Audiovisual Products Management Regulations (Revised)

The “Audiovisual Product Management Regulations” were adopted at the 50th executive meeting of the State Council on December 12, 2001, are hereby promulgated, and shall take effect on February 1, 2002.

Chapter 1 General provisions

Article 1: In order to strengthen audiovisual products management, promoting the healthy development and prospering of the audiovisual product sector, enriching the cultural life of the masses and promoting the construction of socialist material civilization and spiritual civilization, these Regulations are formulated.

Article 2: These Regulations shall apply to activities such as publication, production, duplication, import, wholesale, retail, and rental, etc. of audiovisual products such as audio tapes, video tapes, gramophone records, compact discs and laser discs, etc. on which content are recorded.

Audiovisual products used for radio and television broadcasts shall be subject to the laws and administrative regulations on radio and television.

Article 3: Those engaged in the publication, production, duplication, import, wholesale, retail, and rental of audiovisual products shall observe the Constitution and relevant laws and regulations, adhere to the orientation of serving the people and serving socialism and disseminate ideas, morals and scientific, technical and cultural knowledge beneficial to economic development and social progress.

Audiovisual products are prohibited from carrying the following content:

(1) content contradicting the basic principles determined in the Constitution;

(2) content endangering the unity of the nation, sovereignty or territorial integrity;

(3) content that divulging State provisions, endangers national security or damages State  honour or interests;

(4) content that incites ethnic hatred or discrimination, undermines the solidarity of the ethnicities, or infringes upon ethnic customs and habits;

(5) content that propagates evil cults or superstition;

(6) content that disturbs public order or destroys public stability;

(7) content that propagates obscenity, gambling, violence or instigates crimes;

(8) content that insults or slanders others, or infringes upon the lawful rights and interests of others;

(9) content that endangers public ethics or excellent folk cultural traditions;

(10) other content prohibited by laws, regulations or State provisions.

Article 4: The State Council administrative publication entity shall be responsible for the supervision and administration of the publication, production, and duplication of audiovisual products nation-wide; the State Council administrative culture entity shall be responsible for the supervision and administration of the import, wholesale, retail and rental of audiovisual products nation-wide; other relevant State Council administrative entities shall, in accordance with the division of duties prescribed by the State Council, be responsible for the supervision and administration of business activities of relevant audiovisual products.

The county-level or higher local People’s Government administrative entity responsible for publication management (hereafter simply named “the administrative publication entity”) shall be responsible for the supervision and administration of the publication, production and duplication of audiovisual products within its own jurisdiction; the county-level or higher People’s Government administrative culture entity shall be responsible for the supervision and administration of the import, wholesale, retail and rental of audiovisual products within its own jurisdiction; other relevant county-level or higher People’s Government administrative entities shall, within the scope of their respective duties, be responsible for the supervision and administration of business activities of relevant audiovisual products.

Article 5: The State shall apply a licence system concerning the publication, production, duplication, import, wholesale, retail and rental of audiovisual products. No entity or individual shall, without permission, be engaged in the publication, production, duplication, import, wholesale, retail, or rental, etc. of audiovisual products.

The licences or approval documents issued in accordance with these Regulations shall not be rented, lent, sold, or transferred in any other form.

Article 6: The State Council administrative publication entity and the State Council administrative culture entity shall be responsible for enacting the development programming on the career of audiovisual products, and shall, in accordance with the division of duties prescribed by the State Council, respectively determine the total number, distribution and structure of the audiovisual product publication work units and duplication work units as well as the finished audiovisual products import business work units nation-wide.

Article 7: Supervision and administration of business activities concerning audiovisual products work units and their personnel may not, directly or in a disguised form, be engaged in business activities concerning audiovisual products or participate in business activities of the audiovisual product operating entities.

Chapter 2 Publication

Article 8: To establish an audiovisual product publication work unit, the applicant shall meet the following conditions:

(1) having the name and articles of association of the audiovisual product publication work unit;

(2) having a sponsored work unit and the controlling authority recognized by the State Council administrative publication entity;

(3) having a well-defined scope of business;

(4) having an organization adapted to the needs of its scope of business and a staff of professionals in audiovisual products publication who meet the qualification requirements prescribed by the State;

(5) having the funds, equipment and work premises adapted to the needs of its scope of business;

(6) other conditions provided in laws and administrative regulations.

The approval on the establishment of an audiovisual product publication work unit shall not only conform to the conditions enumerated in the preceding paragraph, but also conform to the programming on the total number, distribution and structure of the audiovisual product publication work units.

Article 9: Application for the establishment of an audiovisual product publication work unit shall be examined and approved by the provincial, autonomous region or municipal People’s Government administrative publication entity of the applicant’s locality before it is submitted to the State Council administrative publication entity for examination and approval. The State Council administrative publication entity shall, within 60 days of the receipt of the application, make a decision on approving or not approving the application and shall notify the applicant. If the application is approved, an “Audiovisual Products Publication Permit” shall be issued to the applicant, who shall register and obtain a business licence in accordance with the law in the administrative industry and commerce entity with the “Audiovisual Products Publication Permit”; if the application is not approved, the reason thereof shall be stated.

The application shall clearly state the following content:

(1) the name and address of the audiovisual product publication work unit;

(2) the name and address of the sponsoring work unit and the controlling authority of the audiovisual product publication work unit;

(3) the name(s), address(es) and qualification certifying documents of the legal representative or principal responsible person(s) of the audiovisual product publication work unit;

(4) the sources and amount of funds of the audiovisual product publication work unit.

Article 10: Where an audiovisual product publication work unit changes its name, controlling entity, controlling authority or scope of business, or to merge another audiovisual product publication work unit, or establishes a new audiovisual product publication work unit due to merger or division, it shall conduct examination and approval formalities in accordance with Article 9 of these Regulations, and shall conduct the corresponding registration formalities in the administrative industry and commerce entity that handled the original registration.

Where an audiovisual product publication work unit changes its address, legal representative or principal responsible person(s), or terminates its publication business activities, it shall conduct the registration modification or registration cancellation in the administrative industry and commerce entity that handled the original registration, and shall report to the State Council administrative publication entity for filing.

Article 11: The annual publication plans of an audiovisual product publication work unit and selected topics concerning national security and social stability, etc. shall be examined and verified by the provincial, autonomous region or municipal People’s Government administrative publication entity at its locality before they are submitted to the State Council administrative publication entity for filing; audiovisual products with selected topics shall not be published until they are submitted for filing before publication.

Article 12: An audiovisual product publication work unit shall indicate in a prominent position on the audiovisual product it has published and its packaging such data as the name and address of the publication work unit, the publication number, time of publication and name of the copyright owner, etc. of the audiovisual product; for the publication of imported audiovisual products, it also shall indicate the import approval number.

Audiovisual product publication work units shall, within 30 days of the publication of the audiovisual product, submit a free specimen to the National Library of China, the Archives Library of Chinese Publications and the State Council administrative publication entity.

Article 13: An audiovisual product publication work unit may not rent, lend, sell or transfer in any other form its name to any entity or individual, and may also not sell or transfer in any other form its publication number to any entity or individual.

Article 14: Any entity or individual may not engage in audiovisual product publication activities by such means as purchasing, hiring, borrowing or using the name of an audiovisual product publication work unit without authorization or by purchasing or forging the publication number of the audiovisual product publication work unit.

Book publishers, newspaper offices, periodical offices or electronic publication publishers may not publish audiovisual products not supplementing their own publications; but they may, in accordance with the provisions of the State Council administrative publication entity, publish audiovisual products supplementing their publications, and may enjoy rights and shall undertake obligations as an audiovisual product publication work unit.

Article 15: Audiovisual product publication work units may cooperate with organizations or individuals from Hong Kong Special Administrative Region, Macao Special Administrative Region, Taiwan region and foreign countries to produce audiovisual products. Concrete regulations shall be formulated by the State Council administrative publication entity.

Article 16: An audiovisual product publication work unit shall apply an editorial responsibility system, guaranteeing that audiovisual product content conforms to these Regulations.

Article 17: Applications by an work unit other than audiovisual product publication work units for establishment of a work unit independently engaged in the audiovisual product production business (hereafter named audiovisual product production work unit) shall be examined and approved by the provincial, autonomous region or municipal People’s Government administrative publication entity of the applicant’s locality. The provincial, autonomous region or municipal People’s Government administrative publication entity shall, within 60 days of the receipt of the application, make a decision on approving or not approving the application and shall notify the applicant. To those approved, an “Audiovisual Products Production Permit” shall be issued, who shall register and obtain a business licence in accordance with the law in the administrative industry and commerce entity with the “Audiovisual Products Production Permit”; if the application is not approved, the reason shall be stated. The establishment of radio or television programme production or business work units shall be handled according to with relevant laws and administrative regulations.

The application shall clearly state the following content:

(1) the name and address of the audiovisual product production work unit;

(2) the name(s), address(es) and qualification certifying documents of the legal representative or principal responsible person(s) of the audiovisual product production work unit;

(3) the sources and amount of funds of the audiovisual product production work unit.

The approval on the establishment of an audiovisual product production work unit shall not only be in accordance with the conditions enumerated in the preceding paragraph, but also take the total number, distribution and structure of the audiovisual product production work units into consideration.

Article 18: Where an audiovisual product production work unit changes its name or scope of business, or merges with another audiovisual product production work unit, or establishes a new audiovisual product production work unit due to merger or division, it shall conduct examination and approval formalities in accordance with Article 17 of these Regulations, and shall conduct the corresponding registration formalities in the administrative industry and commerce entity that handled the original registration.

Where an audiovisual product production work unit changes its address, legal representative or principal responsible person(s), or terminates its production business activities, it shall conduct registration modification or registration cancellation in the administrative industry and commerce entity that handled the original registration, and shall report to the provincial, autonomous region or municipal People’s Government administrative publication entity for filing.

Article 19: An audiovisual product publication work unit shall not entrust a work unit not having obtained the “Audiovisual Products Production Permit” to produce audiovisual products.

Where an audiovisual product production work unit is entrusted to produce audiovisual products, it shall, in accordance with the relevant State provisions, conclude a production entrustment contract with the entrusting publication work unit; and shall verify the entrusting publication work unit’s “Audiovisual Products Publication Permit” or the or certification of that publication and an audiovisual product production entrustment letter, carrying the seal of the entrusting publication work unit.

Audiovisual product production work units may not shall publish, duplicate, wholesale, retail or rental audiovisual products.

Chapter 3 Duplication

Article 20: To establish an audiovisual product duplication work unit, the applicant shall meet the following conditions:

(1) having the name and articles of association of an audiovisual product duplication work unit;

(2) having a well-defined scope of business;

(3) having an organization and the staff adapted to the needs of its scope of business;

(4) having the funds, equipment and work premises adapted to the needs of its scope of business;

(5) other conditions provided in laws and administrative regulations.

Approval on the establishment of an audiovisual product duplication work unit shall not only be in accordance with the conditions enumerated in the preceding paragraph, but also conform to the programming on the total number, distribution and structure of the audiovisual product duplication work units.

Article 21: Applications for the establishment of an audiovisual product duplication work unit shall be examined and approved by the provincial, autonomous region or municipal People’s Government administrative publication entity of the applicant’s locality before it is submitted to the State Council administrative publication entity for examination and approval. The State Council administrative publication entity shall, within 60 days of receipt of the application, make a decision on approving or not approving the application and shall notify the applicant. If the application is approved, an “Audiovisual Products Duplication Permit” shall be issued to the applicant, who shall register and obtain a business licence in accordance with the law in the administrative industry and commerce entity with the “Audiovisual Products Duplication Permit”; if the application is not approved, the reason thereof shall be stated.

The application shall clearly state the following:

(1) the name and address of the audiovisual product duplication work unit;

(2) the name(s) and address(es) of the legal representative or principal responsible person(s) of the audiovisual product duplication work unit;

(3) the sources and amount of funds of the audiovisual product duplication work unit.

Article 22: Where an audiovisual product duplication work unit modifies its scope of business, or merges another audiovisual product duplication work unit, or establishes a new audiovisual product duplication work unit due to merger or division, it shall conduct examination and approval formalities in accordance with Article 21 of these Regulations, and shall conduct the corresponding registration formalities in the administrative industry and commerce entity.

Where an audiovisual product duplication work unit changes its name, address, legal representative or principal responsible person(s), or to terminate its duplication business activities, it shall conduct registration modification or registration cancellation in the administrative industry and commerce entity that handled the original registration, and shall report to the State Council administrative publication entity for filing.

Article 23: Where an audiovisual product duplication work unit is entrusted to duplicate audiovisual products, it shall, in accordance with the relevant State provisions, conclude a duplication entrustment contract with the entrusting publication work unit; and shall verify the entrusting publication work unit’s “Audiovisual Products Publication Permit”, a copy of its business licence, letter of entrustment for duplication audiovisual products, carrying the seal of the entrusting publication work unit, and the written authorization of the copyright owner. Where the audiovisual products subject to entrusted duplication are not for sale, the audiovisual products duplication entrustment letter, which is checked and issued by the provincial, autonomous region or municipal People’s Government administrative publication entity and carrying the seal of the entrusting publication work unit, shall be verified.

The audiovisual product duplication work unit shall, within 2 years as of the completion of the duplication of the audiovisual products, preserve the entrustment contract, specimen of the audiovisual products it has duplicated and the copies of the relevant certification documents, for preparation of inspection.

Article 24: An audiovisual product duplication work unit may not accept entrustment of a work unit or individual not engaged in audiovisual products publication to duplicate commercial audiovisual products, or duplicate audiovisual products of its own accord, or wholesale, retail or rental audiovisual products.

Article 25: An audiovisual product duplication work unit engaged in the duplication of optical disks must, when duplicating, use moulds etched with the SID code, examined and issued by the State Council administrative publication entity.

Article 26: Where an audiovisual product duplication work unit is entrusted to duplicate overseas audiovisual products, it shall submit a specimen of these audiovisual products in advance to the provincial, autonomous region or municipal People’s Government administrative publication entity for examination and approval, and shall register in the administrative copyright entity in accordance with the law with the written authorization of the copyright owner; the duplicated audiovisual products shall be completely transported out of the territory.

Chapter 4 Import

Article 27: The finished audiovisual products import business shall be operated by the finished audiovisual products import business work units designated by the State Council administrative culture entity; no entity or individual may operate the finished audiovisual products import business without being designated.

Article 28: Import of audiovisual products used for publication or finished audiovisual products used for wholesale, retail or rental, etc. content shall be reported to the State Council administrative culture entity for examination.

The State Council administrative culture entity shall, within 30 days of the receipt of the application for examination of audiovisual product content, make a decision on approving or not approving the application and shall notify the applicant. If the application is approved, an approval document shall be issued; if the application is not approved, the reason shall be stated.

Work units importing audiovisual products used for publication, and finished audiovisual products import business work units shall conduct import formalities with Customs with the approval documents of the State Council administrative culture entity.

Article 29: When importing audiovisual products used for publication, its copyright shall be registered with the State Council administrative copyright entity.

Article 30: When importing audiovisual products for research or teaching reference, a finished audiovisual products import entity shall be entrust to carry out import in accordance with Article 28 of these Regulations.

When importing audiovisual products used for exhibition or display, after being approved by the State Council administrative culture entity, temporary import formalities shall be conducted with Customs.

Audiovisual products imported in accordance with this Article shall not be used for commercial duplication, wholesale, retail, rental or projection.

Chapter 5 Wholesale, retail and rental

Article 31: To establish an audiovisual product wholesale, retail or rental work unit, applicants shall meet the following conditions:

(1) having the name and articles of association of an audiovisual product wholesale, retail or rental work unit;

(2) having a well-defined scope of business;

(3) having an organization and the staff adapted to the needs of its scope of business;

(4) having the funds, equipment and work premises adapted to the needs of its scope of business;

(5) other conditions provided in laws and administrative regulations.

Article 32: Applications for the establishment of nationwide chain business work units of audiovisual products shall be examined and approved by the provincial, autonomous region or municipal administrative culture entity of the applicant‘s headquarters locality before it is submitted to the State Council administrative culture entity for examination and approval. Applications for the establishment of an audiovisual product wholesale work unit shall be submitted to the provincial, autonomous region or municipal administrative culture entity of the applicant‘s locality for examination and approval. Applications for being engaged in audiovisual product retail or rental business shall be submitted to the county-level administrative culture entity for examination and approval. The administrative culture entity shall, within 30 days of the receipt of the application, make a decision on approving or not approving the application and shall notify the applicant. If the application is approved, an “Audiovisual Products Dealing Permit” shall be issued to the applicant, who shall register and obtain a business licence in accordance with the law in the administrative industry and commerce entity with the “Audiovisual Products Dealing Permit”; if the application is not approved, the reason shall be stated.

The “Audiovisual Products Dealing Permit” shall indicate the sort of audiovisual product business activities.

Article 33: Where an audiovisual product wholesale, retail or rental work unit changes its name or scope of business, or merges with another audiovisual product wholesale, retail or rental work unit, or establishes a new audiovisual product wholesale, retail or rental work unit due to merger or division, it shall conduct examination and approval formalities in accordance with Article 32 of these Regulations, and shall conduct the corresponding registration formalities in the administrative industry and commerce entity that handled the original registration.

Where, an audiovisual product wholesale, retail or rental work unit changes its address, legal representative or principal responsible person(s), or terminates its business activities, or, an individual engaged in audiovisual product retail or rental business changes his scope of business, address or terminates its business activities, it/he shall conduct registration modification or cancellation in the administrative industry and commerce entity that handled the original registration, and shall report to the administrative culture entity that granted the original approval for filing.

Article 34: An audiovisual product publication work unit may, in accordance with the relevant State provisions, wholesale and retail audiovisual products it published. If it is engaged in wholesale or retail business of the audiovisual products not of its own publication, it shall conduct examination and approval formalities in accordance with Article 32 of these Regulations, and shall conduct registration formalities in the administrative industry and commerce entity that handled the original registration.

Article 35: The State permits the establishment of Sino-foreign cooperative enterprises engaged in the audiovisual product distribution business. Concrete measures and procedures for implementation shall be formulated by the State Council administrative culture entity jointly with the State Council foreign trade and economic cooperation entity in accordance with relevant regulations.

Article 36: Audiovisual product wholesale work units or entities or individual engaged in the retail or rental business, etc. of audiovisual products may not deal in audiovisual products published by any work unit other than an audiovisual product publication work units or duplicated by any entity other than an audiovisual product duplication work unit, nor shall it/he deal in audiovisual products imported without the approval of the State Council administrative culture entity or which infringe upon others’ copyright.

Chapter 6: Penalty provisions

Article 37: Where the administrative publication entity, the administrative culture entity, the administrative industry and commerce entity or any other relevant administrative entity or any personnel, uses work privileges to accept benefits or other advantages, and approves an audiovisual product publication, production, duplication, import, wholesale, retail or rental work unit which does not meet legal conditions for establishment, or does not carry out supervision duties, or does not investigate illegal acts found, causing serious consequences, the responsible person in charge and other directly responsible persons shall be charged with criminal liability in accordance with the provisions of the Criminal Law on the crimes of accepting bribes, abusing power, neglecting duty or other crimes; where the case is not serious enough for imposing of criminal punishment, an administrative sanction of demotion or dismissal shall be imposed.

Article 38: Where any personnel in a supervisory and administrative entity for audiovisual product business activities is engaged in the audiovisual product business activities directly or in a disguised form, or participate in an audiovisual product operating entity’s business activities directly or in a disguised form, he shall be imposed upon an administrative sanction of dismissal from his post or dismissal in accordance with the law.

Where the supervisory and administrative entity for audiovisual product business activities commits any of the acts listed in the preceding paragraph, the responsible person in charge and other directly responsible persons shall be punished in accordance with the preceding paragraph.

Article 39: Establishment without approval or without authorization of an audiovisual product publication, production, duplication, import, wholesale, retail, rental or projection entity or engaging, without authorization, in the publication, production, duplication business or importing, wholesale, retail or rental business activities, shall be banned by the administrative publication entity and the administrative industry and commerce entity in accordance with their legal powers; and criminal liability shall be investigated in accordance with the provisions in the Criminal Law on  illegal business operation; if the case is not serious enough for imposing criminal punishment, its illegally traded audiovisual products, illegal gains and instruments and equipment specifically used in the illegal activities shall be confiscated; if the amount of illegal business volume is 10,000 Yuan or more, a fine of not less than 5 times but not exceeding than 10 times the amount of illegal business volume shall also be imposed; if the amount of illegal business volume is less than 10,000 Yuan, a fine of not more than 50,000 Yuan shall also be imposed.

Article 40: Publication of audiovisual products containing any content prohibited by Article 3, Paragraph 2 of these Regulations, or produces, duplicates, wholesales, retails, rents or projects audiovisual products known to or should be known to contain any content prohibited by Paragraph 2, Article 3 of these Regulations, criminal liability shall be investigated in accordance with the relevant provisions in the Criminal Law; if the case is not serious enough for imposing criminal punishment, the administrative publication entity, the administrative culture entity and the public security entity shall, according to their respective powers, order cessation of business for rectification, confiscate illegally traded audiovisual products and illegal gains; if the amount of illegal business volume is 10,000 Yuan or more, a fine of not less than 5 times but not more than 10 times the amount of illegal business volume shall also be imposed; if the amount of illegal business volume is less than 10,000 Yuan, a fine of not more than 50,000 Yuan may also be imposed; if the case is serious, the licence shall be revoked also by the original organ that issued the licence.

Article 41: For smuggling of audiovisual products, criminal liability shall be investigated in accordance with the provisions in the Criminal Law on smuggling; where the case is not serious enough for criminal punishment, an administrative punishment shall be imposed by Customs in accordance with the law.

Article 42: Where any of the following circumstances exist, the administrative publication entity shall order cessation of the illegal activity, issue a warning, confiscate illegally traded audiovisual products and illegal gains; if the amount of illegal business volume is not less than 10,000 Yuan, a fine of not less than 5 times but not more than 10 times the amount of illegal business volume shall also be imposed; if the amount of illegal business volume is less than 10,000 Yuan, a fine of not less than 10,000 Yuan but not more than 50,000 Yuan shall also be imposed; where circumstances are grave, also, business cessation for rectification shall be ordered or licences shall, also, be revoked by the original organ that issued the licence:

(1) where an audiovisual product publication work unit rents, lends, sells or transfers in any other form its name to or sells or transfers in any other form its publication number to another entity or individual;

(2) where an audiovisual product publication work unit entrusts a work unit not having obtained the “Audiovisual Products Production Permit” to produce audiovisual products, or entrusts a work unit not having obtained the “Audiovisual Products Duplication Permit” to duplicate audiovisual products;

(3) where an audiovisual product publication work unit publishes audiovisual products imported without State Council administrative culture entity approval;

(4) where an audiovisual product production work unit or an audiovisual product duplication work unit does not verify the entrustment letter or the relevant certification of the audiovisual product publication work unit in accordance with these Regulations;

(5) where an audiovisual product duplication work unit duplicates others’ audiovisual products without authorization, or accepts entrustment of a non-audiovisual publication work unit or individual to duplicate commercial audiovisual products, or duplicates audiovisual products of its own accord.

Article 43: Where an audiovisual product publication work unit violates relevant State provisions by cooperating with an organization or individual from Hong Kong Special Administrative Region, Macao Special Administrative Region, Taiwan region or a foreign country to produce audiovisual products without being examined and approved by the provincial, autonomous region or municipal People’s Government administrative publication entity, or where an audiovisual product duplication work unit violates relevant State provisions by accepting entrustment to duplicate foreign audiovisual products without fully transporting the duplicated overseas audiovisual products out of the territory, correction and confiscation of illegally traded audiovisual products and illegal gains shall be ordered by the provincial, autonomous region or municipal People’s Government administrative publication entity; if the amount of illegal business volume is 10,000 Yuan or higher,  a fine of not less than 5 times but not more than 10 times the amount of illegal business volume shall also be imposed; if the amount of illegal business volume is less than 10,000 Yuan,  a fine of not less than 10,000 Yuan but not more than 50,000 Yuan shall also be imposed; if the case is serious, licences also shall be revoked by the original organ that issued the licence.

Article 44: Where any of the following circumstances exist, correction and a warning shall be ordered by the administrative publication entity and the administrative culture entity; if the case is serious, it shall, also, order rectification or revocation of by the original organ that issued the licence:

(1) where an audiovisual product publication work unit does not submit its annual publication plans and the selected topics concerning national security and social stability, etc. to the State Council administrative publication entity for filing;

(2) where an audiovisual product publication, production, duplication, wholesale, retail or rental work unit does not conduct examination, approval and recording formalities in accordance with these Regulations when it changes its name, address, legal representative, principal responsible person(s) or scope of business, etc.;

(3) where an audiovisual product publication work unit does not indicate in a prominent position on the audiovisual product it published and its packaging the content provided in these Regulations;

(4) where an audiovisual product publication work unit does not submit a specimen in accordance with these Regulations;

(5) where an audiovisual product duplication work unit does not preserve materials in preparation for inspection in accordance with these Regulations;

(6) where an audiovisual product duplication work unit engaged in the duplication of optical disks uses, when duplicating optical disks, plastic moulds not etched with a SID code verified and issued by the State Council administrative publication entity.

Article 45: In case of any of the following acts, the administrative culture entity shall order cessation of illegal activities, issue a warning, and confiscate illegally traded audiovisual products and illegal gains; if the amount of illegal business volume is 10,000 Yuan or more, a fine of not less than 5 times but not more than 10 times the amount of illegal business volume shall also be imposed; if the amount of illegal business volume is less than 10,000 Yuan, a fine of not less than 10,000 Yuan but not more than 50,000 Yuan shall also be imposed; if the case is serious, it shall, also, order cessation of business for rectification, or order revocation of licences by the original organ that issued the licence:

(1) wholesale, retail, rental or projection of audiovisual products published by a non-audiovisual products publication work units or duplicated by a non-audiovisual product duplication work unit;

(2) wholesale, retail, rental or projection of audiovisual products imported without the approval of the State Council administrative culture entity;

(3) to wholesale, retail, rental or projection of audiovisual products imported for research or education reference or used for exhibition or display;

(4) where an audiovisual product publication work unit publishes audiovisual products imported without the approval of the State Council administrative culture entity.

Article 46: Where a work unit violates these Regulations and is subject to the administrative penalty of licence revocation, it shall conduct the registration modification or registration cancellation in the administrative industry and commerce entity; if it has not conducted this registration after expiry, its business licence shall be revoked by the administrative industry and commerce entity.

Article 47: Where a work unit violates these Regulations and is subject to the administrative penalty of licence revocation, its legal representative or all main responsible persons may not, within 10 years of the revocation of the licence, undertake the duties of legal representative or main responsible person of an audiovisual product publication, production, duplication, importing, wholesale, retail or rental work unit.

Where an individual engaged in the audiovisual product retail, rental or projection business violates these Regulations and is subject to the administrative penalty of licence revocation of its licence, he may not, within 10 years of the revocation of the licence, be engaged in the audiovisual product retail, rental or projection business.

Article 48: Concerning administrative punishments of fines imposed in accordance with these Regulations, the decision to fine shall be separate from fine in accordance with the provisions of relevant laws and administrative regulations; the collected fine must be completely turned over to the State treasury.

Chapter 7: Supplementary provisions

Article 49: The establishment of commercial audiovisual product projection entities shall not be approved from the date when these Regulations take effect; those established in accordance with the law may not renovate their present equipment, and shall be closed within 5 years; prior to closure, they shall be supervised and administered by the administrative culture entity.

Article 50: Relevant entities shall not, when issuing licences in accordance with these Regulations, collect any fees other than the cost that shall be collected on the basis of the legal standards.

Article 51: These Regulations shall take effect on 1 February 2002. The “Audiovisual Products Management Regulations” promulgated by the State Council on August 25, 1994 shall be simultaneously abolished.

《音像制品管理条例》已经2001年12月12日国务院第50次常务会议通过,现予公布,自2002年2月1日起施行。

第一章 总 则
第一条 为了加强音像制品的管理,促进音像事业的健康发展和繁荣,丰富人民群众的文化生活,促进社会主义物质文明和精神文明建设,制定本条例。
第二条 本条例适用于录有内容的录音带、录像带、唱片、激光唱盘和激光视盘等音像制品的出版、制作、复制、进口、批发、零售、出租等活动。
音像制品用于广播电视播放的,适用广播电视法律、行政法规。
第三条 出版、制作、复制、进口、批发、零售、出租音像制品,应当遵守宪法和有关法律、法规,坚持为人民服务和为社会主义服务的方向,传播有益于经济发展和社会进步的思想、道德、科学技术和文化知识。
音像制品禁止载有下列内容:
(一)反对宪法确定的基本原则的;
(二)危害国家统一、主权和领土完整的;
(三)泄露国家秘密、危害国家安全或者损害国家荣誉和利益的;
(四)煽动民族仇恨、民族歧视,破坏民族团结,或者侵害民族风俗、习惯的;
(五)宣扬邪教、迷信的;
(六)扰乱社会秩序,破坏社会稳定的;
(七)宣扬淫秽、赌博、暴力或者教唆犯罪的;
(八)侮辱或者诽谤他人,侵害他人合法权益的;
(九)危害社会公德或者民族优秀文化传统的;
(十)有法律、行政法规和国家规定禁止的其他内容的。
第四条 国务院出版行政部门负责全国音像制品的出版、制作和复制的监督管理工作;国务院文化行政部门负责全国音像制品的进口、批发、零售和出租的监督管理工作;国务院其他有关行政部门按照国务院规定的职责分工,负责有关的音像制品经营活动的监督管理工作。
县级以上地方人民政府负责出版管理的行政部门(以下简称出版行政部门)负责本行政区域内音像制品的出版、制作和复制的监督管理工作;县级以上地方人民政府文化行政部门负责本行政区域内音像制品的进口、批发、零售和出租的监督管理工作;县级以上地方人民政府其他有关行政部门在各自的职责范围内负责有关的音像制品经营活动的监督管理工作。
第五条 国家对出版、制作、复制、进口、批发、零售、出租音像制品,实行许可制度;未经许可,任何单位和个人不得从事音像制品的出版、制作、复制、进口、批发、零售、出租等活动。
依照本条例发放的许可证和批准文件,不得出租、出借、出售或者以其他任何形式转让。
第六条 国务院出版行政部门、文化行政部门负责制定音像事业的发展规划,按照国务院规定的职责分工分别确定全国音像出版单位、音像复制单位和音像制品成品进口经营单位的总量、布局和结构。
第七条 音像制品经营活动的监督管理部门及其工作人员不得从事或者变相从事音像制品经营活动,并不得参与或者变相参与音像制品经营单位的经营活动。
第二章 出版
第八条 设立音像出版单位,应当具备下列条件:
(一)有音像出版单位的名称、章程;
(二)有符合国务院出版行政部门认定的主办单位及其主管机关;
(三)有确定的业务范围;
(四)有适应业务范围需要的组织机构和符合国家规定的资格条件的音像出版专业人员;
(五)有适应业务范围需要的资金、设备和工作场所;
(六)法律、行政法规规定的其他条件。
审批设立音像出版单位,除依照前款所列条件外,还应当符合音像出版单位总量、布局和结构的规划。
第九条 申请设立音像出版单位,由所在地省、自治区、直辖市人民政府出版行政部门审核同意后,报国务院出版行政部门审批。国务院出版行政部门应当自收到申请书之日起60日内作出批准或者不批准的决定,并通知申请人。批准的,发给《音像制品出版许可证》,由申请人持《音像制品出版许可证》到工商行政管理部门登记,依法领取营业执照;不批准的,应当说明理由。
申请书应当载明下列内容:
(一)音像出版单位的名称、地址;
(二)音像出版单位的主办单位及其主管机关的名称、地址;
(三)音像出版单位的法定代表人或者主要负责人姓名、住址、资格证明文件;
(四)音像出版单位的资金来源和数额;
第十条 音像出版单位变更名称、主办单位或者其主管机关、业务范围,或者兼并其他音像出版单位,或者因合并、分立而设立新的音像出版单位的,应当依照本条例第九条的规定办理审批手续,并到原登记的工商行政管理部门办理相应的登记手续。
音像出版单位变更地址、法定代表人或者主要负责人,或者终止出版经营活动的,应当到原登记的工商行政管理部门办理变更登记或者注销登记,并向国务院出版行政部门备案。
第十一条 音像出版单位的年度出版计划和涉及国家安全、社会安定等方面的重大选题,应当经所在地省、自治区、直辖市人民政府出版行政部门审核后报国务院出版行政部门备案;重大选题音像制品未在出版前报备案的,不得出版。
第十二条 音像出版单位应当在其出版的音像制品及其包装的明显位置,标明出版单位的名称、地址和音像制品的版号、出版时间、著作权人等事项;出版进口的音像制品,还应当标明进口批准文号。
音像出版单位应当自音像制品出版之日起30日内向国家图书馆、中国版本图书馆和国务院出版行政部门免费送交样本。
第十三条 音像出版单位不得向任何单位或者个人出租、出借、出售或者以其他任何形式转让本单位的名称,不得向任何单位或者个人出售或者以其他形式转让本单位的版号。
第十四条 任何单位和个人不得以购买、租用、借用、擅自使用音像出版单位的名称或者购买、伪造版号等形式从事音像制品出版活动。
图书出版社、报社、期刊社、电子出版物出版社,不得出版非配合本版出版物的音像制品;但是,可以按照国务院出版行政部门的规定,出版配合本版出版物的音像制品,并参照音像出版单位享有权利、承担义务。
第十五条 音像出版单位可以与香港特别行政区、澳门特别行政区、台湾地区或者外国的组织、个人合作制作音像制品。具体办法由国务院出版行政部门制定。
第十六条 音像出版单位实行编辑责任制度,保证音像制品的内容符合本条例的规定。
第十七条 音像出版单位以外的单位申请设立独立从事音像制品的制作业务的单位(以下简称音像制作单位),由所在地省、自治区、直辖市人民政府出版行政部门审批。省、自治区、直辖市人民政府出版行政部门应当自收到申请书之日起60日内作出批准或者不批准的决定,并通知申请人。批准的,发给《音像制品制作许可证》,由申请人持《音像制品制作许可证》到工商行政管理部门登记,依法领取营业执照;不批准的,应当说明理由。广播、电视节目制作经营单位的设立,依照有关法律、行政法规的规定办理。
申请书应当载明下列内容:
(一)音像制作单位的名称、地址;
(二)音像制作单位的法定代表人或者主要负责人的姓名、住址、资格证明文件;
(三)音像制作单位的资金来源和数额。
审批设立音像制作单位,除依照前款所列条件外,还应当兼顾音像制作单位总量、布局和结构。
第十八条 音像制作单位变更名称、业务范围,或者兼并其他音像制作单位,或者因合并、分立而设立新的音像制作单位的,应当依照本条例第十七条的规定办理审批手续,并到原登记的工商行政管理部门办理相应的登记手续。
音像制作单位变更地址、法定代表人或者主要负责人,或者终止制作经营活动的,应当到原登记的工商行政管理部门办理变更登记或者注销登记,并向省、自治区、直辖市人民政府出版行政部门备案。
第十九条 音像出版单位不得委托未取得《音像制品制作许可证》的单位制作音像制品。
音像制作单位接受委托制作音像制品的,应当按照国家有关规定,与委托的出版单位订立制作委托合同;验证委托的出版单位的《音像制品出版许可证》或者本版出版物的证明及由委托的出版单位盖章的音像制品制作委托书。
音像制作单位不得出版、复制、批发、零售、出租音像制品。
第三章 复制
第二十条 设立音像复制单位应当具备下列条件:
(一)有音像复制单位的名称、章程;
(二)有确定的业务范围;
(三)有适应业务范围需要的组织机构和人员;
(四)有适应业务范围需要的资金、设备和复制场所;
(五)法律、行政法规规定的其他条件。
审批设立音像复制单位,除依照前款所列条件外,还应当符合音像复制单位总量、布局和结构的规划。
第二十一条 申请设立音像复制单位,由所在地省、自治区、直辖市人民政府出版行政部门审核同意后,报国务院出版行政部门审批。国务院出版行政部门应当自收到申请书之日起60日内作出批准或者不批准的决定,并通知申请人。
批准的,发给《音像制品复制许可证》,由申请人持《音像制品复制许可证》,到工商行政管理部门登记,依法领取营业执照;不批准的,应当说明理由。
申请书应当载明下列内容:
(一)音像复制单位的名称、地址;
(二)音像复制单位的法定代表人或者主要负责人的姓名、住址;
(三)音像复制单位的资金来源和数额;
第二十三条 音像复制单位接受委托复制音像制品的,应当按按照国家有关规定,与委托的出版单位订立复制委托合同;验证委托的出版单位的《音像制品出版许可证》和营业执照副本及其盖章的音像制品复制委托书及著作权人的授权书;接受委托复制的音像制品属于非卖品的,应当验证经省、自治区、直辖市人民政府出版行政部门核发并由委托单位盖章的音像制品复制委托书。
音像复制单位应当自完成音像制品复制之日起2年内,保存委托合同和所复制的音像制品的样本以及验证的有关证明文件的副本,以备查验。
第二十四条 音像复制单位不得接受非音像出版单位或者个人的委托复制经营性的音像制品;不得自行复制音像制品;不得批发、零售、出租音像制品。
第二十五条 从事光盘复制的音像复制单位复制光盘,必须使用蚀刻有国务院出版行政部门核发的激光数码储存片来源识别码的注塑模具。
第二十六条 音像复制单位接受委托复制境外音像制品,应当事先将该音像制品的样品报经省、自治区、直辖市人民政府出版行政部门审核同意,并持著作权人的授权书依法到著作权行政管理部门登记;复制的音像制品应当全部运输出境。
第四章 进 口
第二十七条 音像制品成品进口业务由国务院文化行政部门指定音像制品成品进口经营单位经营;未经指定,任何单位或者个人不得经营音像制品成品进口业务。
第二十八条 进口用于出版的音像制品,以及进口用于批发、零售、出租等的音像制品成品,应当报国务院文化行政部门进行内容审查。
国务院文化行政部门应当自收到音像制品内容审查申请书之日起30日内作出批准或者不批准的决定,并通知申请人。批准的,发给批准文件;不批准的,应当说明理由。
进口用于出版的音像制品的单位、音像制品成品进口经营单位应当持国务院文化行政部门的批准文件到海关办理进口手续。
第二十九条 进口用于出版的音像制品,其著作权事项应当向国务院著作权行政管理部门登记。
第三十条 进口供研究、教学参考的音像制品,应当委托音像制品成品进口经营单位依照本条例第二十八条的规定办理。
进口用于展览、展示的音像制品,经国务院文化行政部门批准后,到海关办理临时进口手续。
依照本条规定进口的音像制品,不得进行经营性复制、批发、零售、出租和放映。
第五章 批发、零售和出租
第三十一条 设立音像制品批发、零售、出租单位,应当具备下列条件:
(一)有音像制品批发、零售、出租单位的名称、章程;
(二)有确定的业务范围;
(三)有适应业务范围需要的组织机构和人员;
(四)有适应业务范围需要的资金和场所;
(五)法律、行政法规规定的其他条件。
第三十二条 申请设立全国性音像制品连锁经营单位,应当由其总部所在地省、自治区、直辖市人民政府文化行政部门审核同意后,报国务院文化行政部门审批。申请设立音像制品批发单位,应当报所在地省、自治区、直辖市人民政府文化行政部门审批。申请从事音像制品零售、出租业务,应当报县级地方人民政府文化行政部门审批。文化行政部门应当自收到申请书之日起30日内作出批准或者不批准的决定,并通知申请人。批准的,应当发给《音像制品经营许可证》,由申请人持《音像制品经营许可证》到工商行政管理部门登记,依法领取营业执照;不批准的,应当说明理由。
《音像制品经营许可证》应当注明音像制品经营活动的种类。
第三十三条 音像制品批发、零售、出租单位变更名称、业务范围,或者兼并其他音像制品批发、零售、出租单位,或者因合并、分立而设立新的音像制品批发、零售、出租单位的,应当依照本条例第三十二条的规定办理审批手续,并到原登记的工商行政管理部门办理相应的登记手续。
音像制品批发、零售、出租单位变更地址、法定代表人或者主要负责人或者终止经营活动,从事音像制品零售、出租经营活动的个人变更业务范围、地址或者终止经营活动的,应当到原登记的工商行政管理部门办理变更登记或者注销登记,并向原批准的文化行政部门备案。
第三十四条 音像出版单位可以按照国家有关规定,批发、零售本单位出版的音像制品。从事非本单位出版的音像制品的批发、零售业务的,应当依照本条例第三十二条的规定办理审批手续,并到原登记的工商行政管理部门办理登记手续。
第三十五条 国家允许设立从事音像制品分销业务的中外合作经营企业。具体实施办法和步骤,由国务院文化行政部门会同国务院对外经济贸易主管部门按照有关规定规定。
第三十六条 音像制品批发单位和从事音像制品零售、出租等业务的单位或者个人,不得经营非音像出版单位出版的音像制品或者非音像复制单位复制的音像制品,不得经营未经国务院文化行政部门批准进口的音像制品,不得经营侵犯他人著作权的音像制品。
第六章 罚 则
第三十七条 出版行政部门、文化行政部门、工商行政管理部门或者其他有关行政部门及其工作人员,利用职务上的便利收受他人财物或者其他好处,批准不符合法定设立条件的音像制品出版、制作、复制、进口、批发、零售、出租单位,或者不履行监督职责,或者发现违法行为不予查处,造成严重后果的,对负有责任的主管人员和其他直接责任人员依照刑法关于受贿罪、滥用职权罪、玩忽职守罪或者其他罪的规定,依法追究刑事责任;尚不够刑事处罚的,给予降级或者撤职的行政处分。
第三十八条 音像制品经营活动的监督管理部门的工作人员从事或者变相从事音像制品经营活动的,参与或者变相参与音像制品经营单位的经营活动的,依法给予撤职或者开除的行政处分。
音像制品经营活动的监督管理部门有前款所列行为的,对负有责任的主管人员和其他直接责任人员依照前款规定处罚。
第三十九条 未经批准,擅自设立音像制品出版、制作、复制、进口、批发、零售、出租、放映单位,擅自从事音像制品出版、制作、复制业务或者进口、批发、零售、出租、放映经营活动的,由出版行政部门、工商行政管理部门依照法定职权予以取缔;依照刑法关于非法经营罪的规定,依法追究刑事责任;尚不够刑事处罚的,没收违法经营的音像制品和违法所得以及进行违法活动的专用工具、设备;违法经营额1万元以上的,并处违法经营额5倍以上10倍以下的罚款;违法经营额不足1万元的,并处5万元以下的罚款。
第四十条 出版含有本条例第三条第二款禁止内容的音像制品,或者制作、复制、批发、零售、出租、放映明知或者应知含有本条例第三条第二款禁止内容的音像制品的,依照刑法有关规定,依法追究刑事责任;尚不够刑事处罚的,由出版行政部门、文化行政部门、公安部门依据各自职权责令停业整顿,没收违法经营的音像制品和违法所得;违法经营额1万元以上的,并处违法经营额5倍以上10倍以下的罚款;违法经营额不足1万元的,可以并处5万元以下的罚款;情节严重的,并由原发证机关吊销许可证。
第四十一条 走私音像制品的,依照刑法关于走私罪的规定,依法追究刑事责任;尚不够刑事处罚的,由海关依法给予行政处罚。
第四十二条 有下列行为之一的,由出版行政部门责令停止违法行为,给予警告,没收违法经营的音像制品和违法所得;违法经营额1万元以上的,并处违法经营额5倍以上10倍以下的罚款;违法经营额不足1万元的,并处1万元以上5万元以下的罚款;情节严重的,并责令停业整顿或者由原发证机关吊销许可证:
(一)音像出版单位向其他单位、个人出租、出借、出售或者以其他任何形式转让本单位的名称,出售或者以其他形式转让本单位的版号的;
(二)音像出版单位委托未取得《音像制品制作许可证》的单位制作音像制品,或者委托未取得《音像制品复制许可证》的单位复制音像制品的;
(三)音像出版单位出版未经国务院文化行政部门批准擅自进口的音像制品的;
(四)音像制作单位、音像复制单位未依照本条例的规定验证音像出版单位的委托书、有关证明的;
(五)音像复制单位擅自复制他人的音像制品,或者接受非音像出版单位、个人的委托复制经营性的音像制品,或者自行复制音像制品的。
第四十三条 音像出版单位违反国家有关规定与香港特别行政区、澳门特别行政区、台湾地区或者外国的组织、个人合作制作音像制品,音像复制单位违反国家有关规定接受委托复制境外音像制品,未经省、自治区、直辖市人民政府出版行政部门审核同意,或者未将复制的境外音像制品全部运输出境的,由省、自治区、直辖市人民政府出版行政部门责令改正,没收违法经营的音像制品和违法所得;违法经营额1万元以上的,并处违法经营额5倍以上10倍以下的罚款;违法经营额不足1万元的,并处1万元以上5万元以下的罚款;情节严重的,并由原发证机关吊销许可证。
第四十四条 有下列行为之一的,由出版行政部门、文化行政部门责令改正,给予警告;情节严重的,并责令停业整顿或者由原发证机关吊销许可证:
(一)音像出版单位为将其年度出版计划和涉及国家安全、社会安定等方面的重大选题报国务院出版行政部门备案的;
(二)音像制品出版、制作、复制、批发、零售、出租单位变更名称、地址、法定代表人或者主要负责人、业务范围等,未依据本条例规定办理审批的、备案手续的;
(三)音像出版单位未在其出版的音像制品及其包装的明显位置标明本条例规定的内容的;
(四)音像出版单位未依照本条例的规定送交样本的;
(五)音像复制单位未依照本条例的规定留存备查的资料的;
(六)从事光盘复制的音像复制单位复制光盘,使用未蚀刻国务院出版行政部门核发的激光数码存片来源识别码的注塑模具的。
第四十五条 有下列行为之一的,由文化行政部门责令停止违法行为,给予警告,没收违法经营的音像制品和违法所得;违法经营额1万元以上的,并处违法经营额5倍以上10倍以下的罚款;违法经营额不足1万元的,并处1万元以上5万元以下的罚款;情节严重的,并责令停业整顿或者由原发证机关吊销许可证:
(一)批发、零售、出租、放映非音像出版单位出版的音像制品或者非音像复制单位的音像制品的;
(二)批发、零售、出租或者放映未经国务院文化行政部门批准进口的音像制品的;
(三)批发、零售、出租、放映供研究、教学参考或者用于展览、展示的进口音像制品的;
(四)音像出版单位出版未经国务院文化行政部门批准进口的音像制品的。
第四十六条 单位违反本条例的规定,被处以吊销许可证行政处罚的,应当到工商行政管理部门办理变更登记或者注销登记;逾期未办理的,由工商行政管理部门吊销营业执照。
第四十七条 单位违反本条例的规定,被处以吊销许可证行政处罚的,其法定代表人或者主要负责人自许可证被吊销之日起10年内不得担任音像制品出版、制作、复制、进口、批发、零售、出租单位的法定代表人或者主要负责人。
从事音像制品零售、出租或者放映业务的个人违反本条例的规定,被处以吊销许可证行政处罚的,自许可证被吊销之日起10年内不得从事音像制品零售、出租或者放映业务。
第四十八条 依照本条例的规定实施罚款的行政处罚,应当依照有关法律、行政法规的规定,实行罚款决定与罚款收缴分离;收缴的罚款必须全部上缴国库。
第七章 附则
第四十九条 自本条例施行之日起,不再审批设立经营性音像制品放映单位;已经依法设立的,不得更新现有设备,并于5年内予以关闭;关闭前,由文化行政部门进行监督管理。
第五十条 依照本条例发放许可证,除按照法定标准收取成本费外,不得收取其他任何费用。
第五十一条 本条例自2002年2月1日起施行。1994年8月25日国务院发布的《音像制品管理条例》同时废止。
