Notice Concerning Launching a Concentrated Campaign Attacking Pirated Audiovisual and Computer Software Products

Concerning the problem of audiovisual and computer software product piracy, through continuous disciplining over many years, clear results have been achieved, the market appearance has gotten a grand new outlook. But pirated audiovisual and computer software product production and sale activities have not yet been effectively contained, the general situation is still severe. In order to strictly rectify audiovisual and computer software market order, strictly standardize the business activities of business work units, strictly attack production and sale activities of pirated products, further raise the market share of legitimate products and the protection level of our country’s intellectual property rights, according to the deployment of the Central Committee Secretariat and the State Council Secretariat “2006 “Sweeping Pornography and Striking Illegality” Action Plan” and the spirit of the central leading comrades’ instructions, the national “Sweeping Pornography and Striking Illegality” work small group office, Central Propaganda Department, Central Political-Legal Committee, Ministry of Culture, General Administration of Press and Publications, State Administration of Industry and Commerce, Ministry of Public Security, Ministry of Construction and Ministry of Supervision have decided, at the same time as continuing to strictly attack all sorts of illegal publishing activities, from 15 July until 25 October 2006, launch a nationwide campaign of about 100 days to concentratedly attack audiovisual and computer software product piracy (hereafter simply named “Anti-Piracy Hundred Days Campaign”).

 

I, Work objectives

Through launching the “Anti-Piracy Hundred Days Campaign”, closing and stopping a batch of work units dealing in pirated audiovisual and computer software product wholesale, retail, rental and screening, investigating and prosecuting a batch of publishing, production and reproduction work units participating in audiovisual and computer software product piracy activities, investigating and dealing with a batch of major cases of audiovisual and computer software product piracy, completely cleaning away peddlers and stalls selling pirated products, digging out illegal production, reproduction and storage hideouts. Through this campaign, clearly purifying the audiovisual and computer software market, clearly strengthening the law-abiding consciousness of businesspeople, and clearly raising the consciousness of society in resisting pirated products.

 

II, Work focus points

1, Inspecting all audiovisual and computer software product concentrated business venues and wholesale, retail, rental and screening work units, according to the law strictly and quickly punishing work units continuing to engage in pirated product business activities after the announcement period. Determinedly cancelling permits of a batch of work units dealing in relatively large quantities of pirated products or receiving administrative punishment because of dealing in pirated products twice.

2, Cleaning up and banning unlicensed operators, peddlers and stalls selling pirated audiovisual and computer software products. Establishing an in-front-of-the-door management responsibility system, implementing all work units’ in-front-of-the-door management responsibility systems and the area responsibility systems of venues such as communities, schools, parks, etc. Where unlicensed operators and peddlers of stalls sell pirated products, the relevant responsible work unit shall timely report to city management administrative law enforcement entities, and assist in doing well clean-up and banning work.

3, Investigating pirated audiovisual and computer software product production sources, attacking illegal production, reproduction and storage hideouts, investigating and prosecuting publishing work units and reproduction enterprises violating regulations. Dealing with publishing and reproduction work units participating in piracy activities through cessation of business for rectification, postponing annual examination registration, etc., where circumstances are grave, cancelling permits.

4, Through news media, propagating and reporting the content of the “Announcement” and the situation of self-examination and self rectification, and law enforcement examination, announcing the investigation and prosecution process and handling result of major and large cases, in order to frighten law-breakers and criminals, raise all citizens’ intellectual property rights consciousness, shaping a public opinion atmosphere beneficial to launching the “Anti-Piracy Hundred Days Campaign”.

 

III, Work measures

The “Anti-Piracy Hundred Days Campaign” is divided into the four stages of propagation and mobilization, concentrated clean-up, inspection and supervision, and summarizing and checking.

1, the propagation and mobilization stage (15 July – 15 August)

The “Announcement” is announced to society on 15 July, and the announcement period runs until 15 August. Organizing press media to conduct broad and deep propaganda concerning the “Anti-Piracy Hundred Days Campaign”, the “Announcement” and the opening ceremony.

The national “Sweeping Pornography and Striking Illegality” work small group office jointly with relevant entities organizes a “Anti-Piracy Hundred Days Campaign” opening ceremony in Beijing. Relevant sector organizations integrate and implement the socialist view of honour and dishonour, and launch promotion activities in their sector with “refusing piracy, being law-abiding in business” as main theme. All municipalities and provincial capitals must at the same time organize opening ceremonies and promotion activities.

All localities’ administrative culture and copyright entities, with the assistance of administrative construction entities, are respectively responsible for putting up the “announcement” in all audiovisual product business venues and computer software business venues in their jurisdiction, and respectively convene a meeting with the responsible persons from audiovisual product business work units and computer software product business work units, to study and transmit the content of the “Announcement”. All localities’ administrative press and publications entities are responsible for issuing the “Announcement” to audiovisual publishing work units and compact disc reproduction enterprises, and organizing concentrated study for enterprise persons in charge.

All localities’ administrative culture, copyright, and press and publications entities respectively organize that all audiovisual product business work units, computer software product business work units, compact disc reproduction enterprises and audiovisual publishing work units launch self-examination and self-rectification activities, and report the self-examination and self-rectification launching situation every week to the administrative culture, copyright or press and publications entities of one level higher. Audiovisual and computer software product concentrated business venues’ sponsoring work unit respectively sign commitment letters with administrative culture, copyright and industry and commerce entities, clarifying and undertaking corresponding responsibilities according to the law.

 

2, Concentrated clean-up phase (16 August – 15 October)

From 16 August, all localities’ administrative “Sweeping Pornography and Striking Illegality”, culture, press and publications, copyright, industry and commerce entities, etc., launch implementation of the “announcement” and law enforcement and inspection campaigns over all audiovisual and computer software product concentrated business venues and wholesale, retail, rental and screening work units, and compact disc reproduction enterprises in their jurisdiction. Press and publications, industry and commerce, and public security conduct concentrated clean-up and banning of enterprises printing or reproducing illegally. Industry and commerce, and city management law enforcement entities launch concentrated discipline over unlicensed operators, peddlers and stalls.

Administrative culture entities confiscate unlawful audiovisual products, confiscate illegal income and impose a fine of more than 10.000 Yuan but less than 50.000 Yuan of business work units dealing in pirated audiovisual products in a quantity of less than 100 discs at one time after the announcement period. Administrative copyright entities confiscate unlawful computer software products, confiscate illegal income and impose a fine of more than 10.000 Yuan but less than 50.000 Yuan of business work units dealing in pirated audiovisual products in a quantity of less than 100 discs at one time after the announcement period. Administrative industry and commerce entities impose cessation of business for rectification according to the law on business work units dealing in pirated computer software products in a quantity of more than 100 discs or receiving administrative punishment because of dealing in pirated audiovisual products twice, and where circumstances are grave, cancel their business licence according to the law.

Administrative press and publications entities shall impose the punishment of cessation of business for rectification on audiovisual publishing work units or compact disc reproduction entities participating in piracy activities, and where circumstances are grave, cancel their permits according to the law. Where dealing in pirated products constitutes a crime, according to the provisions of the “Criminal Law” and the Supreme People’s Court and Supreme People’s Procuratorate “Supreme People’s Court and Supreme People’s Procuratorate Interpretation Concerning Some Issues on the Concretely Applicable Law in Handling Criminal Intellectual Property Rights Infringement Cases”, criminal liability will be investigated.

A number of large cities will be chosen nationwide, that at the same time launch concentrated destruction of pirated product activities, and organize news media to report concentratedly.

Establishing work coordination and information communication mechanisms between all localities and all departments. All localities report the law enforcement situation of the previous week to the national “Sweeping Pornography and Striking Illegality” work small group office. The national “Sweeping Pornography and Striking Illegality” work small group office timely collects and circulates the work progress situation, and on the “China Sweeping Pornography and Striking Illegality Net”, announces a name list of punished business work units.

 

3, Inspection and supervision phase (25 July – 17 October)

Starting from 25 July, relevant Central entities jointly or independently conduct secret visits to inspect the business situation of all localities’ audiovisual and computer software markets, and audiovisual publishing work units and compact disc reproduction enterprises.

Starting from September, relevant Central entities compose joint inspection teams, conducting inspection and supervision over all localities’ law enforcement situation.

Inspection results will be announced through news media.

 

4, Summarizing and checking phase (18 – 25 October)

All localities’ “Sweeping Pornography and Striking Illegality” work leading small group offices conduct summary of the “Anti-Piracy Hundred Days Campaign”, and report this in written form before 22 October to the national “Sweeping Pornography and Striking Illegality” work small group office.

The national “Sweeping Pornography and Striking Illegality” work small group office convenes a “Anti-Piracy Hundred Days Campaign” summary and commendation conference. Commendations will be issued to regions, work units and individuals having outstanding achievements; regions and work units with weak work will be criticized; and they will be required to strictly implement the responsibility investigation system and rectify within a limited period; at the same time, requirements will be put forward for consolidating the achievements of the concentrated campaign.

All localities and all entities must integrate launching the concentrated discipline campaign with strengthening daily supervision and management, completely implement the “2006 “Sweeping Pornography and Striking Illegality” Action Plan” and the spirit of the important guidelines of the central leading comrades, completely preserve a state of maximum pressure,  a state of high pressure in strictly attacking political illegal publications, obscene and sexual publications and other illegal publishing activities, realistically safeguarding national cultural security and social stability.

 

IV, Work requirements and duty division

All localities and all entities must hold the “Anti-Piracy Hundred Days Campaign” in high regard, make this campaign into a focus point of “Sweeping Pornography and Striking Illegality” and intellectual property rights protection work this year, according to the departmental duty division and the principle of localized management, clarify objectives, break through in focus points, organize meticulously, strictly enforce the law, do not leave blind spots, bring all tasks to a substantial conclusion, making the campaign receive substantial results. All localities and all entities, on the basis of each performing their own functions, must strengthen comprehensive administration, mutually coordinate, and act uniformly. Corresponding associations such as the audiovisual association, software association, etc., must strengthen sector self-regulation, and formulate behaviour criteria and professional standards for the personnel they employ, firmly establishing the concept of abiding the law in doing business in the complete sector. All localities must fully muster forces from all aspects of society, strengthen public opinion supervision, social supervision and consumer supervision, educate and lead the people to resist pirated products of their own accord, shaping a beneficial public opinion atmosphere and work environment for attacking infringement and piracy.

The national “Sweeping Pornography and Striking Illegality” work small group office is the coordinating organ for this concentrated discipline campaign, and is responsible for coordinating the implementation of all tasks determined in the “Notice”, coordinating investigation and prosecution of major and large cases, organizing news media to launch propaganda and reporting work, and is responsible for printing the “Announcement”. All localities’ “Sweeping Pornography and Striking Illegality” work leading small group offices perform corresponding work.

Administrative culture entities are responsible for law enforcement examination and administrative punishment of audiovisual product concentrated business venues and wholesale, retail, rental and screening work units, engage in audiovisual product appraisal, and organize the development of law enforcement training.

Administrative press and publications entities are responsible for law enforcement examination and administrative punishment of audiovisual product publishing work units and compact disc reproduction enterprises, assisting in the appraisal of audiovisual products, organizing development of law enforcement training, guiding sector associations’ work.

Administrative copyright entities are responsible for law enforcement examination and administrative punishment of computer software product concentrated business venues and wholesale, retail and rental work units, and computer hardware production businesses, and selling businesses’ pre-installation of software situation, engage in computer software product appraisal, investigate and prosecute copyright infringement cases, organize development of law enforcement training, guiding sector associations’ work.

Administrative industry and commerce entities coordinate with administrative culture, press and publications, copyright, entities, etc., in launching law enforcement examination in audiovisual and computer software product concentrated business venues and wholesale and retail work units, cancel business licences of work units with grave circumstances of violating regulations in business, investigating and banning unlicensed business venues or illegal printing, reproduction and sale enterprises, assisting city management law enforcement entities in cleaning up and banning peddlers and stalls selling pirated products.

Public security entities coordinate with administrative culture, press and publications, and copyright entities, etc., in expanding attack strength against pirated products production and sale activities, and must timely file cases and investigate cases suspected to be a crime that are transferred by corresponding administrative entities. They must punish those obstructing state organ work personnel implementing their duties according to the law according to Article 50 of the “People’s Republic of China Public Order Management and Punishment Law”; and determinedly investigate their criminal liability.

Administrative construction entities are responsible for assisting administrative culture and copyright entities in putting up the “Announcement” at audiovisual and computer software product business venues, guiding city management law enforcement entities in cleaning up and banning peddlers and stalls selling pirated products, and strictly plan, examine and approve newspaper kiosk installation.

Administrative supervision entities are responsible for conducting investigating and prosecuting administrative entities and State civil servants participating in, engaging in, conniving at or shielding pirated product production and sale activities.

Political-legal entities are responsible for implementing tasks relating to “Sweeping Pornography and Striking Illegality” in comprehensive public order administration, and coordinate and guide public security, procuratorate and judicial systems’ work.

Propaganda departments jointly with the “Sweeping Pornography and Striking Illegality” work leading small group offices perform concentrated campaign organization and coordination work, and coordinate and organize launching of public opinion propaganda work.

各省、自治区、直辖市“扫黄打非”工作领导小组办公室、党委宣传部、政法委、文化厅(局)、新闻出版局、版权局、工商局、公安厅(局)、建设厅(委)、监察厅(局):
音像和计算机软件制品的盗版问题,经过多年持续整治,取得了明显成效,市场面貌有了很大改观。但是,盗版音像和计算机软件制品制售活动尚未得到有效遏制,总体态势依然严峻。为严肃整顿音像和计算机软件市场秩序,严格规范经营单位的经营行为,严厉打击盗版制品的制售活动,进一步提高正版制品的市场占有率和我国知识产权的保护水平,根据中办、国办转发的《2006年“扫黄打非”行动方案》的部署和中央领导同志的批示精神,全国“扫黄打非”工作小组办公室、中央宣传部、中央政法委、文化部、新闻出版总署、国家版权局、国家工商总局、公安部、建设部、监察部决定,在继续严厉打击各类非法出版活动的同时,自2006年7月15日至10月25日,在全国开展为期100天左右的集中打击盗版音像和计算机软件制品行动(以下简称“反盗版百日行动”)。
一、工作目标
通过开展“反盗版百日行动”,关停一批经营盗版音像和计算机软件制品的批发、零售、出租、放映单位,查处一批参与音像和计算机软件制品盗版活动的出版、制作、复制单位,查办一批盗版音像和计算机软件制品的重大案件,严惩一批从事盗版活动的不法分子。同时,坚决取缔无证照的音像和计算机软件制品经营场所,全面清理销售盗版制品的游商、地摊,深挖非法制作、复制、仓储窝点。通过此次行动,使音像和计算机软件市场得到明显净化,经营者的守法经营意识明显增强,全社会抵制盗版制品的自觉性明显提高。
二、工作重点
1、检查所有音像和计算机软件制品集中经营场所及批发、零售、出租、放映单位,依法从重从快处罚在公示期后继续从事盗版制品经营活动的单位。对一次经营盗版制品数量较大或者两次因经营盗版制品受到行政处罚的单位,坚决吊销其许可证。
2、清理并取缔销售盗版音像和计算机软件制品的无证照经营者及游商、地摊。建立门前管理责任制,落实各单位的门前管理责任和社区、学校、公园等场所的区域管理责任。发现无证照经营者及游商、地摊销售盗版制品,有关责任单位应当及时向城管执法部门报告,并协助做好清理取缔工作。
3、追查盗版音像和计算机软件制品的生产源头,打击非法制作、复制、仓储窝点,查处违规出版单位和复制企业。对参与盗版活动的出版、复制单位,予以停业整顿、年检时暂缓登记等处理,情节严重的吊销其许可证。
4、通过新闻媒体,宣传报道《公告》内容和自查自纠、执法检查情况,公布重大案件的查处过程和处理结果,以震慑违法犯罪分子,提高全民知识产权保护意识,形成有利于“反盗版百日行动”开展的舆论氛围。
三、工作步骤
“反盗版百日行动”分为宣传动员、集中治理、检查督导和总结验收四个阶段。
1、宣传动员阶段(7月15日―8月15日)

7月15日向社会公布《公告》,公示期至8月15日。组织新闻媒体对“反盗版百日行动”、《公告》、启动仪式进行广泛深入宣传。
全国“扫黄打非”工作小组办公室联合有关部门在京举办“反盗版百日行动”启动仪式。相关行业协会结合贯彻社会主义荣辱观,在本行业开展以“拒绝盗版、守法经营”为主题的倡议活动。各直辖市和省会城市同时举行启动仪式和倡议活动。
各地文化、版权行政部门在建设行政部门的协助下,分别负责向辖区内所有音像制品经营场所、计算机软件制品经营场所张贴《公告》,并分别召集音像制品经营单位、计算机软件制品经营单位负责人会议,学习传达《公告》内容。各地新闻出版行政部门负责向音像出版单位和光盘复制企业发放《公告》,并组织企业负责人集中学习。
各地文化、版权、新闻出版行政部门分别组织所有音像制品经营单位、计算机软件制品经营单位、光盘复制企业和音像出版单位开展自查自纠活动,并每周向上一级文化、版权、新闻出版行政部门报告自查自纠开展情况。音像和计算机软件制品集中经营场所的主办单位分别与文化、版权、工商行政部门及经营业者签订承诺书,依法明确并承担相应责任。
2、集中治理阶段(8月16日―10月15日)
自8月16日起,各地“扫黄打非”、文化、新闻出版、版权、工商等行政部门对辖区内所有音像和计算机软件制品集中经营场所及批发、零售、出租、放映单位和光盘复制企业开展《公告》实施和执法检查行动。新闻出版、工商、公安部门对非法印刷、复制企业进行集中清理取缔。工商、城管执法部门对无证照经营者及游商、地摊开展集中整治。
对公示期后一次经营盗版音像制品不足100张的经营单位,由文化行政部门没收违法音像制品,没收违法所得,并处以1万元以上5万元以下的罚款。对一次经营盗版音像制品100张以上或者两次因经营盗版音像制品受到行政处罚的经营单位,由文化行政部门依法吊销其许可证,情节严重的由工商行政部门依法吊销其营业执照。对一次经营盗版计算机软件制品不足100张的经营单位,由版权行政部门没收违法软件制品,没收违法所得,并处以1万元以上5万元以下的罚款。对一次经营盗版计算机软件制品100张以上或者两次因经营盗版计算机软件制品受到行政处罚的单位,由工商行政部门依法予以停业整顿,情节严重的依法吊销其营业执照。对参与盗版活动的音像出版单位和光盘复制企业,由新闻出版行政部门依法给予停业整顿的处罚,情节严重的依法吊销其许可证。对经营盗版制品涉嫌构成犯罪的,依照《刑法》和最高人民法院、最高人民检察院《关于办理侵犯知识产权刑事案件具体应用法律若干问题的解释》的规定,追究刑事责任。
在全国选择若干大城市,同时开展集中销毁盗版制品活动,并组织新闻媒体集中报道。
建立各地区、各部门间的工作协调和信息沟通机制。各地每周一将上周执法情况报告全国“扫黄打非”工作小组办公室。全国“扫黄打非”工作小组办公室及时汇总交流工作进展情况,在“中国扫黄打非网”上公布被处罚的经营单位名单。
3、检查督导阶段(7月25日―10月17日)
7月25日开始,中央有关部门联合或者单独对各地音像、计算机软件市场及音像出版单位、光盘复制企业的经营情况进行暗访检查。
9月份开始,中央有关部门组成联合检查组,对各地执法情况进行检查督导。
检查结果通过新闻媒体公布。
4、总结验收阶段(10月18日―25日)
各地“扫黄打非”工作领导小组办公室对“反盗版百日行动”进行总结,并于10月22日前书面报告全国“扫黄打非”工作小组办公室。
全国“扫黄打非”工作小组办公室召开“反盗版百日行动”总结表彰大会。对成绩突出的地区、单位和个人进行表彰;对工作不力的地区和单位提出批评,要求其严格落实责任追究制并限期整改;同时对巩固集中行动成果提出要求。
各地、各部门要将开展集中整治行动与加强日常监管结合起来,全面落实《2006年“扫黄打非”行动方案》和中央领导同志重要批示精神,始终保持高压态势,严厉打击政治性非法出版物、淫秽色情出版物和其他非法出版活动的高压态势,切实维护国家的文化安全和社会稳定。
四、工作要求和职责分工
各地、各部门要高度重视“反盗版百日行动”,将此次行动列入今年“扫黄打非”和知识产权保护重点工作之一,按照部门职责分工和属地管理原则,明确目标,突出重点,精心组织,严格执法,不留死角,把各项任务落到实处,使行动收到实效。各地、各部门在各司其职的基础上,要加强综合治理,互相配合,统一行动。音像协会、软件协会等相关协会要加强行业自律,制定从业人员行为准则和职业规范,在全行业牢固树立守法经营观念。各地要充分调动社会各方面的力量,加强舆论监督、社会监督和消费者监督,教育引导群众自觉抵制盗版制品,形成打击侵权盗版的良好舆论氛围和工作环境。
全国“扫黄打非”工作小组办公室是此次集中整治行动的协调机构,负责协调落实《通知》确定的各项任务,协调查处重大案件,组织新闻媒体开展宣传报道工作,并负责《公告》的印制工作。各地“扫黄打非”工作领导小组办公室做好相应工作。
文化行政部门负责对音像制品集中经营场所及批发、零售、出租、放映单位的执法检查和行政处罚,从事音像制品鉴定,组织开展执法培训。
新闻出版行政部门负责对音像出版单位和光盘复制企业的执法检查和行政处罚,协助鉴定音像制品,组织开展执法培训,指导行业协会工作。
版权行政部门负责对计算机软件制品集中经营场所及批发、零售单位和计算机硬件制造商、销售商预装软件情况的执法检查和行政处罚,从事计算机软件制品鉴定,查处著作权侵权案件,组织开展执法培训,指导行业协会工作。
工商行政部门配合文化、新闻出版、版权等行政部门开展对音像和计算机软件制品集中经营场所及批发、零售单位的执法检查,对违规经营情节严重的单位吊销其营业执照,清查取缔无证照经营场所和非法印刷、复制、销售企业,协助城管执法部门清理取缔销售盗版制品的游商、地摊。
公安部门配合文化、新闻出版、版权等行政部门加大对制售盗版制品活动的打击力度,对相关行政部门移送的涉嫌构成犯罪的案件,要及时立案侦办。对阻碍国家机关工作人员依法执行职务的,要依照《中华人民共和国治安管理处罚法》第五十条的规定予以处罚;构成犯罪的,坚决追究其刑事责任。
建设行政部门负责协助文化、版权行政部门在音像和计算机软件制品经营场所张贴《公告》,指导城管执法部门清理取缔销售盗版制品的游商、地摊,并严格规划和审批报刊摊点的设置。
监察机关负责对行政部门及其国家公职人员参与、从事、纵容、包庇盗版制品制售活动的行为进行查处。
政法部门负责落实社会治安综合治理中涉及“扫黄打非”的相关工作,并协调指导公、检、法系统工作。
宣传部门会同“扫黄打非”工作领导小组办公室做好集中行动组织协调工作,并协助组织开展舆论宣传工作。
