Implementation Regulations Concerning City (District) and County (City) Radio and Television Broadcasting Organ Duty Transformation Work (Trial)

On the basis of the “Central Committee Secretariat and State Council Secretariat Notice Concerning Transmitting the ‘Central Propaganda Department, SARFT, and General Administration of Press and Publications Some Opinions concerning Deepening Press, Publications, Radio, Film and Television Sector Reform’” (GBF No. (2001)17), hereby, the following implementation regulations concerning city (district) and county (city) radio and television broadcast organ function transformation are formulated.

I, City (district) and county (city) radio and television broadcasting organ function transformation must fix eyes upon liberating and developing radio and television productive forces, fix eyes upon strengthening and improving radio and television sector management, fix eyes upon even better mustering and giving rein to the vigour of city (district) and county (city) radio and television workers, fix eyes upon stimulating the healthy and ordered development of radio and television undertakings, further optimizing structures, and adjusting structures and rationally allocating resources. Promoting City (district) and county (city) radio and television broadcast organs to transform their work duties into relaying central and provincial radio and television programmes, transform the core of their work into expanding radio and television coverage and raising radio and television service levels, transform the energy of their work into reforming and perfecting radio and television network, developing cable radio and television users and expanding radio and television business.

 

III, The main tasks of City (district) and county (city) radio and television organ function transformation are (1) adjusting city (district) television station self-organized programme channel quantities, adjusting county (city) level radio and television stations’ self-organized channels into broadcasting timeslots, completing the establishment of public stations in provincial-level and a part of city-level television stations; (2) completing the vertical linking of the three levels of provincial, city and county radio and television transmission coverage networks, unifying operations and unifying management; (3) progressively implementing concentrated management over county (city) level and town radio and television, in localities that already realized networking connections of county and town radio and television transmission networks, county (city) administrative radio and television departments’  vertical management model for town and country radio and television offices “having tiao at the core” must be implemented as soon as possible.

 

III, Under the precondition of completely relaying all sets of radio and television programmes of the central and provincial levels, existing self-organized programme channels may be adjusted according to the following principles:

(1) Television stations in provincial capital cities and plan-listed cities, and cities (districts) with a GDP exceeding 100 billion Yuan may preserve the existing self-organized programme channels.

(2) Television stations in other cities (districts) may without exception only organize one channel by themselves. Where the existing self-organized channels exceed one, it must be reduced to one. Where 2 self-organized channels are required because of exceptional reasons, it must be reported to SARFT for approval.

(3) County (city, including the counties of provincial-level municipalities) radio and television stations, no longer preserve self-organized television programme channels, and may insert self-organized programmes into public channels. Cases with special circumstances are reported to SARFT for examination and approval.

 

IV, Provincial-level television stations establishing public channels, where the existing self-organized programmes include or exceed eight sets or more, must adjust the existing channels; where there are fewer than eight existing self-organized programmes, application for expansion may be made according to requirements.

Public channels shall plan certain timeslots and provide them to county (city) radio and television broadcast organs to broadcast their regional news and economic-type, science and technology-type, legal-type, agricultural-type and major event-type theme programmes, culture and art programmes with local characteristics as well as advertising, etc. Television stations establishing public channels shall clarify the scope, timing, and quantity of county (city) broadcast organs’ inserted programmes and advertising, rationalize operational mechanisms and appropriately resolve questions of profit sharing, etc.

A number of city (district) television stations may also establish one public channel with approval.

 

V, Radio programmes organized by city (district) radio stations and county (city) radio and television stations will not be adjusted for the time being.

 

VI, Continuing to consolidate the achievements of eliminating fragmentation and eliminating overflow, persisting in stopping phenomena such as illegal station setup outside of the radio and television system, disseminating radio and television programmes through networks without authorization, etc. Strengthening management over enterprise and undertaking work units’ cable radio and television offices, and problems of disorderly station naming, unauthorized setup of radio and television programmes, unauthorized receiving and transmitting of foreign satellite television programmes etc., must be timely investigated and prosecuted. Enterprise and undertaking work unit cable radio and television networks must link up with radio and television transmission networks in their administrative area, and progressively realize integration.

 

VII, Strengthening administrative management over educational television stations, vigorously creating conditions to stimulate city (district) education television stations to unite or merge with the same level’s television stations. Where provincial and city-level education television stations merge with the same level’s television stations, one educational programme set may be preserved after merging.

 

VIII, In the work of transforming duties, everything involving the changing of broadcasting organs’ station names, call signs, logos, programme set quantities, programme setup scope and channel adjustment shall be strictly conducted according to regulations, and the regular examination and approval formalities are to be conducted.

 

IX,  City (district) and county (city) radio and television broadcasting organs in the Tibet, Xinjiang and Inner Mongolia autonomous regions as well as the Tibetan regions in Qinghai, Sichuan, Gansu and Yunnan provinces provisionally do not conduct duty transformation work.

 

X, All levels’ administrative radio and television controlling departments must realistically strengthen leadership over duty transformation work, the number one leader is in charge of general duties, clarifying duties and implementing tasks. it is necessary to strengthen coordination and communication with the relevant departments of local Party Committees and governments, doing the ideological and political well, thoroughly and in detail, strengthening radio and television management, guaranteeing  that no problems appear in propaganda, no problems appear in teams and no problems appear in reform, guaranteeing the smooth completion of City (district) and county (city) radio and television broadcasting organ duty transformation work.

关于市(地)、县(市)广播电视播出机构职能转变工作的实施细则(试行)

根据《中共中央办公厅、国务院办公厅关于转发〈中央宣传部、国家广电总局、新闻出版总署关于深化新闻出版广播影视业改革的若干意见〉的通知》(中办发[2001]17号),现就市(地)、县(市)广播电视播出机构转变职能,制定以下实施细则。

一、市(地)、县(市)广播电视播出机构职能转变,必须着眼于解放和发展广播电视生产力,着眼于加强和改善广播电视行业管理,着眼于更好地调动和发挥市(地)、县(市)广播电视工作者的积极性,着眼于促进广播电视事业健康有序地发展,进一步优化结构、调整结构,合理配置资源。推动市(地)、县(市)广播电视播出机构把工作任务转到转播中央和省的广播电视节目上来,工作重心转移到扩大广播电视覆盖和提高广播电视服务水平上来,工作精力转移到改造、完善广播电视网络、发展有线广播电视用户、拓展广播电视业务上来。

二、市(地)、 县(市)广播电视播出机构职能转变的主要任务是:(1)调整市(地)电视台自办节目频道数量,调整县(市)广播电视台自办频道向播出时段的转变,完成省级和部分市级电视台公共频道的设立;(2)完成省、市、县三级广播电视传输覆盖网络的垂直贯通,统一经营,统一管理;(3)逐步实行对县(市)及乡镇广播电视的集中管理,已实现县乡广播电视传输网络联网的地方,应尽快实行县(市)广播电视行政部门对乡镇广播电视站”以条为主”的垂直管理模式。

三、在完整转播中央和省级各套广播电视节目的前提下,现有自办节目频道按以下原则调整:

(一)省会市、计划单列市和GDP超过1000亿元的市(地)的电视台,可保留现有自办节目频道。

(二)其余的市(地)电视台一律只自办1个频道。现有自办节目频道超过1套的,应精简为1套。 个别情况特殊确需自办2个频道的,报国家广电总局特批。

(三)县(市,含直辖市所辖的县)广播电视台,不再保留自办电视节目频道,可在公共频道中插播自办节目。特殊情况个案报国家广电总局审批。

四、省级电视台设立公共频道,现有自办节目在8套以上(含)的,必须在现在频道中调整;现有自办节目不足8套的,根据需要可申请增设。

公共频道应当划出一定的时段供县(市)广播电视播出机构播出当地新闻和经济类、科技类、法制类、农业类、重大活动类专题、有地方特色的文艺节目以及广告等。设立公共频道的电视台应明确县(市)播出机构插播节目、广告的范围、时间、数量,理顺运行机制、妥善解决利益共享等问题。

部分市(地)电视台,经批准也可设立1个公共频道。

五、市(地)广播电台和县(市)广播电视台开办的广播节目暂不作调整。

六、继续巩固治散治滥成果,坚决制止广播电视系统外非法办台、通过网络擅自传输广播电视节目等现象。依法加强对企事业单位有线广播电视站的管理、对乱称台、擅自开办广播电视节目、擅自收转境外卫星节目等问题要及时查处。企事业单位有线广播电视网必须与行政区域广播电视传输网络联网,并逐步实现整合。

七、加强对教育电视台的行业管理,积极创造条件促进市(地)教育电视台与同级电视台联合或合并。省、市级教育电视台与同级电视台合并的,合并后保留1套教育类节目。

八、在转变职能工作中,凡涉及到播出机构的台名、呼号、台标、节目套数、节目设置范围的变更和频道的调整,应严格按规定,履行正常审批手续。

九、西藏、新疆、内蒙古自治区以及青海、四川、甘肃、云南省的藏区,其市(地)、县(市)广播电视播出机构转变职能工作可暂不进行。

十、各级广播电视行政主管部门要切实加强对职能转变工作的领导,一把手负总责,明确责任,落实任务。要注意加强与当地党委、政府有关部门的协调、沟通,做好深入细致的思想政治工作,加强广播电视管理,确保宣传不出问题、队伍不出问题、改革不出问题,确保市(地)、县(市)广播电视播出机构职能转变工作的顺利完成。
