Provisions on the Main Duties, Internal Organization and Personnel Allotment of the Ministry of Culture

On the basis of the State Council organ reform plan approved at the first meeting of the 11th National People’s Congress and the “State Council Notice Concerning Organic Installation” (NDC No. (2008)11), the Ministry of Culture is established, and is a component organ of the State Council.

I, Duty adjustment

(1) Cancelled duties.

Administrative examination and approval matters already cancelled by the State Council.

(2) Reassigned and transferred out duties.

1, appointing film distribution and screening work duties are transferred to the State Administration of Radio, Film and Television.

2, audiovisual product wholesale, retail, rental, screening and import management duties are transferred to the General Administration of Press and Publications.

(3) Reassigned and transferred in duties:

1, State-Council Information Office organization of large-scale foreign culture exchange activity duties are transferred to the Ministry of Culture.

2, State Administration of Radio, Film and Television cartoon (not including film and television cartoons, and cartoon programmes part of network audiovisuals) management duties are transferred to the Ministry of Culture.

3, General Administration of Press and Publications cartoon, network game management (not including on-line pre-publication examination and approval of network games), and corresponding sector planning, sector base, item construction, expo trade and market supervision duties are transferred to the Ministry of Culture.

4, Coordination of drafting cultural market development plans, policies, laws and regulations as well as guiding comprehensive cultural market law enforcement duties are added.

5, Conducting supervision over people-run organs engaging in performing arts activities duties are added.

(4) Strengthened duties.

Promoting public cultural service, guiding grass roots culture construction and protection of intangible cultural heritage duties are strengthened.

II, Main duties

(1) Formulating general and specific culture and art policies, drafting culture and art laws and regulations.

(2) Formulating culture and art undertaking development plans and organizing implementation, moving culture and art-sphere structural and mechanism reform forward.

(3) Guiding and managing culture and art undertakings, guiding art creation and production, promoting all sorts or art development, managing national-scale major cultural events.

(4) Moving culture and art-sphere public culture services forward, planning and guiding public culture product production, guiding State focus culture facility construction and grass roots culture facility construction.

(5) Formulating culture and art industry development plans, guiding and coordinating culture and art production and development, moving foreign-related cultural industry exchange and cooperation forward.

(6) Formulating intangible cultural heritage protection plans, drafting relevant laws and regulations, organizing implementation of intangible cultural heritage protection and excellent ethnic culture inheritance and dissemination work.

(7) Guiding and managing social culture undertakings, guiding library, cultural centre (station) undertaking and grass roots culture construction.

(8) Drafting culture market development plans, guiding comprehensive culture market law enforcement work, being responsible for conducting sector supervision over culture and art business activities, guiding supervision work over people-run organs engaging un performing arts activities.

(9) Being responsible for advance examination and approval work for art-type products’ on-line dissemination, being responsible for implementing business licence management over online service business venues such as Internet cafés, etc., conducting supervision over network gaming services (not including advance examination for network game online publication).

(10) Formulating cartoon and gaming industry development plans  and organizing implementation, guiding and coordinating cartoon and gaming industry development.

(11) Formulating cultural science and technology development planning and supervising implementation, moving cultural science and technology information construction forward.

(12) Guiding and managing foreign cultural exchange and foreign cultural propaganda work, organizing the formulation of foreign and Hong Kong, Macau and Taiwan cultural exchange policies, guiding the work of embassies (consulates) abroad and Hong Kong and Macau culture organs, representing the State in concluding and signing Sino-foreign cultural cooperation agreements, organizing implementation of large-scale foreign-related cultural exchange activities.

(13) Undertaking other matters as handed over by the State Council.

III, Internal structure

According to the above responsibilities, in the Ministry of Culture, 11 internal organs are set up.

(1) Secretariat.

Comprehensively coordinating the organ’s and directly subordinate work units work; supervising and urging the implementation of large ministerial matters; formulating internal organ regulation systems and annual work planning; being responsible for the organ’s daily operation work such as documents and telegrams, meeting affairs, confidential matters, filing, etc.; being responsible for information, secrecy, letters and petitions work and the organ’s financial administration work; managing the organ’s administrative affairs.

(2) Policy, Laws and Regulations Department.

Formulating general and specific culture and art policies, drafting relevant laws and regulations; comprehensively planning and coordinating major culture policy investigation and research work; formulating long-term development plans in culture and art; undertaking the organ’s law work; guiding culture and art-sphere structural and mechanism reform.

(3) Personnel Department.

Being responsible for work such as personnel management, education and training, the organs’ personnel allotment, labour resources, etc. in the organ, directly subordinate work units and cultural organs abroad; formulating and organizing implementation of culture and art sector talent construction planning; in consultation with relevant controlling authorities, guiding working personnel professional qualification management work.

(4) Financial Department

Managing culture undertaking administrative fees; guiding and supervising cultural organs abroad and directly subordinate work units’ financial administration work; being responsible for statistics work of the culture system; being responsible for the basic construction, State-owned resources, government procurement and internal accounting work of the organ and directly subordinate work units; guiding State focus culture facility construction and grass roots culture facility construction; being responsible for Chinese cultural centre construction abroad work.

(5) Art Department.

Formulating literature and art undertaking development plans; supporting representative, exemplary and experimental literature and art product varieties, supporting literature and art work embodying the core Socialist value system and culture and art institutes and groups representing State standards and ethnic characteristics, promoting all sorts of art development; guiding and coordinating nationwide-scale art displays, exhibitions as well as major literature and art events.

(6) Culture Science and Technology Department.

Formulating culture science and technology development plans, coordinating tackling of State focus culture and art science research programme and popularization of major achievements; moving culture science and technology informatization construction forward; being responsible for higher art academy sponsoring work; guiding cultural sector vocational art education; organizing formulation of art level-examination policies and standards, coordination, supervision and implementation; undertaking interprovincial art level-examination organs’ examination and approval work.

(7) Culture Market Department

Formulating culture market development plans and policies, drafting relevant laws and regulations; guiding comprehensive culture market law enforcement, promoting law enforcement strength integration of vice-provincial level cities and county and city-lever or lower entities such as culture, radio, film and television, press and publications, etc., conducting sector management over cultural-sphere business activities; conducting supervision over culture performances, culture entertainment and culture art products; undertaking network music and fine art entertainment, network cartoons (not including cartoon programmes in network audiovisuals), network performance dramas (programmes), network performance work and mobile telephone music advance examination and approval work.; coordinating cartoon and gaming industry planning, industry bases, programme establishment, exhibition trading and market supervision, guiding sector association work; conducting supervision over imported Internet literature and art-type products in the utilization segment; being responsible for implementing business permit management over on-line service business venues such as Internet cafés, etc., conducting content supervision and management over electronic gaming consoles in the production, importation and operation segments; conducting supervision over network gaming services (not including advance on-line publication examination and approval of network gaming); guiding supervision and management work over people-run organs engaging in performing arts activities.

(8) Cultural Industry Department.

Formulating cultural industry development plans and policies, drafting relevant laws and regulations; supporting and promoting cultural industry construction and development; moving cultural industry informatization construction forward; guiding cultural industry base and regional characteristic culture industry grouping forward; promoting implementation of major cultural industry programmes, being responsible for moving foreign cultural industry exchange and cooperation forward.

(9) Social Culture Department.

Formulating social culture undertaking development plans and policies, drafting relevant laws and regulations; guiding mass culture, ethnic minority culture, minors’ culture and old persons’ culture work; guiding library and cultural centre (station) undertakings; guiding information resource sharing projects and ancient book protection work; guiding grass roots mass culture activities, guiding village culture activity rooms and community culture activity centre construction.

(10) Intangible Cultural Heritage Department.

Formulating intangible cultural heritage protection policies, drafting relevant laws and regulations; formulating State-level intangible cultural heritage representation programme protection plans; organizing development of intangible cultural heritage protection work, undertaking State-level intangible cultural heritage representation programme reporting and examining work; organizing implementation of excellent ethnic culture inheritance and popularization work; undertaking compilation work of the Qing dynasty history.

(11) Foreign Culture Contact Department (Hong Kong, Macau and Taiwan Office).

Guiding and managing foreign culture exchange and foreign culture propaganda work; organizing formulation of foreign and Hong Kong, Macau and Taiwan culture exchange policies, drafting relevant laws and regulations; guiding work by embassies (consulates) abroad and Hong Kong and Macau culture organs; guiding and managing Chinese culture centres abroad work, managing foreign countries’ culture centres in China; organizing launching of cultural exchange work for Hong Kong, Macau and Taiwan; undertaking relevant work for concluding and signing Sino-foreign cultural cooperation agreements; organizing large-scale foreign culture exchange events.

The Organ’s Party Committee is responsible for the Party group work in the organ, the State Administration of Cultural Heritage and directly subordinate work units.

The Retired Cadre Department is responsible for retired cadre work of the organ, guiding retired cadre work of directly subordinate work units.

IV, Personnel allotment

The Ministry of Culture organic administrative personnel allotment is 327 (including the two committees’ personnel allotment of 10, detached flexible work allotment of 2, and the retired cadre work personnel allotment of 39). Of those: 1 Minister, 4 Vice-ministers, 44 department and bureau-level leading posts (including 1 Ministerial assistant, 1 organ Party Committee specific duty assistant secretary, 3 retired cadre work office leading posts).

V, Other matters

(1) Management of the State Administration of Cultural Heritage.

(2) Division of responsibility for cartoons and network gaming management. The Ministry of Culture is responsible for industrial planning, industrial bases, project establishment, exhibitions and trade, and market management related to cartoons and network games. The General Administration of Press and publications is responsible for conducting management over cartoons during the process of publishing, and conducts preliminary examination and approval over game publications’ online publication and distribution.

(3) Subordinate undertaking work unit setup, duties and work allotment matters are formulated elsewhere.

The Central Institutional Organization Commission Office is responsible for interpretation of these Regulations, their adjustment shall be conducted according by the Central Institutional Organization Commission Office according to provided procedures.

《文化部主要职责内设机构和人员编制规定》已经国务院批准,现予印发。

文化部主要职责内设机构和人员编制规定

根据第十一届全国人民代表大会第一次会议批准的国务院机构改革方案和《国务院关于机构设置的通知》(国发[2008]11号),设立文化部,为国务院组成部门。

一、职责调整

(一)取消的职责。

已由国务院公布取消的行政审批事项。

(二)划出转移的职责。

1、将指导电影发行、放映工作的职责划给国家广播电影电视总局。

2、将音像制品批发、零售、出租、放映和进口管理的职责划给国家新闻出版总署。

(三)划入和增加的职责。

1、将国务院新闻办公室组织大型对外文化交流活动的职责划入文化部。

2、将国家广播电影电视总局动漫(不含影视动漫和网络视听中的动漫节目)管理的职责划入文化部。

3、将国家新闻出版总署动漫、网络游戏管理(不含网络游戏的网上出版前置审批),及相关产业规划、产业基地、项目建设、会展交易和市场监管的职责划入文化部。

4、增加协调拟订文化市场发展规划、政策和法规草案以及指导文化市场综合执法的职责。

5、增加对从事演艺活动的民办机构进行监管的职责。

(四)加强的职责。

加强推进公共文化服务、指导基层文化建设和保护非物质文化遗产的职责。

二、主要职责

(一)拟订文化艺术方针政策,起草文化艺术法律法规草案。

(二)拟订文化艺术事业发展规划并组织实施,推进文化艺术领域的体制机制改革。

(三)指导、管理文学艺术事业,指导艺术创作与生产,推动各门类艺术的发展,管理全国性重大文化活动。

(四)推进文化艺术领域的公共文化服务,规划、引导公共文化产品生产,指导国家重点文化设施建设和基层文化设施建设。

(五)拟订文化艺术产业发展规划,指导、协调文化艺术产业发展,推进对外文化产业交流与合作。

(六)拟订非物质文化遗产保护规划,起草有关法规草案,组织实施非物质文化遗产保护和优秀民族文化的传承普及工作。

(七)指导、管理社会文化事业,指导图书馆、文化馆(站)事业和基层文化建设。

(八)拟订文化市场发展规划,指导文化市场综合执法工作,负责对文化艺术经营活动进行行业监管,指导对从事演艺活动民办机构的监管工作。

(九)负责文艺类产品网上传播的前置审批工作,负责对网吧等上网服务营业场所实行经营许可证管理,对网络游戏服务进行监管(不含网络游戏的网上出版前置审批)。

(十)拟订动漫、游戏产业发展规划并组织实施,指导协调动漫、游戏产业发展。

(十一)拟订文化科技发展规划并监督实施,推进文化科技信息建设。

(十二)指导、管理对外文化交流和对外文化宣传工作,组织拟订对外及对港澳台的文化交流政策,指导驻外使(领)馆及驻港澳文化机构的工作,代表国家签订中外文化合作协定,组织实施大型对外文化交流活动。

(十三)承办国务院交办的其他事项。

三、内设机构

根据上述职责,文化部设11个内设机构:

(一)办公厅。

综合协调机关和直属单位业务;督促部重大事项的落实;拟订机关内部规章制度和年度工作计划;负责文电、会务、机要、档案等机关日常运转工作;负责信息、保密、信访工作和机关财务工作;管理机关行政事务。

(二)政策法规司。

拟订文化艺术方针政策,起草有关法律法规草案;统筹协调重要文化政策调研工作;拟订文化艺术中长期发展规划;承办机关法律事务;指导文化艺术领域的体制机制改革。

(三)人事司。

负责机关、直属单位和驻外文化机构的人事管理、教育培训、机构编制、劳动工资等工作;拟订并组织实施文化艺术行业人才建设规划,会同有关主管部门指导从业人员职业资格管理工作。

(四)财务司。

管理文化行政事业经费;指导、监督驻外文化机构和直属单位的财务工作;负责文化系统的统计工作;负责机关和直属单位的基本建设、国有资产、政府采购和内部审计工作;指导国家重点文化设施建设和基层文化设施建设;负责驻外中国文化中心建设工作。

(五)艺术司。

拟订文学艺术事业发展规划;扶持代表性、示范性、实验性文艺品种,扶持体现社会主义核心价值体系的文艺作品和代表国家水准及民族特色的文艺院团,推动各门类艺术的发展;指导、协调全国性艺术展演、展览以及重大文艺活动。

(六)文化科技司。

拟订文化科技发展规划;协调国家重点文化艺术科研项目攻关及重大成果推广;推进文化科技信息化建设;负责高等艺术院校共建工作;指导文化行业艺术职业教育;组织拟订艺术考级的政策和标准并协调、监督和实施;承担跨省艺术考级机构的审批工作。

(七)文化市场司。

拟订文化市场发展规划和政策,起草有关法规草案;指导文化市场综合执法,推动副省级城市和地市级以下文化、广电、新闻出版等部门执法力量的整合;对文化领域的经营活动进行行业监管;对文艺演出、文化娱乐和文化艺术品市场进行监管;承担网络音乐美术娱乐、网络动漫(不含网络视听中的动漫节目)、网络演出剧(节)目、网络表演业务和手机音乐的前置审批工作;协调动漫游戏产业规划、产业基地、项目建设、会展交易和市场监管,指导行业协会工作;在使用环节对进口互联网文艺类产品内容进行审查;负责对网吧等上网服务营业场所实行经营许可证管理,对电子游戏机在生产、进口和经营环节上进行内容监管;对网络游戏服务进行监管(不含网络游戏的网上出版前置审批);指导对从事演艺活动民办机构的监管工作。

(八)文化产业司。

拟订文化产业发展规划和政策,起草有关法规草案;扶持和促进文化产业建设与发展;推进文化产业信息化建设;指导文化产业基地和区域性特色文化产业群建设;督促重大文化产业项目实施,负责推进对外文化产业交流与合作。

(九)社会文化司。

拟订社会文化事业发展规划和政策,起草有关法规草案;指导群众文化、少数民族文化、未成年人文化和老年文化工作;指导图书馆和文化馆(站)事业;指导文化信息资源共享工程建设和古籍保护工作;指导基层群众文化活动,指导村文化活动室和社区文化活动中心建设。

(十)非物质文化遗产司。

拟订非物质文化遗产保护政策,起草有关法规草案;拟订国家级非物质文化遗产代表项目保护规划;组织开展非物质文化遗产保护工作,承办国家级非物质文化遗产代表项目的申报与评审工作;组织实施优秀民族文化的传承普及工作;承担清史纂修工作。

(十一)对外文化联络局(港澳台办公室)。

指导、管理对外文化交流和对外文化宣传工作;组织拟订对外及对港澳台的文化交流政策,起草有关法规草案;指导驻外使(领)馆及驻港澳文化机构的工作;指导、管理中国驻外文化中心的工作,管理外国在华文化中心的工作;组织开展对港澳台的文化交流工作;承办中外文化合作协定签订的有关工作;组织大型对外文化交流活动。
