The “Provisional Cable Television On-demand Video Broadcast Management Rules” were passed at the executive meeting, are hereby promulgated, and take effect on the day of promulgation.

Provisional Cable Television On-demand video Management Rules

Article 1: In order to stimulate the construction of a socialist spiritual civilization and strengthen on-demand video work management, these Rules are formulated

Article 2: Cable television on-demand video as named in these Rules refers to work activities using a cable television network, broadcasting its appointed audiovisual programme to specific consumers. It contains service methods such as pay-per-view selection, round broadcast, according to the actual selection time, etc.,

To activities of engaging in broadcast using cable television networks, employing multimedia technology, integrate sound, images, figures, writing, data, etc., to one whole, the “Provisional Information Network Dissemination and Broadcast of Film and Television-like Programmes Supervision Management Rules” shall apply.

Article 3: The State Administration of Radio, Film and Television is responsible for the cable television on-demand video work management work in the entire country, all levels’ local radio and television management entity is responsible for cable television on-demand video work management work in their jurisdiction.

Article 4: Cable television on-demand video work will be operated by radio and television broadcasting organs established with State Administration of Radio, Film and Television-approval, any other domestic and foreign organ or individual may not operate or operate in cooperation with a radio or television broadcast organ or do business in cable television on-demand video work.

The State Administration of Radio, Film and Television implements overall planning for cable television on-demand video work development. For operating cable television on-demand video, application for approval must be made with The State Administration of Radio, Film and Television.

Article 5: Applications for operating cable television on-demand video work, shall simultaneously fulfil the following conditions:

(1) conforming to State Administration of Radio, Film and Television planning of the national television selection work.

(2) possessing comprehensive power and network technological demands for operating cable television on-demand video work such as finance, technology, personnel, etc., and being able to accomplish propaganda duties and broadcast duties according to relevant State regulations;

(3) equipment used in operating television selection work must have obtained a State Administration of Radio, Film and Television-issued “Cable Television Network-Entry Equipment and Facility Accreditation Certificate”;

(4) television selection technology systems shall conform to State Administration of Radio, Film and Television management regulations concerning conditional receiving systems;

(5) having a complete programme broadcast management system;

(6) having feasible programme inspection and control schemes;

(7) conforming to the provisions of other State laws, regulations and documents.

Article 6: For operating cable television on-demand video work, application and examination and approval shall be conducted according to the following procedure:

(1) the applying organ raises an application with the local radio and television management entity, which is gradually reported up to the State Administration of Radio, Film and Television;

(2) where reported material is deemed to meet qualifications at preliminary screening, the State Administration of Radio, Film and Television organizes relevant entities and experts, to conduct a feasibility study of the operating plan;

(3) where the study conforms to the television selection work operating conditions, the State Administration of Radio, Film and Television shall grant approval, and trial broadcast shall be conducted;

(4) After one year of trial broadcast, the State Administration of Radio, Film and Television organizes inspection, only those inspected as meeting qualifications, may officially broadcast.

Article 7: For applications for operating cable television on-demand video work, the following written documents must be submitted:

(1) an application by the broadcast organ for operating television selection;

(2) the examination opinions of all levels’ radio and television entities.

(3) a television selection operating plan, containing: television selection programme planning, channel resources’ occupation methods and quantity, business planning, technological and equipment planning, broadcast inspection and control planning, etc.

Article 8: For copyright protection of television selection programmes, the provisions of the “Copyright Law” shall be conformed to.

Article 9: It is prohibited to broadcast television selection programmes containing the following content:

(1) content endangering State unity, sovereignty and territorial integrity;

(2) content endangering State security, honour and interests;

(3) content inciting ethnic separatism, destroying ethnic unity;

(4) content divulging State secrets;

(5) content slandering and insulting others;

(6) content propagating obscenity, superstition or promoting violence;

(7) other content prohibited by the provisions of laws and regulations.

Article 10: Of programmes used for television selection, domestically produced programmes shall be given first place.

Article 11: For foreign programmes especially used for television selection, State Administration of Radio, Film and Television-appointed cable television programme import work units are responsible for import, and they must be reported to State Administration of Radio, Film and Television for examination. To those passing examination, an “Import Television Selection Programme Broadcast Permit” shall be issued.

Foreign television dramas especially used for television selection shall clearly display the Permit number on the first film.

Article 12: Programmes used for television selection are limited to the following categories:

(1) television dramas having obtained a “Television Drama Distribution Permit” or a “Public Film Projection Permit” and programmes with an “Import Television Selection Programme Broadcast Permit”.

(2) programmes produced and broadcasted by radio and television broadcast entities established according to the law;

(3) art and special interest programmes produced by film production business organs established according to the law and being examined and approved by provincial-level and higher radio and television entities.

Article 13: After lawful authorization of television dramas used for cable television selection, they may first be used for television selection.

Article 14: Radio and television organs operating cable television on-demand video work shall establish a feasible programme inspection and control scheme, and must transmit the broadcast programme list to be broadcasted in the following time through the network to State Administration of Radio, Film and Television, and establish and perfect a programme inspection system, where programmes are re-broadcasted, they shall conduct re-examination procedures according to the provisions of Article 9.

Article 15: Without permission and unauthorized operation of television selection in violation of Article 4 and Article 6 of these Rules, will be banned by the county-level or higher administrative radio and televisions entity, the equipment used in engaging in unlawful activities shall be confiscated, and a fine of 30,000 Yuan or lower shall be additionally imposed.

import and broadcast of television selection programmes not according to regulations, in violation of Article 11 and Article 12 of these Rules, as well as programmes not having been examined or re-examined according to regulations in violation of Article 14 of these Rules, the county-level or higher radio and television management entity shall order punishments of cessation of unlawful activities, according to the circumstances impose suspension of television selection work of one to six months, up to cancelling operating qualifications, and may additionally impose a fine of 30,000 Yuan or lower.

Where the abovementioned activities violate public order management rules, they will be punished according to the “Public Order Management Punishment Regulations”, where they constitute a crime, criminal liability shall be investigated according to the law.

Article 16: These Regulations take effect on the day of promulgation. The original document no. RDP (2000)901 shall be simultaneously abolished.

有线电视视频点播管理暂行办法
第一条  为促进社会主义精神文明建设,加强对视频点播业务的管理,制定本办法。

第二条  本办法所称的有线电视视频点播,是指利用有线电视网络,向特定用户播放其指定的视听节目的业务活动。包括按次付费点播、轮播、按需实时点播等服务形式。

利用有线电视网络,采用多媒体技术,将声音、图像、图形、文字、数据等集成为一体进行传播的活动,适用《信息网络传播广播电影电视类节目监督管理暂行办法》。

第三条  国家广播电影电视总局负责全国有线电视视频点播业务的管理工作,地方各级广播电视管理部门负责本辖区内有线电视视频点播业务的管理工作。

第四条  有线电视视频点播业务由经国家广播电影电视总局批准设立的广播电视播出机构开办,其他任何境内外机构、个人不得开办或与广播电视播出机构合作开办、经营有线电视视频点播业务。

国家广播电影电视总局对有线电视视频点播业务的发展实行统筹规划。开办有线电视视频点播业务,须报国家广播电影电视总局批准。

第五条  申请开办有线电视视频点播业务,应当同时具备以下条件:

(一)符合国家广播电影电视总局对全国视频点播业务的总体规划;

(二)具备开办视频点播业务的资金、技术、人员等综合实力和网络技术条件,能够按照国家有关规定完成宣传任务和转播任务;

(三)开展视频点播业务所使用的设备应取得国家广播电影电视总局颁发的《有线电视入网器材设备认定证书》;

(四)视频点播技术系统应符合国家广播电影电视总局关于有条件接收系统的管理规定;

(五)有健全的节目播出管理制度;

(六)有可行的节目监控方案;

(七)符合国家其他法规、文件的规定。

第六条  开办有线电视视频点播业务,按照以下程序进行申报和审批:

(一)申办机构向当地广播电视管理部门提出申请,逐级上报至国家广播电影电视总局;

(二)上报材料经初审合格的,由国家广播电影电视总局组织有关部门和专家,对开办方案进行可行性论证;

(三)经论证符合视频点播业务开办条件的,由国家广播电影电视总局予以批准,进行试播;

(四)试播一年后,由国家广播电影电视总局组织验收,验收合格的,方可正式播出。

第七条  申请开办有线电视视频点播业务,需提交以下书面材料:

(一)播出机构开办视频点播的申请;

(二)各级广播电视部门的审核意见;

(三)视频点播开办方案,包括:视频点播节目方案、频道资源的占用方式和数量、运营方案、技术和设备方案、播出监控方案等。

第八条  对视频点播节目的著作权保护,应当符合《著作权法》的规定。

第九条  禁止播放载有下列内容的视频点播节目:

(一)危害国家的统一、主权和领土完整的;

(二)危害国家的安全、荣誉和利益的;

(三)煽动民族分裂、破坏民族团结的;

(四)泄露国家秘密的;

(五)诽谤、侮辱他人的;

(六)宣扬淫秽、迷信或者渲染暴力的;

(七)法律、法规规定禁止的其它内容。

第十条  用于视频点播的节目,应以国产节目为主。

第十一条  专门用于视频点播的境外节目,由国家广播电影电视总局指定的有线电视节目进口单位负责引进,并报国家广播电影电视总局审查。经审查通过的,发给《进口视频点播节目播放许可证》。

专门用于视频点播的境外影视剧应在每集片首注明许可证编号。

第十二条  用于视频点播的节目限于以下几类:

(一)取得《电视剧发行许可证》或《电影片公映许可证》的影视剧及《进口视频点播节目播放许可证》的节目;

(二)依法设立的广播电视播出机构制作、播出的节目;

(三)依法设立的影视制作经营机构制作并经省级以上广播电视部门审查批准的综艺、专题节目。

第十三条  用于有线电视播出的影视剧经合法授权后,可先用于视频点播。

第十四条  开办有线电视视频点播业务的广播电视播出机构应制定可行的节目监控方案,须将前端播出的点播节目单通过网络传送到国家广播电影电视总局,并建立健全节目审查制度,节目重播时应按第九条规定进行重审。

第十五条  违反本办法第四条、第六条,未经许可擅自开办视频点播的,由县级以上广播电视行政部门予以取缔,没收其从事违法活动的设备,可以并处3万元以下的罚款。

违反本办法第十一条、第十二条,未按规定引进、播放视频点播节目以及违反本办法第十四条,未按规定审查和重审视频点播节目的,由县级以上广播电视管理部门责令停止违法活动,根据情况给予暂停视频点播业务一至六个月直至取消开办资格的处罚,可以并处3万元以下的罚款。

上述行为违反治安管理规定的,依据《治安管理处罚条例》予以处罚;构成犯罪的,依法追究刑事责任。

第十六条  本办法自发布之日起施行。原广发社字〔2000〕901号文件同时废止。
