Provisional Information Network Dissemination of Radio, Film and Television-Type Programme Supervision Management Rules

Article 1: In order to stimulate the construction of a socialist spiritual civilization, standardize radio, film and television-type programme dissemination order, strengthen information network dissemination of radio, film and television-type programme supervision and management, these Management Rules are formulated.

Article 2: These Rules apply to disseminating radio, film and television-type programme work through information networks and non-broadcasting methods (including but not limited to on-demand methods) and corresponding activities of editing, broadcasting or transmitting radio, film and television-type programmes. These Rules do not apply to radio-method broadcast or transmission of programmes, counting as radio, film and television programme dissemination, which is standardized by the “Radio and Television Management Regulations.

Article 3: Information networks as named in these Rules, refers to systems using many kinds of media to conduct information dissemination, composed of information sending, transmission, receiving and handling equipment, connected through all sorts of concrete forms of wireless or cable-linked paths, including satellite, microwave, optical fibre, coaxial cable, double-twist cable, etc. Information networks include radio and television transmission coverage networks, communication networks, computer networks, closed-circuit television systems, etc.

Radio, film and television-type programme as named in these Rules, refers to pictures composed of continuously moving images or continuously listenable sounds, similar in appearance to radio or television programmes or films.

Radio, film and television-type programme producer as named in these Rules, refers to organs that, after organizing or arranging radio, film and television-type programme material, disseminate them to the public through information networks.

Information network operators as named in these Regulations, refers to organs providing information network software and hardware platforms and other technological support.

Article 4: The State Administration of Radio, Film and Television is the controlling entity of dissemination of radio, film and television-type programmes through information networks, and is responsible for formulating nationwide dissemination of radio, film and television-type programmes through information networks development plans, and determining the total amount, distribution and structuring of radio, film and television-type programme dissemination.

All levels’ administrative radio, film and television entities are responsible for dissemination of radio, film and television-type programmes through information networks development planning, supervision and management work in their jurisdiction.

Article 5: The State Administration of Radio, Film and Television implements a permit system over dissemination of radio, film and television-type programmes through information networks. Only when holding a “Online Dissemination of Radio, Film and Television-Type Programmes Permit”, is it permitted to launch dissemination of radio, film and television-type programmes through information networks work.

Article 6: The State Administration of Radio, Film and Television implements categorized management over the following four categories of radio, film and television-type programmes disseminated over information networks: 1, news-type; 2, television and film drama type; 3, entertainment-type, including music, opera, sport, etc.; 4, special-type, including science and technology, education, medicine, finance and economics, weather, military affairs, etc.

Article 7: For launching dissemination business of radio, film and television-type programmes through information networks to the public, the following basic conditions must be met simultaneously:

(1) conforming to the concrete plans, technological standards and management requirements of dissemination of radio, film and television-type programmes through information networks to the public;

(2) having own finances, equipment and premises suited for the business scale;

(3) having radio, film and television-type programme resources conform to State regulations suited for the business scale;

(4) having the necessary expert personnel;

(5) conforming to other relevant provisions of State laws and regulations.

For disseminating different categories of radio, film and television-type programmes through the information network, corresponding filing conditions must also be met.

Article 8: For launching dissemination of news-type programmes through information networks work, apart from meeting the basic conditions provided in Article 7 of these Rules, one of the following conditions must also be met:

(1) already having obtained the “Online Dissemination of Radio, Film and Television-Type Programmes Permit”, engaging in disseminating entertainment-type or special-type programmes for three years of more;

(2) being a news organ established according to the law for three years or more.

Article 9: For launching dissemination of television and film drama programme through information networks work, apart from meeting the basic conditions provided in Article 7 of these Rules, one of the following conditions must also be met:

(1) having obtained the “Online Dissemination of Radio, Film and Television-Type Programmes Permit”, engaging in disseminating entertainment-type programmes for two years or more;

(2) being a film and television production business organ operating according to the law for three years or more.

Article 10: For launching dissemination of radio, film and television-type programmes through information networks to the public work, written materials relevant to the provisions of Article 7, Article 8 and Article 9 of these Rules must be held, and after examination, verification and agreement by the provincial-level administrative radio, film and television entity, reported to the State Administration of Radio, Film and Television for approval. Direct central-subordinate work units and enterprises registered with the State Administration of Industry and Commerce, may directly raise applications with the State Administration of Radio, Film and Television. Those examined as meeting conditions, are issued with a “Online Dissemination of Radio, Film and Television-Type Programmes Permit” by the State Administration of Radio, Film and Television. After obtaining a permit, dissemination work may only be launched according to the symbol, dissemination method, dissemination carrier, dissemination scope and programme category clearly indicated on the “Online Dissemination of Radio, Film and Television-Type Programmes Permit”. Those needing to change the above items, shall according to the abovementioned procedure conduct relevant modification examination and approval formalities.

After obtaining the “Online Dissemination of Radio, Film and Television-Type Programmes Permit”, when change occurs in matters such as the launching work unit’s name, address, website address, web-site name, legal representative, etc., they shall within 30 days of the change apply for permit exchange with the original permit-issuing work unit.

Article 11: When applying for establishment of a special organ to launch dissemination of radio, film and television-type programmes through information networks work, the sponsoring work unit conducts examination and approval formalities according to the provision of Article 10 of these Rules. Those operating this sort of work in an enterprise form, before going to the industry and commerce entity to conduct registration formalities, must first obtain a “Online Dissemination of Radio, Film and Television-Type Programmes Permit”.

Article 12: Work units obtaining permits shall open work formally within one year; of those not able to open in excess of the time limit, the permit-issuing organ recalls the permit.

Article 13: The State implements an “Online Dissemination of Radio, Film and Television-Type Programmes Permit” annual examination system.

The period of validity of the “Online Dissemination of Radio, Film and Television-Type Programmes Permit” is three years. Within the period of validity, work units obtaining an “Online Dissemination of Radio, Film and Television-Type Programmes Permit”, shall within the statutory time limits submit annual examination reports and conduct annual examination formalities. Those not meeting annual examination qualifications rectify within a set time, those not meeting conditions after rectification, will have their “Online Dissemination of Radio, Film and Television-Type Programmes Permit” recalled. Permits of work units not conducting annual examination formalities according to regulations, become invalid automatically. Those needing to continue to operate when the period of validity expires, shall conduct continuation of permit formalities 60 days before the permit expires.

Concrete rules for annual examination will be formulated by the State Administration of Radio, Film and Television elsewhere.

Article 14: Information network possessors and operators may not in any way rent or sell their network to work units not having a “Online Dissemination of Radio, Film and Television-Type Programmes Permit” for use in dissemination of radio, film and television-type programmes through information networks to the public, and may not provide network hardware and software platforms and other services related to radio, film and television-type programme dissemination to work units not having a “Online Dissemination of Radio, Film and Television-Type Programmes Permit”.

Article 15: News-type programmes used for dissemination through information networks to the public are limited to programmes produced and broadcasted by domestic radio stations, television stations or radio and television stations. Television and film drama-type programmes used for dissemination through information networks to the public must be chosen from a special radio, film and television-type programme catalogue.

The special radio, film and television-type programme catalogue is compiled by the State Administration of Radio, Film and Television. Special programmes and films are provided by all sorts of programme copyright holders, and reported to provincial-level or higher administrative radio, film and television entities for examination, verification and registration. The State Administration of Radio, Film and Television is responsible for announcing the circumstances of programmes and films entered into the catalogue regularly to work units holding the “Online Dissemination of Radio, Film and Television-Type Programmes Permit”.

Entertainment-type and special-type programmes used for dissemination through information networks to the public must conform to the provisions of relevant State laws and regulations.

Article 16: It is prohibited to disseminate programmes through information networks that contain the following content:

(1) harming State unity, sovereignty and territorial integrity;

(2) harming State security, honour and interest;

(3) inciting ethnic separatism, destroying ethnic unity;

(4) divulging State secrets;

(5) slandering or insulting other persons;

(6) publicizing obscenity, superstition or playing up violence;

(7) false information;

(8) television or film drama programmes not included in the radio, film and television-type programme special catalogue;

(9) foreign programmes recorded through networks or foreign media;

(10) other content prohibited by laws and regulations.

Article 17: Radio, film and television-type programme disseminators must bear responsibility for the lawfulness of the programmes they broadcast.

Article 18: The State encourages radio stations and television stations to disseminate that station’s radio and television programmes through the international Internet.

Those directly broadcasting, transmitting or using radio stations’ and television stations’ programmes through information networks, shall obtain permission from that radio station or television station.

Article 19: All levels’ administrative radio, film and television entities shall through methods such as monitoring, establishing corresponding public supervision reporting systems, etc., conduct supervision and management over dissemination of radio, film and television-type programmes through information networks.

Article 20: Work units violating these Rules, having one of the following acts, will be ordered to cease the unlawful activity and issued a warning by the provincial-level or higher administrative radio, film and television entity, and may be fined less than 30.000 Yuan. Those violating public security management regulations, will be given public order management punishments by Public Security organs; where it constitutes a crime, criminal liability will be investigated according to the law:

(1) without permission, unauthorized launch of dissemination of radio, film and television-type programmes through information networks to the public work;

(2) radio, film and television-type programmes violating the provisions of Article 15 and Article 16 of these Rules.

Article 21: These Rules take effect on the day of promulgation.

根据国家有关规定,我局制定了《信息网络传播广播电影电视类节目监督管理暂行办法》,现予下发,自下发之日起施行。

第一条 为促进社会主义精神文明建设,规范广播电影电视类节目的传播秩序,加强信息网络传播广播电影电视类节目的监督管理,制定本管理办法。

第二条 本办法适用于开办通过信息网络以非广播方式(包括但不限于点播方式)传播广播电影电视类节目的业务及相应的编辑、播放、传输广播电影电视类节目等活动。以广播方式播放、传输节目,属于广播电视节目的传播,由《广播电视管理条例》规范,不适用本办法。

第三条 本办法所称的信息网络,是指通过无线或有线链路相联接,包括卫星、微波、光纤、同轴电缆、双绞线等各种具体的形式,由信息发送、传输、接收、处理设备所组成的,使用多种媒体进行信息传播的系统。信息网络包括广播电视传输覆盖网、通讯网、计算机网、闭路电视系统等。
    本办法所称的广播电影电视类节目,是指在表现形式上类同于广播电视节目或电影片,由可连续运动的画面组成的图象或可收听到的连续的声音。
    本办法所称的广播电影电视类节目传播者,是指将广播电影电视类节目素材组织编排后,通过信息网络向公众传播的机构。
    本办法所称的信息网络经营者,是指提供信息网络硬软件平台及其它技术支持的机构。

第四条 国家广播电影电视总局是信息网络传播广播电影电视类节目的主管部门,负责制定全国信息网络传播广播电影电视类节目的发展规划,确定广播电影电视类节目传播者的总量、布局和结构。
    各级广播电视行政部门负责本辖区内信息网络传播广播电影电视类节目的发展规划和监督管理工作。

第五条 国家广播电影电视总局对信息网络传播广播电影电视类节目的业务实行许可管理。持有《网上传播广播电影电视类节目许可证》,方可开办通过信息网络向公众传播广播电影电视类节目的业务。

第六条 国家广播电影电视总局对通过信息网络传播的广播电影电视类节目按以下四个类别实行分类管理:1、新闻类;2、影视剧类;3、娱乐类,包括音乐、戏曲、体育等;4、专业类,包括科技、教育、医疗、财经、气象、军事等。
    第七条 开办通过信息网络向公众传播广播电影电视类节目的业务,应当同时具备以下基本条件:
    (一)符合通过信息网络向公众传播广播电影电视类节目的具体规划、技术标准和管理要求;

(二)有与业务规模相适应的自有资金、设备及场所;
    (三)拥有与其业务规模相适应的符合国家规定的广播电影电视类节目资源;

(四)拥有必要的专业人员;

(五)符合国家法律、法规及其他有关规定。
    通过信息网络传播不同类别的广播电影电视类节目,还应当具备相应的申办条件。

第八条 开办通过信息网络传播新闻类节目的业务,除具备本办法第七条规定的基本条件外,还应当具备以下条件之一:

(一) 已取得《网上传播广播电影电视类节目许可证》,从事娱乐类或专业类节目传播业务3年以上;

(二) 依法设立3年以上的新闻机构。

第九条 开办通过信息网络传播影视剧类节目的业务,除具备本办法第七条规定的基本条件外,还应当具备以下条件之一:

(一) 取得《网上传播广播电影电视类节目许可证》,从事娱乐类节目传播业务2年以上;

(二) 依法经营3年以上的影视制作经营机构。

第十条 开办通过信息网络向公众传播广播电影电视类节目业务,须持与本办法第七条、第八条、第九条规定有关的书面材料,经省级广播电视行政部门审核同意后,报国家广播电影电视总局审批。中央直属单位和在国家工商行政管理局注册的企业,可直接向国家广播电影电视总局提出申请。审查合格者,由国家广播电影电视总局发给《网上传播广播电影电视类节目许可证》。取得许可证后,只能按照《网上传播广播电影电视类节目许可证》载明的标识、传播方式、传播载体、传播范围和节目类别开办传播业务。需变更以上事项者,应当按上述程序办理有关的变更审批手续。
    取得《网上传播广播电影电视类节目许可证》后,如果开办单位的名称、地址、网址、网站名、法定代表人等项目发生变更时,应当在变更后的三十日向原发证单位申请换证。

第十一条 申请成立专门机构开办通过信息网络传播广播电影电视类节目业务的,由发起单位按本办法第十条的规定办理审批手续。以企业形式经营此类业务的,到工商部门办理注册登记手续前,须先取得《网上传播广播电影电视类节目许可证》。

第十二条 取得许可证的单位应当在一年之内正式开通业务;逾期不能开通的,由发证机关收回许可证。

第十三条 国家实行《网上传播广播电影电视类节目许可证》年检制度。
    《网上传播广播电影电视类节目许可证》有效期为三年。在有效期内,取得《网上传播广播电影电视类节目许可证》的单位,应当在规定的期限内提交年检报告,办理年检手续。年检不合格者限期整改,整改后仍不合格的,收回《网上传播广播电影电视类节目许可证》。未按规定办理年检手续的单位,其许可证自动失效。有效期届满,需要继续经营的,应当在许可证届满前六十日办理续证手续。
    年检的具体办法由国家广播电影电视总局另行制定。
    第十四条 信息网络的拥有者和经营者不得以任何形式将网络出租、出让给未持有《网上传播广播电影电视类节目许可证》的单位用以向公众传播广播电影电视类节目,不得向未持有《网上传播广播电影电视类节目许可证》的单位提供网络硬软件平台和其它与传播广播电影电视类节目有关的服务。

第十五条 用于通过信息网络向公众传播的新闻类节目限于境内广播电台、电视台、广播电视台制作、播放的节目。用于通过信息网络向公众传播的影视剧类节目须从广播电影电视类节目专用目录中选取。
    广播电影电视类节目专用目录由国家广播电影电视总局编制。专用节目片目由各类节目的版权持有者提供,报省级以上广播电视行政部门审核登记。国家广播电影电视总局负责将载入目录中的节目片目等情况定期向持有《网上传播广播电影电视类节目许可证》的单位公布。
    用于通过信息网络向公众传播的娱乐类、专业类节目须符合国家有关法律、法规的规定。

第十六条 禁止通过信息网络传播有以下内容的节目:
    (一)危害国家的统一、主权和领土完整的;
    (二)危害国家的安全、荣誉和利益的;
    (三)煽动民族分裂、破坏民族团结的;

(四)泄漏国家秘密的;

(五)诽谤、侮辱他人的;

(六)宣扬淫秽、迷信或者渲染暴力的;

(七)虚假的信息;
    (八)不列入广播电影电视类节目专用目录的影视剧类节目;
    (九)从网络或境外媒体上收录下来的境外节目;
    (十)法律、法规规定禁止的其它内容。

第十七条 广播电影电视类节目传播者必须对所传播节目的合法性承担责任。
    第十八条 国家鼓励广播电台、电视台通过国际互联网络传播本台广播电视节目。
    通过信息网络直播、转播、使用广播电台、电视台节目的,应取得该广播电台、电视台的许可。

第十九条 各级广播电视行政部门应通过监听监看、建立相应的公众监督举报制度等方式,对信息网络传播广播电影电视类节目进行监督管理。

第二十条 违反本办法,有下列行为之一的单位,由省级以上广播电视行政部门责令停止违法活动,给予警告,没收违法所得,可以并处人民币3万元以下的罚款。违反治安管理规定的,由公安机关依法给予治安管理处罚;构成犯罪的,依法追究刑事责任。

(一) 未经许可,擅自开办通过信息网络向公众传播广播电影电视类节目的业务的;

(二) 违反本办法第十五条、第十六条的规定传播广播电影电视类节目的。
    第二十一条 本办法自发布之日起施行。
