Article 1: In order to safeguard network copyright, standardize the activities of Internet employees, stimulate the development and use of network information resources, and promote the development of Internet information resources, this Convention is promulgated.
Article 2: Members of the Convention shall earnestly study and consciously abide by copyright laws and regulations related to the Internet, strengthen a sense of copyright protection, forcefully carry forward the excellent cultural traditions of the Chinese nation and the moral principles of the Socialist spiritual civilization, and vigorously promote the construction of professional ethics.
Article 3: Members of the Convention should strengthen communication and cooperation, jointly research and explore copyright protection measures for our country’s Internet, and put forward related policy suggestions and legislation suggestions.
Article 4: Members of the Convention shall vigorously adopt effective technological methods and management methods to protect the rights of rights holders.
Article 5: Members of the Conventions should encourage, support and protect competition that is fair, orderly and conducted according to the law, and oppose unfair competition.
Article 6: Members of the Convention shall consciously accept supervision and criticism form all walks of society, and jointly resist and correct unhealthy tendencies in the sector.
Article 7: The Internet Society of China Network Copyright Union (“Union”) is the implementing organ for this Convention, and is responsible for the propagation and implementation of this Convention.
Article 8: The Union is responsible for organizing Convention members to study network copyright management and corresponding laws, regulations and measures, organizing the exchange of sector information related to network copyright, representing Convention members to conduct communication with government management departments, reflecting the wishes and requirements of Convention members, realistically safeguarding the proper rights and interests of convention members, vigorously promoting and implementing Internet sector self-discipline, and conducting supervision and examination of the situation of members abiding by this Convention.
Article 9: Where members of this Convention violate the Convention, any work unit or individual has the power to report this with the Union, the Union conducts inspection, and shall publish the inspection results to the whole body of members. Where Convention members violate this Convention, creating a harmful influence and where this is verified, the Union shall deal with this through internal communication or cancelling Convention membership qualifications, in view of the different situations.
Article 10: All members of this Convention have the power to supervise the legality and fairness of the Union’s implementation of this Convention, and have the power to report the Union or its personnel to the Union’s controlling department in case of acts violating this Convention and related work systems.
Article 11: The Union establishes a secretariat, which accepts “notifications” and “counter-notifications” on the basis of Convention member authorization, concrete rules are formulated separately.
Article 12: The Union establishes a network copyright dispute settlement centre, to be responsible for resolving network copyright disputes between Convention members, concrete rules are formulated separately.
Article 13: The Union designs and applies for a uniform logo for this Convention, and will formulate concrete use rules. Members of this convention have the power to use the uniform logo of the Convention according to rules on usage.
Article 14: All Internet content service providers and network service providers accepting this Convention, may apply to accede to this Convention, Members of this Convention may also withdraw from this Convention, and notify the organ implementing the Convention. The organ implementing the Convention regularly publishes a list of names of members acceding to or withdrawing from this Convention.
Article 15: This Convention is published to society by the Internet Society of China Copyright Union, signature is accepted from the date of publication, when the number of signatory members reaches 20, this Convention takes effect.
Article 16: The period of validity of this Convention, is proposed by the organ implementing the Convention or 10 per cent of the members of this Convention, and may be revised with agreement of two thirds of the members of more.
Article 17: The Internet Society of China Copyright Union is responsible for interpreting this Convention.
