In order to implement the Central Committee General Office and State Council General Office “Opinions concerning Further Strengthening Internet Management Work” (GBF No. (2004)32), our Administration has formulated the “SARFT Implementation Rules for the Central Committee General Office and State Council General Office ‘Opinions concerning Further Strengthening Internet Management Work'”, which are hereby issued to you, please obey and implement them.

SARFT Implementation Rules for the Central Committee General Office and State Council General Office “Opinions concerning Further Strengthening Internet Management Work”

In order to implement the Central Committee General Office and State Council General Office “Opinions concerning Further Strengthening Internet Management Work” (GBF No. (2004)32), and realistically strengthen supervision and management work of the dissemination of audiovisual programmes through the Internet and other such information networks (including film and television-type audiovisual products), these Implementation Rules are formulated.

I, Earnestly study, strengthen training, stimulate the orderly development of management work of information network dissemination of audiovisual programmes.

Following the development of network and digital technology, dissemination of audiovisual programmes through the Internet and other such information networks has gradually become a new dissemination form of radio, film and televisions, reception terminals have also broadened from computers to television sets, mobile telephones and other reception devices. Strengthening management over the dissemination of audiovisual programmes through the Internet and other such information networks has an extremely important significance for guaranteeing the correct public opinion guidance, safeguarding social stability, and promoting the coordinated development of all parts of national radio, film and televisions.

All levels’ administrative radio, film and television management departments must fully understand the necessity and importance of strengthening management over the dissemination of audiovisual programmes through the Internet and other such information networks, they must earnestly study the “Opinions concerning further Strengthening Internet Management Work” (hereafter simply named “Opinions”) and the “Management Rules for the Dissemination of Audiovisual Programmes through the Internet and Other Such Information Networks” (SARFT Decree No. 39), they must formulate realistic and effective measures to expand management strength. From May 2005 until the end of the year, all provincial-level radio, film and television management departments must organize and launch professional training activities at the provincial level, and raise the political levels and technological levels of management teams and supervision personnel. They must organize the radio and television broadcast organs in their provinces and organs holding an “Information Network Audiovisual Programme Dissemination Permit” to launch concentrated propaganda on management policies and regulations concerning the dissemination of audiovisual programmes through the Internet and other such information networks, they must let the social public fully understand the relevant regulations and requirements of the State, raise the awareness and consciousness of business organs to do business according to the law, and stimulate the healthy and orderly development of the sector.

II, Realistically implement duties and responsibilities, completely clean up and rectify matters, expand supervision and management strength for the dissemination of audiovisual programmes through information networks.

According to the work division of the “Opinions”, SARFT is the controlling department for online dissemination activities of radio, film, television and audiovisual programmes (including film and television-type audiovisual products), it is responsible for the supervision and control over websites disseminating of foreign harmful radio and television programmes, putting forward blocking opinions and notifying the Ministry of Information Industry about implementation. Local radio, film and television management departments are responsible for supervision and management work over online dissemination activities of network radio, film, television and audiovisual programmes (including film and television-type audiovisual products) within their area. All levels’ radio, film and television management departments must, according to the clear work division of the “Opinions”, realistically implement their duties, strengthen their cooperation and coordination with information industry, Internet news and propaganda and other such Internet management departments, shape joint forces, and jointly do Internet supervision and management work well.

(1) Completely launch clean-up and rectification work of business organs disseminating audiovisual programmes on information networks.

On the basis of the deployment of the “Opinions”, all corresponding Internet management department must launch concentrated Internet site clean-up and rectification activities on a nationwide scale. According to the deployment of SARFT, all provincial radio, film and television management departments must clear out organs that do not hold an “Information Network Audiovisual Distribution Permit” and have set up unauthorized information network dissemination businesses of audiovisual programmes in their administrative areas (including organs that have set up unauthorized IP television or mobile telephone television business without approval”. All localities shall, during concentrated clean-up and rectification work, establish clean-up work leading small groups under the command of SARFT leaders, concrete work is divided into four steps:

1, Thoroughly investigate the situation. All provincial radio, film and television departments must inspect all organs running information network dissemination of audiovisual programme businesses in their areas, register the names, broadcast content, broadcast method, technological parameters (website address, domain name, etc.) and other such corresponding information, and report this to SARFT before 20 May.

2, Clean-up and rectification. On the basis of the investigation of the situation, organs running audiovisual programme businesses violating regulations are to be dealt with in a categorized manner. Those who truly meet the examination conditions to engage in information network distribution of audiovisual programme business according to preliminary examination by the provincial-level radio, film and television departments, are to report to SARFT to conduct examination and approval formalities before 20 May 2005; those who are found not to conform to examination and approval conditions through preliminary examination in the various provinces, or who do not obtain final approval after reporting to SARFT, are ordered to cease the running of audiovisual programme businesses in violation of regulation before 15 June 2005.

3, Investigation and prosecution according to the law. Concerning those who have not ceased the running of audiovisual programme businesses in violation of regulation within the specified time limits, according to requirements, as well as websites of which the work unit that actually runs it is difficult to find out, the provincial-level radio, film and television department will collect the relevant situations, and report a name list to the provincial information industry department before 20 June, the information industry department orders Internet access service providers to cease services to them according to the requirements of the “Opinions”, to force them to close their online programmes. Websites that disseminate harmful audiovisual programmes are reported to the public security departments for punishment according to the law.

All provincial radio, film and television departments’ summaries concerning clean-up and rectification work in their regions shall be reported to SARFT before the end of June.

(2) Doing annual examination work well, implement a veto system.

On the basis of the requirements of the “Opinions”, the State implements an annual examination system over telecommunications operators, Internet access service providers, Internet information service providers and registration service organs, all management departments related to the Internet must each put respectively put forward opinions within their scope of responsibility, a veto decision system is implemented. In the future, before the end of September every year, all levels’ radio, film and television management departments must conduct annual examination of basic telecommunications operators, Internet access service providers and Internet information service providers, on whether or not these have launched information network audiovisual programme dissemination services according to regulations, and they must put forward opinions about whether or not these pass annual examination. With regard to the annual examination of organs directly subordinate to the Centre, SARFT is responsible, the annual examination work of other organs is the responsibility of the local provincial radio, film and television management department. Furthermore, concerning cases where unauthorized audiovisual programme dissemination businesses are run without an “Information Network Audiovisual Programme Dissemination Permit”, they shall notify the local telecommunications industry management departments according to the demands of the “Opinions” and SARFT Decree No. 39, to cancel their telecommunications business permits, and notify the local administrative industry and commerce management department to modify or cancel their registration according to the law, at the same time, they are to report to SARFT; annual examination opinions put forward concerning organs having “Information Network Audiovisual Programme Dissemination Permits” are to be reported to SARFT directly.

III, Perfect laws and regulations, improve methods, establish and complete long-term management mechanisms for dissemination of audiovisual products through information networks.

(1) Grasp the drafting of the “Internet Audiovisual Programme Management Regulations”. SARFT will, on the basis of the “Management Rules for the Dissemination of Audiovisual Programmes through the Internet and Other Such Information Networks”, broadly launch investigation and research, draft a regulatory draft as soon as possible, and report this to the State Council after soliciting opinions according to the stipulated procedure.

(2) Strengthen daily supervision and management of organs holding certifications, establish and complete all sorts of management systems. All local levels’ radio and television management departments must, on the basis of the principle of localized management, strengthen supervision and management over organs holding an “Information Network Audiovisual Programme Dissemination Permit” in their administrative areas, and within the first half of 2005, they must require all organs holding certification to implement programme examination systems and general programme editing responsibility systems, according to all provisions of the “Management Rules for the Dissemination of Audiovisual Programmes through the Internet and Other Such Information Networks”, guarantee that the broadcast programmes conform to the requirements of State propaganda management, that programme sources conform to the relevant provisions of the  “Management Rules for the Dissemination of Audiovisual Programmes through the Internet and Other Such Information Networks”, and have the corresponding copyrights, it is not permitted to disseminate illegally traded radio and television programmes or foreign radio and television programmes.

(3) Improve management means, accelerate the construction of prevention and control systems for Internet dissemination of audiovisual programmes.

1, Establish and perfect all levels’ supervision and control networks for the dissemination of audiovisual programmes through information networks. At the same time as further perfecting SARFT’s supervision and management centre for the dissemination of audiovisual programmes through information networks, Beijing, Guangdong and Shanghai must also accelerate the establishment of supervision and management branch centres for the dissemination of audiovisual programmes through information networks. All provincial-level and focus city radio, film and television departments must expand inputs and strength, accelerate the establishment of regional supervision and management systems for the dissemination of audiovisual programmes through information networks, and build audiovisual programme supervision and control networks that are connected on a nationwide scale.

2, Establish and perfect Internet website IP address usage information bases. SARFT will continue to strengthen coordination with the Ministry of Information Industry, strive to realize that the radio, film and television public information network audiovisual programme supervision and control system is connected to the China Internet Network Information Centre’s nationwide domain name database and the IP address usage database, and share information. All levels’ radio, film and television departments must pay attention to gathering and putting in order IP address information concerning Internet information service providers, especially audiovisual programme service provision organs, add them to the SARFT IP information database, and progressively establish a website IP address usage information base that is suited to the needs of audiovisual programme supervision and management work.

3, Establish supervision and control systems for websites with foreign harmful radio, film and television programmes. SARFT is currently grasping the formulation of technological plans of a supervision and control system for websites with foreign harmful radio, film and television programmes, and implement authorization and corresponding work procedures for the blocking of websites with foreign harmful radio, film and television programmes.

(4) Establish and substantiate management teams for the dissemination of audiovisual programmes through information networks.

All levels’ radio, film and television departments must strengthen leadership over management work of audiovisual programme dissemination through information networks, strengthen management team construction, further expand inputs and strengths in terms of organic structure, personnel (including administrative management personnel and supervision personnel) allocation, funding guarantees and other such aspects, and guarantee the satisfactory implementation of all items from the “Opinions”.

广电总局落实中办国办《关于进一步加强互联网管理工作的意见》实施细则
为贯彻落实中共中央办公厅、国务院办公厅《关于进一步加强互联网管理工作的意见》(中办发(2004)32号),切实加强互联网等信息网络传播视听节目(包括影视类音像制品)监管工作,制定本实施细则。
一、认真学习,强化培训,促进信息网络传播视听节目管理工作有序开展。
随着网络和数字技术的发展,互联网等信息网络传播视听节目逐渐成为广播影视新的传播形式,接收终端也从计算机扩展到电视机、手机和其它接收设备。加强互联网等信息网络传播视听节目管理,对于确保舆论导向正确,维护社会稳定,推动国家广播影视各项事业协调发展,具有十分重要的意义。
各级广播影视行政管理部门要充分认识加强互联网等信息网络传播视听节目管理的必要性和重要性,要认真学习《关于进一步加强互联网管理工作的意见》(以下简称《意见》)和《互联网等信息网络传播视听节目管理办法》(广电总局令第39号),要制定切实有效措施加大管理力度。从2005年5月至年底,各省级广播影视管理部门要以省为单位组织开展业务培训活动,提高管理队伍和监管人员的政策水平和技术水平。要组织本省的广播电视播出机构和《信息网络传播视听节目许可证》持证机构,集中开展对互联网等信息网络传播视听节目管理政策、法规的社会宣传,要让社会公众充分了解国家的有关规定和要求,提高经营机构的依法经营意识和自觉性,促进行业健康有序发展。

二、切实履行职责,全面清理整顿,加大信息网络传播视听节目监管力度。
根据《意见》的分工,广电总局是网络广播影视和视听节目(包括影视类音像制品)网上传播活动的主管部门,负责对传播境外有害广播电视节目的网站进行监控、提出封堵意见并通知信息产业部实施。地方广电管理部门负责本区域内网络广播影视和视听节目(包括影视类音像制品)网上传播活动的监管工作。各级广电管理部门要按照《意见》明确的分工,切实履行职责,加强与信息产业、互联网新闻宣传等其他互联网管理部门的协调配合、形成合力,共同做好互联网监管工作。
(一)全面开展对信息网络传播视听节目业务机构的清理整顿工作。
根据《意见》的部署,互联网各相关管理部门要在全国范围内开展互联网站集中清理整顿活动。按照总局的部署,各省广电管理部门要对本辖区内未持有《信息网络传播视听节目许可证》擅自开办通过信息网络传播视听节目业务的机构(包括未经批准擅自开办IP电视、手机电视业务的机构)进行清查。各地在集中清理整顿工作中,应成立由局领导挂帅的清理工作领导小组,具体工作分四个步骤:
1、查清情况。各省广电部门要对本区域内所有开办信息网络传播视听节目业务的机构进行排查,将违规机构名称、播出内容、播出方式、技术参数(网站地址、域名等)等相关信息登记造册,应在5月20日前报广电总局。
2、清理整顿。在查清情况的基础上,对违规开办视听节目业务的机构进行分类处理。经各省广电部门初审确实具备信息网络传播视听节目业务审批条件的,于2005年5月20日前报广电总局办理审批手续;经各省初审不符合审批条件或报广电总局后未获得最终批准的,责令其于2005年6月15日前停止违规开办的视听节目业务。
3、依法查处。对未在规定期限内按要求停止违规开办的视听节目业务的,以及难以查找到实际开办单位的网站,由省级广电管理部门将有关情况汇总后,于6月20日前将名单通报给本省信息产业部门,由信息产业部门按《意见》的要求,责令互联网接入服务提供商停止对其服务,强制关闭其网上的节目。对传播有害视听节目的网站,通报公安部门依法惩处。
各省广电部门关于本区域内清理整顿工作总结,应于6月底前报总局。
(二)做好年检工作,实行一票否决。
根据《意见》的要求,国家对基础电信运营商、互联网接入服务提供商、互联网信息服务提供者及域名注册服务机构实行年检制度,互联网各有关管理部门要在各自分管的职责范围内对其分别提出意见,实行一票否决制。今后每年9月底前,各级广电管理部门要对本区域内基础电信运营商、互联网接入服务提供商、互联网信息服务提供者是否按规定开展信息网络传播视听节目业务的情况进行年度审核,对其作出年度审核是否合格的意见。对中央直属机构的年检工作,由广电总局负责,对其他机构的年检工作由所在省的广电管理部门负责。其中,对于未持有《信息网络传播视听节目许可证》擅自开办视听节目传播业务的,应按《意见》和总局39号令的要求通报给当地信息产业管理部门取消其相应电信业务许可,并通报给当地工商行政管理部门依法变更或取消其登记,同时报总局;对已持有《信息网络传播视听节目许可证》机构所提的年检意见,直接报总局。

三、完善法规,改进手段,建立健全信息网络传播视听节目长效管理机制。
(一)抓紧起草《互联网视听节目管理条例》。广电总局将在《互联网等信息网络传播视听节目管理办法》的基础上,广泛开展调查研究,尽快起草条例草案,按规定程序征求意见后,上报国务院。
(二)加强持证机构日常监管,建立健全各项管理制度。地方各级广电管理部门要按照属地化管理的原则,对本行政区域内持有《信息网络传播视听节目许可证》的机构加强监管,在2005年上半年内,必须按照《互联网等信息网络传播视听节目管理办法》的各项规定,要求所有持证机构全部落实节目审查制度和节目总编责任制度,确保所播出的节目符合国家宣传管理的要求,节目来源符合《互联网等信息网络传播视听节目管理办法》的有关规定,并具有相应版权,不得转播非法开办的广播电视节目和境外广播电视节目。
(三)改进管理手段,加快互联网传播视听节目防控体系建设。
1、建立和完善各级信息网络传播视听节目监控网络。进一步完善总局信息网络视听节目传播监管中心的同时,北京、广东、上海也要加快建立信息网络视听节目传播监管分中心。各省级及重点地市广电部门要加大投入力度,加快设立区域性信息网络视听节目监控系统,形成全国联动的视听节目监控网络。
2、建立和完善互联网站IP地址使用信息库。总局将继续加强与信息产业部的协调,争取实现广电公共信息网络视听节目监控系统与中国互联网信息中心全国域名数据库和IP地址使用信息库的联网和信息共享。各地广电部门要注意收集、整理互联网信息服务提供者,特别是视听节目服务提供机构的IP地址信息,充实到广电总局IP信息库中,逐步建立适应视听节目监管需要的网站IP地址使用信息库。
3、建立境外有害广播电视节目网站监控系统。广电总局正在抓紧制定境外有害广播电视节目网站监控系统技术方案并组织建设,落实封堵境外有害广播电视节目网站的授权和相关工作程序
(四)建立和充实信息网络传播视听节目管理队伍。
各级广电部门对信息网络传播视听节目管理工作,要加强领导,强化管理队伍建设,在机构设置、人员(包括行政管理人员和监管人员)配备、经费保障等方面要进一步加大投入力度,确保将《意见》的各项要求落到实处。
