Cultural Product and Service Export Guidance Catalogue

In order to support our country’s cultural product and service export, the Ministry of Commerce, the Ministry of Foreign Affairs, the State Administration of Radio, Film and Television, the General Administration of Press and Publications and the State Council Information Office jointly formulated the “Cultural Products and Services Export Guidance Catalogue”, which is hereby promulgated.

In order to give rein to the traditional superiority of Chinese culture, encourage and support cultural enterprises to participate in international competition, raise the international influence of cultural enterprises, drive our country’s cultural product and service export, entities such as the People’s Republic of China Ministry of Commerce, the Ministry of Foreign Affairs, the State Administration of Radio, Film and Television, the General Administration of Press and Publications and the State Council Information Office etc., jointly formulated the “Cultural Products and Services Export Guidance Catalogue”, and are responsible for interpretation and adjustment.

All entities shall in the items listed in this Catalogue, accredit a batch of “State Culture Export Focus Programmes” beneficial to carrying forth the outstanding traditional culture of the Chinese nation, beneficial to safeguarding national unity and ethnic unity, beneficial to developing friendship between China and the people of all world nation and having relatively superior and distinctive ethnic characteristics; of the enterprises conforming to the requirements of this Catalogue, appraise a batch of “State Culture Export Focus Enterprises” having international culture trade export talents, possessing relatively strong international market competitiveness, do business according to the law, with a good reputation. All entities and all localities according to relevant regulations create conditions and grant support in aspects such as market expansion, technological innovation, customs clearance, etc.

I, Press and Publications

01: Books and electronic publications published and distributed by publishing work units

Focus enterprise standards:

1: Having corresponding fixed export channels, annual export copyright results of 15 or more or material export value of 300.000 U.S. Dollar or more;

2: having originally-created products with indigenous intellectual property rights, products reflecting Chinese cultural characteristics, having international market exploitation capacity.

Remark:

Electronic publications include electronic gaming publications.

02: Newspapers and periodicals published and distributed by publishing work units

Focus enterprise standards:

1: having originally-created products with indigenous intellectual property rights, products reflecting Chinese cultural characteristics, having international market exploitation capacity;

2: or having scientific periodicals and mass periodicals abroad with a certain influence, and relatively high scientific level; or periodicals publishing foreign editions, having publishing organs abroad, exporting copyrights abroad; or periodicals using foreign languages or ethnic minority languages to publish and distribute abroad; or hometown news aimed at distribution for overseas Chinese.

03: Internet publications and services:

Focus enterprise standards:

1: having corresponding fixed transmission channels, annual export amounts of 10.000 U.S. Dollar or more;

2: having originally-created products with indigenous intellectual property rights, products reflecting Chinese cultural characteristics, having international market exploitation capacity.

Remark:

Internet publications include Internet books, Internet magazines, Internet newspapers, Internet electronic publications, Internet audiovisual publications, Internet scientific reference publications, Internet education reading material, Internet map publications, Internet gaming publications, mobile telephone publications, etc.

04: Sino-foreign co-produced publications

Focus enterprise standards:

1: Vigorously cooperating with foreign publishing groups, foreign-oriented products with desirable market capacity aimed at international market exploitation;

2: Entering international mainstream sales channels, outstanding achievements in foreign propaganda and popularization activities;

3: having originally-created products with indigenous intellectual property rights or intellectual property rights jointly enjoyed with a foreign party, products reflecting Chinese cultural characteristics:

Remark:

Sino-foreign co-produced publication refers to:

1: publications which a Chinese party and a foreign publication organ jointly invested in, jointly planned, jointly share profit in and bear risks of;

2: publications financed and planned by a Chinese party, jointly published with a foreign publishing organ, and where the foreign party is responsible for market expansion abroad;

3: major publishing programmes financed and planned by a foreign party, to which the Chinese party provided content, reflecting Chinese cultural characteristics and aimed at international markets;

4: including books, newspapers, periodicals, audiovisual products, electronic publications, Internet publications, etc.

05: Publication copyright export

Focus enterprise standards:

1: having corresponding fixed export channels, annual copyright export of 30 items or more, or an annual copyright export profit reaching 10.000 U.S. Dollar or more of a single variety (including book series and collections) of publications;

2: having originally-created products with indigenous intellectual property rights, products reflecting Chinese cultural characteristics, having international market exploitation capacity.

06: Publishing material export

Focus enterprise standards:

1: having corresponding fixed export channels, annual export value of 1.000.000 U.S. Dollar or more;

2: products reflecting Chinese cultural characteristics, having international market exploitation capacity.

07: Major international publications trade fairs

Focus enterprise standards:

1 the organized fair has a number of fixed organization times, domestic fairs, reaching 200 or more copyright export trade items, foreign fairs, reaching 200 or more copyright export trade items or having material sales amounts of 100.000 U.S. Dollar or higher;

2 organized fairs have a certain scope and reputation.

08: Foreign translation services

Focus enterprise standards:

1: having a relatively high reputation in the domestic interpretation world, having outstanding translation achievements;

2: having fixed specialized office premises.

09: Printing, reproduction and production services

Focus enterprise standards:

1: annual export amount of 100.000 U.S. Dollar or higher;

1: technology reaching international levels.

10: Organs established abroad providing services such as publishing, distribution, printing, reproduction, production, etc.

Focus enterprise standards:

1: annual copyright export item amount or material export amount in the first 50 nationwide

2: having relatively strong international market expansion capacity.

II, Radio and Television category

11: Completed films and television products, propaganda films and materials

Focus enterprise standards:

1: annual outstanding export achievements (amounts and financial value) situated in the first 20 nationwide, or an export value of 300.000 U.S. Dollar or more;

2: having desirable development potential, having outstanding achievements in aspects such as promoting film and television culture product production, distribution, screening and aftermarket exploitation capacity;

3; vigorously cooperating with foreign radio and television organs, annual foxed participation in well-known international film and television expos and setting up exhibition platforms;

4; having desirable foreign sales networks, outstanding achievements in foreign propaganda and popularization activities.

Remarks:

1: Completed films and television products refers to domestic film products (feature films, documentary films, art films, popular science films, etc.) and television products (television dramas, cartoons, documentaries, arts and entertainment programmes, etc.) examined by domestic film and television product examination organs and that have obtained broadcasting permission such as a “Public Film Screening Permit”, “Television Drama Distribution Permit”, “Cartoon Distribution Permit”, etc. Carriers include all kinds and standards of film tape copies, videotapes, compact discs, digital film hard drives, digital or analogue television tapes, etc;

2: Film and television product propaganda film refers to announcement and propaganda films (including incomplete ones) for domestic films and television products shot with approval of the State administrative film and television controlling authority, mainly used to promote export of the film or television product and conducting propaganda and popularization work abroad. Carriers include all kinds and standards of film tapes, videotapes, compact discs, digital film hard drives, digital or analogue television tapes, etc;

3: Film tape and television product material refers to according to film and television product distribution, screening and dubbing work requirements abroad, or catering to the requirements of distributors, providing materials such as domestic film and television product correct, negative and international audio tapes, etc.;

4: Including the abovementioned film and television product copyright export.

12: Sino-foreign co-produced film and television programme services

Focus enterprise standards:

1: Vigorously cooperating with foreign film and television production organs, film and television culture products and services aimed at international market exploitation, having desirable market potential;

2: entering international mainstream sales channels, outstanding achievements in foreign propaganda and popularization activities;

3: having originally-created products with indigenous intellectual property rights or intellectual property rights jointly enjoyed with a foreign party, carrying forward our country’s excellent traditional culture, having vigour in deepening all world countries’ understanding of China.

Remarks:

Sino-foreign co-produced films and television programmes include:

1: Sino-foreign co-produced film refers to films jointly shot, filmed in cooperation or filmed through entrustment by a domestic film producer having obtained a “Film Shooting Permit” or a “Film Shooting Permit (Single Film)” according to the law together with a foreign film producer within Chinese borders;

2: Sino-foreign co-produced television drama refers to activities of jointly producing television dramas (including television cartoons) by a domestic radio and television programme-producing organ having obtained credentials according to the law with a foreign legal person or natural person;

3: other Sino-foreign co-produced film and television programme services refers to services related to film and television work such as performance, production, editing, transmission, sales, etc.;

4: including abovementioned film and television product copyright export.

13: Integration and broadcast services of radio and television programmes landing abroad

Focus enterprise standards:

1: already having successful precedents with international influence, being relatively well known within the sector;

2: having a vigorous function in establishing our country’s international level and image;

3: good financial situation, desirable reputation.

14: Radio, film and television foreign-related design, consulting, prospecting, and inspecting services

20: Commercial art exposition category

Focus enterprise standards:

1: annual export value of 200.000 U.S. Dollars or higher, having corresponding fixed export channels;

2: having one or more exhibition product’s foreign operation agency right, the product has originality, has a relatively high artistic level and international market exploitation prospects.

21: Game products

Focus enterprise standards:

1: annual export value of 600.000 U.S. Dollar or higher, having corresponding fixed export channels;

2: having indigenous intellectual property rights, reflecting Chinese cultural characteristics, having international market exploitation potential.

22: Fine art works

Focus enterprise standards:

1: annual export value of 100.000 U.S. Dollar or higher, having corresponding fixed export channels;

2: having one or more fine art work or artist’s foreign operation agency right, having international market exploitation potential.

23: Musical instruments

Focus enterprise standards:

1: annual export value of 1.000.000 U.S. Dollars or higher, having corresponding fixed export channels;

2: having indigenous intellectual property rights, having international market exploitation potential.

24: Handicraft articles and handiwork products

Focus enterprise standards:

IV, Comprehensive category

25: Cartoon products

Focus enterprise standards:

1: annual export value of 300.000 U.S. Dollars or higher, having corresponding fixed export channels;

2: having indigenous intellectual property rights, reflecting Chinese cultural characteristics, having international market exploitation potential.

Remark:

Cartoon product refers to “creativity” at the core, with cartoon animations or images as manifestation of form, including direct cartoon products such as cartoon books, periodicals, films, television, audiovisual products, stage plays and new cartoon product varieties based on modern information technology dissemination methods, not including indirect products related to cartoon images such as costumes, games, toys, etc.

26: Published and distributed audiovisual products

Focus enterprise standards:

1: having corresponding fixed export channels, annual copyright export of five or more, or export value of 600.000 U.S. Dollars or more (including copyright and material export);

2: having originally-created products with indigenous intellectual property rights, reflecting Chinese cultural characteristics, having international market exploitation potential.

27: Culture and art business agency

Focus enterprise standards:

1: already having planned successful precedents having international influence, being relatively well-known in the sector;

2: good financial situation, desirable reputation.

Remark:

Culture and art business agency refers to culture and art management agency, performer, artist management agency, cultural activity organization and planning services, etc.

为支持我国文化产品和服务出口,商务部、外交部、文化部、广电总局、新闻出版总署、国务院新闻办共同制定了《文化产品和服务出口指导目录》,现予以公布。中华人民共和国商务部

文化产品和服务出口指导目录

为发挥中华文化的传统优势,鼓励和支持文化企业参与国际竞争,提高文化企业国际竞争力,带动我国文化产品和服务出口,中华人民共和国商务部、外交部、文化部、广电总局、新闻出版总署、国务院新闻办等部门共同制定《文化产品和服务出口指导目录》,并负责解释和调整。

各部门将在列入本目录的项目中认定一批有利于弘扬中华民族优秀传统文化、有利于维护国家统一和民族团结、有利于发展中国同世界各国人民友谊的且具有比较优势和鲜明民族特色的“国家文化出口重点项目”;在符合本目录要求的企业中认定一批拥有国际文化贸易专门人才、具备较强国际市场竞争力、守法经营、信誉良好的“国家文化出口重点企业”。各部门、各地区依据有关规定在市场开拓、技术创新、海关通关等方面创造条件予以支持。

一、新闻出版类

01出版单位出版发行的图书、电子出版物

重点企业标准:

1有相对固定的出口渠道,年出口版权成果15个以上或实物出口额30万美元以上;

2拥有自主知识产权的原创产品,产品体现中华文化特色,具有国际市场开发潜力。

说明:

电子出版物包括电子游戏出版物。

02出版单位出版发行的报纸、期刊

重点企业标准:

1拥有自主知识产权的原创产品,产品体现中华文化特色,具有国际市场开发潜力;

2或拥有在国外有一定影响、学术水平较高的学术期刊和大众化报刊;或出版海外版、在海外设有出版机构、向海外输出版权的报刊;或使用外语和少数民族语言出版并发行到境外的报刊;或面向海外侨胞定向发行的侨刊乡讯。

03互联网出版物与服务

重点企业标准:

1有相对固定的输出渠道,年出口额1万美元以上;

2拥有自主知识产权的原创产品,产品体现中华文化特色,具有国际市场开发潜力。

说明:

互联网出版物包括互联网图书、互联网杂志、互联网报纸、互联网电子出版物、互联网音像出版物、互联网学术文献出版物、互联网教育读物、互联网地图出版物、互联网游戏出版物、手机出版物等。

04中外合作出版物

重点企业标准:

1积极与国外出版集团合作,针对国际市场开发的有良好市场潜力的外向型产品;

2进入国际主流销售渠道,海外宣传和推广活动效果突出;

3拥有自主知识产权或与外方共享知识产权的原创产品,产品体现中华文化特色。

说明:

中外合作出版物指:

1中方与境外出版机构共同投资、共同策划、共同分享收益并承担风险的出版物;

2由中方出资策划、与境外出版机构联合出版,并由外方负责在海外开拓市场的出版物;

3外方出资策划、中方提供内容,体现中华文化特色并面向国际市场的重大出版项目;

4包括图书、报纸、期刊、音像制品、电子出版物、互联网出版物等。

05出版物版权输出

重点企业标准:

1有相对固定的出口渠道,年出口版权30项以上,或单品种(含系列丛书)出版物的年版权输出收益达到1万美元以上;

3拥有自主知识产权的原创产品,产品体现中华文化特色,具有国际市场开发潜力。

06出版物实物出口

重点企业标准:

1有相对固定的出口渠道,年出口额100万美元以上;

2产品体现中华文化特色,具有国际市场开发和销售潜力。

07重大国际性出版物商业展览

重点企业标准:

1所承办展览有固定举办的届次,境内展览每届达成输出版权交易200项以上,境外展览每届达成输出版权交易200项以上或销售实物金额10万美元以上;

2所承办展会有一定的规模和知名度。

08对外翻译服务

重点企业标准:

1在国内翻译界具有较高声誉,有突出翻译成果;

2有固定的专门办公场所。

09印刷、复制、制作服务

重点企业标准:

1年出口额在10万美元以上;

2工艺达到国际水平。

10境外设立机构提供出版、发行、印刷、复制、制作等服务

重点企业标准:

1年出口版权项目数量或实物出口额在全国排名前十五名之内;

2具备较强国际市场开拓能力。

二、广播影视类

11电影、电视产品完成片、宣传片和素材

重点企业标准:

1年出口业绩(数量和金额)位于全国前二十名之列,或出口金额30万美元以上;

2具有良好发展潜质,在提升影视文化产品的生产、发行、播映和后产品开发能力等方面成绩突出;

3积极与国外广播影视机构合作,每年固定参加国际知名影视节展并设置展台;

4拥有良好的海外销售网络,海外宣传和推广活动效果突出。

说明:

1电影、电视产品完成片指经国家电影、电视产品审查机构审查通过并取得《电影片公映许可证》、《电视剧发行许可证》、《动画片发行许可证》等播出许可的国产电影产品(故事片、纪录片、美术片、科教片等)和电视产品(电视剧、动画片、纪录片、综艺节目等)。载体包括各种规格的胶片拷贝、录像带、光盘、数字电影硬盘、数字或模拟电视磁带等;

2电影、电视产品宣传片指经国家电影电视行政主管部门批准拍摄的国产电影、电视产品的预告、宣传片(包括未完成的),主要用于为促进电影和电视产品出口而进行海外宣传、推广工作。载体包括各种规格的胶片、录像带、光盘、数字电影硬盘、数字或模拟电视磁带等;

3电影片、电视产品素材指根据电影、电视产品在海外发行、放映和译制工作的需要,应发行商要求,而向国外提供的国产电影、电视产品的翻正、翻底片及国际声带等素材;

4含上述电影、电视产品版权的输出。

12中外合作制作电影、电视节目服务

重点企业标准:

1积极与国外影视制作机构合作,针对国际市场开发的有良好市场潜力的影视文化产品和服务;

2进入国际主流销售渠道,海外宣传和推广活动效果突出;

3拥有自主知识产权或与外方共享知识产权的原创产品,弘扬我国优秀传统文化,对加深世界各国对中国的了解具有积极意义。

说明:

中外合作制作电影、电视节目服务包括:

1中外合作制作电影是指依法取得《摄制电影许可证》或《摄制电影片许可证(单片)》的境内电影制片者与境外电影制片者在中国境内外联合摄制、协作摄制、委托摄制的电影;

2中外合作制作电视剧是指境内依法取得资质的广播电视节目制作机构与外国法人及自然人合作制作电视剧(含电视动画片)的活动;

3其他中外合作制作电影电视节目服务是指与电影电视业务相关的演出、制作、采编、传输、销售等服务;

4含上述电影、电视产品版权的输出。

13广播电视节目境外落地的集成、播出服务

重点企业标准:

1已实施具有国际影响力的成功案例,在业内具有较高知名度;

2对树立我国的国际地位及形象具有积极作用;

3财务状况优良,信誉良好。

14广播影视对外设计、咨询、勘察、监理服务

重点企业标准:同上

15广播电视对外工程、劳务承包服务

重点企业标准:同上

16广播影视对外培训服务

重点企业标准:同上

17影视器材产品

重点企业标准:同上

18互联网视听节目与服务

重点企业标准:同上

三、文化艺术类

19商业演出类

重点企业标准:

1有相对固定的出口渠道,意向演出费在每场3000美元以上;

2拥有一个或以上演出产品的海外经营代理权,产品有独创性,具有较高的艺术水平和国际市场开发前景。

20商业艺术展览类

重点企业标准:

1年出口额20万美元以上,有相对固定的出口渠道;

2拥有一个或以上展览产品的海外经营代理权,产品有独创性,具有较高的艺术水平和国际市场开发前景。

21游戏产品

重点企业标准:

1年出口额60万美元以上,有相对固定的出口渠道;

2拥有自主知识产权,体现中华文化特色,具有国际市场开发潜力。

22美术品

重点企业标准:

1年出口额10万美元以上,有相对固定的出口渠道;

2拥有一个或以上美术品或者艺术家作品的海外经营代理权,具有国际市场开发潜力。

23乐器

重点企业标准:

1年出口额100万美元以上,有相对固定的出口渠道;

2拥有自主知识产权产品,具有国际市场开发潜力。

24工艺品和手工艺品

重点企业标准:同上

四、综合类

25动漫产品

重点企业标准:

1年出口额30万美元以上,有相对固定的出口渠道;

2产品拥有自主知识产权,体现中华文化特色,具有国际市场开发潜力。

说明:

动漫产品是指以“创意”为核心,以动画、漫画为表现形式,包含动漫图书、报刊、电影、电视、音像制品、舞台剧和基于现代信息技术传播手段的动漫新品种等动漫直接产品,不包含与动漫形象有关的服装、游戏、玩具等衍生产品。

26出版发行的音像制品

重点企业标准:

1有相对固定的出口渠道,年出口版权数5个以上或出口额60万美元以上(含版权和实物出口);

2拥有自主知识产权的原创产品,体现中华文化特色,具有国际市场开发潜力。

27文化艺术商务代理

重点企业标准:

1已策划具有国际影响力的成功案例,在业内具有较高知名度;

2财务状况优良,信誉良好。

说明:

文化艺术商务代理指文化艺术经纪代理,演员、艺术家经纪代理,文化活动组织、策划服务等。
