Self-Discipline Convention for Blog Services

Chapter I: General Principles

Article 1: In order to standardize Internet blog services and stimulate the orderly development of blog services, this Convention is formulated.

Article 2: Blogs as named in this Convention, refers to self-service network space, including using written, image, audiovisual and other forms, provided by Internet service providers to users.

Article 3: Blog services shall abide by the principles of civilization and the law, sincerity, honesty and self-discipline, and consciously safeguarding the national interest and the public interest.

Article 4: The China Internet Association is responsible for organizing the implementation of this Convention.

Chapter II: Self-disciplinary provisions

Article 5: Blog service providers shall consciously abide by relevant State laws, regulations and policies, and safeguard the lawful rights and interests of blog users.

Article 6: Those engaging in Internet blog service business shall have lawful Internet information service qualifications, and at the same time shall meet the following conditions:

(1) perfect blog service and management systems;

(2) sufficient blog service management personnel and technology personnel, being able to provide good service, implementing effective management;

(3) complete blog information security guarantee measures, including user registration processes, user information secrecy protection measures, blog content information security guarantee measures, etc.;

(4) conforming to the requirements of other relevant provisions of State laws, regulations and rules.

Article 7: Blog service providers are encouraged to vigorously explore blog service models, provide good creative environments for blogs, guide blog users’ creation and dissemination of excellent network culture works.

Article 8: Blog service providers shall conclude agreements with blog users, and require blog users to consciously fulfil the service agreement, where service agreement conclusion is refused, blog service providers are entitled to refuse provision of blog services.

Article 9: The service agreement that blog service providers conclude with blog users shall include the following content:

(1) the blog user pledges to consciously abide by State laws and regulations related to Internet information services, to use the network in a civilized manner, to not disseminate sexual or obscene information as well as other unlawful or harmful information;

(2) the blog user pledges to not disseminate information insulting or criticizing other ethnicities, races, different religious beliefs and cultural traditions;

(3) the blog user pledges to not disseminate rumours, defaming information and other false information, and to not disseminate information infringing other persons’ lawful rights and interests;

(4) the blog user pledges to not disseminate information infringing other persons’ intellectual property rights;

(5) the blog user pledges to conduct effective supervision and management over pasted content, and to timely remove unlawful and harmful pasted information;

(6) the blog user pledges to not utilize blogs to disseminate computer viruses and other malicious programmes, and not to harm other persons’ computer information security.

Article 10: Where blog users violate the user agreement, blog service providers shall timely impose supervision and correction, directly delete the corresponding unlawful or harmful information or content, or cease providing blog services to them.

Article 11: Blog service providers are encouraged to implement real-name registration of the blog users, the registration information shall include users’ real full name, correspondence address, contact telephone number, mailbox, etc.

Article 12: Blog service providers should formulate effective real-name blog user information security management systems, and safeguard blog user materials. Without permission of real-name blog users, they may not publish or provide to third parties user registration information and the non-public blog content stored on the website, except where laws and regulations provide otherwise.

Article 13: Blog service providers shall provide management powers to blog users concerning pasted content, blog users shall conduct effective management over pasting, and shall delete unlawful or harmful pasted information.

Article 14: Blog service providers shall consciously implement their supervision and management duties over blog content, they shall establish convenient on-line complaint windows, complaints telephone lines and other channels, accept reports and complaints from the public concerning blog services and blog content, and timely deal with these.

Chapter III: The implementation of the Convention.

Article 15: It is proposed that the broad blog service providers vigorously sign and implement this Convention, the Chinese Internet Association will regularly publish name list of signatory work units.

Those who have not concluded blog user service agreements before the promulgation of this Convention, shall sign supplementary service agreements from the date of promulgation of this Convention.

Article 16: All blog service providers signing this Convention shall standardize their implementation of all content of this Convention, those violating this Convention and creating grave influence, will be given a warning or will be exposed to society by the organ organizing implementation of this Convention with regard to the different circumstances.

Article 17: Blog service providers shall consciously accept professional guidance from relevant government departments, consciously accept supervision from the social masses, strengthen self-discipline consciousness, and stimulate the healthy development of blog services.

Chapter IV: Supplementary provisions

Article 18: The responsibility for interpretation of this Convention is with the Chinese Internet Association

Article 19: This Convention takes effect on the date of promulgation.

博客服务自律公约

第一章 总则

第一条 为规范互联网博客服务,促进博客服务有序发展,制定本公约。

第二条 本公约所称博客,是指互联网服务提供者提供给用户的自主网络空间,包括文字、图片、音视频等形态。

第三条 博客服务应当遵循文明守法、诚信自律、自觉维护国家利益和公共利益的原则。

第四条 中国互联网协会负责本公约的组织实施。

第二章 自律条款

第五条 博客服务提供者应当自觉遵守国家有关法律、法规和政策,维护博客用户及公众的合法权益。

第六条 从事互联网博客服务业务应当具备合法的互联网信息服务资质,同时还应当具备下列条件:

(一)完善的博客服务和管理制度;

(二)足够的博客服务管理人员和技术人员,能够提供优良服务,实施有效管理;

(三)健全的博客信息安全保障措施,包括用户注册流程、用户信息保密措施、博客内容信息安全保障措施等;

(四)符合国家法律法规和规章要求的其他相关规定。

第七条 鼓励博客服务提供者积极探索博客服务模式,为博客提供良好的创作环境,引导博客用户创作和传播优秀网络文化作品。

第八条 博客服务提供者应当与博客用户签订服务协议,要求博客用户自觉履行服务协议,拒绝签订服务协议的,博客服务提供者有权拒绝为其提供博客服务。

第九条 博客服务提供者与博客用户签订的服务协议,应当包括以下内容:

(一)博客用户保证自觉遵守国家有关互联网信息服务的法律、法规,文明使用网络,不传播色情淫秽信息以及其他违法和不良信息;

(二)博客用户保证不传播侮辱或贬损其他民族、种族、不同宗教信仰和文化传统的信息;

(三)博客用户保证不传播造谣、诽谤信息以及其他虚假信息,不传播侵害他人合法权益的信息;

(四)博客用户保证不传播侵害他人知识产权的信息;

(五)博客用户保证对跟贴内容进行有效监督和管理,及时删除违法和不良跟贴信息;

(六)博客用户保证不利用博客传播计算机病毒等恶意程序,不危害他人计算机信息安全。

第十条 博客用户违反服务协议的,博客服务提供者应当及时予以督促改正,直接删除相关违法和不良信息内容或停止为其提供博客服务。

第十一条 鼓励博客服务提供者对博客用户实行实名注册,注册信息应当包括用户真实姓名、通信地址、联系电话、邮箱等。

第十二条 博客服务提供者应制定有效的实名博客用户信息安全管理制度,保护博客用户资料。未经实名博客用户本人允许,不公开或向第三方提供用户注册信息及其存储在网站上的非公开博客内容,法律、法规另有规定的除外。

第十三条 博客服务提供者应当为博客用户提供对跟贴内容的管理权限,博客用户应当对跟贴进行有效管理,应当删除违法和不良跟贴信息。

第十四条 博客服务提供者应当自觉履行对博客内容的监督管理义务,应当设立便捷的在线投诉窗口、投诉电话等渠道,受理公众对博客服务和博客内容的举报与投诉,并及时予以处理。

第三章 公约的执行

第十五条 倡议广大博客服务提供者积极签署并实施本公约,中国互联网协会将定期公布签约单位名单。

本公约发布之前未与博客用户签订服务协议的,应当从本公约发布生效之日起补充签订服务协议。

第十六条 凡签署本公约的博客服务提供者应当规范履行本公约的各项内容,违反本公约并造成不良影响的,由本公约的组织实施机构视不同情况给予警示或向社会公布。

第十七条 博客服务提供者应当自觉接受有关政府部门的业务指导,自觉接受社会公众的监督,增强自律意识,促进博客服务健康发展。

第四章 附则

第十八条 本公约由中国互联网协会负责解释。

第十九条 本公约自公布之日起施行。
