Provisional Foreign Satellite Television Channel Landing Examination and Approval Management Rules
Article 1: In order to strengthen management over foreign satellite television channel landing management, these Rules are formulated.
Article 2: These Rules apply to the management of radio and television media established outside of the territory of the mainland of the People’s Republic of China landing within the borders of the People’s Republic of China through satellite broadcast methods.
Article 3: SARFT is responsible for implementing specialized management over satellite television channel landing, and implements an examination and approval system over foreign satellite television channel landing.
Article 4: With SARFT approval, foreign satellite television channels may land within a specified scope of foreign-oriented guesthouses and hotels of three stars and higher, residential buildings specially provided for residence by foreign persons, etc., and other specified scopes.
Article 5: Foreign satellite television channels applying for landing, shall have the following conditions:
(1) broadcast content may not violate the provisions of Chinese laws, regulations and corresponding regulatory systems.;
(2) have a position of listing amongst the first three in terms of comprehensive strength or viewing rates within their own country’s (region’s) television media;
(3) having the capacity to work with us in a “mutually beneficial” manner, committing to and vigorously assisting Chinese radio and television programmes to land abroad;
(4) being friendly to us, vigorously stimulating friendly Sino-foreign radio and television exchange and cooperation;
(5) agreeing to transmit their channel’s programmes through a uniform orientation organ determined by SARFT, and committing to not land within the borders of China through other channels.
Article 6: Foreign satellite television channels applying or landing must first put this forward to an organ appointed by SARFT, and fill out a “Satellite Television Channel Memorandum” according to requirements, submit certification materials with the content determined in Article 5 of these Rules, other materials when special explanation is necessary as well as decoders and other viewing equipment.
Article 7: The SARFT-appointed organ, after receiving all the application materials provided in Article 6 of these Rules, report them to SARFT for examination and approval.
Article 8: Where application materials are incomplete, supplementary materials shall be submitted within two weeks after receiving a notice to that effect, excess of this period is considered as voluntarily abandoning application.
Article 9: SARFT annually examines and approves foreign satellite television channels landing applications once, and handles this between July and September every year.
Article 10: If foreign satellite television channels approved to land within the borders of China, do not sign a contract with the SARFT-appointed organ within 90 days after SARFT approval, it is considered as voluntarily abandoning landing qualifications.
Article 11: Of one foreign satellite television organ, in principle, only one channel may be approved for landing within the provided scope. No news-type foreign satellite television channels are approved to land within our borders, no domestic radio and television organs and relevant departments and groups are permitted to launch satellite television channel landing inside the borders. If there are special needs, they shall be specially reported for approval.
Article 12: Foreign satellite television channels approved to land in China must entrust a SARFT-appointed organ to solely represent them in all matters corresponding to landing within the borders of China.
Article 13: Foreign satellite television channels approved to land un China must abide by all regulations of the Chinese government concerning foreign satellite television channel management, may not broadcast television programmes containing content violating our country’s laws, regulations and policies, and may not launch television channels within Chinese borders or corresponding reception popularization activities without authorization.
Article 14: Where the broadcast content of foreign satellite television channels approved to land violates Chinese laws, regulations and rules, creating harmful influence, apart from receiving the punishment of ceasing broadcast, they shall cancel the harmful influence within a similar broadcast scope.
Article 15: Where the broadcast content of foreign satellite television channels approved to land violates Chinese laws, regulations or riles three times within one year, landing qualifications are cancelled. Foreign satellite television channels of which landing qualifications are cancelled, may not put forward landing requests for three years.
Article 16: These Rules take effect on 1 February 2002.
