Chapter I: General Principles

Article 1: In order to standardize Internet news information services, satisfy the public’s demand for Internet news information, safeguard national security and the public interest, protect the lawful rights and interests of Internet news information service work units, and stimulate the healthy and orderly development of Internet news information services, these Regulations are formulated.

Article 2: These Regulations shall be observed when engaging in Internet news information services within the borders of the People’s Republic of China.

News information as mentioned in these Regulations refers to current affairs-type news information, including reports and comments on politics, economics, military affairs, foreign relations and other social public affairs, as well as reporting and comments concerning sudden social incidents.

Internet news information services as mentioned in these Regulations, include the publication of news information, providing current affairs-type electronic notification services and sending current affairs-type newsletters and information to the public through the Internet.

Article 3: Internet news information service work units engaging in Internet news information services, shall abide by the Constitution, laws and regulations, persist in the orientation of serving the people and serving Socialism, persist in the correct public opinion orientation, and safeguard the national interest and the public interest.

The State encourages Internet news information service work units to disseminate healthy and civilized news information beneficial to raising the quality of the nation, promoting economic development and stimulating social progress.

Article 4: The State Council Information Office is in charge of Internet news information service supervision and management work nationwide. Provincial, autonomous region and municipal People’s Government Information Offices are responsible for Internet news information service supervision and management work within their administrative areas.

Chapter II: The establishment of Internet news information service work units

Article 5: Internet news information service work units are divided in the following three categories:

(1) Internet news information service work units established by news work units, which provide current affairs-type electronic notification services and send current affairs-type newsletters to the public, outside of the news information this work unit already published in print;

(2) Internet news information service work units established by non-news work units, to reprint news information, provide current affairs-type notification services and send current affairs-type newsletters to the public;

(3) Internet news information service work units established by news work units, to reprint news information this work unit already published in print.

On the basis of the “State Council Decision on Establishing Administrative Permits for Administrative Examination and Approval Items that Need to Be Maintained”, the establishment of Internet news information service work units as provided in Clauses (1) and (2) of the previous Paragraph shall be examined and approved by the State Council Information Office.

The establishment of Internet news information service work units as provided in Clause (3) of Paragraph 1 shall be filed with the State Council Information Office or the provincial, autonomous region or municipal People’s Government Information Office.

Article 6: Where the share that news work units hold in Internet news information service work units jointly established by news work units and non-news work units is not lower than 51%, it is considered as an Internet news information service work unit established by a news work unit; where the share of news work units is lower than 51%, it is considered as an Internet news information service work unit established by a non-news work unit.

Article 7: To establish an Internet news information service work unit as provided in Clause (1), Paragraph 1 of Article 5 of these Regulations, the following conditions shall be met:

(1) having complete Internet news information service management regulations;

(2) having five or more full-time news editing staff who have engaged in news work within news work units for three years or more;

(3) having the necessary premises, equipment and finances, the source of finances shall be lawful.

Bodies permitted to apply for the establishment of an Internet news information service work unit as provided in the previous Paragraph shall be Central news work units, provincial, autonomous region or municipal directly-subordinate news work units, as well as news work units directly subordinate to cities where provincial, autonomous region or municipal governments are located.

Examination and approval of the establishment of an Internet news information service work unit as provided in the first Paragraph of this Article, apart from the conditions that shall be met according to the provisions of this Article, shall also conform to the State Council Information Office’s demands concerning the total quantity, structuring and distribution of the Internet news information sector’s development.

Article 8: To establish an Internet news information service work unit as provided in Clause (2), Paragraph 1 of Article 5, apart from the conditions provided in Clause (1) and Clause (3), Paragraph 1 of Article 7, there shall be ten or more full-time news editing staff; of those, there may not be fewer than five news editing staff who have engaged in news work within news work units for three years or more.

Organizations permitted to apply for the establishment of an Internet news information service work unit as provided in the previous Paragraph shall be legal persons who have engaged in Internet news information services, which have been lawfully established for two years or more, and who have not been subject to administrative punishment for violation of laws, regulations or rules concerning Internet information service management within the previous two years; where the applying organization is an enterprise legal person, the registered capital shall not be lower than 1000 Yuan.

Examination and approval of the establishment of an Internet news information service work unit as provided in the first Paragraph of this Article, apart from the conditions that shall be met according to the provisions of this Article, shall also conform to the State Council Information Office’s demands concerning the total quantity, structuring and distribution of the Internet news information sector’s development.

Article 9: No organization may establish Sino-foreign cooperative joint venture, Sino-foreign contractual joint venture or foreign-invested Internet news information service work units.

Where Internet news information service work units engage in cooperation involving Internet news information services with Sino-foreign cooperative joint ventures, Sino-foreign contractual joint ventures or foreign-invested Internet news information service work units, they shall report the matter to State Council Information Office, which will conduct a security evaluation.

Article 10: To apply for the establishment of an Internet news information service work unit as provided in Clause (1) or Clause (2), Paragraph 1 of Article 5 of these Regulations, an application registration form shall be filled out, and the following materials shall be submitted:

(1) Internet news information service management rules and systems;

(2) Proof of the property rights of premises or proof of use rights, and proof of the source and amount of funds;

(3) Proof of the professional qualifications of news editing staff.

Bodies applying for the establishment of an Internet news information service work unit provided in Clause (1), Paragraph I of Article 5 of these Regulations, shall also submit proof of news work unit qualifications; organizations applying for the establishment of an Internet news information service work unit as provided in Clause (2), Paragraph I of Article 5 of these Regulations, shall also submit proof of legal person qualifications.

Article 11: When applying for the establishment of an Internet news information service work unit as provided in Clauses (1) and (2), Paragraph I of Article 5 of these Regulations, central news work units shall submit applications to the State Council Information Office; provincial, autonomous region or municipal news work units and news work units directly subordinated to the cities where provincial, autonomous region or municipal People’s Governments are located, as well as non-news work units, shall submit applications to the State Council Information Office through the local provincial, autonomous region or municipal People’s Government Information Office.

Where applications are submitted through provincial, autonomous region or municipal People’s Government Information Offices, provincial, autonomous region or municipal People’s Government Information Offices shall conduct an on-the-ground inspection within 20 days of receiving the application, and submit a preliminary opinion to the State Council; the State Council Information Office shall make a decision within 40 days of receiving the preliminary opinion. Where applications are submitted to the State Council Information Office, the State Council Information Office shall conduct an on-the-ground inspection and make a decision within 40 days of receiving the application. In case of approval, an Internet news information service permit is issued; in case of non-approval, the applicant shall be notified in writing and the reasons shall be explained.

Article 12: Internet news information service work units as provided in Clause (3), Paragraph I of Article 5 of these Regulations, which are established by central news work unit, shall report to the State Council Information Office for filing within 1 month from the date on which they engage in Internet news information services; where they are established by other news work units, they shall report to the local provincial, autonomous region or municipal People’s Government Information Office for filing within 1 month from the date on which they engage in Internet news information services.

When conducting filing, a filing registration form shall be filled out, and the Internet news information service management rules and structures, and proof of news work unit qualifications shall be submitted.

Article 13: After Internet news information service work units are established according to these regulations, they shall conduct relevant formalities with telecommunications controlling departments according to administrative regulations concerning Internet information service management.

Article 14: Where Internet news information service work units as provided in Clauses (1) and (2), Paragraph I of Article 5 of these Regulations change their name, address, legal representative or main responsible person, shareholding structure, service affairs, website address and other such matters, they shall apply to the State Council Information Office for exchange of the Internet news information service permit. Where approval by telecommunications controlling departments is required, or it is necessary that telecommunications controlling departments conduct permit or filing modification formalities on the basis of relevant telecommunications, the matter shall be handled according to relevant regulations.

Where Internet news information service work units as provided in Clause (3) Paragraph I of Article 5 of these Regulations change their name, address, legal representative or main responsible person, shareholding structure, service affairs, website address and other such matters, they shall renew their filing with the original filing body; however, where after change in the shareholding structure, the share of a news work unit is lower than 51%, they shall conduct permission formalities according to these Regulations. Where approval by telecommunications controlling departments is required, or it is necessary that telecommunications controlling departments conduct permit or filing modification formalities on the basis of relevant telecommunications, the matter shall be handled according to relevant regulations.

Chapter III: Internet news information service standards

Article 15: Internet news information service work units shall provide Internet news information services according to the approved service list.

Article 16: Internet news information service work units as provided in Clauses (1) and (2), Paragraph I of Article 5 of these Regulations, shall, when reprinting news information or distributing current affairs-type newsletters to the public, reprint or distribute news information published by central news work units or news work units directly subordinate to provinces, autonomous regions and municipalities, and shall clearly indicate the source of the news information, they may not distort the content of the original news information.

Internet news information service work units as provided in Clause (2), Paragraph I of article 5 of these Regulations may not publish news information they gathered and edited themselves.

Article 17: Internet news information service work units as provided in Clauses (1) and (2), Paragraph I of Article 5 of these Regulations shall sign a written agreement with central news work units or news work units directly subordinate to provinces, autonomous regions and municipalities. Internet news information service work units established by central news work units shall submit a copy of the agreement to the State Council Information Office for filing; other Internet news information service work units shall submit a copy of the agreement to the provincial, autonomous region or municipal People’s Government Information Office for filing.

Central news work units or news work units directly subordinate to provinces, autonomous regions and municipalities concluding agreements as provided in the previous Paragraph, shall check the Internet news information service permit of the counterpart, and may not provide news information to work units who do not have an Internet news information service permit.

Article 18: Central news work units engaging in Internet news business cooperation other than provision of copy with Internet news information service work units as provided in Clause (2), Paragraph I of Article 5 of these Regulations, shall report this to the State Council Information Office ten days before launching the cooperative business; other news work units engaging in Internet news business cooperation with Internet news information service work units as provided in Clause (2), Paragraph I of Article 5 of these Regulations, shall report this to the local provincial, autonomous region or municipal People’s Government Information Office ten days before launching the cooperative business.

Article 19: News information published or distributed by Internet news information service work units, or current affairs-type electronic notification services they provide, may not contain the following content:

(1) content violating the basic principles determined in the Constitution;

(2) content harming national security, divulging state secrets, subverting the State regime, or destroying national unity;

(3) content harming the honour and interests of the State;

(4) content inciting ethnic hatred or ethnic discrimination, or destroying ethnic unity;

(5) content destroying State religious policies, or propagating heresy and feudal superstition;

(6) content disseminating rumours, disordering social order, or destroying social stability;

(7) content disseminating obscenity, sex, gambling, violence or terror, or instigating crime;

(8) content insulting or defaming others, or harming others’ lawful rights and interests;

(9) content inciting illegal assemblies, associations, demonstrations, marches, or gathering a crowd to disorder social order

(10) content concerning actions in the name of illegal popular organizations;

(11) other content prohibited by laws or administrative regulations.

Article 20: Internet news information service work units shall establish a news information content management responsibility system. They may not publish or distribute news information with content violating Paragraph I of Article 3, and of Article 19 of these Regulation; where they discover that provided current affairs-type electronic notification services contain content prohibited by the provision of Paragraph I of Article 3, and of Article 19 of these Regulations, they shall immediately delete it, preserve relevant record, and provide it to relevant departments when these request so according to the law.

Article 21: Internet news information service work units shall record news information content they publish or distribute, as well as their time and Internet address, record files shall be preserved for sixty days at least, and provided to relevant departments when these request so according to the law.

Chapter IV: Supervision and management

Article 22: The State Council Information Office and provincial, autonomous region or municipal People’s Government Information Offices conduct supervision and management of Internet news information service work units according to the law, relevant work units and individuals shall provide cooperation.

When State Council Information Office and provincial, autonomous region or municipal People’s Government Information Offices’ staff conduct on-the-ground inspections, they shall display their law enforcement credentials.

Article 23: The State Council Information Office and provincial, autonomous region or municipal People’s Government Information Offices shall conduct supervision over Internet news information services; where they discover that Internet news information service work units publish or distribute news information or provide current affairs-type electronic notification services with content violating the provisions of Paragraph I of Article 3, or of Article of these Regulations, they shall notify [the Internet news information service work unit] to delete it. Internet news information service work units shall immediately delete the matter, preserve relevant records, and provide them to relevant departments when these request so according to the law.

Article 24: Internet news information service work units as provided in Clauses (1) and (2), Paragraph I of Article 5 of these Regulations, which are established by central news work units, shall annually submit an annual business report to the State Council Information Office within the stipulated period; those established by other news work units or non-news work units, shall annually submit an annual business report to the State Council Information Office through the local provincial, autonomous region or municipal People’s Government Information Office within the stipulated period.

The State Council Information Office may, on the basis of the reported situation, conduct inspections of the management structure, staff qualifications, service content, etc., of Internet news information service work units.

Article 25: Internet news information service work units shall accept public supervision.

The State Council Information Office shall publish the URL and telephone number of a reporting website, which accepts public reports and deals with them according to the law; reports falling in the scope of responsibilities of other departments, shall be submitted to the relevant department for processing.

Chapter V: Legal liability

Article 26: Where, in violation of the provisions of Paragraph II, Article 5 of these Regulations, Internet news information services are conducted without authorization, or where in violation of the provision of Article 15 of these Regulations, Internet news information services are conducted outside the approved service list, the State Council Information Office or provincial, autonomous region or municipal People’s Government Information Offices, on the basis of their respective powers, order cessation of the unlawful activities, and impose an additional fine of 10.000 Yuan or more but less than 30.000 Yuan; where circumstances are grave, the telecommunications controlling department will, on the basis of a written opinion of confirmation from the State Council Information Office or the provincial, autonomous region or municipal People’s Government Information Office, and according to the provisions in administrative regulations concerning Internet information service management, cease their Internet information services or order Internet access service providers to cease access services.

Article 27: Where Internet news information service work units publish or distribute news information containing content prohibited by Article 19 of these Regulations, or refuse to carry out their duty of deletion, the State Council Information Office or provincial, autonomous region or municipal People’s Government Information Offices issue a warning, and may impose an additional fine of 10.000 Yuan or more but less than 30.000 Yuan; where circumstances are grave, telecommunications management departments will, on the basis of a written opinion of confirmation from the State Council Information Office or the provincial, autonomous region or municipal People’s Government Information Office, and according to the provisions in administrative regulations concerning Internet information service management, cease their Internet information services or order Internet access service providers to cease access services.

Where Internet news information service work units publish or distribute news content containing content violating the provisions of Paragraph I, Article 3 of these Regulations, the State Council Information Office or provincial, autonomous region or municipal People’s Government Information Offices impose punishment on the basis of their respective powers, according to the punishment categories and degrees provided in the previous Paragraph.

Article 28: Where [Internet news information service work units], in violation of the provisions of Article 16 of these Regulations, publish news information from unlawful sources, carry news content they gathered and edited themselves or distort the content of original news information, the State Council or provincial, autonomous region or municipal People’s Government Information Offices, on the basis of their respective powers, order rectification, issue a warning, and impose an additional fine of 5.000 Yuan or more but less than 30.000 Yuan.

Where, in violation of the provisions of Article 16 of these Regulations, the source of news information is not clearly indicated, the State Council or provincial, autonomous region or municipal People’s Government Information Offices, on the basis of their respective powers, order rectification, issue a warning, and impose an additional fine of 5.000 Yuan or more but less than 20.000 Yuan.

Article 29: Where one of the following acts violating these Regulations take place, the State Council Information Office or provincial, autonomous region or municipal People’s Government Information Offices, on the basis of their respective powers, order rectification, issue a warning, and may impose an additional fine of 30.000 Yuan or less:

(1) not having carried out filing duties;

(2) not having carried out reporting duties

(3) not having carried out duties of recording, record preservation or provision.

Article 30: Where news information is provided to work units without an Internet news information service permit, in violation of Clause (2), Article 17 of these Regulations, the responsible person in charge and other directly responsible personnel will be subject to administrative punishment according to the law.

Article 31: Where work personnel in the State Council Information Office, all provincial, autonomous region or municipal People’s Government Information Offices as well as telecommunications controlling departments neglect their duties, abuse their powers or engage in favouritism, resulting in grave consequences and constituting a crime, criminal liability will be prosecuted according to the law; where it does not constitute a crime, the responsible person in charge and other directly responsible personnel will be subject to administrative punishment according to the law.

Chapter VI: Supplementary provisions

Article 32: News work unit as mentioned in these regulations refers to newspaper publishers, radio stations, television stations and news agencies established according to the law; specifically, Central news units include the news work units established by all departments of Centre and State organs.

Article 33: These Regulations take effect on the date of promulgation.

互联网新闻信息服务管理规定

第一章 总 则

第一条 为了规范互联网新闻信息服务,满足公众对互联网新闻信息的需求,维护国家安全和公共利益,保护互联网新闻信息服务单位的合法权益,促进互联网新闻信息服务健康、有序发展,制定本规定。

第二条 在中华人民共和国境内从事互联网新闻信息服务,应当遵守本规定。

本规定所称新闻信息,是指时政类新闻信息,包括有关政治、经济、军事、外交等社会公共事务的报道、评论,以及有关社会突发事件的报道、评论。

本规定所称互联网新闻信息服务,包括通过互联网登载新闻信息、提供时政类电子公告服务和向公众发送时政类通讯信息。

第三条 互联网新闻信息服务单位从事互联网新闻信息服务,应当遵守宪法、法律和法规,坚持为人民服务、为社会主义服务的方向,坚持正确的舆论导向,维护国家利益和公共利益。

国家鼓励互联网新闻信息服务单位传播有益于提高民族素质、推动经济发展、促进社会进步的健康、文明的新闻信息。

第四条 国务院新闻办公室主管全国的互联网新闻信息服务监督管理工作。省、自治区、直辖市人民政府新闻办公室负责本行政区域内的互联网新闻信息服务监督管理工作。

第二章 互联网新闻信息服务单位的设立

第五条 互联网新闻信息服务单位分为以下三类:

(一)新闻单位设立的登载超出本单位已刊登播发的新闻信息、提供时政类电子公告服务、向公众发送时政类通讯信息的互联网新闻信息服务单位;

(二)非新闻单位设立的转载新闻信息、提供时政类电子公告服务、向公众发送时政类通讯信息的互联网新闻信息服务单位;

(三)新闻单位设立的登载本单位已刊登播发的新闻信息的互联网新闻信息服务单位。

根据《国务院对确需保留的行政审批项目设定行政许可的决定》和有关行政法规,设立前款第(一)项、第(二)项规定的互联网新闻信息服务单位,应当经国务院新闻办公室审批。

设立本条第一款第(三)项规定的互联网新闻信息服务单位,应当向国务院新闻办公室或者省、自治区、直辖市人民政府新闻办公室备案。

第六条 新闻单位与非新闻单位合作设立互联网新闻信息服务单位,新闻单位拥有的股权不低于51%的,视为新闻单位设立互联网新闻信息服务单位;新闻单位拥有的股权低于51%的,视为非新闻单位设立互联网新闻信息服务单位。

第七条 设立本规定第五条第一款第(一)项规定的互联网新闻信息服务单位,应当具备下列条件:

(一)有健全的互联网新闻信息服务管理规章制度;

(二)有5名以上在新闻单位从事新闻工作3年以上的专职新闻编辑人员;

(三)有必要的场所、设备和资金,资金来源应当合法。

可以申请设立前款规定的互联网新闻信息服务单位的机构,应当是中央新闻单位,省、自治区、直辖市直属新闻单位,以及省、自治区人民政府所在地的市直属新闻单位。

审批设立本条第一款规定的互联网新闻信息服务单位,除应当依照本条规定条件外,还应当符合国务院新闻办公室关于互联网新闻信息服务行业发展的总量、结构、布局的要求。

第八条 设立本规定第五条第一款第(二)项规定的互联网新闻信息服务单位,除应当具备本规定第七条第一款第(一)项、第(三)项规定条件外,还应当有10名以上专职新闻编辑人员;其中,在新闻单位从事新闻工作3年以上的新闻编辑人员不少于5名。

可以申请设立前款规定的互联网新闻信息服务单位的组织,应当是依法设立2年以上的从事互联网信息服务的法人,并在最近2年内没有因违反有关互联网信息服务管理的法律、法规、规章的规定受到行政处罚;申请组织为企业法人的,注册资本应当不低于1000万元人民币。

审批设立本条第一款规定的互联网新闻信息服务单位,除应当依照本条规定条件外,还应当符合国务院新闻办公室关于互联网新闻信息服务行业发展的总量、结构、布局的要求。

第九条 任何组织不得设立中外合资经营、中外合作经营和外资经营的互联网新闻信息服务单位。

互联网新闻信息服务单位与境内外中外合资经营、中外合作经营和外资经营的企业进行涉及互联网新闻信息服务业务的合作,应当报经国务院新闻办公室进行安全评估。

第十条 申请设立本规定第五条第一款第(一)项、第(二)项规定的互联网新闻信息服务单位,应当填写申请登记表,并提交下列材料:

(一)互联网新闻信息服务管理规章制度;

(二)场所的产权证明或者使用权证明和资金的来源、数额证明;

(三)新闻编辑人员的从业资格证明。

申请设立本规定第五条第一款第(一)项规定的互联网新闻信息服务单位的机构,还应当提交新闻单位资质证明;申请设立本规定第五条第一款第(二)项规定的互联网新闻信息服务单位的组织,还应当提交法人资格证明。

第十一条 申请设立本规定第五条第一款第(一)项、第(二)项规定的互联网新闻信息服务单位,中央新闻单位应当向国务院新闻办公室提出申请;省、自治区、直辖市直属新闻单位和省、自治区人民政府所在地的市直属新闻单位以及非新闻单位应当通过所在地省、自治区、直辖市人民政府新闻办公室向国务院新闻办公室提出申请。

通过省、自治区、直辖市人民政府新闻办公室提出申请的,省、自治区、直辖市人民政府新闻办公室应当自收到申请之日起20日内进行实地检查,提出初审意见报国务院新闻办公室;国务院新闻办公室应当自收到初审意见之日起40 日内作出决定。向国务院新闻办公室提出申请的,国务院新闻办公室应当自收到申请之日起40 日内进行实地检查,作出决定。批准的,发给互联网新闻信息服务许可证;不批准的,应当书面通知申请人并说明理由。

第十二条 本规定第五条第一款第(三)项规定的互联网新闻信息服务单位,属于中央新闻单位设立的,应当自从事互联网新闻信息服务之日起1个月内向国务院新闻办公室备案;属于其他新闻单位设立的,应当自从事互联网新闻信息服务之日起1个月内向所在地省、自治区、直辖市人民政府新闻办公室备案。

办理备案时,应当填写备案登记表,并提交互联网新闻信息服务管理规章制度和新闻单位资质证明。

第十三条 互联网新闻信息服务单位依照本规定设立后,应当依照有关互联网信息服务管理的行政法规向电信主管部门办理有关手续。

第十四条 本规定第五条第一款第(一)项、第(二)项规定的互联网新闻信息服务单位变更名称、住所、法定代表人或者主要负责人、股权构成、服务项目、网站网址等事项的,应当向国务院新闻办公室申请换发互联网新闻信息服务许可证。根据电信管理的有关规定,需报电信主管部门批准或者需要电信主管部门办理许可证或者备案变更手续的,依照有关规定办理。

本规定第五条第一款第(三)项规定的互联网新闻信息服务单位变更名称、住所、法定代表人或者主要负责人、股权构成、网站网址等事项的,应当向原备案机关重新备案;但是,股权构成变更后,新闻单位拥有的股权低于51%的,应当依照本规定办理许可手续。根据电信管理的有关规定,需报电信主管部门批准或者需要电信主管部门办理许可证或者备案变更手续的,依照有关规定办理。

第三章 互联网新闻信息服务规范

第十五条 互联网新闻信息服务单位应当按照核定的服务项目提供互联网新闻信息服务。

第十六条 本规定第五条第一款第(一)项、第(二)项规定的互联网新闻信息服务单位,转载新闻信息或者向公众发送时政类通讯信息,应当转载、发送中央新闻单位或者省、自治区、直辖市直属新闻单位发布的新闻信息,并应当注明新闻信息来源,不得歪曲原新闻信息的内容。

本规定第五条第一款第(二)项规定的互联网新闻信息服务单位,不得登载自行采编的新闻信息。

第十七条 本规定第五条第一款第(一)项、第(二)项规定的互联网新闻信息服务单位转载新闻信息,应当与中央新闻单位或者省、自治区、直辖市直属新闻单位签订书面协议。中央新闻单位设立的互联网新闻信息服务单位,应当将协议副本报国务院新闻办公室备案;其他互联网新闻信息服务单位,应当将协议副本报所在地省、自治区、直辖市人民政府新闻办公室备案。

中央新闻单位或者省、自治区、直辖市直属新闻单位签订前款规定的协议,应当核验对方的互联网新闻信息服务许可证,不得向没有互联网新闻信息服务许可证的单位提供新闻信息。

第十八条 中央新闻单位与本规定第五条第一款第(二)项规定的互联网新闻信息服务单位开展除供稿之外的互联网新闻业务合作,应当在开展合作业务10日前向国务院新闻办公室报告;其他新闻单位与本规定第五条第一款第(二)项规定的互联网新闻信息服务单位开展除供稿之外的互联网新闻业务合作,应当在开展合作业务10日前向所在地省、自治区、直辖市人民政府新闻办公室报告。

第十九条 互联网新闻信息服务单位登载、发送的新闻信息或者提供的时政类电子公告服务,不得含有下列内容:

(一)违反宪法确定的基本原则的;

(二)危害国家安全,泄露国家秘密,颠覆国家政权,破坏国家统一的;

(三)损害国家荣誉和利益的;

(四)煽动民族仇恨、民族歧视,破坏民族团结的;

(五)破坏国家宗教政策,宣扬邪教和封建迷信的;

(六)散布谣言,扰乱社会秩序,破坏社会稳定的;

(七)散布淫秽、色情、赌博、暴力、恐怖或者教唆犯罪的;

(八)侮辱或者诽谤他人,侵害他人合法权益的;

(九)煽动非法集会、结社、游行、示威、聚众扰乱社会秩序的;

(十)以非法民间组织名义活动的;

(十一)含有法律、行政法规禁止的其他内容的。

第二十条 互联网新闻信息服务单位应当建立新闻信息内容管理责任制度。不得登载、发送含有违反本规定第三条第一款、第十九条规定内容的新闻信息;发现提供的时政类电子公告服务中含有违反本规定第三条第一款、第十九条规定内容的,应当立即删除,保存有关记录,并在有关部门依法查询时予以提供。

第二十一条 互联网新闻信息服务单位应当记录所登载、发送的新闻信息内容及其时间、互联网地址,记录备份应当至少保存60日,并在有关部门依法查询时予以提供。

第四章 监督管理

第二十二条 国务院新闻办公室和省、自治区、直辖市人民政府新闻办公室,依法对互联网新闻信息服务单位进行监督检查,有关单位、个人应当予以配合。

国务院新闻办公室和省、自治区、直辖市人民政府新闻办公室的工作人员依法进行实地检查时,应当出示执法证件。

第二十三条 国务院新闻办公室和省、自治区、直辖市人民政府新闻办公室,应当对互联网新闻信息服务进行监督;发现互联网新闻信息服务单位登载、发送的新闻信息或者提供的时政类电子公告服务中含有违反本规定第三条第一款、第十九条规定内容的,应当通知其删除。互联网新闻信息服务单位应当立即删除,保存有关记录,并在有关部门依法查询时予以提供。

第二十四条 本规定第五条第一款第(一)项、第(二)项规定的互联网新闻信息服务单位,属于中央新闻单位设立的,应当每年在规定期限内向国务院新闻办公室提交年度业务报告;属于其他新闻单位或者非新闻单位设立的,应当每年在规定期限内通过所在地省、自治区、直辖市人民政府新闻办公室向国务院新闻办公室提交年度业务报告。

国务院新闻办公室根据报告情况,可以对互联网新闻信息服务单位的管理制度、人员资质、服务内容等进行检查。

第二十五条 互联网新闻信息服务单位应当接受公众监督。

国务院新闻办公室应当公布举报网站网址、电话,接受公众举报并依法处理;属于其他部门职责范围的举报,应当移交有关部门处理。

第五章 法律责任

第二十六条 违反本规定第五条第二款规定,擅自从事互联网新闻信息服务,或者违反本规定第十五条规定,超出核定的服务项目从事互联网新闻信息服务的,由国务院新闻办公室或者省、自治区、直辖市人民政府新闻办公室依据各自职权责令停止违法活动,并处1万元以上3万元以下的罚款;情节严重的,由电信主管部门根据国务院新闻办公室或者省、自治区、直辖市人民政府新闻办公室的书面认定意见,按照有关互联网信息服务管理的行政法规的规定停止其互联网信息服务或者责令互联网接入服务者停止接入服务。

第二十七条 互联网新闻信息服务单位登载、发送的新闻信息含有本规定第十九条禁止内容,或者拒不履行删除义务的,由国务院新闻办公室或者省、自治区、直辖市人民政府新闻办公室给予警告,可以并处1万元以上3万元以下的罚款;情节严重的,由电信主管部门根据有关主管部门的书面认定意见,按照有关互联网信息服务管理的行政法规的规定停止其互联网信息服务或者责令互联网接入服务者停止接入服务。

互联网新闻信息服务单位登载、发送的新闻信息含有违反本规定第三条第一款规定内容的,由国务院新闻办公室或者省、自治区、直辖市人民政府新闻办公室依据各自职权依照前款规定的处罚种类、幅度予以处罚。

第二十八条 违反本规定第十六条规定,转载来源不合法的新闻信息、登载自行采编的新闻信息或者歪曲原新闻信息内容的,由国务院新闻办公室或者省、自治区、直辖市人民政府新闻办公室依据各自职权责令改正,给予警告,并处5000元以上3万元以下的罚款。

违反本规定第十六条规定,未注明新闻信息来源的,由国务院新闻办公室或者省、自治区、直辖市人民政府新闻办公室依据各自职权责令改正,给予警告,可以并处5000元以上2万元以下的罚款。

第二十九条 违反本规定有下列行为之一的,由国务院新闻办公室或者省、自治区、直辖市人民政府新闻办公室依据各自职权责令改正,给予警告,可以并处3万元以下的罚款:

(一)未履行备案义务的;

(二)未履行报告义务的;

(三)未履行记录、记录备份保存或者提供义务的。

第三十条 违反本规定第十七条第二款规定,向没有互联网新闻信息服务许可证的单位提供新闻信息的,对负有责任的主管人员和其他直接责任人员依法给予行政处分。

第三十一条 国务院新闻办公室和省、自治区、直辖市人民政府新闻办公室以及电信主管部门的工作人员,玩忽职守、滥用职权、徇私舞弊,造成严重后果,构成犯罪的,依法追究刑事责任;尚不构成犯罪的,对负有责任的主管人员和其他直接责任人员依法给予行政处分。

第六章 附 则

第三十二条 本规定所称新闻单位是指依法设立的报社、广播电台、电视台和通讯社;其中,中央新闻单位包括中央国家机关各部门设立的新闻单位。

第三十三条 本规定自公布之日起施行
