Implementation Regulations concerning Vigorously Moving Radio, Film and Television Grouping Reform Forward (Trial)
According to the “Central Committee Secretariat and State Council Secretariat Notice Concerning Transmitting the ‘Central Propaganda Department, SARFT, and General Administration of Press and Publications Some Opinions concerning Deepening Press, Publications, Radio, Film and Television Sector Reform'” (GBF No. (2001)17), hereby, the following implementation regulations for vigorously moving forward radio, film and television grouping reform are formulated.
I, radio, film and television grouping reform must persist in having development as core theme, structural adjustment as main line, fix eyes upon further expanding strength, strengthening vitality and raising competitiveness. It is necessary to fully consider our country’s national conditions, persist in the special nature of radio, film and television, abide by the rules of the Socialist market economy and the inherent requirements for radio, film and television sector development, learn from successful experiences in the reform of the economic sphere and beneficial foreign methods, to benefit and guarantee the Party’s leadership over the radio, film and television sector, benefit the strengthening of public opinion propaganda and ideological culture battlefield construction, benefit the joint development of radio, film and television, and benefit giving rein to the vigour of radio, film and television workers.
II, radio, film and television groups are important mouthpieces and important ideological cultural battlegrounds for the Party, and are comprehensive media groups possessing radio stations, television stations film production studios (companies), transmission network companies, Internet websites as well as newspaper, publishing, science and technological research and development, advertising business and maintenance management. Groups have an undertaking nature and implement enterprise-type management. Groups shall have radio, film and television as core business, news and propaganda at the centre, flourishing creation as focus point, and at the same time engage in other corresponding industries. Groups undertake complete propaganda tasks and State-owned asset value maintenance and increase responsibilities. After being formed, groups continue to enjoy the preferential policies of the State for the radio, film and television sector they originally enjoyed.
III, The formation of radio, film and television groups is the responsibility of administrative radio, film and television departments. Organizing groups persists in the principles of trials first and extension later, where one is mature, one is approved, the focus point is to do the formation trial work of the Chinese Radio, Film and Television Group and provincial (regional, municipal) radio, film and television groups well. Already formed groups must further become standardized, perfected and raised on the basis of the spirit of document GBF No. (2001)17.
Provincial capitals with corresponding power and plan-listed cities may, under the presupposition of completely relaying central and provincial (regional, municipal) radio and television programmes, organize groups. “With corresponding power” refers to achieving the following conditions in 2000: (1) having a gross domestic product of 80 billion Yuan or more; (2) having a permanent population of 5 million or more; (3) having a relatively strong comprehensive radio and television strength.
Six film groups are organized with China Film, Shanghai Film, Changchun Film, Pearl Film, Emei Film and Xi’an Film as backbones, and they are to join radio, film and television groups in close form or loose form.
IV, Radio, film and television groups implement a management board responsibility system under the leadership of Party Committees (Party Organization). Party Committee (Party Organizations) are the leading core of the group, and completely lead the group’s work, they are responsible for strengthening the group’s Party building, researching and formulating the group’s development plans and development strategies, and decide on major policies such as important propaganda work, human resources appointment and dismissal, capital operation, etc. Group management boards, under the leadership of the group’s Party Committee (Party Organization), plan, manage and organize the implementation of all of the group’s tasks, and move undertaking development forward.
Groups act as independent undertaking legal person entities, manage and operate the State-owned assets of their subordinate radio, film and television entities according to authorization, implement uniform management over the propaganda, human resources, finances, business and assets, etc., of the subordinate member work units, and according to the principles of simplification, high-efficiency and uniformity, establish corresponding internal organizational structure and management hierarchies. Groups must internally divide into an undertaking side and an enterprise side, and an undertaking management function and an industrial research and development function, a propaganda creation business and an operational business, with capital and business as links, on the basis of defining property rights, standardizing the relationships of rights and obligations between group embers, determine the asset management responsibilities undertaken by each, implement uniform financial management and uniform financial personnel appointment, vigorously explore financial accounting, supervising and management systems adapted to the requirements of the group’s development. In groups, undertaking work units’ press and propaganda business departments operating, editing, gathering news broadcasting, according to undertaking management regulations, etc., may without exception not participate in commercial activities. Within film group companies, radio and television relay network companies and other enterprises subordinate to the group, strict modern enterprise systems and complete legal person governance structures must be established according to State regulations, a board of directors and a board of supervisors independent from the enterprises are to be established, and members of the supervisory board are appointed according to the law and according to cadre management powers.
V, Administrative radio, film and television departments must realistically implement their administrative management duties such as press and propaganda, art creation, science and technology, undertaking planning, transmission coverage, market management, foreign contacts, etc., over radio, film and television groups and radio, film and television work units. Groups mainly manage their own propaganda and undertaking development. In order to strengthen leadership over group work, it is permitted to practice that there are a few overlapping positions in administrative radio, film and television management departments’ leadership rank members and group leadership rank members.
VI, Plans for provincial (regional, municipal) radio, film and television group formation are put forward by provincial (regional, municipal) radio, film and television bureaus, examined and verified by provincial (regional, municipal) Party Committee Propaganda Departments and provincial (regional, municipal) Party Committees, and after government agreement, are reported to the Central Propaganda Department and SARFT for approval. Plans for radio, film and television group formation in provincial capital cities and plan-listed cities are put forward by municipal radio, film and television bureaus, and after agreement by provincial (regional, municipal) Party Committee Propaganda Departments and provincial (regional, municipal) Party Committees, are reported to the Central Propaganda Department and SARFT for approval. Before provincial (regional, municipal) radio, film and television groups are formed; no radio, film and television group formation will be examined and approved in cities within administrative areas provisionally.
For the appointment or dismissal of provincial (regional, municipal) and city radio, film and television group Party Organizations (Party Committees) and management boards’ main responsible persons, the opinion of SARFT shall be sought in advance, and it will be reported and approved according to cadre management powers.
The responsibility for formulating formation plans for film groups are with provincial (regional, municipal) radio, film and television bureaus, and after agreement by provincial (regional, municipal) Party Committees and governments, are reported to the Central Propaganda Department and SARFT for examination and approval.
VII, In the process of group formation, all adjustments involving broadcast organs, channels and frequencies, regular examination and approval formalities shall be carried out strictly according to the “Radio and Television Management Regulations.
VIII, After forming radio, film and television groups, all work must be comprehensively planned, have a prominent focus, be implemented step by step, and attain the goals progressively. First, it is necessary to strive to deepen internal management structure and operational structure reform, according to the principles of unifying what can be unified best, dividing what is divided best, integrating unity and division, and rational division of work, implementing structural adjustment, optimizing resource allocation, and as quickly as possible realize the objective of the group’s overall operation. Secondly, accelerating radio and television transmission network integration, building nationwide and provincial (autonomous region, municipal) radio and television transmission network companies, realizing linking up of high and low, unifying operations. Third, integrating the city (district) and county (city) radio and television broadcast organ function transformation, strengthening uniting with and reorganizing city (district) and county (city) radio and television broadcast organs, creating conditions to stimulate their accession into groups as quickly as possible, and become substations or delegated agencies of group-subordinate radio stations and television stations. Fourth, vigorously mocking multimedia cross-operations and cross-region operation forward, shaping superiority of scale, making groups progressively develop into media groups having corresponding scale and power, and that are able to adapt to domestic and foreign media competition.
IX, Forcefully supporting radio, film and television groups to expand export and foreign sales of domestic film and television dramas. Encouraging film groups to form cinema chains and expand film distribution and screening. All film groups established according to regulations may within their provinces and cities’ television stations add one film channel, to be handled by the said film group, and brought into television station broadcast management. Film channels mainly broadcast films (including television films), and may also appropriately broadcast television dramas, but the broadcasting duration may not exceed 45% of the total quantity of film and television broadcasting. Film channels adopt cable television network transmission, and cover their administrative areas, income reverts to the film group and is to be used for film creation, production and undertaking development, and may not be moved to other uses.
X, Organizing radio, film and television groups is a major reform of radio, film and television sector management and operational mechanisms, has extensive involvement, a strong policy nature, and it is necessary to, according to the requirements of liberating thoughts, seeking through from facts, taking vigorous initiative, expanding strength, innovating deeply, and steadily moving forward, realistically strengthen leadership, organize meticulously, deploy carefully, move forward with leadership, with planning and gradually, preventing rushing headlong into action and oversimplification. It is necessary to deeply and in a detailed fashion do ideological and political work well, guarantee that no propaganda problems emerge during group reform, that no problems emerge in broadcasting security, and no problems emerge in teams. All provincial (regional, municipal) radio, film and television bureaus must strengthen coordination and communication with Party Committees and relevant government departments, strengthen investigation and research, and timely report major situations and major problems emerging during group reform to SARFT.
