SARFT Circular Concerning the Situation of Dealing with the Problem of the film “Lost in Beijing” Violating Regulations

On 3 January, SARFT has issued the “SARFT Circular Concerning the Situation of Dealing with the Problem of the film “Lost in Beijing” Violating Regulations” to all provincial, autonomous region and municipal radio, film and television bureaus, the Xinjiang Production-Construction Corps radio, film and television bureau, all film production work units, film distribution companies, cinema chain companies and directly subordinate film work units in Beijing, the Circular says, the film “Lost in Beijing”, jointly produced by the Beijing Laolei Film Culture Co. Ltd., Beijing Baolina Film Distribution Co. Ltd and Beijing Zhonghong Real Estate Development Group Co. Ltd, has gravely violated the “Film Management Regulations” (hereafter simply named “Regulations” and corresponding laws and regulations in aspects such as film production, participation in international film festivals, Internet dissemination and audiovisual product production, etc., creating harmful effects. Hereby, the relevant circumstances are circulated as follows:

I, The main problems violating regulations of the film “Lost in Beijing”

(1) In violation of regulations, producing fragments with pornographic content (not passed through examination), and without authorization disseminating through the Internet and producing audiovisual products of film containing pornographic content not passed through examination, has violated the provisions of Article 25 of the “Regulations”.

(2) Letting film versions not passed through examination, enter the competition in the 57th Berlin Film Festival, has violated the provisions of Article 24 and Article 35 of the “Regulations”.

(3) Conducting unhealthy and improper advertising and propaganda during film distribution and screening, has violated the provisions of Article 3 of the “Regulations” and the “Advertising Law”.

II, Considering that the above-mentioned grave problems of violation of regulations appear in the film “Lost in Beijing”, in order to strengthen and standardize film production, distribution and screening management, guarantee the healthy and orderly dissemination of films and all sorts of media, further purifying the silver screen and video channels, to create a beneficial cultural environment for the broad masses and especially the youth audiences, according to corresponding laws and regulations such as the “Film Management Regulations”, the “Film Script (Outline) Filing and Film Management Regulations”, the “Dissemination of Audiovisual Products through Information Networks such as the Internet, etc. Management Regulations”, and according to the requirements of the “SARFT Notice Concerning Reaffirming Prohibition of Production and Screening of Pornographic Films”, the “SARFT Notice Concerning Strengthening Internet Dissemination of Film and Television Drama Management”, etc., the abovementioned problems of violation of regulations by the film “Lost in Beijing” are decided to be dealt with as follows:

(1) According to the provision of Articles 42, 43 and 56 of the Regulations, the “Film Public Screening Permit” of the concerned film is revoked, all film copies not having passed through examination and corresponding materials are confiscated, the producing work unit shall deliver the copies, etc., to the SARFT Film Bureau within 15 days; distribution and screening of the concerned film is stopped; its network dissemination is stopped; corresponding administrative entities are suggested to stop the distribution of its audiovisual products.

(2) According to the provisions of Articles 56, 61, 63 and 64 of the “Regulations”, the film production qualifications of the mainly responsible Beijing Laolei Film Culture Co. Ltd, are revoked for two years; the concerned company’s legal representative Fang Li, my not engage in corresponding film work for two years; a report of criticism is made against the Beijing Baolina Film Distribution Co. Ltd. and Beijing Zhonghong Real Estate Group Co. Ltd for having corresponding responsibility and participation in investment and filming, and they are ordered to rectify and improve within a limited time.

(3) Strict criticism and education will be conducted against the producers, director and corresponding actors that participated in filming of the corresponding film, and they are required to do deep examination.

广电总局关于处理影片《苹果》 违规问题的情况通报

1月3日,广电总局向各省、自治区、直辖市广播影视局,新疆生产建设兵团广播电视局,各电影制片单位、电影发行公司、院线公司,在京电影直属单位发出《广电总局关于处理影片<苹果>违规问题的情况通报》的通报,通报说,由北京劳雷影视文化有限责任公司、北京保利博纳电影发行有限公司、北京中鸿房地产开发集团有限公司联合出品的影片《苹果》,在电影制作、参加国际电影节、互联网传播及音像制品制作等方面,严重违反《电影管理条例》(以下简称《条例》)及相关法规,造成了不良影响。现将有关情况通报如下:
一、影片《苹果》的主要违规问题
(一)违规制作色情内容的片段(未经审查通过),并擅自将未经审查通过的含有色情内容的影片在互联网上传播及制作音像制品,违反了《条例》第二十五条的规定。
(二)将未经审查通过的电影版本,送第57届柏林电影节参赛,违反了《条例》第二十四、三十五条的规定。
(三)在影片发行放映中进行不健康、不正当的广告宣传,违反了《条例》第三条和《广告法》的相关规定。
二、鉴于影片《苹果》发生上述严重违反法规问题,为加强和规范电影制片及发行放映的管理,确保电影及各种媒体的传播健康有序,进一步净化银幕视频,为广大群众特别是青少年观众营造良好的文化环境,根据《电影管理条例》、《电影剧本(梗概)备案、电影片管理规定》、《互联网等信息网络传播视听节目管理办法》等相关法规,并按照《广电总局关于重申禁止制作和播映色情电影的通知》、《广电总局关于加强互联网传播影视剧管理的通知》等要求,现对影片《苹果》的上述违规问题作出如下处理决定:
(一)依据《条例》第四十二、四十三、五十六条的规定,吊销该片的《电影片公映许可证》,没收未经审查通过的影片拷贝及相关素材,制片单位15天内将拷贝等送达总局电影局;停止该片在影院发行、放映;停止其网络传播;建议有关行政部门停止其音像制品的发行。
(二)依据《条例》第五十六、六十一、六十三、六十四条的规定,对负有主要责任的北京劳雷影视文化有限责任公司,取消其两年内摄制电影的资格;该公司的法定代表人方励,两年内不得从事相关电影业务;对负有相关责任、参与投资拍摄的北京保利博纳电影发行有限公司和北京中鸿房地产开发集团有限公司,进行通报批评,责令其限期整改。
(三)对参与该片拍摄的制片人、导演及相关演员,则进行严肃的批评教育,并要求其作出深刻检查。
