的网络,不再搞重复建设。确需新建,须符合国家信息化规划并经过信息产业主管部门同意。另一类是城市市区和县以下的广播电视分配网,也就是市、县广播电视台的播出前端到用户的网络,应由广播电视部门形成相对完整的专用网,以适应广播电视节目管理和发展用户的特殊要求。分配网中的入户接点以上部分,新建须经信息产业主管部门统筹规划同意;分配网中的入户部分,由广播电台、电视台根据发展用户的需要进行安排。

 

第二条 确保广播电视节目安全传输

 

随着科学技术的发展,广播电视以自身的技术优势,已成为群众最广泛的传播媒体,是舆论宣传的重要阵地。对广播电视传输网络的管理,应充分考试这种特殊性。同时,在中国将要进一步对外开放的情况下,还要考虑如何保证广播电视节目的安全传输,为此,在规定建立广播电视网传输公司、接受信息产业主管部门在制定广播电视传输网的统筹规划和全国统一技术标准等方面行业管理的同时,为给管住管好广播电视宣传提供必要条件,必须进一步明确,建立有线电视频道、设立网上播出前端和经营广播电视节目传送业务等,须经广播电视主管部门许可。

 

第三条 加快广播电视行业改革步伐

 

(一)建立企业化的广播电视网络传输公司。结合广播电视业的改革和中央关于治散治滥的精神,以现有广播电视网络资产为基础,以省、自治区、直辖市为单位组建公司,地(市)、县相应建立分公司或子公司,统一经营管理广播电视传输业务。国家广播电影电视总局已建成的国家级光缆干线资产的重组问题将作为专题研究,然后提出处理方案。广播电视网络传输公司的归属方式可以有两种:一是在省、自治区、直辖市组建包括广播电台和电视台在内的广播电视集团的基础上,将网络传输公司纳入集团;二是将各级广播电视部门已形成的传输网络资产划入同级广播电台、电视台,由广播电台、电视台组建广播电视网络传输公司。网络传输公司按照国家有关规定保障广播电视节目的安全传输,同时处理好与电信等方面的合作关系。在作出有关规定之前,广播电视网络传输公司暂不上市,确有需要的个案报批。广播电台、电视台及其播出业务、节目制作和广播经营不得上市。

 

(二)大力推广公共频道。在县级广播电视实行三台合一的基础上,由省级电视台制作一套公共节目供所辖各县电视台播出,从中空出一定时段供县级电视台播放自己制作的新闻和专题节目。 推进地(市)、省级无线电视台和有线电视台的合并,进一步优化资源的合理配置,减少内部矛盾。

 

第四条 大幅度降低网络租费

 

目前,租用电信网资费过高,租网不如建网合算。为改变这种现象,要尽快确定合理价格,把租金下调到让用网单位感到建网不如租网的水平,从机制上避免重复建设。

 

第五条 继续遵守电信部门与广播电视部门的分工

 

按照规定,电信部门不得从事广播电视业务,广播电视部门不得从事通信业务,对此必须坚决贯彻执行。

 

第六条 保护消费者的合法权益是全社会的共同责任。

 

国家鼓励、支持一切组织和个人对损害消费者合法权益的行为进行社 会监督。 大众传播媒介应当做好维护消费者合法权益的宣传,对损害消费者合 法权益的行为进行舆论监督。
