The “On-demand Radio and Television Broadcast Management Rules”  were adopted at the executive meeting of the State Administration of Radio, Film and Television on June 15, 2004. They are hereby promulgated and shall come into force as of August 10, 2004.

On-demand Radio and Television Broadcast Management Rules

Chapter I: General Provisions

Article 1: In order to promote the healthy development of on-demand radio and television broadcast services, strengthen supervision and management and promote the construction of socialist spiritual civilization, these Rules are formulated

Article 2: On-demand radio and television broadcast (hereafter simply named the on-demand video broadcast)as mentioned in these Rules refers to the professional activities providing radio and television programmes to be decided by users themselves through radio and television technical systems through methods such as broadcasting by instant order, broadcasting by quasi-video order (broadcasting in turns), playing after downloading, etc.

Article 3: The State Administration of Radio, Film and Television (hereafter simply named as SARFT) shall be responsible on-demand video broadcast services management nationwide, shall formulate national plans for the on-demand video broadcast services and shall determine the total number and distribution of organs engaging in the on-demand video broadcast services.

Local county-level or higher administrative radio and television entities shall be responsible for video broadcasting services management within their respective administrative areas.

Article 4: The state implements a licensing system for on-demand video broadcast services. Without license, no organ or individual may launch any on-demand video broadcast services.

Wholly foreign-owned, Sino-foreign joint-venture or Sino-foreign cooperative organs are prohibited to apply for launching on-demand video broadcast services except those conforming to Article 8 Paragraph 1 of these Rules.

Chapter II, Business Permit

Article 5: For launching on-demand video broadcast services, a “On-demand Radio and Television Programme Broadcast Service Permit” must be obtained.

Article 6: The “On-demand Radio and Television Programme Broadcast Service Permit” is divided into categories A and B.

Organs holding a “On-demand Radio and Television Programme Broadcast Service Permit” (Category A) may engage in on-demand video broadcast services within the administrative areas as clearly indicated in the “On-demand Radio and Television Programme Broadcast Service Permit” (Category A).

Organs holding a “On-demand Radio and Television Programme Broadcast Service Permit” (Category B) may engage in on-demand video broadcast services in hotels as clearly indicated in the “On-demand Radio and Television Programme Broadcast Service Permit” (Category B).

Article 7: The following organs may apply for a “On-demand Radio and Television Programme Broadcast Service Permit” (Category A):

(1) district (city) level or higher radio stations and television stations approved for establishment;

(2) radio, film and television groups (general stations) approved for establishment.

Article 8: The following organs may apply for a “On-demand Radio and Television Programme Broadcast Service Permit” (Category B):

(1) three-star hotels or above, or equivalent to three-star hotels or above;

(2) organs are able to provide 10 or more three-star hotels or above, or equivalent to three-star hotels or above with on-demand video broadcast services

Article 9: To apply for a “On-demand Radio and Television Programme Broadcast Service Permit”, the following conditions must be met:

(1) conforming to the national plan on on-demand video broadcast services;

(2) having programme resources conform to the provisions of these Rules;

(3) having the funding, premises, technology, personnel, and other conditions adapted to the operating scale of on-demand video broadcast services;

(4) using systems and equipment conform to national and industrial technical standards;

(5) having complete programme content examination systems and broadcasting management systems;

(6) having a determined broadcast scope;

(7) having creditworthiness and service ability adapted to the operating scale of on-demand video broadcast services;

(8) having plans on realizing connection with the administrative radio and television entity supervision system;

(9) other conditions as provided by laws and administrative regulations.

Article 10: To apply for a “On-demand Radio and Television Programme Broadcast Service Permit”, the following materials must be submitted:

(1) An application report, of which the content shall include permit category (category A or category B), transmission method (instant order, quasi-video order or playing after downloading), broadcast scope, etc.;

(2) a “On-demand Radio and Television Programme Broadcast Service Permit” application form;

(3) plans on the launch of on-demand radio and television broadcast services, technical plans, operating plans and management systems;

(4) supervision plans for providing the supervision department with supervision signals;

(5) a brief introduction of the main persons in charge and certification materials for equipment and premises.

To apply for a “On-demand Radio and Television Programme Broadcast Service Permit” (Category B), the business license and certification for the star rating of the hotel must also be submitted; among those those, organs other than hotels applying for a “On-demand Radio and Television Programme Broadcast Service Permit” (Category B), must also shall submit articles of association, capital verification certification, as well as the written document in which the hotel agrees to engaging in of video broadcasting services within its hotel.

Article 11:  Those applying for a “On-demand Radio and Television Programme Broadcast Service Permit” (Category A), shall apply with the local administrative radio and television entity and submit application materials conform to the provisions of Article 10. After examination level by level, the application materials shall be submitted to SARFT for examination and approval.

SARFT conducts examination of the application materials, for those examined to meet standards, relevant experts shall be organized to conduct an appraisal period for appraisal is 30 days. SARFT shall make a decision on the basis of the appraisal conclusion, to those conforming to conditions, a “On-demand Radio and Television Programme Broadcast Service Permit” (Category A) is issued; to those not conforming to conditions, the applying organ shall be notified in writing and the reasons given.

Article 12: Those applying for a “On-demand Radio and Television Programme Broadcast Service Permit” (Category B), shall apply with the local county level or higher administrative radio and television entity and submit application materials conform to the provisions of Article 10. After examination level by level, the application materials shall be submitted to the provincial administrative radio and television entity for examination and approval.

The provincial administrative radio and television entity conducts examination of the application materials, where examined to meet standards, applicant organs may install the broadcasting equipment. After equipment installation, the provincial administrative radio and television entity shall organize an acceptance check and shall make a decision on the basis of the check conclusion, to those conforming to conditions, a “On-demand Radio and Television Programme Broadcast Service Permit” (Category B) is issued and they are to report to SARFT for filing within 90 days. to those not conforming to conditions, the applying organ shall be notified in writing and the reasons given.

Article 13: An administrative radio and television entity responsible for acceptance shall, under the time limit and power scope as provided in the Administrative License Law, perform acceptance and examination functions.

Article 14: The validity period of a “On-demand Radio and Television Programme Broadcast Service Permit” is three years, to be calculated from the date of issue. Upon the expiration of the validity period, those needing to continue to run video broadcast services shall, 6 months prior to the expiration, conduct examination and approval formalities as provided in these Rules.

Article 15: Operating organs shall begin broadcasting within 90 days after obtaining a “On-demand Radio and Television Programme Broadcast Service Permit”. If it is impossible to begin broadcast because of special reasons, they shall obtain approval of the permit-issuing entity, otherwise it shall be handled as if terminating services.

Article 16: Where organs holding a “On-demand Radio and Television Programme Broadcast Service Permit” needs to terminate the business, they shall apply 60 days in advance with the original permit-issuing entity, their “On-demand Radio and Television Programme Broadcast Service Permit” shall be announced as cancelled by the original permit-issuing entity.

Article 17: A “On-demand Radio and Television Programme Broadcast Service Permit” shall state items such as the subject, scope, programme category, transmission method, etc.

Operating organ must engage in on-demand video broadcast services according to the matters as stated in the Permit.

Article 18: Where an operating organ intends to change any of the registry items in the Permit, registered capital, shareholders, or share proportion, it shall report to the original permit-issuing entity for approval 60 days in advance.

Article 19: Where an organ engaging in on-demand video broadcast services changes business premises, legal representative, chief programme editor or any other important matter, it shall notify the original permit-issuing entity in writing within 30 days.

Article 20: No hotel may allow any organ without a “On-demand Radio and Television Programme Broadcast Service Permit” to engage in on-demand video broadcast services in the hotel.

Where a hotel allows other organs, to engage as an organizing subject in on-demand video broadcast services in that hotel, it shall conduct necessary supervision over their business operations. If any activity violating these Rules is discovered, it shall cease it and shall immediately report it to the local administrative radio and television entity.

Chapter III: Programme management

Article 21 It is prohibited for on-demand video broadcast to containe any of the following content:

(1) content violating the basic principles provided in the Constitution;

(2) content endangering national unity, sovereignty and territorial integrity;

(3) content revealing State secrets, endangering State security or damaging State prosperity and interests;

(4) content inciting ethnic hatred, ethnic discrimination, destroying ethnic unity, or violating ethnic customs and habits;

(5) content propagating cults and superstitions;

(6) content disordering social order, destroying social stability;

(7) content inducing minors to commit unlawful acts and crimes and playing up violence, sex, gambling and terrorist activities;

(8) content insulting or slandering others, violating other’s lawful rights such as citizen’s individual privacy, etc;

(9) content endangering social virtue, damaging excellent ethnic cultural traditions;

(10) other content prohibited by relevant laws, regulations and rules, and State provisions.

Article 22: Programmes used for on-demand video broadcast, shall conform to the provisions of the Copyright Law.

Article 23: Of programmes used for on-demand video broadcast, domestic programmes shall be the most important.

Article 24: Imported foreign film or television dramas used for on-demand video broadcast shall be reported to SARFT for examination according to relevant provisions.

Article 25: Programmes used for the on-demand video broadcast are limited to the following 5 categories:

(1) films and television dramas that have obtained a “Television Drama Distribution Permit” or “Film Public Screening Permit”;

(2) programmes produced or broadcast by lawfully established radio and television broadcast organs;

(3) programmes produced by lawfully established radio and television production and operation organs;

(4) foreign radio and television programmes after examination and approval by provincial-level or higher administrative radio and television entities;

(5) information programmes such as weather forecasts and stock prices obtained through lawful channels.

Article 26: News or information programmes used for on-demand video broadcast shall be true and fair.

Article 27: Organizing organs shall be dispose of programme examinators, a complete programme examination system, implement the chief programme editor responsibility system and conduct examination of programme content broadcasted by itthem The chief programme editor shall have the necessary professional qualifications and relevant experience.

Article 28: The front broadcasting end of organizing organs holding a “On-demand Radio and Television Programme Broadcast Service Permit” (Category A) shall be linked to SARFT’s supervision system for on-demand video broadcast services. The front broadcasting end of organizing organs holding a “On-demand Radio and Television Programme Broadcast Service Permit” (Category B) shall, be linked to the supervision system for on-demand video broadcast services of the local administrative radio and television entity.

Chapter IV: Punitive provisions

Article 29 Those illegally engaging in on-demand video broadcast services in violation of these Rules shall be banned by the county-level or higher administrative radio and television entity and may be simultaneously fined no less than 10, 000 Yuan and no more than 30, 000 Yuan; where a crime is constituted, criminal liability shall be investigated according to the law.

Article 30: Those violating these Rules, where one of the following is present, shall be ordered by the county-level or higher the administrative radio and television entity to cease the unlawful activity, given a warning, ordered to rectify within a limited period, and may be fined no more than 30, 000 Yuan:

(1) not engage in on-demand video broadcast services according to the items indicated in the “On-demand Radio and Television Programme Broadcast Service Permit”;

(2) without approval or authorization, changing any Permit items, registered capital, shareholders or proportion of shares, or terminating on-demand video broadcast services;

(3) broadcasting any programme not conform to the provisions of these Rules;

(4) not broadcasting on-demand video broadcast programmes according to Article 21,  Article 24 and Article 25 of these Rules;

(5) In violation of Article 18 and Article 19 of these Rules, when important matters change, not notifying the original permit-issuing entity within the prescribed time limit of;

(6)In violation of Article 28 of these Rules, not linking the front broadcast end to the administrative radio and television entity supervision system according to regulations.

Article 31: Where chief programme editors or programme censors, in violation of these Rules, fail to perform their duties, and illegal content appears 3 times, SARFT may give a warning to the relevant person responsible. The relevant person responsible may not assume the position of chief programme editor or programme censor in organs engaging in on-demand video broadcast services for 3 years.

Article 32: Where a hotel, in violation of Article 20 of these Rules, allows an organ that has not obtained a “On-demand Radio and Television Programme Broadcast Service Permit” to engage in on-demand video broadcast services in it, the county-level or higher administrative radio and television entity shall give a warning and may simultaneously fine no more than 30,000 Yuan.

Chapter V: Supplementary Provisions

Article 33: Organs granted approval to engage in video broadcast services by administrative radio and television entities prior to the implementation of these Rules shall, within 6 months of the date of implementation of these Rules, apply for replacement of its Permit according to these Rules.

Article 34: These Rules take effect on 10 August 2004. The “Provisional Cable Television On-demand Video Broadcast Management Rules” (SARFT Decree No. 4) and the “Provisional Hotels and Restaurants On-demand Video Management Rules” (SARFT Decree No. 6) shall be abolished simultaneously.

广播电视视频点播业务管理办法

第一章 总  则

第一条 为促进广播电视视频点播业务健康发展,加强监督管理,促进社会主义精神文明建设,制定本办法。
第二条 本办法所称的广播电视视频点播(以下简称视频点播),是指通过广播电视技术系统以即时点播、准视频点播(轮播)、下载播放等点播形式供用户自主选择收看广播电视节目的业务活动。
第三条 国家广播电影电视总局(以下简称广电总局)负责全国视频点播业务的管理,制定全国视频点播业务总体规划,确定视频点播开办机构的总量、布局。
县级以上地方广播电视行政部门负责本辖区内视频点播业务的管理。
第四条 国家对视频点播业务实行许可制度。未经许可,任何机构和个人均不得开办视频点播业务。
禁止外商独资、中外合资、中外合作机构申请开办视频点播业务,但符合本办法第八条第一款的除外

第二章 业务许可

第五条 开办视频点播业务须取得《广播电视视频点播业务许可证》。
第六条 《广播电视视频点播业务许可证》分为甲、乙2种。
持有《广播电视视频点播业务许可证(甲种)》的机构,可在许可证载明的行政区域内从事视频点播业务。
持有《广播电视视频点播业务许可证(乙种)》的机构,可在许可证载明的宾馆饭店内从事视频点播业务。
第七条 下列机构可以申请《广播电视视频点播业务许可证(甲种)》:
(一)经批准设立的地(市)级以上广播电台、电视台;
(二)经批准设立的广播影视集团(总台)。
第八条 下列机构可以申请《广播电视视频点播业务许可证(乙种)》:
(一)三星级以上或相当于三星级以上的宾馆饭店;
(二)具有同时为10家以上三星级或相当于三星级以上的宾馆饭店提供视频点播业务能力的机构。
第九条 申请《广播电视视频点播业务许可证》必须具备以下条件:
(一)符合国家视频点播业务总体规划;
(二)有符合本办法规定的节目资源;
(三)具备与视频点播业务开办规模相适应的资金、场所、技术、人员等条件;
(四)所使用的系统和设备符合国家和行业技术标准;
(五)有健全的节目内容审查制度、播出管理制度;
(六)有确定的传播范围;
(七)具备与开办视频点播业务相适应的信誉和服务能力;
(八)有与广播电视行政部门监控系统实现联网的方案;
(九)其他法律、行政法规规定的条件。
第十条 申请《广播电视视频点播业务许可证》的,须提交以下材料:
(一)申请报告,内容应包括:申请许可证类别(甲种、乙种)、传播方式(即时点播、准视频点播、下载播放)、播放范围等;
(二)《广播电视视频点播业务许可证》申请表;
(三)从事广播电视视频点播业务的节目开办方案、技术方案、运营方案、管理制度;
(四)向政府监管部门提供监控信号的监控方案;
(五)主管人员简要情况介绍和设备、场所的证明资料。
申请《广播电视视频点播业务许可证(乙种)》的,还应提交营业执照和宾馆饭店星级评定的相关证明;其中,由宾馆饭店以外的机构申请《广播电视视频点播业务许可证(乙种)》的,还需要提交公司章程、验资证明以及宾馆饭店同意在其宾馆饭店从事视频点播业务的书面文件。
第十一条 申请《广播电视视频点播业务许可证(甲种)》的,应向当地广播电视行政部门提出申请,并提交符合第十条规定的申报材料。经逐级审核后,报广电总局审批。
广电总局对申报材料进行审核,审核合格的,组织有关专家进行论证,论证期限为30日。广电总局根据论证结论做出决定,符合条件的,颁发《广播电视视频点播业务许可证(甲种)》;不符合条件的,书面通知申办机构并说明理由。
第十二条 申请《广播电视视频点播业务许可证(乙种)》,应向当地县级以上广播电视行政部门提出申请,并提交符合第十条规定的申报材料。经逐级审核后,报省级广播电视行政部门审批。
省级广播电视行政部门对申报材料进行审核,审核合格的,申办机构可以安装视频点播设备。设备安装完毕,省级广播电视行政部门组织验收,根据验收结论做出决定,符合条件的,颁发《广播电视视频点播业务许可证(乙种)》,并在90日内报广电总局备案;不符合条件的,书面通知申办机构并说明理由。
第十三条 负责受理的广播电视行政部门应按照行政许可法规定的期限和权限,履行受理、审核职责。
第十四条 《广播电视视频点播业务许可证》有效期为3年,自颁发之日起计算。有效期届满,需继续经营视频点播业务的,应于期满前6个月按本办法规定的审批程序办理续办手续。
第十五条 开办机构应在领取《广播电视视频点播业务许可证》之后90日内开播。如因特殊理由不能如期开播,应经发证机关同意,否则按终止业务处理。
第十六条 持有《广播电视视频点播业务许可证》的机构需终止业务的,应提前60日向原发证机关申报,其《广播电视视频点播业务许可证》由原发证机关予以公告注销。
第十七条 《广播电视视频点播业务许可证》包含开办主体、开办范围、节目类别、传送方式等项目。
开办机构必须按照许可证载明的事项从事视频点播业务。
第十八条 开办机构变更许可证登记项目、注册资本、股东及持股比例的,应提前60日报原发证机关批准。
第十九条 开办机构的营业场所、法定代表人、节目总编等重要事项发生变更,应在30日内书面告知原发证机关。
第二十条 宾馆饭店不得允许未获得《广播电视视频点播业务许可证》的机构在其宾馆饭店内从事视频点播业务。
宾馆饭店同意其他机构作为开办主体在本宾馆饭店内从事视频点播业务的,应对其经营活动进行必要的监督。如发现有违反本办法规定行为的,应予以制止并立即报告当地广播电视行政部门。

第三章 节目管理

第二十一条 视频点播节目禁止载有下列内容:
(一)反对宪法确定的基本原则的;
(二)危害国家统一、主权和领土完整的;
(三)泄露国家秘密、危害国家安全或者损害国家荣誉和利益的;
(四)煽动民族仇恨、民族歧视,破坏民族团结,或者侵害民族风俗、习惯的;
(五)宣扬邪教、迷信的;
(六)扰乱社会秩序,破坏社会稳定的;
(七)宣扬淫秽、赌博、暴力或者教唆犯罪的;
(八)侮辱或者诽谤他人,侵害他人合法权益的;
(九)危害社会公德或者民族优秀文化传统的;
(十)有法律、行政法规和国家规定禁止的其他内容的。
第二十二条 用于视频点播业务的节目,应符合《著作权法》的规定。
第二十三条 用于视频点播业务的节目,应以国产节目为主。
第二十四条 引进用于视频点播的境外影视剧,应按有关规定报广电总局审查。
第二十五条 用于视频点播的节目限于以下5类:
(一)取得《电视剧发行许可证》、《电影片公映许可证》的影视剧;
(二)依法设立的广播电视播出机构制作、播出的节目;
(三)依法设立的广播电视节目制作经营机构制作的节目;
(四)经省级以上广播电视行政部门审查批准的境外广播电视节目;
(五)从合法途径取得的天气预报、股票行情等信息类节目。
第二十六条 用于视频点播的新闻类或信息类节目应真实、公正。
第二十七条 开办机构应配备节目审查员,健全节目审查制度,实行节目总编负责制,对其播放的节目内容进行审查。节目总编应具备必要的业务素质和相关的从业经验。
第二十八条 持有《广播电视视频点播业务许可证(甲种)》开办机构的播出前端应与广电总局视频点播业务监控系统实现联网;持有《广播电视视频点播业务许可证(乙种)》开办机构的播出前端应与所在地广播电视行政部门视频点播业务监控系统实现联网。

第四章 罚  则

第二十九条 违反本办法规定,未经批准,擅自开办视频点播业务的,由县级以上广播电视行政部门予以取缔,可以并处1万元以上3万元以下的罚款;构成犯罪的,依法追究刑事责任。
第三十条 违反本办法规定,有下列行为之一的,由县级以上广播电视行政部门责令停止违法活动、给予警告、限期整改,可以并处3万元以下的罚款:
(一)未按《广播电视视频点播业务许可证》载明的事项从事视频点播业务的;
(二)未经批准,擅自变更许可证事项、注册资本、股东及持股比例或者需终止开办视频点播业务的;
(三)播放不符合本办法规定的广播电视节目的;
(四)未按本办法第二十一条、第二十四条、第二十五条规定播放视频点播节目的;
(五)违反本办法第十八条,第十九条规定,有重要事项发生变更未在规定期限内通知原发证机关的;
(六)违反本办法第二十八条规定,播出前端未按规定与广播电视行政部门监控系统进行联网的。
第三十一条 违反本办法规定,节目总编或节目审查员未履行应尽职责,出现3次以上违规内容的,广电总局可以对相关责任人予以警告;相关责任人3年内不得担任视频点播开办机构的节目总编或节目审查员。
第三十二条 违反本办法第二十条规定,宾馆饭店允许未获得《广播电视视频点播业务许可证》的机构在其宾馆饭店内经营视频点播业务的,由县级以上广播电视行政部门予以警告,可以并处3万元以下罚款。

第五章 附  则

第三十三条 本办法施行前经广播电视行政部门批准开办视频点播业务的机构,应自本办法实施之日起6个月内,按照本办法规定申换许可证。
第三十四条 本办法自2004年8月10日起施行。广电总局《有线电视视频点播管理暂行办法》(广电总局令第4号)和《宾馆饭店视频点播管理暂行办法》(广电总局令第6号)同时废止。
