In order to strictly attack infringement and piracy activities, safeguard the cultural market business order, stimulate the flourishing and development of the audiovisual and computer software industries, according to our county’s laws, regulations and departmental rules concerning audiovisual and computer software products’ intellectual property rights protection aspects, the national ““Sweeping Pornography and Striking Illegality”” work small group office, Ministry of Culture, General Administration of Press and Publications, National Copyright Administration, State Administration of Industry and Commerce, Ministry of Public Security, Ministry of Construction and Ministry of Supervision have decided to, at the same time as continuing to strictly attack all sorts of illegal publishing activities, launch a nationwide campaign of about one hundred days to concentratedly attack activities of audiovisual and computer software product piracy (hereafter simply named “Anti-Piracy Hundred Days Campaign”). The relevant matters are announced as follows:

 

I, The “Anti-Piracy Hundred Days Campaign” shall focus on disciplining wholesale, retail, rental and screening work units and concentrated audiovisual and computer software product business venues engaging in pirated product business activities, ban peddlers and stalls, and unlicensed operators selling pirated audiovisual and computer software products, dig out illegal printing, reproduction and storage hideouts producing and selling pirated products, investigating and prosecuting punishing work units, and printing and reproduction enterprises participating in audiovisual and computer software piracy activities and gravely punishing criminals engaging in production or sale activities of pirated products.

 

II, From 15 July until 15 August 2006 is the announcement period, all audiovisual and computer software product business work unit develops self-examination and self-rectification activities in the light of relevant laws, regulations and departmental rules, submit pirated products to relevant administrative controlling authorities of their own accord and explain the situation. Within the announcement period, the liability of all those submitting pirated products and explaining the reasons of their own accord, shall not be investigated by relevant administrative controlling authorities.

 

III, From 16 August until 15 October 2006 is the concentrated discipline phase, all localities relevant aces launch lx inspections, strictly investigate and punish activities violating laws and regulations according to the law. Of business work units dealing in a quantity of less than 100 pirated audiovisual product discs at one time, administrative culture entities confiscate unlawful products, confiscate unlawful income, and impose a fine of more than 10.000 but less than 50.000 Yuan. Of business work units dealing in a quantity of less than 100 pirated computer software product discs at one time, administrative copyright entities confiscate unlawful products, confiscate unlawful income, and impose a fine of more than 10.000 but less than 50.000 Yuan. Of work units dealing in a quantity of 100 or more pirated products or that are given administrative punishment for dealing in pirated products twice, administrative culture entities cancel their permits according to the law, and the administrative industry and commerce entity imposes cessation of business for rectification according to the law; where circumstances are grave, business licences are revoked according to the law. Criminal liability is investigated of those whose dealing in pirated products is suspected to constitute a crime, according to the “Criminal Law” and the Supreme People’s Court and Supreme People’s Procuratorate “Interpretation Concerning Some Issues on the Concretely Applicable Law in Handling Criminal Intellectual Property Rights Infringement Cases”.

 

IV, From the end of 2006 until the beginning of 2007, administrative permit entities shall conduct annual examination registration of all audiovisual publishing and reproduction work units. At that time, work units continue to deal in pirated products after the end of the announcement period, regardless of quantities, administrative permit entities shall not grant registration or postpone registration according to the law.

 

V, Concerning activities of producing, selling, storing or transporting pirated audiovisual and computer software products, all walks of society are welcomed to report to relevant administrative entities such as all levels’ ““Sweeping Pornography and Striking Illegality”” offices or culture, copyright, etc. The national ““Sweeping Pornography and Striking Illegality”” work small group office reporting number is: 010-65212870; the National Copyright Administration reporting number is: 010-65212738; all local administrative culture entities’ reporting number is: 12318.

Concerning activities of administrative entities and their State civil servants participating, engaging, conniving or shielding pirated product production and sale activities, all walks of society are welcomed to report to all levels’ supervision organs All levels’ supervision organs’ reporting number is: 12380.

All relevant administrative entities receiving reports, shall scrupulously fulfil their duties, ascertain the facts, strictly enforce the law, and may not shift responsibilities, do their work perfunctorily or put it off, and accept supervision of the masses.

全国“扫黄打非”工作小组关于印发《关于开展反盗版百日行动的公告》的通知

各省、自治区、直辖市“扫黄打非”工作领导小组办公室、文化厅（局）、新闻出版局、版权局、工商局、公安厅（局）、建设厅（委）、监察厅（局）： 现将全国“扫黄打非”工作小组办公室、文化部、新闻出版总署、国家版权局、工商总局、公安部、建设部、监察部联合签发的《关于开展反盗版百日行动的公告》印发给你们，请根据本地、本部门实际，做好《公告》的印制、张贴和宣传教育等项工作，努力营造开展“反盗版百日行动”的良好社会氛围。 关于开展反盗版百日行动的公告 为了严厉打击侵权盗版行为，维护文化市场的经营秩序，促进音像和计算机软件产业的繁荣发展，依照我国有关音像、计算机软件制品知识产权保护方面的法律法规和部门规章，全国“扫黄打非”工作小组办公室、文化部、新闻出版总署、国家版权局、国家工商行政管理总局、公安部、建设部、监察部决定，在继续严厉打击各类非法出版活动的同时，在全国开展为期100天左右的集中打击盗版音像和计算机软件制品行动（以下简称“反盗版百日行动”）。现将有关事项公告如下： 一、“反盗版百日行动”将重点整治从事盗版制品经营活动的音像、计算机软件制品集中经营场所及批发、零售、出租、放映单位，取缔销售盗版音像和计算机软件制品的无证照经营者及游商、地摊，深挖制售盗版制品的非法印刷、复制、仓储窝点，查处参与音像、计算机软件盗版活动的出版单位和印刷、复制企业，严惩从事盗版制品制售活动的不法分子。 二、2006年7月15日至8月15日为公示期，各音像、计算机软件制品经营单位对照有关法律法规和部门规章开展自查自纠活动，将盗版制品主动上缴有关行政主管部门并说明情况。公示期内，凡主动上缴盗版制品并说明情况的，有关行政主管部门不再追究其责任。 三、2006年8月16日至10月15日为集中整治阶段，各地有关行政部门开展执法检查，依法严厉查处违法违规行为。对一次经营盗版音像制品数量不足100张的经营单位，由文化行政部门没收违法制品，没收违法所得，并处以1万元以上5万元以下的罚款。对一次经营盗版计算机软件制品数量不足100张的经营单位，由版权行政部门没收违法制品，没收违法所得，并处以1万元以上5万元以下的罚款。对一次经营盗版制品数量100张以上或者两次因经营盗版制品受到行政处罚的单位，由行政许可部门依法吊销其许可证，由工商行政部门依法予以停业整顿，情节严重的依法吊销其营业执照。对经营盗版制品涉嫌构成犯罪的，依照《刑法》和最高人民法院、最高人民检察院《关于办理侵犯知识产权刑事案件具体应用法律若干问题的解释》的规定，追究刑事责任。 四、2006年底至2007年初，行政许可部门将对各音像出版、复制单位进行年检登记。届时，对公示期结束后继续经营盗版制品的单位，无论数量多少，行政许可部门将依法不予登记或者暂缓登记。 五、对制售、储运盗版音像和计算机软件制品的行为，欢迎社会各界向各级“扫黄打非”办公室或文化、版权等有关行政部门举报。全国“扫黄打非”工作小组办公室举报电话：010-65212870；国家版权局举报电话：010-65212738；各地文化行政部门举报电话：12318。 对行政部门及其国家公职人员参与、从事、纵容、包庇盗版制品制售活动的行为，欢迎社会各界向各级监察机关举报。各地监察机关举报电话：12380。 有关行政部门受理举报，应当恪尽职守、查明事实、严格执法，不得推诿、敷衍、拖延，并接受群众的监督。 特此公告
