All provincial, autonomous region and municipal Party Committee Propaganda Departments, telecommunications management bureaus, information offices, education offices (education commissions), cultural offices (bureaus), public security offices (bureaus), national security offices (bureaus), radio, film and television bureaus, press and publications bureaus, secrecy preservation bureaus, administrative industry and commerce management bureaus, food and drug supervision and management bureaus (drug supervision and management bureaus):
On the basis of the uniform deployment of the Centre, relevant departments launched joint and concentrated clean-up and rectification work of Internet sites between November 2004 and June 2005. In this concentrated campaign, all departments resolutely grasped implementation according to the “Plan for the Centralized Launch of Internet Site Clean-Up and Rectification Work”, acted vigorously, cooperated closely, accumulated certain experiences in coordinated work, and laid a firm basis for further doing daily supervision and management work of the Internet well.
In order to realistically do Internet site management work well, strengthen coordination between relevant Internet management departments, and establish long-term mechanisms for Internet management work, the CCP Central Committee Propaganda Department, the Ministry of Information Industry, the State Council Information Office, the Ministry of Education, the Ministry of Culture, the Ministry of Hygiene, the Ministry of Public Security, the Ministry of National Security, the Ministry of Commerce, the State Administration of Radio, Film and Television, the General Administration of Press and Publications, the State Secret Preservation Bureau, the State Administration of Industry and Commerce, the State Food and Drug Supervision and Management Bureau, the Chinese Academy of Science and the General Staff Headquarters Telecommunications Department have jointly formulated the “Coordinated Work Plan for Internet Site Management”, this is hereby issued to you, please obey and implement it.

Coordinated Work Plan for Internet Site Management
In order to implement the spirit of the CCP Central Committee Secretariat and State Council Secretariat opinions concerning further strengthening Internet management work, realistically do Internet management work well, strengthen coordination and cooperation between relevant Internet management departments, the CCP Central Committee Propaganda Department, the Ministry of Information Industry, the State Council Information Office, the Ministry of Education, the Ministry of Culture, the Ministry of Hygiene, the Ministry of Public Security, the Ministry of National Security, the Ministry of Commerce, the State Administration of Radio, Film and Television, the General Administration of Press and Publications, the State Secret Preservation Bureau, the State Administration of Industry and Commerce, the State Food and Drug Supervision and Management Bureau, the Chinese Academy of Science and the General Staff Headquarters Telecommunications Department have jointly formulated the following coordinated work plan for Internet site management:
I, Establish daily coordination structures, realistically strengthen Internet site management communication and coordination
During the period in which concentrated clean-up and rectification work of Internet sites was launched, relevant State departments jointly established the “Nationwide Small Work Coordination Group for the Concentrated Launching of Internet Site Clean-up and Rectification”, after this work stage concluded, it was restructures as the “Nationwide Small Work Coordination Group for Internet Site Management” (simply named Nationwide Small Coordination Group”), of which the member units include: the Ministry of Information Industry, the State Council Information Office, the Ministry of Education, the Ministry of Culture, the Ministry of Hygiene, the Ministry of Public Security, the Ministry of National Security, the Ministry of Commerce, the State Administration of Radio, Film and Television, the General Administration of Press and Publications, the State Secret Preservation Bureau, the State Administration of Industry and Commerce, the State Food and Drug Supervision Bureau, the Chinese Academy of Science and the General Staff Headquarters Telecommunications Department. The Nationwide Small Coordination Group is responsible for the coordination of nationwide daily Internet site management work, and for guiding and coordinating all member work units in implementing the grasping and management of Internet sited together. The Nationwide Small Coordination Group office is set up inside the Ministry of Information Industry.
All provinces (autonomous regions, municipalities) are to restructure the leading small groups for the concentrated launch of Internet site clean-up and rectification work in their administrative areas into small work coordination groups for Internet site management in their administrative areas (simply named provincial-level small coordination groups), member work units include: provincial (autonomous region, municipal) Party Committee propaganda departments, telecommunications management bureaus, information offices, education offices (education committees), cultural offices (bureaus), hygiene offices (bureaus), public security offices (bureaus), national security offices (bureaus), radio, film and television bureaus, press and publications bureaus, secrecy preservation bureaus, administrative industry and commerce management bureaus, food and drug supervision and management bureaus (drug supervision and management bureaus). Provincial-level small coordination groups are responsible for the coordination and guidance of daily Internet site management work in their administration. Provincial-level small coordination group offices are set up in the provincial (autonomous region, municipal) telecommunications management bureau.
All levels’ small coordination group offices are responsible for the communication between the member work units within the small group, and for coordinating work, they are responsible for regularly convening joint conferences, communicating situations, researching issues, supervising the implementation of work processes, timely determining and reporting major matters, and establishing channels for daily work coordination and information communication for the member units of the small coordination groups. Small coordination group member work units shall appoint responsible persons (bureau level) and liaison officers (departmental level), who are responsible for daily Internet site management work as well as daily contact and communication work with the small coordination group office, they shall also report the contact method of the responsible person and liaison person (including their names, departments, posts, contact telephone number, fax, e-mail and other such information) to the small coordination group office. If it happens that personnel are changed, this shall be timely notified to the same level’s small coordination group office. The coordination group office is responsible for collecting and updating the abovementioned information, and timely notifying all member work units.
II, Implementing Internet site management duties, forming joint management forces
Under the uniform coordination of small coordination groups, Internet sector departments (the Ministry of Information Industry), special content controlling departments (including the State Council Information Office, the Ministry of Education, the Ministry of Culture, the Ministry of Health, the Ministry of Public Security, the Ministry of National Security, the Ministry of Commerce, the State Administration of Radio, Film and Television, the General Administration of Press and Publications, the State Secrecy Preservation Bureau, etc.), preliminary examination and approval departments (including the State Council Information Office, the Ministry of Education, the Ministry of Culture, the Ministry of Hygiene, the State Administration of Radio, Film and Television, the General Administration of Press and Publications, the State Food and Drug Supervision Bureau, etc.), public interest-type interconnection work unit controlling departments (the Ministry of Education, the Ministry of Commerce, the Chinese Academy of Science, the General Staff Headquarters Telecommunications Department, etc.), and enterprise registration controlling departments (the State Administration of Industry and Commerce) shall earnestly implement Internet site management duties, strengthen communication, tighten cooperation, and at the same time as giving rein to the role of the duties of each department, strengthen information circulation and joint management actions, all departments that discover websites violating laws and regulations, or harmful information will, at the same time as investigating and prosecuting this according to the law, timely notify the small coordination group’s corresponding member work units, the corresponding member work unit will vigorously provide cooperation, form joint management forces, and implement joint grasping and joint management of websites.
The CCP Central Committee Propaganda Department conducts macro-level coordination and guidance over ideological work on the Internet.
Internet sector controlling departments are responsible for Internet sector management work, concretely undertaking Internet site management coordination work, carrying out daily sectoral supervision and management of basic telecommunications operators, Internet access service providers, Internet information service providers and domain name registration service organs, and for guiding the work of Internet sectoral associations.
Preliminary examination and approval departments are responsible for the preliminary examination and approval of the Internet information services of which they are in charge, conducting supervision, examination and verification of corresponding website content, and providing annual examination opinions to the Internet sector controlling department. Ministry-level preliminary examination and approval departments shall clarify examination and approval categories, complete examination and approval procedures, establish daily supervision and management rules for website content, and notify the Ministry of Information Industry about the departments and personnel responsible for nationwide examination and approval work and contact methods (names, telecommunications addresses, post codes), if changes occur, these are to be reported timely.
The State Council Information Office is responsible for Internet ideology work, concretely coordinating Internet ideology management, and comprehensive online management of the propaganda and culture system. Public security organs are responsible for Internet site security supervision, investigating, prosecuting and attacking online violations of laws and regulations according to the law; national security organs are responsible for conducting supervision and inspection of Internet site content that involves national security matters. Public security organs, national security organs and secrecy preservation work controlling departments provide annual examination opinions.
Public interest-type interconnection work unit controlling departments are responsible for daily supervision and management of public interest-type interconnection work units under their jurisdictions (including the China Education and Scientific Research Computer Network, the China International Economic and Trade Network, the China Science and Technology Network, the China Long Wall Network and other such public interest-type interconnection network operation and maintenance work units). Public interest-type interconnection work unit controlling departments shall, strictly according to the requirements of “who is in charge is responsible”, realistically bear responsibility for the management of public interest-type interconnection work units, supervise their subordinate public interest-type interconnection work units to implement corresponding Internet access service duties and responsibilities, and coordinate with the Internet sector controlling departments and special content controlling departments to implement management over the websites that are accessed through their interconnection networks.
III, Rationalizing website management work chains and workflows, tightening departmental coordination
Under the uniform coordination of the small coordination groups, effective Internet site management chains and workflow are to established and perfected between Internet sector controlling departments, preliminary examination and approval departments, special content controlling departments, public interest-type interconnection work unit controlling departments as well as enterprise registration controlling departments, and workflows for preliminary examination and approval, the investigation and prosecution of websites that break laws or regulations, annual inspection, for public interest-type interconnection controlling departments to manage websites, inquire about website information, etc., relevant departments shall earnestly implement work flows that have been commonly formulated, cooperate closely, make concerted and coordinated efforts, and realistically do Internet site management work well.
(1) Preliminary examination and approval workflows
1, Those planning to engage in news, publishing, education, healthcare, drug and medical treatment, culture, audiovisual programme (including film and television-type audiovisual products) and other such Internet information service, shall undergo examination and approval by the corresponding preliminary examination and approval department.
2, Before website operators carry out commercial Internet information service permit or non-commercial Internet information service filing with the Internet sector controlling department, they shall submit corresponding examination and approval materials to the provincial-level or ministerial-level preliminary examination and approval department.
3, After preliminary examination and approval documents receive the application materials submitted by website operators, they make a decision of approval, non approval or that preliminary examination and approval is not required within the statutory time limits.
4, After website operators who plan to engage in non-commercial Internet information services obtain approval from preliminary examination and approval departments, they are to carry out filing formalities through the “Ministry of Information Industry ICP/IP Address Information Filing and Management System” (hereafter simply named Filing and Management System”, URL: http://www.miibeian.gov.cn), and must at the same time submit examination, verification and agreement documents of the corresponding preliminary examination and approval departments to the local provincial (autonomous region, municipal) telecommunications management bureau of their locality (the residence indicated on a natural person’s identity card or where a legal person is registered) in writing; after website operators who plan to engage in commercial Internet information services obtain approval from preliminary examination and approval departments, they carry out commercial permit formalities with the corresponding provincial (autonomous region, municipal) telecommunications management bureaus or the Ministry of Information Industry.
5, After provincial (autonomous region, municipal) telecommunications management bureaus receive filing information and relevant preliminary approval materials submitted by website operators, they shall carry out filing formalities within the statutory time limit, where filing is granted, an electronic filing certification mark and filing number are issued timely; where provincial (autonomous region, municipal) telecommunications management bureaus or the Ministry of Information Industry permits operations, the corresponding website operator’s information will be timely listed in the “Filing and Management System”, and electronic permit certification marks are issued.
6, Internet sector controlling departments publish a list of names of website operators that have obtained commercial permits or have been filed through the “Filing and Management System” in a categorized manner, according to the preliminary examination and approval files.
7, Industry and commerce departments handle corresponding registration or commercial scope modification formalities for commercial Internet information service providers, on the basis of Internet information service business permits issued by the Internet sector controlling departments.
Where the name, address, legal representative or website representative, service entry, website domain name, IP address or other such matters of website operators change, they must conduct modification formalities analogous to preliminary examination and verification workflows.
(2) Workflow for investigating and prosecuting websites that violate laws and regulations.
1, Special content controlling departments shall conduct examination of the Internet information service content subordinate to them.
2, Special content controlling departments shall conduct investigation and prosecution of websites that violate laws and regulations, and will, in view of the circumstances, notify the same level’s Internet sector controlling department about the investigation and prosecution results. In cases where the special content controlling department orders the cessation of provision of information services in excess of scope according to the law, and the website refuses cessation, the Internet sector controlling department notifies the corresponding access service provider or public interest-type interconnection work unit controlling department (public interest-type interconnection work unit controlling departments shall require their subordinate public interest-type interconnection work units) to cease their access services.
3, Where special content controlling departments require the Internet sector controlling department to cooperate in the cessation of access services, it may notify the same level’s Internet sector management department about the corresponding administrative punishment situation. Internet sector controlling departments cancel the business permit or filing of website operators on the basis of the situation reported by the special content controlling department, and notify the corresponding access service provider to cease access services, or notifies the public interest-type interconnection work unit controlling department, to require their subordinate public interest-type interconnection work unit to cease access services.
4, Where preliminary exanimation and approval departments cancel websites’ preliminary examination and approval business qualifications, they shall notify the relevant handling situation to the same level’s Internet sector controlling department. Internet sector controlling departments change website operators’ commercial permit entry or filing service entry on the basis of the situation reported by the preliminary examination and approval department, and report the modification of business permit service entries to the same level’s industry and commerce departments. Industry and commerce departments order commercial Internet information service providers to conduct registration modification or registration cancellation according to the law within a limited period.
5, Where Internet sector controlling department or special content controlling department suspect that a website violating laws or regulations has committed a crime, they shall submit it to the same level’s public security organ for handling.
(3) Workflows for annual examination
1, The Internet sector controlling department conducts annual examination of basic telecommunications operators, Internet access service providers, Internet information service providers and domain name registration organs according to the law.
2, Special content controlling departments are responsible for conducting annual examination of special content under their respective jurisdictions, and providing opinions about cases in which annual examination is not passed to the sector controlling department, a veto decision system is implemented.
3, Special content controlling departments’ annual examination opinions are to be divided into three categories: “passing annual examination”, “cancel special service qualifications” and “close websites”. Of these, “cancel special service qualifications” and “close websites” are considered opinions of not passing annual examination.
4, Special content controlling departments shall first conduct investigation and prosecution of websites about which an opinion of not passing annual examination has been issued, and will report the investigation and prosecution situation to the same level’s Internet sector controlling department according to the law.
5-1 Preliminary examination and approval departments shall put forward opinions of not passing annual examination by differentiating different situations:
(I) Concerning Internet sites that have already obtained preliminary examination and approval documents, an opinion of not passing annual examination, “cancelling special service qualifications” or “closing websites” shall be made according to the law.
(II) Websites who have not obtained corresponding preliminary examination and approval documents, and who provide information services in excess of their scope, are to be investigated and prosecuted according to the law. Websites that refuse to carry out supplementary preliminary examination and approval procedures or that refuse to rectify their act violating laws or regulations, are issued with an opinion of not passing annual examination of “closing websites”.
5-2, Where public security organs, national security organs and state secret preservation controlling departments put forward an opinion of not passing annual examination concerning a website, they shall report the relevant examination and prosecution situation to the same level’s Internet sector controlling department according to the law.
6, The Internet sector controlling department shall deal with opinions of not passing annual examination provided by special content controlling departments in the following manner:
(1) where the annual examination opinion is “cancel special service qualifications”, the business permit entry or filing service entry is changed according to the law;
(2) where the annual examination opinion is “close websites”, their business permit or filing is cancelled according to the law, their access is terminated through the corresponding access provider, or the public interest-type interconnection work unit controlling department is notified and required to cease access to the public interest-type interconnection work unit under their jurisdiction, at the same time, the handling situation is reported to the same level’s Industry and Commerce department.
7, Industry and commerce departments order commercial Internet information service providers to conduct registration modification or conduct cancellation of registration according to the law, on the basis of the situation reported by the Internet sector controlling department.
8, The Internet sector controlling department timely reports the handling results of the annual examination to the relevant departments at the same level.
(4) Workflows for website management work by public interest-type interconnection work unit controlling departments
1, Public-interest-type interconnection work unit controlling departments shall strengthen supervision and inspection over the access service activities of the public interest type interconnection work units under their jurisdiction. Public interest-type interconnection work units shall strictly abide by relevant state regulations, and may not provide Internet access services to telecommunications business operators who have not obtained licences, or website operators who have not carried out filing procedures. Public interest-type work unit controlling departments impose administrative punishment on public interest-type interconnection work units who violate regulations.
2, Public interest-type interconnection work unit controlling departments shall require the public interest-type interconnection work units under their jurisdiction to record the filing information of the website operators for which they provide access, earnestly examine and verify, and dynamically update the filing information of website operators, guarantee the truth, completeness and integrity of filing information, and supervise and guide Internet sites that have already filed to clearly indicate their filing number according to regulations, and to download and install electronic filing symbol files.
3, Public interest-type interconnection work units’ controlling departments shall request their subordinate public interest-type interconnection work units to vigorously cooperate and assisted the Internet sector controlling department and special content controlling departments to investigate and prosecute websites violating laws and regulations according to the law.
(5) Workflows for inquiring about website information
1, The Internet sector controlling department provides convenient conditions to special content controlling departments to inquire about website information, and provides network inquiry conditions as soon as possible.
2, Preliminary examination and approval departments, and special content controlling departments provide a letter to the same level’s Internet sector controlling department, requiring them to cooperate concerning website information.
3, The Internet sector controlling department launches inquiries through the “filing information system”, timely feeds the inquiry results made according to the inquiry request to the corresponding departments, large-quantity enquiries are fed back in the form of electronic data.

互联网站管理协调工作方案
为了贯彻落实中共中央办公厅,国务院办公厅关于进一步加强互联网管理工作的意见精神,切实做好互联网站管理工作,加强互联网管理相关部门之间协调配合,中共中央宣传部、信息产业部、国务院新闻办公室、教育部、文化部、卫生部、公安部、国家安全部、商务部、国家广播电影电视总局、新闻出版总署、国家保密局、国家工商行政管理总局、国家食品药品监督管理局、中国科学院、总参谋部通信部联合制定互联网站管理协调工作方案如下:
一、建立日常协调体制,切实加强互联网站管理沟通协调
在集中开展互联网站清理整顿工作期间,国家有关部门联合成立的“全国集中开展互联网站清理整顿工作协调小组”,在此项工作阶段性结束后,调整为“全国互联网站管理工作协调小组”(简称全国协调小组),成员单位包括:信息产业部、国务院新闻办公室、教育部、文化部、卫生部、公安部、国家安全部、商务部、国家广播电影电视总局、新闻出版总署、国家保密局、国家工商行政管理总局、国家食品药品监督管理局、中国科学院、总参谋部通信部。全国协调小组负责全国互联网站日常管理工作的协调,指导,协调各成员单位对互联网站实施齐抓共管。全国协调小组办公室设在信息产业部。
各省(自治区、直辖市)将本行政区集中开展互联网站清理整顿工作领导小组同步调整为本行政区互联网站管理工作协调小组(简称省级协调小组),成员单位包括:省(自治区、直辖市)党委宣传部、通信管理局、新闻办、教育厅(教委)、文化厅(局)、卫生厅(局)、公安厅(局)、国家安全厅(局)、广播影视局、新闻出版局、保密局、工商行政管理局、食品药品监督管理局(药品监督管理局)。省级协调小组负责本行政区互联网站日常管理工作的协调,指导。省级协调小组办公室设在省(自治区、直辖市)通信管理局。
各级协调小组办公室负责小组内各成员单位间沟通,协调工作,负责定期召集联席会议,通报情况,研究问题,监督落实工作流程,及时确定上报重大事项,建立协调小组各成员单位日常工作协调和信息沟通渠道。协调小组各成员单位日常工作协调和信息沟通渠道。协调小组各成员单位应当指定负责人(局级),联络员(处级),负责网站管理日常工作以及与协调小组办公室的日常联系和沟通工作,并将负责人,联络员的联系方式(包括姓名、所在部门、职务、联系电话、传真、电子邮箱等信息)报同级协调小组办公室。如遇人员调整,应及时通报同级协调小组办公室。协调小组办公室负责对上述信息汇总、更新,并及时通报各成员单位。
二、落实互联网站管理职责,形成管理合力
在协调小组统一协调下,互联网行业部门(信息产业部),专项内容主管部门(包括国务院新闻办公室、教育部、文化部、卫生部、公安部、国家安全部、商务部、国家广播电影电视总局、新闻出版总署、国家保密局等),前置审批部门(包括国务院新闻办公室、教育部、文化部、卫生部、国家广播电影电视总局、新闻出版总署、国家食品药品监督管理局等),公益性互联单位主管部门(教育部、商务部、中国科学院、总参谋部通信部等),企业登记主管部门(国家工商行政管理总局)应认真落实互联网站管理职责,加强沟通,密切合作,在发挥各部门职能作用的同时,加强信息通报和管理联动,各部门发现违法违规网站和有害信息,在依法查处的同时,及时通报协调小组相关成员单位,相关成员单位积极予以配合,形成管理合力,对网站实施齐抓共管。
中央中央宣传部对互联网意识形态工作进行宏观协调和指导。
互联网行业主管部门负责互联网行业管理工作。具体承担互联网站管理协调工作,依法对基础电信运营商,互联网接入服务提供商,互联网信息服务提供者,域名注册服务机构进行日常行业监管,指导互联网行业协会工作。
前置审批部门负责互联网信息服务各自主管服务项目的前置审批,对网站相关专项内容进行监督检查和审核,并向同级互联网行业主管部门提供年度审核意见。部级前置审批部门应当明确审批范畴,健全审批流程,建立网站内容日常监督管理办法,并将全国负责前置审批工作的部门、人员、联系方式(名称、通信地址、邮政编码)等通报信息产业部,如遇变动应及时通报。
国务院新闻办公室负责互联网上意识形态工作,具体协调互联网意识形态管理,统筹宣传文化系统网上管理。公安机关负责互联网站安全监督,依法处罚和打击网上违法犯罪行为;国家安全机关负责对互联网站涉及国家安全事项的信息内容进行监督检查。公安机关,国家安全机关和国家保密工作主管部门提供年度审核意见。
公益性互联单位主管部门负责对所主管的公益性互联单位(包括中国教育和科研计算机网、中国国际经济贸易互联网、中国科学技术网、中国长城互联网等公益性互联网络运行维护单位)进行日常监管。公益性互联单位主管部门应严格按照“谁主管谁负责”的要求,切实承担起公益性互联单位的管理责任,督促所主管的公益性互联单位履行相关互联网接入服务的责任和义务,配合互联网行业主管部门和专项内容主管部门对接入其互联网络内的网站实施管理。
三、理顺网站管理工作衔接流程,密切部门协作
在协调小组统一协调下,互联网行业主管部门与前置审批部门、专项内容主管部门、公益性互联单位主管部门以及企业登记主管部门之间建立、完善有效的互联网站管理工作衔接流程,制定前置审批、查处违法违规网站、年度审核、公益性互联单位主管部门管理网站、查询网站信息等流程,各有关部门应按照共同制定的工作流程,认真执行、密切配合、通力协作,切实做好互联网站管理工作。
(一)前置审批流程
1、拟从事新闻、出版、教育、医疗保健、药品和医疗器械、文化、视听节目(包括影视类音像制品)等互联网信息服务,应当经过相关前置审批部门的批准。
2、网站主办者在向互联网行业主管部门办理经营性互联网信息服务经营许可或非经营性互联网信息服务备案之前,应根据有关规定向省级或部级前置审批部门提交相关申请材料。
3、前置审批部门收到网站主办者提交的申请材料后,在规定时限内做出批准、不予批准或者不需要前置审批的决定。
4、拟从事非经营性互联网信息服务的网站主办者取得前置审批部门批准后,登陆“信息产业部ICP/IP地址信息备案管理系统”(以下简称“备案管理系统”,网址是http://www.miibeian.gov.cn)履行备案手续,同时需向住所(自然人身份证住所或者法人注册住所)所在地省(自治区、直辖市)通信管理局书面提交相关前置审批部门审核同意的文件;拟从事经营性互联网信息服务的网站主办者取得前置审批部门批准后,按照有关规定向相关省(自治区、直辖市)通信管理局或者信息产业部办理经营许可手续。
5、省(自治区、直辖市)通信管理局收到网站主办者提交的备案信息和相关前置审批材料后,应在规定时限内为其办理备案手续,对予以备案的,及时发放备案电子验证标识和备案编号;省(自治区、直辖市)通信管理局或者信息产业部对许可经营的,及时向“备案管理系统”录入网站主办者相关信息,发放许可电子验证标识。
6、互联网行业主管部门通过“备案管理系统”按前置审批项目分类公布已取得经营许可或者已经备案的网站主办者名单。
7、工商部门根据互联网行业主管部门颁发的互联网信息服务经营许可,为经营性互联网信息服务提供者办理相关登记或经营范围变更手续。
网站主办者名称、住所、法定代表人或者网站负责人、服务项目、网站域名、IP地址等事项发生变更的,比照前置审核流程办理变更手续。
(二)查处违法违规网站流程
1、专项内容主管部门应依法对所主管的相关互联网信息服务内容进行检查。
2、专项内容主管部门应依法对违法违规网站进行查处,视情节将查处结果通报同级互联网行业主管部门。对专项内容主管部门依法责令停止超范围提供信息服务而网站拒不停止的,互联网行业主管部门通知相关接入服务提供商或公益性互联单位主管部门(公益性互联单位主管部门应当要求所主管的公益性互联单位)停止其接入服务。
3、专项内容主管部门要求互联网行业主管部门配合停止接入服务的,可以向同级互联网行业主管部门通报有关行政处罚情况。互联网行业主管部门根据专项内容主管部门通报的情况,注销网站主办者的经营许可或备案,并通知相关接入服务提供商停止接入服务,或通知公益性互联单位主管部门要求所主管的公益性互联单位停止接入服务。
4、前置审批部门取消网站前置审批业务资格的,应向同级互联网行业主管部门通报有关处理情况。互联网行业主管部门根据前置审批部门的通报情况,变更网站主办者经营许可服务项目或备案服务项目,并向同级工商部门通报有关变更经营许可服务项目情况。工商部门根据互联网行业主管部门的通报情况,责令经营性互联网信息服务提供者限期办理变更登记或依法办理注销登记。
5、互联网行业主管部门、专项内容主管部门对违法违规网站涉嫌犯罪的,移交同级公安机关处理。
(三)年度审核流程
1、互联网行业主管部门依法对基础电信运营商、互联网接入服务提供商、互联网信息服务提供者、域名注册服务机构进行年度审核。
2、专项内容主管部门负责对各自主管的专项内容进行年度审核,向行业主管部门提供年度审核不合格意见,实行一票否决制。
3、专项内容主管部门的年度审核意见分为“年度审核合格”“取消专项服务资格”、“关闭网站”三种。其中,“取消专项服务资格”、“关闭网站”属于年度审核不合格意见。
4、专项内容主管部门应当对出具年度审核不合格意见的网站先进行依法查处,并将依法查处情况通报同级互联网行业主管部门。
5—1、前置审批部门应区别不同情况提出年度审核不合格意见:
(1)对于已经取得前置审批文件的互联网站,应依法做出“取消专项服务资格”或“关闭网站”的年度审核不合格意见;
(2)对于未取得相应前置审批文件、超范围提供信息服务的网站,依法予以查处。对拒不补办前置审批手续或拒不纠正违法违规行为的网站,依法做出“关闭网站”的年度审核不合格意见。
5—2、公安机关、国家安全机关和国家保密工作主管部门对网站提出年度审核不合格意见的,应当向同级互联网行业主管部门通报有关依法查处情况。
6、联网行业主管部门对同级专项内容主管部门提供年度审核不合格意见的,应依法做出如下处理:
(1)对于年度审核意见为“取消专项服务资格”的,应依法变更经营许可服务项目或备案服务项目;
(2)对于年度审核意见为“关闭网站”的,应依法注销其经营许可证或备案,并通知相关接入服务提供商停止接入,或者通知公益性互联单位主管部门要求其所主管的公益性互联单位停止接入,同时向同级工商部门通报处理情况。
7、工商部门根据互联网行业主管部门的通报情况,责令经营性互联网信息服务提供者限期办理变更登记或依法办理注销登记。
8、互联网行业主管部门应及时向同级有关部门通报年度审核的处理结果。
(四)公益性互联单位主管部门网站管理工作流程
1、公益性互联单位主管部门应对所主管的公益性互联单位的接入服务行为加强监督检查。公益性互联单位应严格遵守国家有关规定,不得为未取得电信业务经营许可或者未履行备案手续的网站主办者提供互联网接入服务。公益性互联单位主管部门对违规的公益性互联单位予以行政处罚。
2、公益性互联单位主管部门应要求所主管的公益性互联单位记录所接入的网站主办者备案信息,对网站主办者的备案信息进行认真核实、动态更新,保证备案信息的真实、完整、准确,并督促、知道已经备案的互联网站按规定标明备案编号、下载安装备案电子标识文件。
3、公益性互联单位主管部门应要求所主管的公益性互联单位积极配合、协助互联网行业主管部门和专项内容主管部门对违法违规网站进行依法查处。
(五)查询网站信息流程
1、互联网行业主管部门向专项内容主管部门提供查询网站信息便利条件,并尽快提供联网查询条件。
2、前置审批部门、专项内容主管部门向同级互联网行业主管部门提供要求配合查询网站有关信息的函。
3、互联网行业主管部门通过“备案信息系统”开展查询,并及时按查询要求将查询结果反馈给相关部门,大批量查询以电子数据方式反馈。
