The Central Propaganda Department and Administration of Press and Publications “Opinions concerning Establishing a Warning System for Newspapers and Periodicals Violating Discipline and regulations” have been agreed to by the Centre. In order to implement the establishment of a warning system for newspapers and periodicals violating discipline and regulations, the Central Propaganda Department and the Administration of Press and Publications have formulated the “Implementation Rules for the Warning System for Newspapers and Periodicals Violating Discipline and regulations”.

“Opinions concerning Establishing a Warning System for Newspapers and Periodicals Violating Discipline and regulations”

Strengthening management over the propaganda, ideology and cultural battlefields, including strengthening management over newspapers and periodicals, and especially small newspapers, small periodicals and other media, persisting in establishing and safeguarding the guiding position of Marxism, strict propaganda discipline, and not providing dissemination battlefields for erroneous discourse are important tasks of all levels’ Party Committee Propaganda Departments and administrative press and publications management departments at this time. In order to guarantee the correct public opinion orientation of newspapers and periodicals, stimulate the flourishing and healthy development of the newspaper and periodical sector, hereby, the following opinions on establishing a warning system for newspapers and periodicals violating discipline and regulations are hereby put forward:

I, Establishing a warning system is an important measure to strengthen macro-level management binding force of news and public opinion work

Since the 14th Party Congress, the propaganda and ideological front has summarized historical experiences, and has, on the basis of the new situations and new issues that emerged under new circumstances, strengthened macro-level management, established and completed management structures and mechanisms, has persisted in the correct public opinion orientation in news and public opinion work, has served the people, served Socialism, and served the larger picture of the work of the entire Party and the entire country, has given rein to an important guaranteeing function and has obtained clear achievements. But, the problems that management over some newspapers and periodicals is unsatisfactory and measures aren’t implemented still exists, especially management over small newspapers and small periodicals is a weak link. Establishing a warning system for newspapers and periodicals violating discipline and regulations is an important measure that benefits strengthening the binding force of macro-level management over news and public opinion work, guaranteeing that the principles of policies of the Party concerning news and propaganda work are implemented even better; it benefits standardization of newspaper and periodical management and safeguarding regular propaganda order; it also benefits the stimulation of the flourishing and healthy development of the newspaper and periodical sector.

II, The duties and requirements for implementing the warning system

According to the principles of hierarchical management, the Central Propaganda Department is responsible for the management of news and propaganda work of central-level newspapers and periodicals, and to put forward a warning opinions concerning central-level newspapers and periodicals where problems of violations of discipline or regulations occur, the Administration of Press and Publications issues a “warning notification letter”, and copies this to the controlling and sponsoring work unit of the newspaper or periodical in question, and files it with the Central Propaganda Department. All provincial, autonomous region and municipal Party Committee propaganda departments must strictly implement localized management, and be responsible over newspapers and periodicals in their locality, including management work of news and propaganda of newspapers and periodicals run by Centre or State organs and central-level media in their localities, and to put forward warning opinions concerning problems of violating discipline and regulations occurring, the local administrative press and publications management department issues a “warning notification letter”, copies this to the controlling and sponsoring work unit of the newspaper or periodical in question, and files it with the Central Propaganda Department, the Administration of Press and Publications and the Party Committee Propaganda Department.

Party Committee Propaganda Departments and administrative press and publications management departments are to put forward warnings against the following problems violating discipline and violating regulations:

1, denying the guiding position of Marxism-Leninism, Mao-Zedong Thought or Deng Xiaoping Theory, creating grave social influence;

2, going against the Party line, principles and policies, displaying grave political mistakes;

3, divulging State secrets, harming national security, damaging State interests;

4, violating ethnic or religious policies, harming the unity of the nations, influencing social stability;

5, propagating murder, violence, sex, superstition, pseudoscience and mistaken ideological orientations;

6, disseminating rumours, releasing false news, interfering with the larger picture of work;

7, other grave mistakes identified by Party Committee propaganda departments and administrative press and publications management departments.

III, Implementation rules for the warning system

1, Where Party Committee Propaganda Departments and administrative press and publications management departments discovering problems of violating discipline and regulations in newspapers within their jurisdictions, the administrative press and publications management department must timely issue a “warning notification letter”, point out the problem, and issue a warning.

2, After Party Committee Propaganda Departments and administrative press and publications management departments have issued a warning opinion concerning newspapers and periodicals violating discipline and regulations, the controlling and sponsoring work units of the newspaper or periodical in question must make a written inspection, and impose corresponding punishment on the responsible person or the person in charge at the newspaper that caused the mistake. Administrative press and publications management departments must record and file the situation of violations of discipline and regulations occurring in newspapers and periodicals.

3, Situations in which Party Committee Propaganda Departments and administrative press and publications management departments issue warnings against newspapers and periodicals, are uniformly printed in the “Internal Communications” run by the Central Propaganda Department News Office, and published in the press and publications system.

4, The Administration of Press and Publications imposes the administrative punishment of cessation of business for rectification on newspapers and periodicals that receive three warnings in one year. The controlling department of the newspaper or periodical in question must dismiss and replace the editor-in-chief or director of the newspaper or periodical in question, and impose the necessary punishments on relevant responsible persons. Party Committee Propaganda Departments must, together with administrative press and publications management departments, supervise the implementation of punishment work, and earnestly inspect the rectification situation of the newspaper or periodical violating discipline and regulations.

5, If, after the conclusion of cessation of business for rectification of a newspaper or periodical violating discipline and regulations, problems of violating discipline and regulations occur again, or grave mistakes of orientation emerge, the Administration of Press and Publications cancels the periodical number of the newspaper or periodical in question.

All levels’ Party Committee Propaganda Departments and administrative press and publications management departments must fully understand the extreme importance of strengthening management over newspapers and periodicals for the larger picture of the work of the entire Party and State, further strengthen a political consciousness, a consciousness of the larger picture and a sense of responsibility. They must strengthen leadership, organize special persons and special departments to do newspaper and periodical review and criticism work well, strictly keep that gate, and earnestly implement the warning system for newspapers and periodicals violating discipline and regulations.

Implementation Rules for the Warning System for Newspapers and Periodicals Violating Discipline and regulations

The Central Propaganda Department and Administration of Press and Publications “Opinions concerning Establishing a Warning System for Newspapers and Periodicals Violating Discipline and regulations” have been agreed to by the Centre. Hereby, implementation rules for a warning system for newspapers and periodicals violating discipline and regulations are formulated as follows:

1, Establishing a warning system for newspapers and periodicals is an important measure adopted to strengthen the binding strength of macro-level management in news and public opinion, and persist in the correct public opinion to guide people, aimed at new situations and new problems occurring in newspaper and periodical propaganda under new circumstances. Party Committee Propaganda Departments and administrative press and publications management departments must fully understand the extreme importance of strengthening management over newspapers and periodicals for the larger picture of the work of the entire Party and the entire State, they must strengthen leadership, strictly keep the gate, closely integrate all sorts of systems and mechanisms in macro-level news and public opinion management and the administrative management over newspapers and periodicals, and earnestly organize implementation of this management structure.

2, Central and all provincial, autonomous region and municipal Party Committee Propaganda Departments and administrative press and publications management departments are jointly responsible for the implementation of the warning system for newspapers and periodicals violating discipline and regulations.

3, After the Central Propaganda Department, according to the relevant provisions of the document, identify a problem of violation of discipline and regulations that occurs in central-level newspapers and periodicals, it puts forward an official written opinion on issuing a warning, and after reporting to the Central Propaganda Department administrative leader for approval, the Administration of Press and Publications issues a “warning notification letter”, and files this with the Central Propaganda Department. During administrative management, the Administration of Press and Publications may, according to the relevant provisions of the document, and with the approval of the administrative leader of the Administration of Press and Publications, directly issue a “warning notification letter” concerning a problem of violation of discipline and regulations occurring in central-level newspapers, and report and file it with the Central Propaganda Department at the same time.

4, After provincial-level Party Committee Propaganda Departments, according to the relevant provisions of the document, identify problems of violation of discipline and regulations that occurs in newspapers and periodicals in their locality, including newspapers and periodicals run by Centre and State organs and central-level media in their localities, it puts forward an official written opinion issuing a warning, and after reporting to the provincial-level Party Committee Propaganda Department administrative leader for approval, the local administrative press and publications management department issues a “warning notification letter”, and files this with the Central Propaganda Department, the Administration of Press and Publications and the provincial-level Party Committee Propaganda Department. During administrative management, the Administration of Press and Publications may, according to the relevant provisions of the document, and with the approval of the administrative leader of the Administration of Press and Publications, directly issue a “warning notification letter” concerning a problem of violation of discipline and regulations occurring in newspapers and periodicals in their locality, including newspapers and periodicals run by Centre and State organs and central-level media in their localities, and report and file it with the provincial-level Party Committee Propaganda Department at the same time, and the provincial-level Party Committee Propaganda Department and the provincial-level administrative press and publications management department file it with the Central Propaganda Department and Administration of Press and Publications.

5, A uniform template for the “warning notification letter” is formulated uniformly by the Administration of Press and Publications, which mainly includes the main facts of the violation of discipline and regulations, basis for inspection and prosecution, investigation and prosecution requirements and other content. The “warning notification letter” is transmitted to the newspaper and periodical violating discipline and regulation by the administrative press and publications management department, and copied to the controlling and sponsoring work units of newspapers and periodicals violating discipline and regulations.

6, Within 10 days of receiving a “warning notification letter”, controlling and sponsoring work units of newspapers and periodicals must report a written examination and the punishment situation of the relevant responsible persons to the Party Committee Propaganda Department and the administrative press and publications management department. The administrative press and publications management department must record and file the relevant situation of violation of discipline and regulations of the relevant newspaper or periodical.

7, The “Internal Communications” run by the Central Propaganda Department News Bureau, on the basis of the relevant filing materials on warnings implemented against newspapers and periodicals, will publish it within the press and publications system in the form of a circular.

8, Newspapers and periodicals that receive three warnings in total within one year after the first warning, are subject to the administrative punishment of cessation of business for rectification imposed by the Administration of Press and Publications. The controlling department of the newspaper or periodical in question must dismiss and replace the editor-in-chief or director of the newspaper or periodical in question, and impose the necessary punishment on relevant responsible persons.

9, Party Committee Propaganda departments must, together with administrative press and publications management departments, supervise the implementation of punishment work of newspapers and periodicals that have received the punishment of cessation of business for rectification, including whether or not they have imposed the necessary punishment on the relevant leaders and responsible person, whether or not they have established and completed relevant regulatory structures, and earnestly check the rectification work of the newspaper or periodical in question.

10, If, after newspapers and periodicals who have received the punishment of cessation of business for rectification resume publishing, problems of violation of discipline and regulations occur again, or grave mistakes in orientation emerge, and after this is established by Party Committee Propaganda Departments and administrative press and publications management departments, the Administration of Press and Publications cancels the relevant newspaper numbers and periodicals numbers.

11, Newspaper and periodical publishers found by Party Committee Propaganda Departments and administrative press and publications management departments to have especially gravely violated discipline and regulations, may be subject to the direct imposition of the administrative punishment of cessation of business for rectification up to cancellation of periodical numbers by the Administration of Press and Publications..

12, Functional departments responsible for concrete implementation of the warning system must regularly convene joint conferences, exchange situations, communicate information, earnestly research new problems that emerge in newspaper and periodical propaganda management work, and for joint management forces.

13, The warning system for newspapers and periodicals violating discipline and regulations takes effect on 1 July 2000.

14, The interpretation of these Rules is the responsibility of the Central Propaganda Department and the Administration of Press and Publications.

关于建立违纪违规报刊警告制度的意见

加强对宣传思想文化阵地的管理,包括加强对报刊特别是小报小刊等传媒阵地的管理,坚持确立和维护马克思主义的指导地位,严格宣传纪律,不给错误的言论提供传播阵地,是当前各级党委宣传部门和新闻出版行政管理部门的重要任务。为确保报刊正确的舆论导向,促进报刊业繁荣健康发展,现就建立违纪违规报刊警告制度提出如下意见:
一、建立警告制度是强化新闻舆论工作宏观管理约束力的重要措施
党的十四大以来,宣传思想战线总结历史经验,根据新形势下出现的新情况、新问题,加强宏观管理,建立健全管理制度和机制,对于新闻舆论工作坚持正确的舆论导向,为人民服务、为社会主义服务、为全党全国工作大局服务,发挥了重要的保障作用,取得了明显成绩。但是,对一些报刊管理不到位、措施不落实的问题仍然存在,特别对小报小刊的管理始终是一个薄弱环节。建立违纪违规报刊警告制度,是为了强化约束机制,进一步健全和完善宏观管理制度,坚持以正确的舆论引导人所采取的重要措施。建立警告制度,有利于增强新闻舆论工作宏观管理的约束力,保证党的新闻宣传工作的方针政策更好地贯彻落实;有利于规范报刊的管理,维护正常的宣传秩序;有利于促进报刊业的繁荣健康发展。
二、实行警告制度的职责要求
按照分级管理的原则,中央宣传部负责对中央级报刊新闻宣传工作的管理,对出现违纪违规问题的中央级报刊提出警告意见,由新闻出版署发出《警告通知书》,抄送该报刊的主管、主办单位,并向中央宣传部备案。各省、自治区、直辖市党委宣传部要严格实行属地管理,负责对本地报刊,包括中央国家机关和中央级媒体在本地所办报刊新闻宣传的管理工作,对出现的违纪违规问题提出警告意见,由当地新闻出版行政管理部门发出《警告通知书》,抄送该报刊的主管、主办单位,并向中央宣传部、新闻出版署和党委宣传部备案。
党委宣传部和新闻出版行政管理部门对报刊出现的以下违纪违规问题提出警告:
1、否定马列主义、毛泽东思想、邓小平理论的指导地位,造成恶劣的社会影响;
2、违背党的路线、方针、政策,出现严重的政治错误;
3、泄露国家秘密,危害国家安全,损害国家利益;
4、违反民族、宗教政策,危害民族团结,影响社会稳定;
5、宣扬凶杀、暴力、色情、迷信和伪科学,思想导向错误;
6、传播谣言,编发假新闻,干扰工作大局;
7、党委宣传部门和新闻出版行政管理部门认定的其他严重错误。
三、警告制度的实施办法
1、党委宣传部门和新闻出版行政管理部门发现管辖范围内的报刊出现违纪违规问题,新闻出版行政管理部门要及时发出《警告通知书》,指出问题,提出警告。
2、党委宣传部门和新闻出版行政管理部门对违纪违规报刊提出警告意见后,该报刊主管、主办单位要作出书面检查,并对造成错误的报刊负责人和责任人,给予相应处分。新闻出版行政管理部门要将有关报刊发生的违纪违规情况,记录在案。
3、党委宣传部门和新闻出版行政管理部门对报刊提出警告的情况,统一刊登在中央宣传部新闻局主办的《内部通信》上,在新闻出版系统公布。
4、对一年内受到三次警告的报刊,由新闻出版署给予停业整顿的行政处罚。该报刊的主管部门要撤换该报刊总编辑或社长,给予有关责任人必要的行政处分。党委宣传部门要会同新闻出版行政管理部门督促处罚工作的落实,对违纪违规报刊的整改情况认真验收。
5、违纪违规报刊停业整顿结束后,如再发生违纪违规问题,出现严重导向错误,由新闻出版署撤销该报刊的刊号。
各级党委宣传部门和新闻出版行政管理部门要充分认识加强报刊管理对于全党全国工作大局的极端重要性,进一步增强政治意识、大局意识、责任意识。要加强领导,组织专人和专门机构做好报刊阅评工作,严格把关,认真落实违纪违规报刊警告制度。

违纪违规报刊警告制度实施细则

中央宣传部、新闻出版署《关于建立违纪违规报刊警告制度的意见》,已经中央同意。现制定违纪违规报刊警告制度实施细则如下:
1、建立违纪违规报刊警告制度,是在新形势下针对报刊宣传出现的新情况、新问题,为强化新闻舆论宏观管理约束力,坚持以正确的舆论引导人所采取的一项重要措施。党委宣传部门和新闻出版行政管理部门,要充分认识加强报刊管理对于全党全国工作大局的极端重要性,加强领导,严格把关,紧密结合新闻舆论宏观管理的各项制度、机制和报刊的行政管理,认真组织实施这项管理制度。
2、中央和各省、自治区、直辖市的党委宣传部门、新闻出版行政管理部门,共同负责实施违纪违规报刊警告制度。
3、中央宣传部按照文件有关规定,对中央级报刊出现的违纪违规问题进行认定后,提出给予警告的正式书面意见,报经中央宣传部主管领导同意,由新闻出版署发出《警告通知书》,并向中央宣传部备案。新闻出版署在行政管理中,对中央级报刊出现的违纪违规问题,可按文件的有关规定,经新闻出版署主管领导同意,直接发出《警告通知书》,同时向中央宣传部通报并备案。
4、省级党委宣传部按照文件有关规定,对本地报刊,包括中央国家机关和中央级媒体在本地所办报刊出现的违纪违规问题进行认定后,提出给予警告的正式书面意见,报经省级党委宣传部主管领导同意,由当地新闻出版行政管理部门发出《警告通知书》,并报中央宣传部、新闻出版署和省级党委宣传部备案。省级新闻出版局在行政管理中,对本地报刊,包括中央国家机关和中央级媒体在本地所办报刊出现的违纪违规问题,可按文件的有关规定,经省级新闻出版局主管领导同意,直接发出《警告通知书》,同时向省级党委宣传部通报并备案,再由省级党委宣传部和省级新闻出版局向中央宣传部、新闻出版署备案。
5、《警告通知书》由新闻出版署制定统一格式,主要包括违纪违规主要事实、查处依据、查处要求等内容。《警告通知书》由新闻出版行政管理部门下达违纪违规报刊,并抄送违纪违规报刊的主管、主办单位。
6、受警告报刊的主管、主办单位,在接到《警告通知书》10天内,要向党委宣传部和新闻出版行政管理部门报送书面检查和对有关责任人的处理意见。新闻出版行政管理部门要将有关报刊发生的违纪违规情况,记录在案。
7、中央宣传部新闻局主办的《内部通信》,根据对违纪违规报刊实行警告的有关备案材料,以通报的形式在新闻出版系统公布。
8、对受到首次警告后一年内累计三次警告的报刊,由新闻出版署给予停业整顿的行政处罚。该报刊的主管部门要撤换该报刊总编辑或社长,给予有关责任人必要的行政处分。
9、对于受到停业整顿处罚的报刊,党委宣传部门要会同新闻出版行政管理部门督促处罚工作的落实,包括是否已对有关领导和责任人进行必要的处分,是否建立健全有关规章制度,认真验收该报刊的整改工作。
10、受到停业整顿处罚的报刊复刊后,如再发生违纪违规问题,出现严重导向错误,经党委宣传部门和新闻出版行政管理部门认定后,由新闻出版署撤销该报刊的刊号。
11、党委宣传部门和新闻出版行政管理部门认定的有特别严重违纪违规问题的报刊社,可由新闻出版署直接给予停业整顿直至撤销刊号的行政处罚。
12、负责具体实施警告制度的职能部门,要定期召开联席会议,交流情况、沟通信息,认真研究报刊宣传管理工作中出现的新问题,形成管理合力。
13、违纪违规报刊警告制度从2000年7月1日起实施。
14、本细则由中央宣传部和新闻出版署负责解释。
