Provisional Regulations Concerning Measures for Radio and Television Broadcasting Organ Personnel Breaking Propaganda Discipline

Article 1: In order to guarantee radio and television propaganda supporting Party spirit principles, persist in correct public opinion guidance, according to relevant regulations such as the “State Council Provisional Regulations Concerning State Administrative Organ Personnel Rewards and Punishments”, “Radio and Television Management Regulations”, “Central Committee Propaganda Department, State Administration of Radio, Film and Television Opinion Concerning Establishing a Warning System for Radio and Television Broadcast Breaking Discipline and Regulations”, “China News Workers’ Professional Ethic Standards”, “Some Regulations Concerning Prohibition of Paid News”, etc., these Regulations are formulated.

Article 2: “Radio and television broadcasting organs” as named in these Regulations refers to organs broadcasting radio and television programmes such as radio stations, television stations, radio and television stations, etc., of the nationwide radio and television broadcasting system, approved for establishment by the State Council administrative entity for radio, film and television

Article 3: Radio and television broadcasting organ personnel, shall abide by propaganda discipline in their propaganda work, and may not violate propaganda work management regulations, the broadcasted language, words, sounds, images, etc., may not contain wrongful content violating the Constitutions, laws, regulations, rules, Party and State policies, etc.

Article 4: For violation of political discipline during propaganda work, where one of the following content sorts is broadcasted, the directly responsible managing personnel and other directly responsible personnel will be punished as for a grave offence or will be demoted; where circumstances are relatively grave, they will be lowered in category or dismissed; where circumstances are grave, they will be discharged on disciplinary probation or discharged.

(1) Content violating the basic principles determined in the Constitution;

(2) Content violating the Four Basic Principles;

(3) Content opposing the Chinese Communist Party’s basic theory, basic line, basic programme;

(4) Content opposing major Party and State policies;

(5) Content endangering State unity, sovereignty and territorial integrity;

(6) Content inciting hatred of the governments, disordering social order, destroying social stability;

(7) Content inciting ethnic hatred, ethnic discrimination, destroying the unity of the ethnicities;

(8) Content disseminating political rumours, insulting, slandering or defaming Party and State and the image of the leaders;

(9) Other content violating political discipline.

Article 5: As to propagating sects, directly responsible managing personnel and other directly responsible personnel will be punished as for a grave offence or will be demoted; where circumstances are relatively grave, they will be  lowered in category or dismissed; where circumstances are grave, they will be discharged on disciplinary probation or discharged.

Article 6: As to divulging State Secrets, during propaganda work broadcasting content, directly responsible managing personnel and other directly responsible personnel will be punished as for an offence or a grave offence or will be demoted; where circumstances are relatively grave, they will be  lowered in category or dismissed; where circumstances are grave, they will be discharged on disciplinary probation or discharged.

Article 7: As to endangering State security or damaging State honour and interests during propaganda work, where one of the following circumstances is present,  directly responsible managing personnel and other directly responsible personnel will be punished as for an offence or a grave offence or will be demoted; where circumstances are relatively grave, they will be  lowered in category or dismissed; where circumstances are grave, they will be discharged on disciplinary probation or discharged.

(1) Violating our country’s foreign policy, broadcasting words and deeds not conform to our country’s foreign relations line of action, creating harmful effects;

(2) Violating regulations on reporting foreign-related law cases, creating harmful effects;

(3) Providing to foreigners radio and television programmes violating the provisions of Article 32 of the “Radio and Television Management Regulations”, utilized by foreign groups;

(4) Having other activities endangering State security or damaging State honour and interests.

Article 8: As to violation of ethnic and religious policies, where one of the following circumstances is present,  directly responsible managing personnel and other directly responsible personnel will be punished as for an offence or a grave offence or will be demoted; where circumstances are relatively grave, they will be  lowered in category or dismissed; where circumstances are grave, they will be discharged on disciplinary probation or discharged.

(1) On the basis of wrongful propaganda and reporting, inducing unstable incidents;

(2) In violation of regulations reporting on foreign ethnic separatist or religious extremist terrorist activities, creating harmful consequences;

(3) Broadcasting content derogating ethnic minority ancestors, culture, important persons, customs and traditions or otherwise harming the feelings of ethnic minority compatriots, inciting ethnic minority masses to be strongly dissatisfied;

(4) Broadcasting content derogating lawful religious faith, religious groups, religious leaders, clergy personnel, religious rights or religious activities, creating harmful consequences;

(5) In violation of regulations permitting foreign media to broadcast religious programmes in our country’s territory

(6) Broadcasting other content violating ethnic and religious policies, creating harmful consequences.

Article 9: For having one of the following circumstances during propaganda work, where one of the following circumstances is present,  directly responsible managing personnel and other directly responsible personnel will be punished with a warning or as for an offence; where circumstances are relatively grave, they will be punished as for a grave offence, lowered in category or dismissed; where circumstances are grave, they will be discharged on disciplinary probation or discharged.

(1) Broadcasting or propagating obscene or gambling content;

(2) Broadcasting or propagating violent or crime-abetting content;

(3) Broadcasting or propagating pseudoscience or content playing up feudal superstition;

(4) Having other activities impairing social management order.

Article 10: For violation of relevant regulations, where one of the following circumstances is present,  directly responsible managing personnel and other directly responsible personnel will be punished with a warning or as for an offence; where circumstances are relatively grave, they will be punished as for a grave offence, lowered in category or dismissed; where circumstances are grave, they will be discharged on disciplinary probation or discharged.

(1) Violating news truthfulness principles, producing and broadcasting false news, refusing to correct or clarify the facts;

(2) Conducting wrongful reporting of major incidents, creating harmful consequences;

(3) Surpassing judicial order, conducting reporting of conviction or the nature of legal cases, creating harmful consequences;

(4) In violation of regulations reporting mass incidents, legal cases, bringing about damage to social stability;

(5) In violation of regulations publishing information essays, etc., analyzing forecasts, and driving up stock prices, misleading the stock market, creating harmful consequences;

(6) In violation of regulations unilaterally reporting conference discussion content, touching upon sensitive problems, creating harmful consequences;

(7) In violation of regulations broadcasting major accidents such as flood situations, epidemics, earthquakes and nuclear accidents, etc.;

(8) Having other activities violating laws or discipline in news reporting.

Article 11: For violating other persons’ personal rights or other lawful rights in propaganda work, where circumstances are relatively light will be punished with a warning or as for an offence; where circumstances are relatively grave, they will be punished as for a grave offence, lowered in category or dismissed; where circumstances are grave, they will be discharged on disciplinary probation or discharged.

(1) Insulting or humiliating other persons, violating other persons’ rights and interests;

(2) When reporting all sorts of legal cases, without approval of the case handling person, victim, accuser, or witness, make public their name, address, work unit, image and other corresponding data;

(3) Broadcasting minor criminal suspects’ name, address, images and other corresponding data;

(4) Broadcasting disclosure of the personal secrets of minors;

(5) Broadcasting content disclosing business secrets or personal secrets, content of personal files, creating harmful consequences;

(6) Broadcasting other content infringing other persons’ personal rights and lawful rights.

Article 12: For violating regulations or grave irresponsibility in propaganda work, directly responsible managing personnel and other directly responsible personnel, where circumstances are relatively light will be punished with a warning or as for an offence; where circumstances are relatively grave, they will be punished as for a grave offence, lowered in category or dismissed; where circumstances are grave, they will be lowered in category, discharged on disciplinary probation or discharged.

(1) Violating book (film) censorship system regulations, without authorization disseminating manuscripts or programmes;

(2) Not broadcasting earlier announced major programmes or appointed programmes according to requirements without proper reason, or not broadcasting programmes closely followed by the audience according to plan, leading to strong dissatisfaction of the audience or other grave consequences;

(3) Broadcasting radio or television programmes without examination approval, creating harmful consequences;

(4) Advertising acting as news broadcasts;

(5) During live broadcasts, not adopting necessary equipment according to regulations, broadcasted content creating grave consequences;

(6) Not dealing with specialized knowledge such as law, medicine or science and technology, etc., according to relevant regulations, broadcasting wrongful content, creating harmful consequences;

(7) Having other activities violating propaganda work regulations or activities of neglect.

Article 13: For violating propaganda work management regulations, directly responsible managing personnel and other directly responsible personnel, where circumstances are relatively light will be punished with a warning or as for an offence; where circumstances are relatively grave, they will be punished as for a grave offence, lowered in category or dismissed; where circumstances are grave, they will be lowered in category, discharged on disciplinary probation or discharged.

(1) During interview work, violating Party and State policies or damaging State honour, interests, creating harmful consequences;

(2) Having activities violating the “Some Regulations Concerning Prohibition of Paid News”;

(3) Without approval, unauthorizedly interviewing with editing journalist status, creating harmful consequences;

(4) Having other activities violating propaganda work management regulations.

Article 14: For above-mentioned activities violating propaganda discipline discovered in radio and television organs, creating grave harmful consequences or grave consequences, the responsible main persons having main leading responsibility or important leading  responsibility will be investigated,  punishment is imposed taking circumstances in considerations, and is lower than the punishment grade of other direct responsible persons.

Article 15: Those violating propaganda discipline, creating relatively grave harmful influence or relatively grave consequences, after disciplinary punishment, will be transferred out of propaganda positions or have their employment contract cancelled. Those being investigated or dismissed for intentional violation of propaganda disciplined may not be employed or hired as radio, film or television work staff by all radio, film and television system work units; those being discharged or dismissed for erroneous violation of propaganda discipline may not be employed or hired as radio, film or television work staff by all radio, film and television system work units within three years.

Article 16: Communist Party members violating propaganda discipline in radio and televisions broadcasting organs, must also be dealt with under Party discipline according to the “Provisional Regulations on Dealing with Communist Party Members Violating Propaganda Discipline in Radio and Television Broadcasting Organs under Party Discipline”. Radio, film and television system periodicals, publishers, information web sites, broadcast stations, transmission stations, monitoring stations, etc., shall be dealt with with reference to these Regulations.

Article 17: Where radio and television broadcast organs’ personnel propaganda discipline activities violations violate the Criminal Law, they will be transferred to the judicial organs for punishment.

Article 18: Punishing relevant responsible persons, will be conducted according to cadre personnel administration jurisdiction, post-punishment wages handling will be implemented according to relevant State personnel department documents.

Article 19: Interpretation of these Regulations will be the responsibility of the State Administration of Radio and Television Supervision Department.

Article 20: These Regulations take effect on the date of issue.

《广播电视播出机构工作人员违反宣传纪律处分处理暂行规定》

第一条 为了确保广播电视宣传坚持党性原则,坚持正确的舆论导向,根据《国务院关于国家行政机关工 作人员的奖惩暂行规定》、《广播电视管理条例》、《中共中央宣传部、国家广播电影电视总局关于建立违纪违规广播电视播出机构警告制度的意见》、《中国新闻工作者职业道德准则》、《 关于禁止有偿新闻的若干规定》等有关规定,制定本规定。

第二条 本规定所称“广播电视播出机构”是指经国务院广播电影电视行政部门批准设立的全国广播电影电视系统的广播电台、电视台、广播电视台等播出广播电视节目的机构。

第三条 广播电视播出机构的工作人员在宣传工作中应当遵守宣传纪律,不得违反宣传工作管理规定,播出的语言、文字、声音、图像等,不得含有违反宪法、法律、法规、规章、党和国家政策等的错误内容。

第四条 在宣传工作中违反政治纪律,播出下列内容之一的,对负有直接责任的主管人员和其他直接责任人员,给予记大过或者降级处分;情节较重的,给予降职或者撤职处分;情节严重的,给予开除 留用察看或者开除处分。

(一) 反对宪法确定的基本原则的;

(二) 反对四项基本原则的;

(三) 反对中国共产党的基本理论、基本路线、基本纲领的;

(四) 反对党和国家重大政策的;

(五) 危害国家统一、主权和领土完整的;

(六) 煽动仇视政府,扰乱社会秩序,破坏社会稳定的;

(七) 煽动民族仇恨、民族歧视,破坏民族团结的;

(八) 传播政治谣言、侮辱、毁谤或丑化党和国家及领导人形象的;

(九) 其他违反政治纪律内容的。

第五条 宣扬邪教的,对负有直接责任的主管人员和其他直接责任人员,给予记大过或者降级处分;情节较重的,给予降职或者撤职处分;情节严重的,给予开除留用察看或者开除处分。

第六条 在宣传工作中,播出内容泄露国家秘密的,对负有直接责任的主管人员和其他直接责任人员,情节较轻的,给予记过、记大过或者降级处分;情节较重的,给予降职或者撤职处分;情节严重的 ,给予开除留用察看或者开除处分。

第七条 在宣传工作中危害国家安全或者损害国家荣誉和利益,有下列情形之一的,对负有直接责任的主管人员和其他直接责任人员,给予记过、记大过或者降级处分;情节较重的,给予降职或者撤职处分;情节严重的,给予开除留用察看或者开除处分。

(一) 违反我国对外政策,播出不符合我国外交口径的言行,造成不良影响的;

(二) 违反规定报道涉外案件,造成不良影响的;

(三) 对外提供违反《广播电视管理条例》第三十二条规定的广播电视节目,被境外组织利用的;

(四) 有其他危害国家安全或者损害国家荣誉和利益行为的。

第八条 违反民族、宗教政策,有下列情形之一的,对负有直接责任的主管人员和其他直接责任人员,给予记过、记大过或者降级处分;情节较重的,给予降职或者撤职处分;情节严重的,给予开除留 用察看或者开除处分。

(一) 因错误宣传报道诱发不安定事件的;

(二) 违反规定报道境外民族分裂或宗教极端分子的恐怖活动,造成不良后果的;

(三) 播出贬损少数民族祖先、文化、重要人物、风俗习惯或其他伤害少数民族同胞感情的内容,引起少数民族群众强烈不满的;

(四) 播出贬损合法宗教信仰、宗教组织、宗教领袖、神职人员、宗教礼仪或宗教活动的内容,造成不良后果的;

(五) 违反规定允许境外传媒在我国境内播放宗教节目的;

(六) 播出其他违反民族、宗教政策内容,造成不良后果的。

第九条 在宣传工作中,有下列情形之一的,对负有直接责任的主管人员和其他直接责任人员,情节较轻的,给予警告或者记过处分;情节较重的,给予记大过、降级、降职或者撤职处分;情节严重的 ,给予开除留用察看或者开除处分。

(一) 播出宣扬淫秽、赌博行为内容的;

(二) 播出宣扬暴力或教唆犯罪内容的;

(三) 播出宣扬伪科学或鼓吹封建迷信内容的;

(四) 有其他妨害社会管理秩序行为的。

第十条 违反有关规定,有下列情形之一的,对负有直接责任的主管人员和其他直接责任人员,情节较轻的,给予警告或者记过处分;情节较重的,给予记大过、降级、降职或者撤职处分;情节严重的 ,给予开除留用察看或者开除处分:

(一) 违反新闻真实性原则,制作播出虚假新闻,拒不更正或澄清事实的;

(二) 对重要事件进行错误报道,造成不良影响的;

(三) 超越司法程序,对案件进行定罪、定性式报道,造成不良影响的;

(四) 违反规定报道群体性事件、案件,给社会稳定带来损害的;

(五) 违反规定发表分析预测、炒作个股的消息、文章等,误导股市,造成不良后果的;

(六) 违反规定片面报道会议讨论内容,触及敏感问题,造成不良后果的;

(七) 违反规定播出汛情、疫情、震情及核事故等重大事故的;

(八) 新闻报道中有其他违法违纪行为的。

第十一条 在宣传工作中侵犯他人人身权利或其他合法权利,有下列情形之一的,对负有直接责任的主管人员和其他直接责任人员,情节较轻的,给予警告或者记过处分;情节较重的,给予记大过、 降级、降职或者撤职处分;情节严重的,给予开除留用察看或者开除处分。

(一) 侮辱或者诽谤他人,侵害他人合法权益的;

(二) 报道各类案件时,未征得办案人、被害人、检举人、知情人同意,公开他们的姓名、地址、工作单位、图像及其他相关资料的;

(三) 播出未成年犯罪嫌疑人的姓名、地址、图像及其他相关资料的;

(四) 播出披露未成年人隐私的;

(五) 播出内容泄露商业秘密或个人隐私、个人档案内容,造成不良后果的;

(六) 播出其他侵犯他人人身权利、合法权利内容的。

第十二条 在宣传工作中违反规定或者严重不负责任,有下列情形之一的,对负有直接责任的主管人员和其他直接责任人员,情节较轻的,给予警告或者记过处分;情节较重的,给予记大过、降级或 者降职处分;情节严重的,给予撤职、开除留用察看或者开除处分。

(一) 违反审稿(片)制度规定,擅自播发稿件、节目的;

(一) 预告的重要节目或指定的节目无正当理由不按要求播出,或受众关注的节目未按计划播出,引起受众强烈不满或其他严重后果的;

(二) 未经审查批准播放广播电视节目,造成不良影响的;

(三) 广告充当新闻播出的;

(四) 在直播节目中,未按规定采用必要设备,所播内容造成不良影响的;

(五) 涉及法律、医药及科技等专门知识不按有关规定处理,播出错误内容,造成不良后果的;

(六) 有其他违反宣传工作规定行为或失职行为的。

第十三条 违反宣传工作管理规定,有下列情形之一的,对负有直接责任的主管人员和其他直接责任人员 ,情节较轻的,给予警告或者记过处分;情节较重的,给予记大过、降级或者降职处分;情节严重的,给予撤职、开除留用察看或者开除处分。

(一) 在采访工作中,违背党和国家政策或者损害国家尊严、利益,造成不良后果的;

(二) 有违反《关于禁止有偿新闻的若干规定》行为的;

(三) 未经批准,擅自以编辑记者身份采访,造成不良后果的;

(四) 有其他违反宣传工作管理规定行为的。

第十四条 广播电视播出机构发生上述违反宣传纪律的行为,造成严重不良影响或严重后果的,对负有主要领导责任、重要领导责任的主要负责人实行责任追究,在其他直接责任人员所受处分档次以 下,酌情给予处分、处理。

第十五条 违反宣传纪律,造成较严重不良影响或较严重后果的,给予纪律处分后,调离宣传岗位或解除聘用合同。因故意违反宣传纪律被开除或辞退的,广播电影电视系统各单位不得重新录用 、聘用其为广播电影电视工作人员;因过失违反宣传纪律被开除或辞退的,广播电影电视系统 各单位三年内不得重新录用、聘用其为广播电影电视工作人员。

第十六条 广播电视播出机构中的共产党员违反宣传纪律的,还应根据《广播电视播出机构中的共产党员违反宣传纪律党纪处分暂行规定》给予党纪处分。广播电影电视系统的报刊、出版社、信息网站、发射台、转播台、监测台(站)等,参照执行本规定。

第十七条 广播电视播出机构工作人员违反宣传纪律行为触犯刑律的,移送司法机关处理。

第十八条 给予有关责任者处分,按照干部人事管理权限进行;处分后的工资处理按国家人事部的有关文件执行。

第十九条 本规定由国家广播电影电视总局监察局负责解释。

第二十条 本规定自下发之日起施行。
