Film Management Regulations (Revised)

The “Film Management Regulations” were adopted at the 50th executive meeting of the State Council on December 12, 2001, are hereby promulgated, and shall come into force on February 1, 2002.

Chapter I: General Provisions

Article 1: In order to strengthen film industry management, promote the film industry, and satisfy the people’s cultural life needs, promote socialist spiritual and material civilization, these Regulations are formulated.

Article 2: These Regulations shall apply to activities such as the production, import, export, distribution and projection, etc. of films inside the territory of the People’s Republic of China, including feature films, documentary films, science and education films, animations, and special topic films.

Article 3: People engaged in the activities such as production, import, export, distribution and projection, etc. of films shall abide by the Constitution and relevant laws and regulations, and shall adhere to the orientation of serving the people and serving socialism.

Article 4: The State Council administrative radio, film and television entity shall be in charge of film affairs in the entire country.

The county-level or higher People’s Government administrative film entities shall be responsible for the film management within their own jurisdiction in accordance with these Regulations.

Article 5: The State shall establish licensing system with for the production, import, export, distribution, and projection of films and public projection of films. Any work unit or individual, without permission, may not be engaged in the activities of production, import, distribution or projection of films, and may not import, export, distribute or project films for which the permit has not been obtained.

Permits or approval documents issued in accordance with these Regulations shall not be leased, lent, sold, or transferred in any other form.

Article 6: A national-size film industry social organization in shall, in accordance with its articles of association, practice self-disciplined management under the direction of State Council administrative radio, film and television entity.

Article 7: The State grants rewards to entities and individuals making significant contributions to the film sector development.

Chapter 2: Film Production

Article 8: In order to establish a film production entity, the following conditions shall be met:

(1) having the name and articles of association of a film production entity;

(2) having a controlling entity and the competent organ of which State Council administrative radio, film and television entity is aware;

(3) having a well-defined scope of business;

(4) having an organization adapted to the needs of its scope of business and a staff of professionals;

(5) having funds, premises and equipment adapted to the needs of its scope of business;

(6) other conditions provided for in laws and administrative regulations.

The approval on the establishment of a film production entity shall not only be conform to the conditions listed in the preceding paragraph, but also to the planning enacted by the State Council administrative radio, film and television entity on the total number, distribution and structure of the film production entities.

Article 9: Applications for the establishment of a film production entity shall be examined and approved by provincial, autonomous region or municipal People’s Government administrative radio, film and television where the applicant is located and submitted to the State Council administrative radio, film and television entity for examination and approval.

The application shall clearly state the following content:

(1) the name, address and economic nature of the film production entity;

(2) the name, address and nature of the controlling entity of and the competent organ of the film production entity;

(3) the name, address and qualification certifying documents of the legal representative of the film production entity;

(4) the sources and amount of funds of the film production entity.

Article 10: The State Council administrative radio, film and television entity shall, within 90 days of receipt of the application for the establishment of a film production entity, make a decision on approving or not approving the application and shall notify the applicant. Where the application is approved, a “Film Production Permit” shall be issued by the State Council administrative radio, film and television entity to the applicant, who shall conduct the registration formalities and obtain the business permit in accordance with the law in the administrative department for industry and commerce under the State Council with the “Film Production Permit”; if the application is not approved, the reason thereof shall be stated.

Article 11: Film production entity shall enjoy civil rights and bear civil liabilities concerning its total property in accordance with the law.

Article 12: Where a film production entity is to be modified or terminated, it shall report to the State Council administrative radio, film and television entity for approval, and shall conduct the modification registration or cancellation registration in the administrative department for industry and commerce that handled the original registration in accordance with the law.

Article 13: A film production entity may be engaged in the following activities:

(1) producing films;

(2) making duplicates of the films it produces, in accordance with relevant State provisions;

(3) distributing through the entire country the films that it produced and that are permitted for public projection as well as the duplicates of such films, in accordance with relevant State provisions;

(4) exporting the films it produced and that are permitted for public projection as well as the duplicates of such films in accordance with relevant State provisions.

Article 14: Film production entities shall establish and perfect management systems and to the quality of films.

Article 15:A film production entity shall enjoy copyright of the films it has produced in accordance with the law.

Article 16: An entity other than film production entities that intends to be independently engaged in the business of producing films shall report to the State Council administrative radio, film and television entity for approval, and shall handle the corresponding registration formalities in the administrative industry and commerce entity with the approval documents.

An entity other than film production entity that is approved to produce films shall obtain a one-off “Film Shooting Permit (Single Film)” in advance from the State Council administrative radio, film and television entity, and shall enjoy rights and bear obligations with reference to a film production entity. Specific measures shall be formulated by the State Council administrative radio, film and television entity.

Article 17: The State encourages enterprises, public institutions and other social organizations as well as individuals to participate in the production of films in the forms of financial aid and investment. Specific measures shall be formulated by State Council administrative radio, film and television entity.

Article 18: A film production entity may, upon approval by the State Council administrative radio, film and television entity, cooperate with a foreign film producer to produce films; no other entity or individual shall cooperate with an overseas film producer to produce films.

A film production entity and an entity holding the “Film Shooting Permit (Single Film)” may, upon approval by State Council administrative radio, film and television entity, be engaged in the activity of producing films outside the territory of China.

No foreign organization or individual may be independently engaged in film production activities inside the territory of the People’s Republic of China.

Article 19: With respect to the production of films through Sino-foreign cooperation, the Chinese partner shall propose an application for project initiation in advance to the State Council administrative radio, film and television entity. The State Council administrative radio, film and television entity shall, after soliciting opinions from the relevant departments, issue a one-off “Sino-foreign Film Coproduction Permit” to the applicant who is examined to be conforming to regulations. The applicant shall, after obtaining the “Sino-foreign Film Coproduction Permit”, conclude a Sino-foreign film coproduction contracts in accordance with the State provisions Council administrative radio, film and television entity.

Article 20: Where any equipment, apparatus, film or tool needs to be imported for a Sino-foreign coproduced film, the Chinese partner shall carry out the import or temporary import formalities with Customs with the approval documents issued by the State Council administrative radio, film and television entity.

Article 21:A foreign film producer who produces a film inside the territory of the People’s Republic of China by cooperating with a Chinese partner or by any other means shall observe the laws and regulations of the People’s Republic of China, and shall respect the customs and habits of the Chinese ethnicities.

Article 22: The development and post- production of the photographic plate and sample film of a film shall be completed inside the territory of the People’s Republic of China. Where such activities have to be completed outside the territory due to particular technical requirements, it shall be singly applied for, and after being reported to the State Council administrative radio, film and television entity for approval, shall be carried out according to the requirements clearly stated in the approval documents.

Article 23: A film laboratory work unit may not process the photographic plate or sample film of a film produced by an entity that has not obtained the “Film Production Permit” or the “Film Shooting Permit (Single Film)”, and may not process film copies for which the “Public Film Projection Permit” has not been obtained.

A film laboratory that is entrusted to process the photographic plate and sample film of an overseas film or film copy shall be approved by the State Council administrative radio, film and television entity in advance, and shall conduct the relevant import formalities in accordance with the law with the customs, with the approval documents. The processed photographic plates, sample films and film copies must be completely transported to the outside of the territory.

Chapter III Film examination

Article 24: The State applies a film examination system.

Films not been examined and adopted by the film examination entity of the State Council administrative radio, film and television entity (hereinafter referred to as “the film examination entity”) shall not be distributed, projected, imported or exported.

The import of special subject films for reference in science research or teaching and the import by China Film Archive of films for archival shall occur in accordance with Article 32 of these Regulations.

Article 25: The following content is prohibited from being recorded in a film:

(1) content that defies the basic principles determined in the Constitution;

(2) content that endangers the unity of the nation, sovereignty or territorial integrity;

(3) content that divulges secrets of the State, endangers national security or damages the honour or benefits of the State;

(4) content that incites the nation hatred or discrimination, undermines the solidarity of the nations, or infringes upon national customs and habits;

(5) content that propagates evil cults or superstition;

(6) content that disturbs the public order or destroys the public stability;

(7) content that propagates obscenity, gambling, violence or instigates crimes;

(8) content that insults or slanders others, or infringes upon the lawful rights and interests of others;

(9) content that endangers public ethics or the fine folk cultural traditions;

(10) other contents prohibited by laws, regulations or State provisions.

The technical quality of films shall conform to State standards.

Article 26: A film production entity shall, in accordance with Article 25 of these Regulations, be responsible for the examination of screenplays to be put into shooting and films not having left the factory.

A film production entity shall, after examining a screenplay to be put into shooting in accordance with the provisions in the preceding paragraph, report to the film examination entity for filing; the film examination entity may examine the screenplays reported for filing, and shall, where finding any content prohibited by Article 25 of these Regulations, timely notify the film production entity that they may not shoot. Specific measures shall be enacted by the State Council administrative radio, film and television entity.

Article 27: A film production entity shall, after producing a film, submit it to the film examination entity for examination; the film import entities shall, after completing the temporary import formalities for the film, submit it to the film examination entity for examination.

The standards for charging fees for film examinations shall be jointly stipulated by the State Council department in charge of price with the State Council administrative radio, film and television entity.

Article 28: The film examination entity shall, within 30 days as of receipt of a film submitted for examination, notify the submitting entity in writing of the examination decision. If the film is examined to be qualified, a “Public Film Projection Permit” shall be issued by State Council administrative radio, film and television entity.

A film production entity or film import entity shall print the number of its “Public Film Projection Permit” on the front of the first copy of the film. Where the film is examined to be unqualified, and is submitted after amendment for re-examination, the examination period shall be recalculated in accordance with Paragraph 1 of this Article.

Article 29: Where a film production entity or film import entity disagrees with the examination decision concerning the film, it may, within 30 days as of receipt of the examination decision, apply to the film re-examination institution of the State Council administrative radio, film and television entity for re-examination; where the film is re-examined to be qualified, the applicant shall be issued the “Public Film Projection Permit” by State Council administrative radio, film and television entity.

Chapter IV: Film Import and Export

Article 30: The business of importing films shall be operated by film import entities designated by State Council administrative radio, film and television entity; without being designated, no entity or individual shall conduct films importing business.

Article 31: Whoever intends to import films for public projection shall, before the import, submit a sample copy of the film to the film examination entity for examination.

Concerning films submitted to the film examination entity for examination, the designated film import entity shall conduct the temporary film import formalities with Customs with the approval documents for temporary import issued by the State Council administrative radio, film and television entity; after the temporarily imported film has been examined by the film examination entity to be qualified and the “Public Film Projection Permit” and the approval documents for import have been issued, the film import entity shall conduct import formalities with Customs with the approval documents for import.

Article 32: An import entity which intends to import special topic films for reference in science research or teaching shall report to the relevant State Council administrative department for examination and approval, conduct the import formalities with Customs with the approval documents, and report to the State Council administrative radio, film and television entity for record within 30 days as of the date of import. However, it shall not import feature films in the name of science research or teaching.

China Film Archive may, when importing archival films, directly conduct the import formalities at customs. China Film Archive shall report by quarter the archival films it has imported to the State Council administrative radio, film and television entity for filing.

Unless otherwise provided in this Article, no entity or individual shall import films that have not been examined to be qualified by State Council administrative radio, film and television entity.

Article 33: A film import entity shall, after obtaining permission from a copyright owner for exploitation of his film work, exploit the film work within the scope of permission; no entity or individual shall exploit the imported film work without obtaining the permission for exploitation.

Article 34: A film production entity that exports its own films shall conduct film export formalities with Customs with the “Public Film Projection Permit”.

Where a film produced through Sino-foreign cooperation is to be exported, the Chinese partner shall conduct export formalities with Customs with the “Public Film Projection Permit”. Where film materials produced through Sino-foreign cooperation are to be exported, the Chinese partner shall conduct the export formalities with Customs with the approval documents by State Council administrative radio, film and television entity.

Where a film or some film materials produced with the assistance of a Chinese party are to be carried outside of the territory, the Chinese assistor shall conduct the exit formalities with Customs with the approval documents by the State Council administrative radio, film and television entity.

Article 35: Whoever intends to organize a Sino-foreign film exhibition, international film festival, or provide films to a film exhibition or film festival, etc. held outside the territory, shall report to the State Council administrative radio, film and television entity for approval.

Films prepared for film exhibitions or film festivals listed in the preceding paragraph must be submitted to the State Council administrative radio, film and television entity for examination and approval. After a film prepared for a film exhibition or film festival held outside the territory has been approved, the participant shall conduct the temporary film export formalities at Customs with the approval documents by State Council administrative radio, film and television entity. After an overseas film prepared for a Sino-foreign film exhibition or international film festival held inside the territory of China has been approved, the holder shall conduct the temporary import formalities with Customs with the approval documents by State Council administrative radio, film and television entity.

Chapter V Film Distribution and Projection

Article 36: In order to establish a film distribution entity or film projection entity, the following conditions shall be fulfilled:

(1) having the name and articles of association of the film distribution entity or film projection entity;

(2) having a well-defined scope of business;

(3) having an organization adapted to the needs of its scope of business and a staff of professionals;

(4) having funds, premises and equipment adapted to the needs of its scope of business;

(5) other conditions provided for in laws and administrative regulations.

Article 37: Applications for the establishment of a film distribution entity shall be filed with the provincial, autonomous region or municipal administrative films department where the applicant is located; application for the establishment of a film distribution entity covering different provinces, autonomous regions or municipalities shall be filed with the State Council administrative radio, film and television entity. The provincial, autonomous region or municipal administrative films department where the applicant is located or State Council administrative radio, film and television entity shall, within 60 days as of receipt of the application, make a decision on approving or not approving the application and shall notify the applicant. If the application is approved, a “Film Distribution Operating Permit” shall be issued to the applicant, who shall have itself registered and obtain a business permit in accordance with the law in the administrative department for industry and commerce with the “Film Distribution Operating Permit”; if the application is not approved, the reason thereof shall be stated.

Article 38: The application for the establishment of a film projection entity shall be filed with the county or city administrative films department where the applicant is located. The county or city administrative films department where the applicant is located shall, within 60 days of receipt of the application, make a decision on approving or not approving the application and shall notify the applicant. If the application is approved, a “Film Projection Operating Permit” shall be issued to the applicant, who shall have itself registered and obtain the business permit in accordance with the law in the administrative department for industry and commerce with the “Film Projection Operating Permit”; if the application is not approved, the reason thereof shall be stated.

Article 39: Where a film distribution entity or film projection entity intends to modify its scope of business, or to merge with another film distribution entity or film projection entity, or to establish a new film distribution entity or film projection entity due to merger or division, it shall conduct the formalities of examination and approval in accordance with Article 37 or 38 of these Regulations, and shall conduct the corresponding registration formalities in the administrative department for industry and commerce.

Where a film distribution entity or film projection entity intends to change its name, address, legal representative or principal responsible person(s), or to terminate its business activities of distributing or projecting films, it shall conduct the modification registration or cancellation registration in the administrative department for industry and commerce which handled the original registration, and shall report to the administrative film entity which handled the original examination and approval for filing.

Article 40: An entity or individual applying to be engaged in the business of distributing or projecting 16-mm rural films may directly conduct registration formalities in the local administrative department for industry and commerce y, and shall report to the administrative film entity under the peoples’ government at the county level at its/his locality; after filing, it/he may be engaged in the business of distributing or projecting the 16-mm films in the rural areas nationwide.

Article 41: The State permits enterprises, public institutions and other social organizations as well as individuals to invest in constructing or rebuilding film theatres.

The State permits the construction and rebuilding of film theatres in the form of Sino-foreign joint ventures or Sino-foreign cooperation. Specific measures shall be enacted by the State Council administrative radio, film and television entity jointly with the State Council administrative department for cultural affairs under the State Council and the State Council department in charge of foreign trade and economic cooperation under the State Council in accordance with the relevant provisions.

Article 42: No one is allowed to distribute or project a film until he/it has obtained the “Public Film Projection Permit” issued by State Council administrative radio, film and television entity, in accordance with the law

Concerning films for which the “Public Film Projection Permit” has been obtained, the State Council administrative radio, film and television entity may, under exceptional circumstances, decide to order cessation of distribution or projection or, only allow distribution and projection after revision; with respect to a film which is decided to be revised, where the copyright owner refuses revision, the State Council administrative radio, film and television entity shall decide to order cease distribution or projection of the film.

The film distribution entities and film projection entities shall execute the decisions made by State Council administrative radio, film and television entity on ceasing distribution or projection.

Article 43: Whoever uses a film to produce audio and video products shall abide by the relevant State provisions on the administration of audio and video products.

No entity or individual shall make use of an archived film to engage in directly or disguised distribution or projection business activities.

Article 44: Those projecting a film shall observe with the State-stipulated proportion of the projection time of domestically produced films to that of imported films.

The duration for a projection entity’s annual projection of domestically produced films shall be not less than two thirds of the total annual film projection duration.

Article 45: Film projection entities shall maintain the public order and environmental sanitation of film theatres, to guarantee the safety and health of the audience.

Chapter VI Film Sector Protection

Article 46: The State establishes and improves a film administration system adapted to the socialist market economic system, and develops the film sector.

Article 47: The State guarantees the freedom of creating films, values and educates film professionals, values and strengthens the academic research on films, encourages the creation of films, and contributes to the quality of films.

Article 48: The State establishes a special fund for the film sector development, and takes other preferential measures to support the film sector development.

An entity obliged to pay the special fund for the film sector development shall perform its payment obligation in accordance with the relevant State provisions.

Article 49: The special fund for the film sector development supports and provides financial aids to the following projects:

(1) production of key films advocated and confirmed by the State and collection of fine screenplays;

(2) technical innovations at key film production bases;

(3) rebuilding of film theatres and technical innovations in projection facilities;

(4) film sector development in areas inhabited by ethnic minorities, remote depressed areas and rural areas;

(5) other projects which need financial aid.

Article 50: The State encourages and supports the production, distribution and projection of science and education films, documentary films, animations and children’s films.

Article 51: The State applies preferential policies to the distribution and projection of films in areas inhabited by ethnic minorities, remote depressed areas and rural areas.

The State supports the entities and individuals engaged in the business of distributing and projecting 16-mm rural films. Specific measures shall be formulated by the State Council administrative radio, film and television entity and the State Council administrative department for cultural affairs under the State Council jointly with the State Council financial department under the State Council.

Article 52: Urban planning made by county-level or higher local People’s Government for its own jurisdiction shall include construction planning of film theatre and the projection facilities.

Whoever intends to rebuild or demolish a film theatre or any projection facility shall apply to the county-level or higher local People’s Government administrative film entity of its locality for examination and approval, and the county-level or higher local People’s Government administrative film entity shall make a decision on approving or not approving the application in accordance with the relevant State provisions.

Article 53: County-level or higher local People’s Government administrative film entities and other relevant administrative departments shall take measures in time to stop and investigate acts of disturbing, holding back and destroying the production, distribution and projection of films in accordance with the law.

Mass media shall not publicize illegal films.

Chapter VII Punitive Provisions

Article 54: Where any cadre of the State Council administrative radio, film and television entity or in County-level or higher local People’s Government administrative film entities or in any other relevant department, by taking advantage of his office, accepts properties or other benefits from others, and approves a film production, distribution or projection entity which does not meet legal conditions for establishment, or does not implement his supervision duties, or does not investigate the illegal acts he has found, and causing serious consequences, the liable person in charge and other directly liable persons shall be investigated for criminal liability in accordance with the provisions in the Criminal Law concerning the crime of accepting bribes, of abusing power, of neglecting duty or other crimes; where the case is not serious enough for criminal punishments, an administrative sanction of demotion or dismissal shall be imposed.

Article 55: Whoever, in violation of these Regulations, establishes a film production, distribution or projection entity without authorization, or, without authorization, is engaged in the activity of production, import, distribution or projection of films, shall be banned by the administrative department for industry and commerce; and shall be investigated for criminal liability in accordance with the provisions in the Criminal Law on the crime of illegal business operation; if the case is not serious enough for criminal punishments, his/its films in illegal operation, illegal gains and tools and equipment only used in the illegal operation shall be confiscated; if the amount of illegal gains is not less than 50,000 Yuan, a fine of not less than 5 times but not more than 10 times the amount of illegal gains shall be imposed in addition; if there are no illegal gains or the amount of illegal gains is less than 50,000 Yuan, a fine of not less than 200,000 Yuan but not more than 500,000 Yuan in addition shall be imposed upon him/it.

Article 56: Whoever produces a film containing any content prohibited by Article 25 of these Regulations, or processes, imports, distributes or projects a film containing any content knows clearly or ought to be known as prohibited by Article 25 of these Regulations that he/it, shall be investigated for criminal liability in accordance with the relevant provisions of the Criminal Law; if the case is not serious enough for criminal punishments, the administrative film entity shall order cessation of business for rectification and shall confiscate illegally handled film and illegal gains; if the amount of illegal gains is not less than 50,000 Yuan, a fine of not less than 5 times but not more than 10 times the amount of illegal gains in addition shall be imposed; if there is no illegal proceed or the amount of illegal gains is less than 50,000 Yuan, a fine of not less than 200,000 Yuan but not more than 500,000 Yuan in addition shall be imposed; if the case is serious, permits shall be revoked in addition by the original organ issuing the permit.

Article 57: Whoever smuggles films shall be investigated for criminal liability in accordance with the provisions in the Criminal Law on the crime of smuggling; if the case is not serious enough for criminal punishments, administrative punishments shall be imposed by Customs in accordance with the law.

Article 58: Whoever exports, distributes or projects a film for which the “Public Film Projection Permit” has not been obtained, shall be ordered by the administrative film entity to cease the illegal act, illegally handled films and illegal gains shall be confiscated; if the amount of illegal gains is not less than 50,000 Yuan, a fine of not less than 10 times but not more than 15 times the amount of illegal gains shall be imposed; if there is no illegal proceed or the amount of illegal gains is less than 50,000 Yuan, a fine of not less than 200,000 Yuan but not more than 500,000 Yuan in addition shall be imposed; if the case is serious, business cessation for rectification shall be ordered or permits shall be revoked by the original organ issuing the permit.

Article 59: In case of any of the following acts, the party concerned shall be ordered by the administrative film entity to cease the illegal act, and illegally handled films and illegal gains will be confiscated; if the amount of illegal gains is not less than 50,000 Yuan, a fine of not less than 5 times but not more than 10 times the amount of illegal gains in addition shall be imposed; if there are no illegal gains or the amount of illegal gains is less than 50,000 Yuan, a fine of not less than 100,000 Yuan but not more than 300,000 Yuan in addition shall be imposed; if the case is serious, cessation of business for rectification shall be ordered or permits shall be revoked by the original organ issuing the permit:

(1) to, without authorization, cooperate with an overseas organization or individual to produce films, or to, without authorization, be engaged in production of films outside the territory;

(2) to, without authorization, conduct the development and post-production of the photographic plate and sample film of a film outside the territory, or not to carry out such an activity according to the requirements clearly stated in the approval documents;

(3) to process the photographic plate and sample film of a film, which is produced by an entity not having obtained the “Film Production Permit” or the “Film Shooting Permit (Single Film)”, or to process a film copy for which the “Public Film Projection Permit” has not been obtained;

(4) to, without authorization, process the photographic plate and sample film of an overseas film or film copy, or not to totally transport the processed photographic plates and sample films of the overseas film or film copy outside of the territory;

(5) to make use of an archival film to be engaged, either directly or in disguised form, in the operative distribution or projection activities;

(6) to project films not in compliance with the stipulated proportion of time, or not to execute a decision by the State Council administrative radio, film and television entity on cessation of distribution or projection.

Article 60: Where an overseas organization or individual is independently engaged in the production of films inside the territory of the People’s Republic of China, the State Council administrative radio, film and television entity shall order cessation of illegal activities; confiscation of illegally produced films and tools and equipment specially used in the illegal activities, and a fine of not less than 300,000 Yuan but not more than 500,000 Yuan in addition shall be imposed.

Article 61: Whoever, without authorization, holds a Sino-foreign film exhibition or international film festival, or, without authorization, provides films to a film exhibition or film festival outside the territory, the State Council administrative radio, film and television entity shall order cessation of the illegal activity, be confiscation of the films illegally provided to the exhibition or festival and the illegal gains; if the amount of illegal gains is not less than 20,000 Yuan, a fine of not less than 5 times but not more than 10 times the amount of illegal gains in addition shall be imposed; if there are no illegal gains or the amount of illegal gains is less than 20,000 Yuan, a fine of not less than 20,000 Yuan but not more than 100,000 Yuan in addition shall be imposed.

Article 62: Whoever, without authorization, rebuilds or demolishes a film theatre or any projection facility, shall be ordered by the county-level or higher People’s Government administrative film entity to recover the film theatre or projection facility to the original state within a set period, and receive a warning; the liable person in charge and other directly liable persons shall receive a disciplinary sanction in accordance with the law.

Article 63: Where an entity’s permits are revoked as administrative penalty due to its violation of these Regulations, it shall conduct registration modification or registration cancellation in the administrative department for industry and commerce in accordance with the relevant State provisions; if it has not gone through the said registration after the expiration date, its business permit shall be revoked by the administrative department for industry and commerce.

Article 64: Where the administrative penalty of permit revocation is imposed upon an entity due to its violation of these Regulations, its legal representative or each of its principal responsible persons shall not, within 5 years of revocation of the permit, hold the post of legal representative or principal responsible person of a film production, import, export, distribution or projection entity.

Where an individual violates these Regulations by, without authorization, engaging in film production, import or distribution business, or by, without authorization, holding a Sino-foreign film exhibition or international film festival or by, without authorization, providing films to a film exhibition or film festival outside the territory, he shall not be engaged in the relevant film business within 5 years.

Article 65: Those failing to perform the obligatory payment to the special fund for film sector development in accordance with relevant State provisions shall be ordered by the provincial-level or higher People’s Government administrative film entity to make up the payment within a time limit, and a delay payment of 0.05% of the owed amount shall be added daily, starting from the owing date.

Article 66: With respect to administrative fines imposed in accordance with these Regulations, the decision on the fine shall be separated from the collection of the fine in accordance with the relevant laws and administrative regulations; the collected fine must be completely turned over to the State treasury.

Chapter 8: Supplementary Provisions

Article 67: The State applies an annual inspection system to the “Film Production Permit”, the “Film Distribution Operating Permit” and the “Film Projection Operating Permit”. The measures for annual inspection shall be formulated by the State Council administrative radio, film and television entity.

Article 68: These Regulations shall take effect on February 1, 2002. The “Film Management Regulations” promulgated by the State Council on June 19, 1996 shall be simultaneously abolished.

电影管理条例

第一章 总则

第一条 为了加强对电影行业的管理,发展和繁荣电影事业,满足人民群众文化生活需要,促进社会主义物质文明和精神文明建设,制定本条例。

第二条 本条例适用于中华人民共和国境内的故事片、纪录片、科教片、美术片、专题片等电影片的制片、进口、出口、发行和放映等活动。

第三条 从事电影片的制片、进口、出口、发行和放映等活动,应当遵守宪法和有关法律、法规,坚持为人民服务、为社会主义服务的方向。

第四条 国务院广播电影电视行政部门主管全国电影工作。

县级以上地方人民政府管理电影的行政部门(以下简称电影行政部门),依照本条例的规定负责本行政区域内的电影管理工作。

第五条 国家对电影摄制、进口、出口、发行、放映和电影片公映实行许可制度。未经许可,任何单位和个人不得从事电影片的摄制、进口、发行、放映活动,不得进口、出口、发行、放映未取得许可证的电影片。

依照本条例发放的许可证和批准文件,不得出租、出借、出售或者以其他任何形式转让。

第六条 全国性电影行业的社会团体按照其章程,在国务院广播电影电视行政部门指导下,实行自律管理。

第七条 国家对为电影事业发展做出显著贡献的单位和个人,给予奖励。

第二章 电影制片

第八条 设立电影制片单位,应当具备下列条件:

(一)有电影制片单位的名称、章程;

(二)有符合国务院广播电影电视行政部门认定的主办单位及其主管机关;

(三)有确定的业务范围;

(四)有适应业务范围需要的组织机构和专业人员;

(五)有适应业务范围需要的资金、场所和设备;

(六)法律、行政法规规定的其他条件。

审批设立电影制片单位,除依照前款所列条件外,还应当符合国务院广播电影电视行政部门制定的电影制片单位总量、布局和结构的规划。

第九条 申请设立电影制片单位,由所在地省、自治区、直辖市人民政府电影行政部门审核同意后,报国务院广播电影电视行政部门审批。

申请书应当载明下列内容:

(一)电影制片单位的名称、地址和经济性质;

(二)电影制片单位的主办单位的名称、地址、性质及其主管机关;

(三)电影制片单位的法定代表人的姓名、住址、资格证明文件;

(四)电影制片单位的资金来源和数额。

第十条 国务院广播电影电视行政部门应当自收到设立电影制片单位的申请书之日起90日内,作出批准或者不批准的决定,并通知申请人。批准的,由国务院广播电影电视行政部门发给《摄制电影许可证》,申请人持《摄制电影许可证》到国务院工商行政管理部门办理登记手续,依法领取营业执照;不批准的,应当说明理由。

第十一条 电影制片单位以其全部法人财产,依法享有民事权利,承担民事责任。

第十二条 电影制片单位变更、终止,应当报国务院广播电影电视行政部门批准,并依法到原登记的工商行政管理部门办理变更登记或者注销登记。

第十三条 电影制片单位可以从事下列活动:

(一)摄制电影片;

(二)按照国家有关规定制作本单位摄制的电影片的复制品;

(三)按照国家有关规定在全国范围发行本单位摄制并被许可公映的电影片及其复制品;

(四)按照国家有关规定出口本单位摄制并被许可公映的电影片及其复制品。

第十四条 电影制片单位应当建立、健全管理制度,保证电影片的质量。

第十五条 电影制片单位对其摄制的电影片,依法享有著作权。

第十六条 电影制片单位以外的单位独立从事电影摄制业务,须报经国务院广播电影电视行政部门批准,并持批准文件到工商行政管理部门办理相应的登记手续。

电影制片单位以外的单位经批准后摄制电影片,应当事先到国务院广播电影电视行政部门领取一次性《摄制电影片许可证(单片)》,并参照电影制片单位享有权利、承担义务。具体办法由国务院广播电影电视行政部门制定。

第十七条 国家鼓励企业、事业单位和其他社会组织以及个人以资助、投资的形式参与摄制电影片。具体办法由国务院广播电影电视行政部门制定。

第十八条 电影制片单位经国务院广播电影电视行政部门批准,可以与境外电影制片者合作摄制电影片;其他单位和个人不得与境外电影制片者合作摄制电影片。

电影制片单位和持有《摄制电影片许可证(单片)》的单位经国务院广播电影电视行政部门批准,可以到境外从事电影片摄制活动。

境外组织或者个人不得在中华人民共和国境内独立从事电影片摄制活动。

第十九条 中外合作摄制电影片,应当由中方合作者事先向国务院广播电影电视行政部门提出立项申请。国务院广播电影电视行政部门征求有关部门的意见后,经审查符合规定的,发给申请人一次性《中外合作摄制电影片许可证》。申请人取得《中外合作摄制电影片许可证》后,应当按照国务院广播电影电视行政部门的规定签订中外合作摄制电影片合同。

第二十条 中外合作摄制电影片需要进口设备、器材、胶片、道具的,中方合作者应当持国务院广播电影电视行政部门的批准文件到海关办理进口或者临时进口手续。

第二十一条 境外电影制片者同中方合作者合作或者以其他形式在中华人民共和国境内摄制电影片,应当遵守中华人民共和国的法律、法规,尊重中华民族的风俗、习惯。

第二十二条 电影底片、样片的冲洗及后期制作,应当在中华人民共和国境内完成。有特殊技术要求确需在境外完成的,应当单项申请,报经国务院广播电影电视行政部门批准后,按照批准文件载明的要求执行。

第二十三条 电影洗印单位不得洗印加工未取得《摄制电影许可证》或者《摄制电影片许可证(单片)》的单位摄制的电影底片、样片,不得洗印加工未取得《电影片公映许可证》的电影片拷贝。

电影洗印单位接受委托洗印加工境外的电影底片、样片和电影片拷贝的,应当事先经国务院广播电影电视行政部门批准,并持批准文件依法向海关办理有关进口手续。洗印加工的电影底片、样片和电影片拷贝必须全部运输出境。

第三章 电影审查

第二十四条 国家实行电影审查制度。

未经国务院广播电影电视行政部门的电影审查机构(以下简称电影审查机构)审查通过的电影片,不得发行、放映、进口、出口。

供科学研究、教学参考的专题片进口和中国电影资料馆进口电影资料片,依照本条例第三十二条的规定办理。

第二十五条 电影片禁止载有下列内容:

(一)反对宪法确定的基本原则的;

(二)危害国家统一、主权和领土完整的;

(三)泄露国家秘密、危害国家安全或者损害国家荣誉和利益的;

(四)煽动民族仇恨、民族歧视,破坏民族团结,或者侵害民族风俗、习惯的;

(五)宣扬邪教、迷信的;

(六)扰乱社会秩序,破坏社会稳定的;

(七)宣扬淫秽、赌博、暴力或者教唆犯罪的;

(八)侮辱或者诽谤他人,侵害他人合法权益的;

(九)危害社会公德或者民族优秀文化传统的;

(十)有法律、行政法规和国家规定禁止的其他内容的。

电影技术质量应当符合国家标准。

第二十六条 电影制片单位应当依照本条例第二十五条的规定,负责电影剧本投拍和电影片出厂前的审查。

电影制片单位依照前款规定对其准备投拍的电影剧本审查后,应当报电影审查机构备案;电影审查机构可以对报备案的电影剧本进行审查,发现有本条例第二十五条禁止内容的,应当及时通知电影制片单位不得投拍。具体办法由国务院广播电影电视行政部门制定。

第二十七条 电影制片单位应当在电影片摄制完成后,报请电影审查机构审查;电影进口经营单位应当在办理电影片临时进口手续后,报请电影审查机构审查。

电影审查收费标准由国务院价格主管部门会同国务院广播电影电视行政部门规定。

第二十八条 电影审查机构应当自收到报送审查的电影片之日起30日内,将审查决定书面通知送审单位。审查合格的,由国务院广播电影电视行政部门发给《电影片公映许可证》。

电影制片单位或者电影进口经营单位应当将《电影片公映许可证》证号印制在该电影片拷贝第一本片头处。

审查不合格,经修改报送重审的,审查期限依照本条第一款的规定重新计算。

第二十九条 电影制片单位和电影进口经营单位对电影片审查决定不服的,可以自收到审查决定之日起30日内向国务院广播电影电视行政部门的电影复审机构申请复审;复审合格的,由国务院广播电影电视行政部门发给《电影片公映许可证》。

第四章 电影进口出口

第三十条 电影进口业务由国务院广播电影电视行政部门指定电影进口经营单位经营;未经指定,任何单位或者个人不得经营电影进口业务。

第三十一条 进口供公映的电影片,进口前应当报送电影审查机构审查。

报送电影审查机构审查的电影片,由指定的电影进口经营单位持国务院广播电影电视行政部门的临时进口批准文件到海关办理电影片临时进口手续;临时进口的电影片经电影审查机构审查合格并发给《电影片公映许可证》和进口批准文件后,由电影进口经营单位持进口批准文件到海关办理进口手续。

第三十二条 进口供科学研究、教学参考的专题片,进口单位应当报经国务院有关行政主管部门审查批准,持批准文件到海关办理进口手续,并于进口之日起30日内向国务院广播电影电视行政部门备案。但是,不得以科学研究、教学的名义进口故事片。

中国电影资料馆进口电影资料片,可以直接到海关办理进口手续。中国电影资料馆应当将其进口的电影资料片按季度向国务院广播电影电视行政部门备案。

除本条规定外,任何单位或者个人不得进口未经国务院广播电影电视行政部门审查合格的电影片。

第三十三条 电影进口经营单位应当在取得电影作品著作权人使用许可后,在许可的范围内使用电影作品;未取得使用许可的,任何单位和个人不得使用进口电影作品。

第三十四条 电影制片单位出口本单位制作的电影片的,应当持《电影片公映许可证》到海关办理电影片出口手续。

中外合作摄制电影片出口的,中方合作者应当持《电影片公映许可证》到海关办理出口手续。中外合作摄制电影片素材出口的,中方合作者应当持国务院广播电影电视行政部门的批准文件到海关办理出口手续。

中方协助摄制电影片或者电影片素材出境的,中方协助者应当持国务院广播电影电视行政部门的批准文件到海关办理出境手续。

第三十五条 举办中外电影展、国际电影节,提供电影片参加境外电影展、电影节等,应当报国务院广播电影电视行政部门批准。

参加前款规定的电影展、电影节的电影片,须报国务院广播电影电视行政部门审查批准。参加境外电影展、电影节的电影片经批准后,参展者应当持国务院广播电影电视行政部门的批准文件到海关办理电影片临时出口手续。参加在中国境内举办的中外电影展、国际电影节的境外电影片经批准后,举办者应当持国务院广播电影电视行政部门的批准文件到海关办理临时进口手续。

第五章 电影发行和放映

第三十六条 设立电影发行单位、电影放映单位,应当具备下列条件:

(一)有电影发行单位、电影放映单位的名称、章程;

(二)有确定的业务范围;

(三)有适应业务范围需要的组织机构和专业人员;

(四)有适应业务范围需要的资金、场所和设备;

(五)法律、行政法规规定的其他条件。

第三十七条 设立电影发行单位,应当向所在地省、自治区、直辖市人民政府电影行政部门提出申请;设立跨省、自治区、直辖市的电影发行单位,应当向国务院广播电影电视行政部门提出申请。所在地省、自治区、直辖市人民政府电影行政部门或者国务院广播电影电视行政部门应当自收到申请书之日起60日内作出批准或者不批准的决定,并通知申请人。批准的,发给《电影发行经营许可证》,申请人应当持《电影发行经营许可证》到工商行政管理部门登记,依法领取营业执照;不批准的,应当说明理由。

第三十八条 设立电影放映单位,应当向所在地县或者设区的市人民政府电影行政部门提出申请。所在地县或者设区的市人民政府电影行政部门应当自收到申请书之日起60日内作出批准或者不批准的决定,并通知申请人。批准的,发给《电影放映经营许可证》,申请人持《电影放映经营许可证》到所在地工商行政管理部门登记,依法领取营业执照;不批准的,应当说明理由。

第三十九条 电影发行单位、电影放映单位变更业务范围,或者兼并其他电影发行单位、电影放映单位,或者因合并、分立而设立新的电影发行单位、电影放映单位的,应当依照本条例第三十七条或者第三十八条的规定办理审批手续,并到工商行政管理部门办理相应的登记手续。

电影发行单位、电影放映单位变更名称、地址、法定代表人或者主要负责人,或者终止电影发行、放映经营活动的,应当到原登记的工商行政管理部门办理变更登记或者注销登记,并向原审批的电影行政部门备案。

第四十条 申请从事农村16毫米电影片发行、放映业务的单位或者个人,可以直接到所在地工商行政管理部门办理登记手续,并向所在地县级人民政府电影行政部门备案;备案后,可以在全国农村从事16毫米电影片发行、放映业务。

第四十一条 国家允许企业、事业单位和其他社会组织以及个人投资建设、改造电影院。

国家允许以中外合资或者中外合作的方式建设、改造电影院。具体办法由国务院广播电影电视行政部门会同国务院文化行政部门、国务院对外经济贸易主管部门按照有关规定制定。

第四十二条 电影片依法取得国务院广播电影电视行政部门发给的《电影片公映许可证》后,方可发行、放映。

已经取得《电影片公映许可证》的电影片,国务院广播电影电视行政部门在特殊情况下可以作出停止发行、放映或者经修改后方可发行、放映的决定;对决定经修改后方可发行、放映的电影片,著作权人拒绝修改的,由国务院广播电影电视行政部门决定停止发行、放映。

国务院广播电影电视行政部门作出的停止发行、放映的决定,电影发行单位、电影放映单位应当执行。

第四十三条 利用电影片制作音像制品的,应当遵守国家有关音像制品管理的规定。

任何单位和个人不得利用电影资料片从事或者变相从事经营性的发行、放映活动。

第四十四条 放映电影片,应当符合国家规定的国产电影片与进口电影片放映的时间比例。

放映单位年放映国产电影片的时间不得低于年放映电影片时间总和的三分之二。

第四十五条 电影放映单位应当维护电影院的公共秩序和环境卫生,保证观众的安全与健康。

第六章 电影事业的保障

第四十六条 国家建立和完善适应社会主义市场经济体制的电影管理体制,发展电影事业。

第四十七条 国家保障电影创作自由,重视和培养电影专业人才,重视和加强电影理论研究,繁荣电影创作,提高电影质量。

第四十八条 国家建立电影事业发展专项资金,并采取其他优惠措施,支持电影事业的发展。

电影事业发展专项资金缴纳单位应当按照国家有关规定履行缴纳义务。

第四十九条 电影事业发展专项资金扶持、资助下列项目:

(一)国家倡导并确认的重点电影片的摄制和优秀电影剧本的征集;

(二)重点制片基地的技术改造;

(三)电影院的改造和放映设施的技术改造;

(四)少数民族地区、边远贫困地区和农村地区的电影事业的发展;

(五)需要资助的其他项目。

第五十条 国家鼓励、扶持科学教育片、纪录片、美术片及儿童电影片的制片、发行和放映。

第五十一条 国家对少数民族地区、边远贫困地区和农村地区发行、放映电影实行优惠政策。

国家对从事农村16毫米电影片发行、放映业务的单位和个人予以扶持。具体办法由国务院广播电影电视行政部门、国务院文化行政部门会同国务院财政部门规定。

第五十二条 县级以上地方人民政府制定的本行政区域建设规划,应当包括电影院和放映设施的建设规划。

改建、拆除电影院和放映设施,应当报经所在地县级以上地方人民政府电影行政部门审查批准,县级以上地方人民政府电影行政部门应当依据国家有关规定作出批准或者不批准的决定。

第五十三条 县级以上地方人民政府电影行政部门和其他有关行政部门,对干扰、阻止和破坏电影片的制片、发行、放映的行为,应当及时采取措施予以制止,并依法查处。

大众传播媒体不得宣扬非法电影。

第七章 罚则

第五十四条 国务院广播电影电视行政部门和县级以上地方人民政府电影行政部门或者其他有关部门及其工作人员,利用职务上的便利收受他人财物或者其他好处,批准不符合法定设立条件的电影片的制片、发行和放映单位,或者不履行监督职责,或者发现违法行为不予查处,造成严重后果的,对负有责任的主管人员和其他直接责任人员依照刑法关于受贿罪、滥用职权罪、玩忽职守罪或者其他罪的规定,依法追究刑事责任;尚不够刑事处罚的,给予降级或者撤职的行政处分。

第五十五条 违反本条例规定,擅自设立电影片的制片、发行、放映单位,或者擅自从事电影制片、进口、发行、放映活动的,由工商行政管理部门予以取缔;依照刑法关于非法经营罪的规定,依法追究刑事责任;尚不够刑事处罚的,没收违法经营的电影片和违法所得以及进行违法经营活动的专用工具、设备;违法所得5万元以上的,并处违法所得5倍以上10倍以下的罚款;没有违法所得或者违法所得不足5万元的,并处20万元以上50万元以下的罚款。

第五十六条 摄制含有本条例第二十五条禁止内容的电影片,或者洗印加工、进口、发行、放映明知或者应知含有本条例第二十五条禁止内容的电影片的,依照刑法有关规定,依法追究刑事责任;尚不够刑事处罚的,由电影行政部门责令停业整顿,没收违法经营的电影片和违法所得;违法所得5万元以上的,并处违法所得5倍以上10倍以下的罚款;没有违法所得或者违法所得不足5万元的,并处20万元以上50万元以下的罚款;情节严重的,并由原发证机关吊销许可证。

第五十七条 走私电影片,依照刑法关于走私罪的规定,依法追究刑事责任;尚不够刑事处罚的,由海关依法给予行政处罚。

第五十八条 出口、发行、放映未取得《电影片公映许可证》的电影片的,由电影行政部门责令停止违法行为,没收违法经营的电影片和违法所得;违法所得5万元以上的,并处违法所得10倍以上15倍以下的罚款;没有违法所得或者违法所得不足5万元的,并处20万元以上50万元以下的罚款;情节严重的,并责令停业整顿或者由原发证机关吊销许可证。

第五十九条 有下列行为之一的,由电影行政部门责令停止违法行为,没收违法经营的电影片和违法所得;违法所得5万元以上的,并处违法所得5倍以上10倍以下的罚款;没有违法所得或者违法所得不足5万元的,并处10万元以上30万元以下的罚款;情节严重的,并责令停业整顿或者由原发证机关吊销许可证:

(一)未经批准,擅自与境外组织或者个人合作摄制电影,或者擅自到境外从事电影摄制活动的;

(二)擅自到境外进行电影底片、样片的冲洗或者后期制作,或者未按照批准文件载明的要求执行的;

(三)洗印加工未取得《摄制电影许可证》、《摄制电影片许可证(单片)》的单位摄制的电影底片、样片,或者洗印加工未取得《电影片公映许可证》的电影片拷贝的;

(四)未经批准,接受委托洗印加工境外电影底片、样片或者电影片拷贝,或者未将洗印加工的境外电影底片、样片或者电影片拷贝全部运输出境的;

(五)利用电影资料片从事或者变相从事经营性的发行、放映活动的;

(六)未按照规定的时间比例放映电影片,或者不执行国务院广播电影电视行政部门停止发行、放映决定的。

第六十条 境外组织、个人在中华人民共和国境内独立从事电影片摄制活动的,由国务院广播电影电视行政部门责令停止违法活动,没收违法摄制的电影片和进行违法活动的专用工具、设备,并处30万元以上50万元以下的罚款。

第六十一条 未经批准,擅自举办中外电影展、国际电影节,或者擅自提供电影片参加境外电影展、电影节的,由国务院广播电影电视行政部门责令停止违法活动,没收违法参展的电影片和违法所得;违法所得2万元以上的,并处违法所得5倍以上10倍以下的罚款;没有违法所得或者违法所得不足2万元的,并处2万元以上10万元以下的罚款。

第六十二条 未经批准,擅自改建、拆除电影院或者放映设施的,由县级以上地方人民政府电影行政部门责令限期恢复电影院或者放映设施的原状,给予警告,对负有责任的主管人员和其他直接责任人员依法给予纪律处分。

第六十三条 单位违反本条例,被处以吊销许可证行政处罚的,应当按照国家有关规定到工商行政管理部门办理变更登记或者注销登记;逾期未办理的,由工商行政管理部门吊销营业执照。

第六十四条 单位违反本条例,被处以吊销许可证行政处罚的,其法定代表人或者主要负责人自吊销许可证之日起5年内不得担任电影片的制片、进口、出口、发行和放映单位的法定代表人或者主要负责人。

个人违反本条例,未经批准擅自从事电影片的制片、进口、发行业务,或者擅自举办中外电影展、国际电影节或者擅自提供电影片参加境外电影展、电影节的,5年内不得从事相关电影业务。

第六十五条 未按照国家有关规定履行电影事业发展专项资金缴纳义务的,由省级以上人民政府电影行政部门责令限期补交,并自欠缴之日起按日加收所欠缴金额万分之五的滞纳金。

第六十六条 依照本条例的规定实施罚款的行政处罚,应当依照有关法律、行政法规的规定,实行罚款决定与罚款收缴分离;收缴的罚款应当全部上缴国库。

第八章 附则

第六十七条 国家实行《摄制电影许可证》和《电影发行经营许可证》、《电影放映经营许可证》年检制度。年检办法由国务院广播电影电视行政部门制定。

第六十八条 本条例自2002年2月1日起施行。1996年6月19日国务院发布的《电影管理条例》同时废止。
